GENERAL INFORMATION:

This is a COMBINED SYNOPSIS / SOLICITATION for commercial products prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The National Park Service contemplates award of a Single Award, Firm-Fixed Price with Economic Price Adjustment as a result of this combined synopsis / solicitation to the vendor providing the best value to the Government. This announcement constitutes the only solicitation issued as Request for Quotation (RFQ) 140P1422Q0039. A WRITTEN SOLICITATION WILL NOT BE ISSUED. FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2022-04 and are available in full text through Internet access at http:// www.acquisition.gov/far/.

The acquisition is in support of Yellowstone National Park. The National Park Service requires Superpave 58-34 Asphalt, Mobile Asphalt Plant and Milling Operations for Yellowstone National Park, in accordance with the attached Statement of Work and Specifications contained herein.

This is a 100% Total Small Business Set Aside. The North American Industry Classification System (NAICS) code is 324121 and the small business size standard is 500 employees.

AWARD SELECTION PROCESS:

Award will be made in accordance with FAR Part 13 to the vendor that provides the lowest price quote that meets the technical specifications and prior experience.

1. Price.

2. Technical: Provide a project narrative that demonstrates how the company will successfully meet the needs of the statement of work.

3. Prior experience: Prior experience is the factual documentation or narrative of a firm’s experience, qualifications, and capability, to meet the acceptability standard provide three examples of if similar size, scope and complexity.

Technical and prior experience when combined, are of equal importance when compared to price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

INSTRUCTIONS TO OFFERORS:

Quotes shall be in accordance with and in the order detailed in this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the quote not being considered for award.

All interested parties shall be registered in the System for Award Management (SAM) at SAM.gov at the time a quotation is submitted.

Quotes shall be submitted no later than May 28, 2022, by 1:00 p.m., Mountain Time. Vendors shall submit quotes by email to Stacy_Valie@nps.gov.

STATEMENT OF WORK / SPECIFICATIONS:

Base Line Items:

1. Mobile Asphalt Plant and materials to mix 4,600 tons and the option to purchase an additional 500 tons of Superpave PG58-34 asphalt mix. (Asphalt concrete aggregate, Oil/Anti- Strip, Mixing)

2. Provide milling of roadway for 44,000 square yards with the option to mill an additional 5,000 square yards.

Period of Performance: The contractor shall be capable of commencing deliveries by August 15, 2022, completing all deliveries by October 28, 2022, milling operations will be conducted within the same dates.

Scope for Asphalt mixing: Contractor shall supply all labor, materials, and equipment necessary to supply mix at a plant within Yellowstone National Park.

Contractor will be responsible for Asphalt concrete aggregate, PG58-34 oil, anti-strip, labor, and equipment to produce 6,000 tons of mix on site at the Norris Junction Pit approximately 22 miles south of Mammoth Hot Springs, Wyoming 82190.

Asphalt oil and mix design specifications: Contractor shall provide contract mixing of 6,000 tons of PG58-34 asphalt with a 1 % Type 3 (lime) anti-strip additive with the aggregate meeting ½” gradation in tables 703-4, 703-5 and table 703.07 Asphalt Concrete Aggregate, to produce a mix with 4% air voids.

The largest size rock in the mix would be all material passing the ¾” inch sieve.

Contractor shall submit mix design to Yellowstone National Park for approval prior to start of mixing.

Mix Plant specifications: The mobile asphalt mixing plant used in Yellowstone National Park must be equipped with a Bag house pollution control system (wet scrubber is not acceptable).

The mobile asphalt mixing plant shall be capable of producing 120 tons per hour under any weather condition suitable for paving.

Due to weather conditions, paving may not occur every day. Days of production could require from, a minimum of 100 tons to a maximum of 900 tons of mix per day.

Ordering and supplying: The contractor shall coordinate the exact dates and times of supply and pick-up with the Yellowstone National Park personnel. During the period of performance, Yellowstone National Park shall contact the contractor daily to place orders for specific amounts of mix needed for the next day. The contractor shall insure total for all amounts ordered and supplied does not exceed the amount noted in the contract line items.

Hauling and cleaning of Equipment: All vehicles and equipment to be used in Yellowstone National Park (Park) shall be thoroughly pressure washed prior to arrival. Equipment shall be inspected at the appropriate Park entrance station by a designated Park employee and only clean equipment shall be permitted into the Park. Particular attention must be shown to the undercarriage and any surface where soil and exotic weed seeds may exist. All loaded trucks and trailers hauling aggregate shall be covered (tarped) when loaded. These efforts are critical to prevent the introduction and establishment of non-native plant species into the Park. Equipment inspection shall be scheduled by the COR and take place at the Park entrance station. Equipment found operating in the Park that has not been inspected shall be dead lined and subject to a citation.

Vegetation Management: The control of noxious weeds shall be achieved through a weed management plan. All parties submitting offers for aggregate coming into Yellowstone National Park (Park) must have a current weed management plan that has been approved by the local county weed board and Yellowstone National Park. All plans require one annual inspection by Park staff during the growing season (June- August) prior to sale or hauling of material. Parties submitting offers must provide proof of the most recent weed inspection by Park staff.

The weed inspection will designate a pit in one of the three rating categories: acceptable, conditional acceptable, or unacceptable. Aggregate from a pit designated as unacceptable can be used if the material is heat treated to 300 degrees Fahrenheit and promptly transported from the quarry to the Park or a preapproved weed free storage area to prevent possible weed contamination.

A copy of the latest pit report for the area has been provided.

Asphalt Concrete Aggregate Specifications:

703.07 Asphalt Concrete Aggregate. Furnish hard, durable particles or fragments of crushed stone, crushed slag, or crushed gravel conforming to the following:

(a) Los Angeles abrasion, AASHTO T 96 35 percent max.

(b) Soundness of aggregate using sodium sulfate AASHTO T 104 (5 cycles):

(1) Coarse aggregate 12 percent loss max.

(2) Fine aggregate 12 percent loss max.

(c) Fractured faces, ASTM D5821 90 percent min.

(d) Fine aggregate angularity, AASHTO T 304, 40.0 percent min.

(1:5 ratio, plus ⅜-inch (9.5-mm) sieve, calculated Mass, weighted average

(g) Gradation. Size, grade and combine the aggregate fractions in mix proportions that result in a composite blend conforming to the specified gradation. Nominal maximum size is one sieve size greater than the first sieve to retain more than 10 percent of the combined aggregate.

Test according to AASHTO T 27 and AASHTO T 11. Volumetric asphalt concrete aggregate gradation.

See Table 703-4. For the surface course, do not use aggregates known to polish or carbonate aggregates containing less than 25 percent by mass of insoluble residue when tested according to ASTM D3042

Scope for Milling Operations: Contactor shall supply a front discharge asphalt milling machine to include one operator and one ground personnel. Milling shall be conducted on a section of roadway from Norris Junction to 3.2 miles east. This will be broken into sections being no more than 1.1 miles, with paving operations on each section will be completed before the next section is milled. Section sizes and time frames shall be coordinated with NPS COR.

Machine specifications and capabilities:

Machine shall have a minimum 6-foot-wide milling width Be capable of milling 2 inches to 4 inches of depth.

Machine shall not cause damage to any part of the pavement structure that is not being removed Contractor shall be responsible for all repairs and maintenance of the milling machine

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215- 2, Audit and Records-Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.216-2 Economic Price Adjustment-Standard Supplies NOV 2021

(a) The Contractor warrants that the unit price stated in the Schedule for _________ [offeror insert Schedule line item number] is not in excess of the Contractor’s applicable established price in effect on the contract date for like quantities of the same item. The term "unit price" excludes any part of the price directly resulting from

(1) Is an established catalog or market price for a commercial product sold in substantial quantities to the general public; and

(2) Is the net price after applying any standard trade discounts offered by the Contractor.

(b) The Contractor shall promptly notify the Contracting Officer of the amount and effective date of each decrease in any applicable established price. Each corresponding contract unit price shall be decreased by the same percentage that the established price is decreased. The decrease shall apply to those items delivered on and after the effective date of the decrease in the Contractor’s established price, and this contract shall be modified accordingly.

(c) If the Contractor’s applicable established price is increased after the contract date, the corresponding contract unit price shall be increased, upon the Contractor’s written request to the Contracting Officer, by the same percentage that the established price is increased, and the contract shall be modified accordingly, subject to the following limitations:

(1) The aggregate of the increases in any contract unit price under this clause shall not exceed 10 percent of the original contract unit price.

(2) The increased contract unit price shall be effective-

(i) On the effective date of the increase in the applicable established price if the Contracting Officer receives the Contractor’s written request within 10 days thereafter; or

(ii) If the written request is received later, on the date the Contracting Officer receives the request.

(3) The increased contract unit price shall not apply to quantities scheduled under the contract for delivery before the effective date of the increased contract unit price, unless failure to deliver before that date results from causes beyond the control and without the fault or negligence of the Contractor, within the meaning of the Default clause.

(4) No modification increasing a contract unit price shall be executed under this paragraph (c) until the Contracting Officer verifies the increase in the applicable established price.

(5) Within 30 days after receipt of the Contractor’s written request, the Contracting Officer may cancel, without liability to either party, any undelivered portion of the contract items affected by the requested increase.

(d) During the time allowed for the cancellation provided for in paragraph (c)(5) of this clause, and thereafter if there is no cancellation, the Contractor shall continue deliveries according to the contract delivery schedule, and the Government shall pay for such deliveries at the contract unit price, increased to the extent provided by paragraph

(c) of this clause.

The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within 75 days after award of contract. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.

(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

(a)The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. (a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an

(b) agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer at Stacy_Vallie@nps.gov

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.

(c) A copy of the protest served on the Contracting Officer shall be simultaneously furnished by the protester to the Department of the Interior Assistant Solicitor, Acquisitions and Intellectual Property, 1849 C Street, NW, Room 6511, Washington, DC 20240.

Electronic Invoicing and Payment Requirements – Invoice Processing Platform (IPP) APR 2013

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. The IPP website address is: https://www.ipp.gov. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

Invoice to be on company letterhead with stated Purchase- Order number.

The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contact (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) within 3 - 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.

If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.
