DOI-AAAP-0028 ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS-INVOICE

PROCESSING PLATFORM (IPP) APR 2013)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

'Payment request' means any request for contract financing payment or invoicing payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions-Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice: A valid vendor invoice for all items delivered and accepted.

The Contractor shall also submit an electronic copy of the IPP invoice to the Contracting Officer, Ms. Lynette Rock at <lrock@usbr.gov > once the invoice has been submitted to IPP. Failure to email the invoice may cause significant delay or possible rejection of your payment request.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3-5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

WBR 1452.223-82 Protecting Federal Employees and the Public from Exposure to Tobacco Smoke in the Federal Workplace -- Bureau of Reclamation (Dec 2009)

(a) In performing work under this contract, the contractor shall comply with the requirements of Executive Order 13058, dated August 9, 1997, which prohibits the smoking of tobacco products in all interior space owned, rented, or leased by the executive branch of the Federal Government, and in any outdoor areas under executive branch control in front of air intake ducts.

(b) In addition, pursuant to Federal Management Regulation (FMR) Bulletin 2009-B1, effective December 22, 2008, smoking is prohibited in courtyards and within 25 feet of doorways and air intake ducts on outdoor space under the jurisdiction, custody or control of GSA.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. 52.219-30 Notice of Set-Aside for, or Sole Source Award to, Women-Owned Small Business Concerns Eligible Under the Women-Owned Small Business Program (DEVIATION 2019-01) (Jul 2019)

(a) Definitions. As used in this clause— “Similarly situated entity” means a first-tier subcontractor, including an independent contractor, that has the same small business program status as that which qualified the prime contractor for the award, and that is considered small for the NAICS code the prime contractor assigned to the subcontract the subcontractor will perform. An example of a similarly situated entity is a first-tier subcontractor that is a HUBZone small business concern for a HUBZone set-aside or sole source award under the HUBZone Program.

“Women-owned small business (WOSB) concern eligible under the WOSB Program” (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.

“WOSB Program Repository” means a secure, Web-based application that collects, stores, and disseminates documents to the contracting community and SBA, which verify the eligibility of a business concern for a contract to be awarded under the WOSB Program.

(b) Applicability. This clause applies only to—

(1) Contracts that have been set aside or reserved for, or awarded on a sole source basis to, WOSB concerns eligible under the WOSB Program;

(1) Services (except construction), it will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded;

(2) Supplies or products (other than procurement from a nonmanufacturer in such supplies or products), it will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the 50 percent subcontract amount that cannot be exceeded;

(3) General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. (f) Joint Venture. A joint venture may be considered a WOSB concern eligible under the WOSB Program if—

(1) It meets the applicable size standard corresponding to the NAICS code assigned to the contract, unless an exception to affiliation applies pursuant to 13CFR 121.103(h)(3);

(2) The WOSB participant of the joint venture is designated in the System for Award Management as a WOSB concern eligible under the WOSB Program;

(3) The parties to the joint venture have entered into a written joint venture agreement that contains provisions−

(i) Setting forth the purpose of the joint venture;

(ii) Designating a WOSB concern eligible under the WOSB Program as the managing venturer of the joint venture, and an employee of the managing venturer as the project manager responsible for the performance of the contract;

(iii) Stating that not less than 51 percent of the net profits earned by the joint venture will be distributed to the WOSB;

(iv) Specifying the responsibilities of the parties with regard to contract performance, sources of labor, and negotiation of the WOSB contract; and

(v) Requiring the final original records be retained by the managing venturer upon completion of the WOSB contract performed by the joint venture.

(4) The joint venture must perform the applicable percentage of work required in accordance with paragraph (e) above; and

(5) The procuring activity executes the contract in the name of the WOSB concern eligible under the WOSB Program or joint venture.

(g) Nonmanufacturer.

(b) Exemptions. The exemptions that apply to Executive Order (E.O.) 11246 (see FAR 22.807) also apply to E.O. 13950 and the requirements of this clause. ATTACHMENT A – STATEMENT OF WORK/SPECIFICATIONS

BOILER REPLACEMENT AND HEATING SYSTEM UPGRADE

STATEMENT OF WORK

BACKGROUND

The boiler heating system at the Provo Area office is currently comprised of one (1) 30 HP Boiler and (1) 50 HP Boiler. The 50 HP boiler is no longer serviceable and needs to be replaced.

REQUIREMENT

The purpose of this procurement is to replace the 50 HP boiler unit with a new 2400 MBTU (or equivalent) energy efficient heating system while allowing the use of the current 30 HP boiler.

LOCATION

All components of the work shall take place at the following location:

Bureau of Reclamation, Provo Area Office 302 East Lakeview Parkway Provo, UT 84606

COMPONENTS OF THE WORK

I. Furnish and install a new energy efficient Boiler Heating System at the Provo Area Office which replaces the 50 HP boiler unit and allows the integration and use of the current 30 HP boiler as follows:

1. Provide all labor, materials, equipment and rigging to remove the existing 50 HP boiler unit and dispose of it offsite.

2. Furnish and install the new high efficiency multiple boiler rack system (Boiler) plumbed together with the existing boiler system to operate together, or individually and be connected to existing natural gas, hot water return lines and supply lines using flexible seismic connections. The new boiler system shall be a 2400 MBTU equivalent unit to replace the defective 50 HP Boiler unit.

3. The efficiency of the new boiler system shall be 85 percent or greater.

4. Boiler shall use natural gas with combustion air provided from outside the Mechanical Room in accordance with the International Mechanical Code® Commentary.

5. Boiler shall meet the requirements of ASME Code Section IV and be manufactured within an ISO 9001 certified facility.

6. The new boiler system shall replace the existing boiler on the concrete slab. Both the new and existing boilers shall be on the 5-foot by 10-foot concrete pad (if practical) in the Mechanical Room such that required maintenance may be performed in place. Secure boiler to the concrete equipment pad with seismic anchors extending through the pad attached to the existing concrete floor in accordance with ASCE 7, Chapter 13.

7. Boiler system shall be plumbed so boilers can operate together or individually. This includes natural gas, supply water and return water. Plumbing shall allow the independent removal of boilers while allowing for independent operation of the remaining boilers.

8. Existing boiler stacks shall be used. If changes are required, stacks shall be combined into the existing stack in such a manner that no blow back occurs during the operation of a single boiler, the stack remains airtight, and no additional roof penetration is required.

9. The modulation of the firing rate, the sequencing of the starting and stopping of the boilers shall be regulated with a digital lead-lag cycling control system. The building utilizes an existing Alerton building control system. The new boiler system shall be connected/controlled by the Alerton System.

10. Boiler shall be designed to assure complete combustion, clean firing, unrestricted gas flow, low heat release, smooth starts and quiet operation.

11. Boiler shall be completely assembled.

12. Furnish boiler with burner controls, low water cut-offs and relief valves as needed.

13. Provide boiler with combination altitude gauge and thermometer as needed.

14. Provide flue gas thermometer, as needed.

15. Provide all documentation, registration requirements, warranty compliance, start-up information, manuals and technical specifications to the Government.

16. The Contractor shall provide a test of the entire boiler system upon completion of the work to show function and compatibility with the system. The start-up shall be scheduled in advance and coordinated with all Government parties involved in this project.

17. The Contractor shall provide manufacturer’s warranty for boiler and lead-lag controller.

18. The Contractor shall provide a minimum of a one (1) year warranty on all parts, labor, material, and services installed for this project. The warranty period shall begin on the date of written acceptance by the Government.

(a) Definitions. For the purposes of this provision and the Freedom of Information Act (5 U.S.C. 552), the following terms shall have the meaning set forth below:

(1) 'Trade Secret' means an unpatented, secret, commercially valuable plan, appliance, formula, or process, which is used for making, preparing, compounding, treating or processing articles or materials which are trade commodities.

(2) 'Confidential commercial or financial information' means any business information (other than trade secrets) which is exempt from the mandatory disclosure requirement of the Freedom of Information Act, 5 U.S.C. 552. Exemptions from mandatory disclosure which may be applicable to business information contained in proposals include exemption (4), which covers 'commercial and financial information obtained from a person and privileged or confidential,' and exemption (9), which covers 'geological and geophysical information, including maps, concerning wells.'
