GENERAL INFORMATION:
This is a COMBINED SYNOPSIS / SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The National Park Service contemplates award of a Firm-Fixed- Price (FFP) with economic price adjustment contract as a result of this combined synopsis/solicitation to the vendor. This announcement constitutes the only solicitation issued as Request for Quotation (RFQ) 140P1222Q0014. A WRITTEN SOLICITATION WILL NOT BE ISSUED.
To be eligible for an award, contractor must be registered in the System for Award Management (SAM) database www.sam.gov. A contractor can contact the SAM by calling 1-866-606-8220 or e-mail at http://www.fsd.gov. NO EXCEPTIONS. A DUNS (Dun and Bradstreet) number is required in order to register. All invoices shall be submitted as instructed in clause 52.212-4 (g) below.
PRICING: Pricing shall be determined based on the local Colorado National Monument Fruita, CO pricing. Deliveries shall be priced according to the posted price on the effective date (date of delivery) plus the contractor’s add-on (markup), rounded to the nearest cent.
FAR clauses and provisions enclosed within this RFQ are those in effect through Federal Acquisition Circular (FAC) 2022-04 and are available in full text through Internet access at http:// www.acquisition.gov/far/.

The Government will not be obligated to pay the Contractor any amount in excess of the obligated price in the Schedule, and the Contractor shall not be obligated to continue performance if to do so would exceed the obligated price set forth in the Schedule, unless and until the Contracting Officer notifies the Contractor in writing that the obligated price has been increased and specifies in the notice a revised Obligated amount that shall constitute the ceiling price for performance under this contract.

INSTRUCTIONS TO OFFERORS:
Quotes must be in accordance with and in the order detailed in this section. Failure to submit quotes according to the instructions provided within the solicitation may result in the respondent’s quote not being considered for award.
All interested parties shall be registered in the System for Award Management or SAM at time an offer or quotation is submitted.

Offers shall submit the following information in its entirety:
QUOTE SUBMISSION
A. GENERAL:
Submit, at a minimum, an offer that conforms to the solicitation documents. By submission of an offer in accordance with the instructions provided in this section, the quoter unconditionally assents to the terms and conditions in this solicitation document and in any solicitation attachments.
Submit an offer that complies with the format, content, and submission instructions contained in this section. Quoters should carefully review this section prior to commencing quote preparation.
B. SUBMISSION INSTRUCTIONS:
1. Quoters shall submit their quotes to the following email address no later than date and time noted in the SF 18.
2. Prior Experience: Quoter shall provide examples of three (3) contracts similar in scope to the requirements outlined in the Statement of Work. The quoter should disclose any instances in which its past performance on a particular contract may be considered by others to be less than fully satisfactory by including or attaching a narrative to the Capabilities Statement. Any termination(s) shall be included as well with Contractor’s explanation for why it was terminated. The quoter should relate pertinent facts and circumstances and describe any remedial action taken or to be taken to correct the deficiency. Failure to disclose such instances may result in a determination that the quoter has been less than candid with the Government, which could result in an unfavorable assessment of the quoter's past performance record.
3. Standard Form 18, Request for Quotation: Complete blocks 11c, d, e, & f., 13 through 16, and detailed price schedule in section B. An official having the authority to contractually bind the company must sign the SF 18 in accordance with the procedures prescribed in FAR 4.102.
4. Quote Schedule: Provide proposed pricing on quote schedule (below).
4. Acknowledgement of Amendments: Acknowledge all solicitation amendments using one of the methods set forth in Block 11 of Standard Form 30 and fill in 15 a, b, c, and return signed.
5. Representations, Certifications and Other Statements of Quoters: Complete all required representations and certifications if they are not available at www.SAM.gov. NOTE: Current, active registration at www.SAM.gov is a requirement of this contract; the Government highly recommends completing SAM registration before submitting the offer.
6. Capabilities Statement: Quoter shall provide a statement no longer than two (2) pages outlining their ability to provide the required supply at the quantity and frequency specified in the Statement of Work.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.219-28 Post-Award Small Business Program Rerepresentation.
As prescribed in 19.309(c)(1), insert the following clause:
Post-Award Small Business Program Rerepresentation (Sep 2021)
(a) Definitions. As used in this clause—
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern—
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is “not dominant in its field of operation” when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts-
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentationthat corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small businesssize standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table- size-standards.
(e) The small business size standard for a Contractor providing an end item that it does not manufacture, process, or produce itself, for a contract other than a construction or service contract, is 500 employees if the acquisition—
(1) Was set aside for small business and has a value above the simplified acquisition threshold;
(2) Used the HUBZone price evaluation preference regardless of dollar value, unless the Contractor waived the price evaluation preference; or
(3) Was an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.
(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
