1.0 Background
Steamtown National Historic Site operates and maintains a live railroad yard, showcasing live, coal-fired steam locomotives, diesel locomotives and various types of railroad equipment. Rail traffic, consisting of but not limited to passenger yard shuttles, mainline excursions, and commercial freight, that operates regularly throughout yard. The 52-acre site also hosts active Locomotive and Restoration Shops, a Visitor Center, History and Technology Museums, a 250-seat Theater and a fully operating Roundhouse and Turntable.
The Site operates year-around and receives thousands of visitors. Waste Removal is an ongoing operation, and many kinds of waste are generated including hazardous material waste, used railroad ties and timbers, and ash from coal fired steam locomotives.
2.0 Scope
Waste from the Site is divided into groupings, based on the kinds of waste and the proper disposal of each kind. The Waste generated include:
a) Hazardous Materials –
a. Coal Ash – see the Appendix of Analysis
b. Asbestos – Friable and Non-Friable
c. Waste oils; Waste oily debris, absorbents, rags; Waste grease
d. Aerosol paints in cans
e. Spent solvents & Antifreeze
f. Batteries – Lead Acid; Alkaline; Rechargeable of many types
g. Paints latex and oil base
h. Lead paint debris
i. Pesticides & Herbicides
j. Light bulbs
k. Light Ballasts with PVC
l. Tires
m. Sharps & medical hazards
n. Computers and electronics including Monitors and TVs (CRTs)
o. Printer Ink Cartridges
p. Railroad Ties and Tie timbers
We are seeking a Contractor who shall provide containers, pick-up and disposal of the waste materials for the following:
1. Hazardous Waste removal and Disposal.
Spent solvents, Antifreeze, Batteries, Paints latex and oil base, Lead paint debris, Waste used oil or used oil contaminated with gasoline, water, dirt, etc., Waste oily debris, absorbents, rags, Waste Greases, Aerosol paints, Light bulbs and Light Ballasts with PCBs, Sharps, Computers, Electronics and Tires.

In Addition, the contractor shall provide the transportation and disposal of drums or other containers of various waste streams. mobilized to and from the site and shall provide all job functions in compliance with all local, state & federal OSHA, DOT & EPA regulations. Contractor shall provide a copy of all waste manifests to the contracting officers representative (COR).
The Contractor shall provide evidence of compliance with 40 CFR § 271.11 – “Requirements for transporters of hazardous wastes” in addition to the Contractor’s EPA ID Number to be included with the submittal of the quote.
Disposal based on provided inventory on the containers at the time of pickup.
All shipping containers shall meet DOT regulations Non damaged, intact, non-leaking.
The Contractor will offer a bid to be for a minimum of twelve (12) months; subject to an optional renewal for up to an additional four (4) years.
3.0 Objectives
Facilitate the maintenance of a clean and safe environment for the employees and all visitors to the 52-acre Site.
4.0 Tasks
Contractor shall provide containers, pick-up/replacement and disposal over the course of one year for the following:
Four -20-yard low-side container shall be substantially similar to those depicted in the following illustration. The side height shall not exceed 48 inches to permit our small skip-loader to easily deposit the ash from our locomotives. For Coal Ash.
Two - 40-yard container shall be substantially similar to that in the following illustration. For Railroad Ties and Tie Timbers
Pick-up, replacement, and disposal of drums of various sizes for waste streams shall be on a “Will Call” basis, and additional 5-gallon, 30-gallon, and 55-gallon steel drums, open head bolt ring closure stay in compliance with United Nations regulations. Open ring drums shall be provided as requested/required.
Waste manifests shall be provided for each drum accepted for disposal.
Contractor is to invoice monthly with detailed breakdown per Bid Line Item. Billing Statement (Invoice) shall not include any items not specifically linked to the named Bid Line Items, and all Bid and Invoice items shall be quoted and billed on a Per Container Pickup/Replacement basis. Option Items in the Bid shall only appear on the Billing Statement (Invoice) after said Item has been requested by the Buyer and related services have been rendered by the contractor. Certified weight tickets shall be furnished with invoices.
Contractor shall provide certificates that the waste disposal practices utilized are fully compliant with Local, State and Federal Mandates, as appropriate for the material.
5.0 Delivery
Performance under the contract is specified above and shall occur at least once per week over the term of the Contract. The Contractor shall provide 24-hour advanced notice prior to any pickup/replacement indicating the date and time of the scheduled pickup/replacement.

Dear Mr. Stowe:
This is in response to your letter of September 5, 1980, requesting this issuance of regulation interpretation memoranda (RIMs) on three questions you have about our RCRA hazardous waste management regulations.
Although we may consider issuing RIMs or amendments to our regulations of these issued at some point in the future, I do not wish to further delay our response to you. Therefore, I am providing answers to your questions in this response.
First you raise the question about whether the mixture rule of §261.3(a)(2)(ii) causes railroad ties to be hazardous, wastes because they contain creosote which is listed in §261.33(£) or causes insulating materials to be hazardous wastes when and because they contain asbestos which also is listed in §261.33(f). The answer is no. The intent and purpose of §261.33 is to list commercial chemical products and manufacturing chemical intermediates as hazardous wastes when and only when they are discarded or intended to be discarded. Thus, we are interested in creosote and asbestos in their common commercial form as hazardous wastes if discarded. If we should ever be interested in listing railroad ties or insulation materials as hazardous wastes, when discarded, because of their content or creosote, asbestos or other chemicals, we will specifically list them in §261.33 or in a similar section. Similarly, if we should ever be interested in listing used railroad ties or used insulation materials (insulation material removed from buildings) as hazardous wastes because of their content of chemicals, we will list them in §261.31.
The mixture rule of §261.3(a)(2)(ii) does apply in a limited way to §261.33 chemicals. If these listed chemicals are discarded by being mixed into a solid waste, then the resulting solid waste mixture becomes a hazardous waste. Examples are dumping excess acetone into a wastewater sewer or dumping excess inventory or expired-date inventory of pesticide into a refuse bin. In these cases, the commercial chemical becomes a hazardous waste instantly when the act of discarding takes place. As a hazardous waste at that point, the mixture rule operates to cause the mixture to become a hazardous waste. Incorporating creosote into railroad ties or asbestos into insulation materials is not an act of discarding these chemicals/ thus, these chemicals do not, at that point, become hazardous wastes, nor does the resulting product.
Your second question is whether the small quantity generator special requirements of §261.5 apply to each facility; a facility being manufacturing plant or, possibly, several manufacturing or other operations on the same or geographically contiguous site (see definition of "on-site" in §260.10(a)). The term "person" was erroneously used in §261.5. TI1e Agency meant to use the term ''generator" which by its definition in §260.10(a) means "any person, by site, ... .'' we will be correcting this error in a forthcoming amendment of §261.5. The terms "person" as defined in §260.10(a) includes whole companies and this causes §261.5 to be applicable only on a company-wide basis. Thus, for example, a company that operates several plants, each of which could qualify for the small quantity generator special requirements because each generates slightly less than 1000 kilograms of hazardous waste each month, could not qualify, under a literal reading of the provision as now written because the company's aggregate generated quantity of hazardous waste exceeds 1000 kilograms each month.
Finally, you ask whether the full regulations apply to intermittent or very small quantities of hazardous waste generated by a facility that cannot qualify for the small generator special requirements because it also generates one or more large quantities of hazardous waste. The full regulations apply to these intermittent and very small quantities of hazardous waste as they do to all other quantities of hazardous waste generated by a "large quantity generator."
I hope I have clearly answered your questions and apologize for the tardiness of this response--we have simply been overburdened with questions, requests for RIMs and other demands.

APPENDIX 2: HAZARDOUS WASTE
2.2 Specific requirements
2.2.1 The contractor shall provide all services necessary for the final treatment/disposal of the hazardous wastes listed in the schedule in accordance with all local, state, and federal laws, and regulations, and the terms and conditions of this contract. These services shall include all necessary personnel, labor, transportation, packaging, equipment and the compilation and submission of all documents required by Steamtown NHS.
2.2.2 Mandatory recycling. The Steamtown NHS is implementing an affirmative program to promote cost-effective waste reduction and recycling of materials generated in its operations and facilities. Recycling and reuse of materials is preferable to incineration and/or land filling. Therefore, the contractor shall maintain an approved list of recycling vendors, haulers, and landfills in their vicinity that are authorized by the EPA or state.
Recyclable Materials May Include but Not Limited To:
1. Spent solvents
2. Antifreeze
3. Batteries
4. Paints latex and oil base
5. Lead paint debris
6. Waste used oil or used oil contaminated with gasoline, water, dirt, etc.
7. Waste oily debris, absorbents, rags.
8. Waste Greases
9. Aerosol paints.

2.2.3 Department of Transportation Requirements. The contractor shall comply with, and ensure that all applicable subcontractors comply with, all requirements of United States Department of Transportation (DoT) regulations, 49CFR Parts 100-199, regarding waste transportation under this contract. Complete compliance with these regulations shall include, but not be limited to, ensuring that emergency response information is carried on transport vehicles and maintained at facilities where hazardous materials are received, stored, or handled during transportation. Shipping papers shall contain an emergency response telephone number supplied by the disposal contractor which is monitored 24 hours a day in order to provide immediate, detailed emergency information to personnel reacting to emergencies. Technical names shall be included in the descriptions of materials reflected on shipping papers by "not otherwise specified" (n.o.s.) descriptions. Definitions of the terms used in this clause are those used in 49 CFR 100-199. Contractors must ensure that off-site shipments of hazardous waste are labeled, marked, and placarded according to the U.S. DoT requirements. Contractor remains responsible for proper management of waste even after it leaves Steamtown NHS property. This includes responsibility for any spill while in transit - see below section 2.2.5.
2.2.4 Transportation Matrix.
2.2.4.1 The contractor shall fill in the following blank spaces indicating each transporter that may be used to transport hazardous or toxic property under this contract. Each transporter must be properly licensed, trained, permitted, conform to this contract and be in good standing with the regulatory community. The contractor agrees that no transporters other than those listed below shall be used without obtaining the prior written approval from the Steamtown NHS or Contracting Officer of the National Park Service.

2.2.4.2 For each transporter listed above, the Contractor shall provide all applicable state hauling permit numbers where appropriate. The applicable state hauling permit numbers must be provided for the state(s) where the pick-up sites are located, the state(s) where the interim storage facilities are located as listed in their Treatment, Storage and Disposal Facilities (TSDF) plan and the state(s) where the disposal facilities are located as listed in the TSDF plan.

2.2.4.3 The transporters approved for use under this contract are only approved subject to all services being performed in accordance with all federal, state, and local laws and regulations and the transporter's permit.
2.2.5 Spill Responsibility
2.2.5.1 The contractor is solely responsible for any and all spills or leaks and subsequent clean ups that may be required during the performance of this contract which occur as a result of or are contributed to by the actions of its agents, employees, or subcontractors. The contractor agrees to clean up such spills or leaks to the satisfaction of the Steamtown NHS and in a manner that complies with applicable Federal, state, and local laws and regulations. The clean-up shall be at no cost to the U.
S. Government.
2.2.5.2 The contractor shall report all such spills or leaks, regardless of their quantity, to the Steamtown NHS immediately upon discovery. A written follow-up report shall be submitted to the Steamtown NHS no later than 24 hours after the initial telephonic report. The written report shall be in narrative form and as a minimum include the following:
1. Description of the item spilled (including identity, quantity, manifest no., etc.).
2. Whether amount spilled is EPA/state reportable, and if so whether it was reported, and to whom.
3. Exact time and location of spill including a description of the area involved.
4. Containment procedures initiated.
5. Summary of any communications contractor has with press, state officials, or
Steamtown NHS officials.
6. Description of clean-up procedures employed or to be employed at the site including final disposition and disposal location of spill residue.
2.2.6 Safety
The contractor must perform all operations in a prudent, conscientious, safe and professional manner. At a minimum, contractor's personnel and equipment shall comply with applicable state, Federal, and local laws, safety regulations and procedures, and contractor shall ensure that its agents, employees, and subcontractors perform in a safe manner. The contractor shall ensure that all personnel involved in handling and packaging the hazardous waste be trained for the level of expertise required for the proper performance of the task and, in particular, in the areas of chemical incompatibility, general first aid procedures and spills. Handling and personnel protective equipment shall be provided by the contractor and must be appropriate to ensure safe handling of the hazardous waste. The contractor agrees that his personnel and equipment are subject to safety inspections by Steamtown NHS personnel and state authorities while on National Park Service property.
2.2.7 Notifications
Except as may otherwise be specified herein, the contractor shall notify the Steamtown NHS of each location, at least five calendar days before attempting site visits, analysis or pickups.
2.2.8 Permits
The contractor shall, without additional expense to the National Park Service, be responsible for obtaining any necessary licenses and permits, and for complying with any applicable Federal, state and local laws, codes, and regulations in connection with the execution of the work. This includes ensuring Steamtown NHS hazardous or toxic wastes are sent to licensed, permitted, and approved disposal sites.
2.2.9 Definition of Final Treatment/Disposal
2.2.9.1 For purposes of this contract, final treatment/disposal means either: treatment so that such wastes no longer meet the definition of a hazardous waste as defined in 40 CFR 261; or treatment of a waste by a Resource Conservation and Recovery Act (RCRA) handling method specified in 40 CFR Parts 264/265 appendix 1, Table 2, paragraph 2.
Waste handling costs that describe methods of storage do not meet the definition of final treatment nor final disposal under this contract. Interim treatment of the waste such that the waste still meets the definition of a hazardous waste as defined in 40 CFR 261 does not meet the definition of final treatment under this contract. Final disposal means disposal of a waste by a RCRA handling method specified in 40 CFR, parts 264/265, appendix 1, table 2, paragraph 3. All facilities used for interim treatment, final treatment or final disposal of items on this contract shall have as a minimum, an EPA/state approved interim status permit showing EPA hazardous waste numbers described in 40 CFR 261, subparts c and d, for each waste the facility is permitted to handle.
2.2.9.2 Mere acceptance of the hazardous waste at a properly permitted treatment, storage, or disposal facility (TSDF) does not meet the definition of final treatment nor final disposal under this contract. It is the contractor's responsibility to obtain all necessary documentation to prove that the final treatment or final disposal of all items (as defined in paragraph a above) has been accomplished. This documentation shall be attached to the certificate of disposal and submitted with, or prior to, the invoices.

2.2.11 Definition of Final Treatment/Disposal
Steamtown NHS that use hazardous or toxic materials are categorized as small quantity generators (SDG) (generators that generate between 100 kilograms and 1,000 kilograms (220-2000 pounds) per month of hazardous waste, and generate no more than 1 kilogram (2.2 pounds) per month of acutely hazardous waste, and accumulate on-site no more than 6,000 kilograms (5,000 pounds) of hazardous waste. Hazardous waste generator requirements are outlined in the following table (Note that in the event that state or local requirements may vary - contractor is responsible for determining appropriate regulatory requirements within the locale of the contract area):

2.2.12 Treatment, Storage and Disposal Facility Plan.
2.2.12.1 The Contractor shall identify each treatment, storage and disposal facility (TSDF) which may perform treatment, storage or disposal services under this contract.
Each facility must have, as a minimum, U.S. Environmental Protection Agency (EPA), RCRA interim status or state approval as a treatment or disposal facility and be in good standing with the regulatory community. The contractor agrees that no facility other than those initially approved for use under this contract shall be used, without first obtaining the written approval of the Steamtown NHS. The appropriate permit/license number, name and address of the permitting/licensing agency shall be provided.
2.2.12.2 The TSDFs approved for use under this contract are only approved subject to all services being performed in accordance with all federal state and local laws and regulations and the TSDF's permit. The contractor must have the capability to meet the removal and disposal timeframes required by the contract for all waste streams identified in Section 2.1.13 as a minimum. At least one interim storage facility for each waste stream identified in Section 2.1.13 shall be included in the proposal.
2.1.13 Manifesting and Shipping Documents
2.1.13.1 A uniform hazardous waste manifest is required for the removal from Steamtown NHS property of all hazardous, medical or toxic items. The contractor shall obtain and review all manifests for completeness and accuracy prior to removal of any hazardous or toxic wastes from Steamtown NHS property. The contractor shall provide the Steamtown NHS with a copy of the manifest(s), land disposal restriction notification(s), and any other shipping documents for review by the appropriate Steamtown NHS at least 24 hours prior to removal, whenever possible. The pickup manifests shall be reviewed and signed by the appropriate Steamtown NHS official.
Completed copies of all manifests shall be furnished to the Steamtown NHS, as well as submitted as attachments to all invoices. Manifests shall be submitted in such a manner as to comply with the timeliness prescribed by the state and EPA regulations.
2.1.13.2 The contractor is required to provide the Steamtown NHS with two (2) copies of any manifest which documents the movement of Steamtown NHS waste after it has departed the Steamtown NHS property within 30 calendar days after acceptance at the accepting facility. For example, if waste is shipped from the accumulation site to a facility for storage or treatment, which does not meet the definition of final disposal, then a manifest detailing the acceptance of the waste into the additional facility must be provided within the prescribed timeframe.
2.1.13.3 Each manifest, as well as other documentation required herein shall be clearly and distinctly marked with the contract number and delivery order number as applicable. If blocks are not provided, the contract and delivery order information shall be placed in the upper right-hand corner of each document.
2.2.14 Segregation of Hazardous Waste
All items collected on this contract must be segregated and kept physically separate from any other items until the initial treatment, storage disposal facility (TSDF) is reached. The items must be so marked, that they are readily identified to this contract throughout this period. In addition, the contractor must ensure that there is a clear audit trail for all items until final treatment/disposal is accomplished.
2.2.15 Statement on Containers
The Steamtown NHS does not warrant that the drums or containers are suitable for transportation in accordance with DoT regulations. The offeror is cautioned to ascertain and assess the need for overpacking or re-containerizing based on the site visit.
2.2.16 National Service Equipment and Personnel
The Steamtown NHS shall not furnish any equipment or personnel to assist the contractor in the performance of the contractor's responsibilities under the contract.
The Contractor understands that any such offers of assistance are unauthorized, and the contractor shall not accept any such offers.
2.2.17 Waste Analysis Sheets
The contractor shall prepare all waste analysis sheets identified to a specific contract line item that may be required for disposal and provide two copies to Steamtown NHS.
2.2.18 Detailed Analysis
If the contractor must perform detailed analysis for disposal, copies of the results identified to a specific contract line item shall be provided to the Steamtown NHS. Any detailed analysis must comply with all federal, state, and local requirements. Analysis must include determination if hazardous or toxic waste shall be treated, recycled, or ultimately disposed of in a landfill and cost benefits of such determination. Analyses shall be provided to the Steamtown NHS and method of ultimate disposal shall be whichever is most cost effective and agreed upon by the contractor and Steamtown NHS representative.
2.2.19 Treatment of Hazardous Waste On National Park Service Property
Treatment of hazardous waste (including solidification) on Steamtown NHS property is not permitted. Treatment is defined as any process which meets the definition of treatment as set forth in applicable federal, state and local laws and regulations.
2.2.20 Hours of Operation
The contractor agrees that, for those portions of the services provided on Steamtown NHS property, the services shall be provided during the normal hours of operations for the Steamtown NHS facility. The normal hours of operations for those facilities included under this contract are available, upon request, from the Steamtown NHS.
2.2.21 Loading
The contractor is responsible for loading, including furnishing all the equipment necessary for loading. Unless otherwise provided in the contract, loading shall not be performed on Saturdays, Sundays, Federal Holidays, or any day that the facility where the items are located is closed.
2.2.21.1 Bulk Items
Bulk items shall be measured by one of the following methods. The method used shall be whichever is most accurate and agreed upon by the contractor and Steamtown NHS representative.
1. Actual weight using NPS or other commercial scales.
2. Calculated weight. As an alternative to actual weighing, the weight of bulk shipments may be computed, provided that the specified gravity of the material is known and the volume actually picked up is determined. For example, 2,000 gallons of liquid with a specific gravity of 1.4 = calculated weight of 23,344 pounds. (2,000 x 1.4 x 8.337, where one gallon of water weighs 8.337 pounds).
Specific gravity shall be obtained from a waste profile sheet.
2.2.21.2 Non-bulk items
For non-bulk items, the contractor shall provide portable scales for outweighing of property. Portable scales must have a minimum capacity for 1500 pounds. For the purpose of this contract, scales permanently affixed or built into a vehicle are considered portable scales. Prior to the use of portable scales at each pickup site, the contractor must demonstrate reasonable weight accuracy to the Steamtown NHS representative. Only materials to be removed by the contractor shall be weighted.
Pallets, boxes, stripping, etc., which are not integral parts of the packaging and are not being removed by the contractor shall not be included in the weight.
2.2.22 Reports
2.2.22.1 A pickup report shall be completed by the contractor at the time of each pickup and shall accompany each shipment. Completed copies are to be furnished to the Steamtown NHS. All waste picked up shall be listed on the appropriate Steamtown NHS forms and reference the contract line item number of this contract.
2.2.22.2 The contractor shall prepare a Certificate of Disposal. This certificate shall be submitted prior to the invoices. Any differences between the contract inventory and what was actually picked up or disposed of must be thoroughly described and documented.
2.2.22.3 Certificate of Recycling. The contractor shall prepare a Certificate of Recycling for any waste that is recycled. This certificate shall be submitted prior to the invoices.
One copy of each certification of recycling signed by a responsible company official for property removed shall be provided to the COR.
2.2.22.4 Annual Report. The contractor shall prepare an annual report summarizing all hazardous waste disposal and recycling data. Report shall be submitted to Steamtown NHS officials no later than (30 dates)
2.2.23 Empty Containers
2.2.23.1 Prior to reuse or sale of empty containers, the contractor shall:
Comply with the cleaning requirements of 40 CFR 261.7.
Obliterate all markings and labels.
2.2.23.2 The contractor shall be exempt from this requirement only if the containers are crushed and sent to a scrap operation, crushed and sent to a landfill, or the containers are physically disposed of concurrently with their contents (i.e., incineration/landfill).
2.2.24 Bulk Removal
It shall be necessary to pump liquids, solids, and sludges from tanks. Contractor shall furnish a collection vehicle equipped with vacuum pumps and hoses. Each pumping truck shall have at least 100 linear feet of hose. Pumps and hoses shall have the capability to safely handle the types of wastes to be collected and be able to remove all liquids, solids, and sludges from tanks that can be removed without agitation or introduction of other materials into the tanks.
2.2.25 Packaging, Marking and Labeling
2.2.25.1 The contractor shall package, mark, label and placard all items in such a manner that all applicable federal, state, and local EPA and DoT regulations are met.
Packaging, shipping names, marking, labelling placarding, etc., under the terms of this contract shall be in accordance with 49 CFR and 40 CFR. If items must be packaged for proper shipment, the contractor shall perform such repackaging and furnish all required materials. When repackaging is necessary, the contractor shall be responsible for disposal of the original container and placarding in a manner that complies with all applicable federal, state, and local EPA and DoT regulations. The contractor shall also provide and affix appropriate placards to each vehicle prior to leaving Steamtown NHS premises and ensure that all other DoT transporter requirements are met.
2.2.25.2 If the contractor elects to package compatible items in the same container, then the contractor must provide an all-inclusive packing list showing each item and its respective quantity. This list shall be placed outside the outer most container. A copy of the packing list must be attached to the manifest. Contractor furnished overpack containers and materials shall not be included in the total weight calculations.

DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (Apr 2013)
Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).
"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements mailto:lori_achkar@nps.gov identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.
Before, Contractor submits an invoice through IPP the Contractor must complete the following:
An invoice will be prepared by the Contractor and submitted to the COR. The COR will confirm work completed. The invoice will include the location, date services rendered, number of stalls serviced.
Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:
a. An approved (COR certified) copy of each invoice must be attached in IPP.
b. Each invoice must be submitted in accordance with FAR 52.212-4. The invoice Mut include the Contract award number, Period of Performance and/ or delivery date, Contractor name and address, Invoice Number, Dollar value, Unit of issue (as applicable), description of services completed and/or items received, and other documents required per the contract.
c. If an IPP invoice is submitted without the attached invoice, the IPP submission will be rejected, and the contractor will be required to re-submit said invoice.
d. Submit a courtesy copy of the invoice and attachments to the Contracting Officer Lori Mora at lori_achkar@nps.gov.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in CCR) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

1452.228-70, DOI Liability Insurance
(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:
Workman’s Compensation and Employer Liability Insurance: Compliance with applicable Federal and State Worker’s Compensation and Occupational Disease Statues shall be required. Employer liability coverage in the minimum amount of $100,000.
General/Professional Liability Insurance: Bodily injury liability insurance minimum amount of $1,000,000 per occurrence.
Automobile Liability Insurance: This insurance shall be required on the comprehensive form of the policy and shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. The minimum limits of $200,000 per person and $500,000 per occurrence for bodily injury and $100,000 per occurrence for property damage shall be required.
(b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy copy of an acceptable insurance certificate prior to beginning the work.
SPECIAL CONTRACT REQUIREMENTS
1452.201-70 Authorities and Delegations (SEP 2011)
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum.
The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph
(e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause.
