This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. Solicitation Number 140P2123Q0223 is issued as a Request for Quote (RFQ) which constitutes the entire solicitation. This acquisition will be conducted pursuant to FAR Part 13.

This solicitation document incorporates all mandatory commercial item provisions and clauses in effect through Federal Acquisition Circular 2023-04, effective June 2nd, 2023. This is a small business set-aside. The North American Industry Classification System (NAICS) code is 513210, Software Publishers, and the related small business size standard is $47M.

The government anticipates award of one (1), firm-fixed price contract.

REQUIREMENT: The National Park Service (NPS) seeks to renew its Jamf licensing and premium support maintenance in order to keep its Mac (Apple) IT equipment in compliance with security guidelines, according to the Department of Interior (DOI), Defense Information Systems Agency (DISA), and (DHS) mandates.

JAMF LICENSING RENEWAL

GENERAL SCOPE

The National Park Service (NPS) seeks to renew its Jamf licensing and premium support maintenance in order to keep its Mac (Apple) IT equipment in compliance with security guidelines, according to the Department of Interior (DOI), Defense Information Systems Agency (DISA), and (DHS) mandates.

The line items and product numbers are as follows:

CLIN – 00010: Mfg. #4440444240, Premium Support Plus Jamf Expert and 24/7 Support (Quantity: 1 Each)

CLIN – 00020: Mfg. #1001010102_0001, COM-NP Jamf Pro MacOS – 250-999 (Quantity: 300 each)

PERIOD OF PERFORMANCE

The period of performance for this requirement shall be September 21, 2023 to September 20, 2024. (12 Months)

ADDITIONAL WORK

Any additional work not detailed in this contract shall be approved, in writing, by the Contracting Officer via a bilateral modification.

LOSS OR DAMAGE

The contractor shall be liable for any loss or damage to any government property caused by negligence, theft, or willful misconduct of the contractor, his agents, servants, and employees, and shall indemnify and save the government harmless against all actions, proceedings, claims, demands, costs, damages, and expenses, including attorney’s fees, by reason of any suit or action brought for any actual or alleged injury to or resulting from the performance of this contract. The contractor shall submit a full written report to the Contracting Officer within 24 hours following the occurrence of such damage, loss, or injury.

If due to fault, neglect, dishonesty of the contractor, his agency or employees, loss or damage to government property is incurred during the performance of this contract, the contractor shall be responsible for same. The government, at its option, may in lieu of repayment, require the contractor to replace at his own expense, all such property as directed by the Contracting Officer. Until the equipment is repaired or replaced, the contractor shall furnish similar, adequate replacement property and/or equipment at no charge to the government, within two working days of the date the equipment has been lost, stolen, or damaged.

CONTRACT ADMINISTRATION

A. The National Park Service, Contract Specialist / Contracting Officer address is:

National Park Service, Harpers Ferry Center Office of Acquisition Management P.O. Box 50, 67 Mather Place Harpers Ferry, West Virginia 25425-0050.

The contractor shall use the Contracting Officer as a point of contact on all business and administrative matters concerning this contract. All correspondence, other than that of a technical nature, shall be addressed to the Contracting Officer, with information copies of the basic correspondence to the COR.

B. The National Park Service, COR address is:

National Park Service, Harpers Ferry Center, Attention: COR P.O. Box 50 Harpers Ferry, West Virginia 25425-0050.

The contractor shall use the COR as the point of contact for all technical matters under the contract. Technical correspondence shall be addressed to the NPS COR, with an information copy of the basic correspondence to the Contracting Officer.

FACILITY SECURITY POLICY

Contractors attending meetings or accomplishing work within the buildings or real property of the National Park Service shall adhere to the security policy of each office. It shall be the responsibility of the contractor to contact the office before work begins for a briefing on security policies.

INQUIRIES

Inquiries and all correspondence concerning this solicitation document shall be submitted via e-mail to the Contracting Officer.

All technical questions shall be submitted via email to tavis_salas@nps.gov no later than the date and time prescribed in the solicitation. A response shall not be furnished on questions received after the cutoff date and time. Oral communication/telephone communication is unacceptable. All questions submitted shall reference specific parts of the solicitation including page numbers.

INSPECTION AND ACCEPTANCE

All service and work performed under this contract shall be subject to inspection and acceptance by the designated Contracting Officer's Representative (COR) at any time during performance. If the COR determined that services, work or materials being furnished do not meet the required standards, the government reserves the right to have the work performed elsewhere, charging the contractor with costs involved, subject to the provisions of FAR 52.249-8.

INSTRUCTIONS FOR THE PREPARATION OF QUOTES AND EVALUATION

The quote shall be submitted electronically as stated below. The offeror whose quote is the lowest priced technically acceptable, shall be selected for award.

THE QUOTE SHALL BE IN THE FOLLOWING FORMAT:

All parts shall be submitted via email to Contracting Officer, Tavis Salas, at tavis_salas@nps.gov.

Offerors are responsible for submitting quotes, and any modifications or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation.

Both parts shall be separate and complete so that evaluation of one may be accomplished independently of, and concurrent with, evaluation of the other. Pricing details shall not appear in any documents except PART II – COST/PRICE. Any price information found outside of the cost/price part will be redacted prior to evaluation. All pages exceeded posted page limits will be redacted prior to evaluation.

PART I - TECHNICAL CAPABILITY

Part I shall consist of the following:

• Proof of Jamf Certifications for any personnel/developers who will be working under this contract.

PART II – COST/PRICE

Offerors’ cost quotes will not be point scored or adjectively scored but will be evaluated on price reasonableness. The price quote will also be used as an aid to determine the Offeror understands the requirements of the solicitation, price reasonableness and to assess the validity of the offeror’s approach to managing and performing the work.

INVOICING

Electronic Invoicing and Payment Requirements - Invoice Processing Platform (IPP) (May 2016)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov.

The contractor shall submit an Invoice Package, including copies of the following documents, to the Contracting Officer’s Representative a minimum of 5 working days prior to submittal of the formal Invoice through IPP. Within 5 working days of receipt, the COR shall provide an acceptability recommendation to both the NPS Contracting Officer and the contractor. If the COR recommends acceptance, the contractor shall submit the invoice through IPP.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
