JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

BRAND NAME ACQUISITION

This justification is in accordance with FAR 13.501 – Special Documentation Requirements (Deviation 2018-O0018) using the format at 6.303-2 as follows:

(1) IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY

DOI/NPS/HFC-WCO

(2) NATURE AND/OR DESCRIPTION OF THE ACTION

The National Park Service (NPS) seeks to renew its Jamf licensing and premium support maintenance in order to keep its Mac (Apple) IT equipment in compliance with security guidelines, according to the Department of Interior (DOI), Defense Information Systems Agency (DISA), and (DHS) mandates.

(3) DESCRIPTION OF THE SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE)

Provide all premium 24x7 maintenance/support and 300 Jamf licenses for all NPS Macintosh computers. (Government Estimate - $33,927.15)

(4) IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING

OTHER THAN FULL AND OPEN COMPETITION.

FAR 6.303-1(a)(2) – Only one responsible source and no other supplies or services will satisfy agency requirements.

(5) DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES USE

OF THE AUTHORITY CITED.

In 2020, the DOI extensively researched other Mac management products and unanimously selected Jamf as the product to replace Centrify. Jamf is the only device management solution of its kind that’s exclusive for iPhones, iPads, and Mac devices. It might as well be referred to as the Apple expert for education, commercial, or government establishments. The various products in this licensing suite allow for seamless setup and deployment of devices, all offered in a single consolidated solution.

Three Jamf servers have now been set up to manage the NPS’s Mac equipment across the agency. Using another brand at this point may jeopardize its ability to function due to the incompatibility with other software. Additionally, the servers will have to be updated to accommodate for new software. This will be a substantial duplication of costs and efforts for another attempt at standardization.

(6) DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS PRACTICABLE,

INCLUDING WHETHER A NOTICE WAS OR WILL BE PUBLICIZED AS

REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION

UNDER 5.202 APPLIES.

The government intends to issue a combined synopsis/solicitation for commercial items in accordance with the format in FAR 12.6 to Jamf vendors. The dollar amount allows for a shorter solicitation.

(7) DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE.

Jamf is commercially available and has an extensive consumer market, including numerous

Government agencies. Jamf is competitively priced with other similar products.

(8) DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART 10)

AND THE RESULTS OR A STATEMENT OF THE REASON MARKET

RESEARCH WAS NOT CONDUCTED.

Market research was conducted for authorized Jamf Partners/Resellers. There is a network of more than 20 resellers in the United States and many more worldwide. This is a commercial, off-the-shelf product, so adequate price competition exists.

(9) ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION, SUCH AS:

(i) Explanation of why technical data packages, specifications, engineering descriptions, statements of work, or purchase descriptions suitable for full and open competition have not been developed or are not available. N/A

(ii) When 6.302-1 is cited for follow-on acquisitions as described in 6.302-1(a)(2)(ii), an estimate of the cost to the Government that would be duplicated and how the estimate was derived. N/A

(iii) When 6.302-2 is cited, data, estimated cost, or other rationale as to the extent and nature of the harm to the Government. N/A

(10) A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING, AN

INTEREST IN THE ACQUISITION.

(11) A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUISITION FOR THE SUPPLIES OR SERVICES

REQUIRED.

The agency has been mandated to use certain software. Until compatibility is allowed, Jamf will be the only product available for use by the NPS.

(12) CONTRACTING OFFICER CERTIFICATION THAT THE JUSTIFICATION IS

ACCURATE AND COMPLETE TO THE BEST OF THE CONTRACTING

OFFICER’S KNOWLEDGE AND BELIEF

The above justification is accurate and complete to the best of my knowledge and belief.

Based on the above information, it is recommended that the NPS renew its Jamf licensing and 24x7 premium support to keep the NPS’s Macintosh equipment in compliance with all security protocols, guidelines, STIGs, etc. Jamf is available by resellers throughout the market. Price competition can be obtained from these sources, allowing the NPS to solicit offers with adequate competition, as well as fair and reasonable pricing.
