(End of provision)

(ix) The provision at 52.212-2, Evaluation—Commercial Products and Commercial Services (NOV 2021), applies to this acquisition. The following is the specific evaluation criteria to be included in paragraph a:

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

1. Technical Capability: The capability of the offeror to meet the performance objectives listed below:

1. The Contractor shall supply four (4) Harley-Davidson Electra Glide Police Motorcycles.

2. All four (4) Harley-Davidson Electra Glide Police Motorcycles shall be the most recent model year 2022 or newer.

3. The Contractor shall provide transportation services for four (4) fully upfitted Harley-Davidson Electra Glide Police Motorcycles to the United States Park Police (USPP) Motorcycle Unit in Washington, DC.

2. Past Performance: These criteria will include, but may not be limited to, the evaluation of past performance available to the Contracting Officer.

3. Price:

The Government will evaluate each offeror's proposed prices submitted for reasonableness as discussed in the following paragraph (i). Offerors are reminded that in order to maintain evaluable pricing, the Government will not accept “Not Separately Priced (NSP),” No Charge (NC), $0, etc. on any line items other than any already designated as “NSP” in the Schedule. The Government will calculate a Total Evaluated Price (TEP) for each offeror’s proposed prices in accordance with paragraph (ii) below.

(i) Reasonableness: The existence of adequate price competition is expected to support a determination of reasonableness. Price analysis techniques may be used to further validate price reasonableness. If adequate price competition is not obtained and/or if price reasonableness cannot be determined using price analysis of Government obtained information, additional information in accordance with FAR 15.4 may be required to support the proposed price.

(ii) Total Evaluated Price: A total evaluated price will be calculated, as shown on the bid sheet, based on the total price proposed for the basic requirements (basic award) and all options.

Award will be made to the offeror with the lowest TEP who passes Technical.

Technical and past performance, when combined, are significantly less important than cost or price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(a) This clause does not apply to the unrestricted portion of a partial set-aside.

(b) Definition. Similarly situated entity, as used in this clause, means a first-tier subcontractor, including an independent contractor, that—

(1) Has the same small business program status as that which qualified the prime contractor for the award (e.g., for a small business set-aside contract, any small business concern, without regard to its socioeconomic status); and

(4) Orders expected to exceed the simplified acquisition threshold and that are—

(ii) Issued directly to small business concerns under multiple-award contracts as described in 19.504(c)(1)(ii);

(6) Contracts using the HUBZone price evaluation preference to award to a HUBZone small business concern unless the concern waived the evaluation preference.

(d) Independent contractors. An independent contractor shall be considered a subcontractor.

(e) Limitations on subcontracting. By submission of an offer and execution of a contract, the Contractor agrees to the following requirements in the performance of a contract assigned a North American Industry Classification System (NAICS) code applicable to this contract:

(1) Services (except construction). It will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding certain other direct costs and certain work performed outside the United States (see paragraph (e)(1)(i)), to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both services and supplies, the 50 percent limitation shall apply only to the service portion of the contract.

(i) The following services may be excluded from the 50 percent limitation:

(A) Other direct costs, to the extent they are not the principal purpose of the acquisition and small business concerns do not provide the service. (2) Supplies (other than procurement from a nonmanufacturer of such supplies). It will not pay more than 50 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 50 percent subcontract amount that cannot be exceeded. When a contract includes both supplies and services, the 50 percent limitation shall apply only to the supply portion of the contract.

(3) General construction. It will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities.

Any work that a similarly situated entity further subcontracts will count towards the prime contractor’s 85 percent subcontract amount that cannot be exceeded.
