1. TASK ORDER TYPE
This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR) subpart 12.6 – Streamlined Procedures for Evaluation and Solicitation for Commercial Items, as supplemented with additional information included in the notice and following the Simplified Acquisition Procedures in FAR Part 13.5. THIS ANNOUNCEMENT CONSTITUTES THE ONLY
SOLICITATION; QUOTES ARE BEING REQUESTED AND A WRITTEN SOLICITATION
WILL NOT BE ISSUED. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) 2005-97, dated January 24, 2018.
This requirement is issued by Department of the Interior/Interior Business Center/Acquisition Services Directorate (DOI/IBC/AQD) on behalf of the Office of Special Trustee for American Indians (OST). AQD is issuing this Request for Quote (RFQ) for the purpose of entering into a single purchase order for a Hirsch Brand Name or Equal Physical Security Access System, as well as scheduled and unscheduled maintenance service as described in the Statement of Work (SOW), Attachment 1.
The Government intends to evaluate quotes and award a contract without exchanges. Therefore, the contractor’s initial quote should contain the contractor’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct exchanges with contractors if later determined by the Contracting Officer (CO) to be necessary.
The resultant award shall be a Firm-Fixed-Price (FFP) Order.
This is a Total Small Business (SB) set aside requirement. Quotes submitted by any vendor that is not SB, will not be accepted.
The applicable North American Industry Classification System (NAICS) code is 561621, Security Systems Services (Except Locksmiths) with a size standard of $20.5 million, and the Product Service Code (PSC) code is J070, Maintenance Repair, and Rebuilding of Equipment – Automatic Data Processing Equipment (Including Firmware), Software, Supplies and Support Equipment.
Site Visit: A site visit is scheduled for Monday, August 3, 2020, 10:00 am MT or 1:30 pm MT at the OST office in Albuquerque, New Mexico. All interested firms may attend with a limit of two
(2) attendees per firm. Please confirm participation in site visit and submit on company letterhead full name and job title of the attendee(s) to Ms. Gloria Crayton at gloria_crayton@ibc.doi.gov no later than July 30, 3:00 pm EST. Attendees should submit all questions regarding the site visit via email to the attention of Ms. Ms. Gloria Crayton at gloria_crayton@ibc.doi.gov. Any remarks or explanations provided by the Government representatives before, during and after the site visit, whether orally or in writing, shall not

4. QUESTIONS
All questions regarding this RFQ must be submitted in writing via email no later than 3:00 PM Eastern Time, Wednesday August 5, 2020 to Gloria Crayton, Contracting Officer, at gloria_crayton@ibc.doi.gov and Jacqueline McAdam, Procurement Technician, at jacqueline_mcadam@ibc.doi.gov. Should any request for clarification or questions be received after the date stated above, the Government reserves the right not to provide an answer. If, however, in the Government’s opinion, the request for clarification, or question, cites an issue of significant importance, the Government may provide written responses to all potential vendors. Questions and comments will not be protected by the Government, as proprietary.
The AQD will answer questions which may affect quotes in an amendment to the solicitation.
The Government reserves the right to transmit those questions and answers of a common interest to all prospective Quoters. The contractor or source of the question will not be referenced when issuing an amendment to the solicitation.

Addendum to FAR 52.212-1 - RFQ Submission Instructions:
This section provides general guidance for preparing the quote and specific instructions on its format and content. The quote shall include all data and information requested and submitted in accordance with these instructions. The quote shall be in compliance with the requirements as stated in the SOW and this RFQ. Non-conformance with the instructions provided may result in an unfavorable quote evaluation.
a. The quote shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated claims. The quote shall not simply rephrase or restate the Government’s requirements but, rather, shall provide convincing rationale to address how the Quoter intends to meet these requirements.
b. The technical quote shall not make any reference to price.
Technical Quotes: The Quoter shall explain in their technical quote how the technical requirements described in the SOW (Attachment 1) will be met with minimal risk to the Government.
Price Quote: Quoters shall complete the Pricing Table in Attachment 2. Pricing shall be FFP for the Quoter’s to meet the requirements in the SOW.
6. QUOTE PACKAGE DUE DATE
Written responses to this RFQ shall be submitted via email no later than 3:00 PM Eastern Time on Wednesday, August 12, 2020 to Gloria Crayton, Contracting Officer, at gloria_crayton@ibc.doi.gov and Jacqueline McAdam, Procurement Technician, at jacqueline_mcadam@ibc.doi.gov. NOTE: It is the Quoter’s responsibility to read the RFQ and all related documents carefully and completely. Additionally, it is the Quoter’s responsibility to ensure/verify the Government receives its submission on or before the date/time specified for the RFQ closing.

The quote shall describe how the proposed solution meets or exceeds the Government’s requirements as stated in Part I and Part II of the SOW (Attachment 1).
2. Technical – Assumptions, Conditions or Exceptions
The Quoter shall submit all (if any) technical assumptions, conditions, or exceptions with any of the terms and conditions of this solicitation, including the SOW. If not noted in this volume of the quote, it will be assumed that the Quoter has no technical assumptions for award and agrees to comply with all of the terms and conditions as set forth herein. Any technical assumptions listed in any other volume shall be null and void.
In accordance with FAR 52.211-6 – Brand Name or Equal, offerors shall provide the brand name product referenced in this solicitation, unless the offeror clearly indicates that the product being offered is an “equal” product. Offerors may propose equivalent equipment;
however, it shall demonstrate that the quote equipment meets or exceeds the minimum salient characteristics. Offerors shall furnish as part of their quote all descriptive material necessary for the Government to determine whether the proposed products meet all technical requirements specified in the Statement of Work.
VOLUME 2 – PRICE QUOTE:
1. Price
The FFP price quote shall be a separate volume from the technical quote. Quoters shall complete the Pricing Table (Attachment 3).

Pricing shall be FFP and the total price shall include all costs associated with fulfilling the requirements of the SOW.
Discount:
The Government requests a price discount for this requirement; the price quote shall include the discount amount broken down by line item to equate to the FFP quote for each line item.
A total amount of all discounts shall be provided.
2. Price Assumptions, Conditions or Exceptions
Quoters shall indicate, in this section only, if any price related assumptions have been made, conditions have been stipulated or exceptions have been taken with the SOW as written. If not noted in this volume of the quote, it will be assumed that the quote reflects no price assumptions for award and agrees to comply with all of the terms and conditions set forth herein. It is not the responsibility of the Government to seek out and identify assumptions, conditions, or exceptions buried within the quote. Accordingly, any price related assumptions listed in any other volume or section will be null and void.
Acknowledgment of Solicitation Amendments. The quoter must submit a statement to acknowledge solicitation amendments, if applicable.
• Period of acceptance for quotes. The quoter agrees to hold the prices in its offer firm for 60 days from the date specified for receipt of offers.
• Multiple quotes. Quoters shall submit only one quote presenting the terms and conditions or commercial items for satisfying the requirements of this solicitation.
• Multiple awards. The Government will award on an “all or none” basis.
8. Evaluation Factors for Award

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Basis of Award: A Lowest Price Technically Acceptable (LPTA) approach will be used; the evaluation criteria are described herein. The policies and procedures under the Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, in conjunction with FAR Subpart 8.405-2 Ordering procedures for services requiring a statement of work., and FAR 19, Small Business Program, will be utilized for this procurement. The Award decision will be based on Lowest Price Technically Acceptable (LPTA). The Government will award a contract resulting from this solicitation to the responsible Contractor whose quote conforming to the solicitation will be most advantageous to the Government.
The Government’s technical evaluation team will evaluate quotes to determine either technically acceptable or technically unacceptable (price excluded).
The Government will evaluate quotes strictly in accordance with this solicitation and will not assume that performance will include areas not specified in the Contractor's submission.
The Government intends to award the contract without discussions. Therefore, each initial quote should contain the Contractor's best terms from a price, and technical approach standpoint. Additional oral or written information from one or more Contractor’s may be requested, but not necessarily from all. The Government reserves the right to conduct discussions. If revised quotes are requested, they will be evaluated against the same criteria as were the initial quotes.
The Government intends to make an award to the responsible Contractor whose quote represents the best overall value. The Contracting Officer will determine which quote represents the best overall value on the basis of the factors described herein.
EVALUATION CRITERIA
The Government will use the criteria set forth below to evaluate and select the awardee. To be considered technically acceptable, Contractor must demonstrate the capability to provide the requirements set forth in the SOW. Acceptability will be based on the following:
Evaluation Criteria. Evaluation criteria consist of two (2) evaluation factors. The quotes will be evaluated under the following evaluation factors:
Factor 1: Technical Capability Factor 2: Price
Assigning Ratings: The Technical Capability Factor will be assigned one of the ratings defined below.
In order to be considered for award, there must be an “acceptable” rating in every factor.

Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
Factor 1: Technical Capability. To be determined technically acceptable, the Quoter must demonstrate all of the following:
(a) Technical Capability - The Quoter’s approach clearly demonstrates a sound and feasible technical approach that addresses all applicable requirements of the SOW and indicates the Quoter will be able to successfully perform this requirement.
Factor 2- Price. The Price Submission will not be scored or rated. To be viable for award, a Quoter’s price must be determined fair and reasonable. The total evaluated price includes the price of the base period, all option periods (to include the option to extend services in accordance with FAR 52.217-8).
(a) As part of price evaluation, the Government will evaluate its option to extend services, FAR Clause 52.217-8. Thus, the Quoter’s total price for the purpose of evaluation will include the base period, 1st option, 2nd option, 3rd option 4th option and 1/2 of the 4th option. Quoters are required to enter a price for the six-month period.
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quoter's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

FAR 52.211-6 Brand Name or Equal-Brand Name or Equal (Aug 1999) (a)If an item in this solicitation is identified as “brand name or equal,” the purchase description reflects the characteristics and level of quality that will satisfy the Government’s needs. The salient physical, functional, or performance characteristics that “equal” products must meet are specified in the solicitation.
(b)To be considered for award, offers of “equal” products, including “equal” products of the brand name manufacturer, must- (1)Meet the salient physical, functional, or performance characteristic specified in this solicitation;
(2)Clearly identify the item by-

(3)Include descriptive literature such as illustrations, drawings, or a clear reference to previously furnished descriptive data or information available to the Contracting Officer; and
(4) Clearly describe any modifications the offeror plans to make in a product to make it conform to the solicitation requirements. Mark any descriptive material to clearly show the modifications.
(c)The Contracting Officer will evaluate “equal” products on the basis of information furnished by the offeror or identified in the offer and reasonably available to the Contracting Officer. The Contracting Officer is not responsible for locating or obtaining any information not identified in the offer.
(d)Unless the offeror clearly indicates in its offer that the product being offered is an “equal” product, the offeror shall provide the brand name product referenced in the solicitation.
FAR 52.217-5 Evaluation of Options (July 1990)
Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
9. SECTION 508
All work shall be compliant with the requirements referenced in these documents including Section 508 of the Rehabilitation Act of 1973 and 29 USC 794d, sub-part B, Technical Standards, 1194.21.
The Section 508 standards established by the Architectural and Transportation Barriers Compliance Board (Access Board) are incorporated into, and made part of all VA contracts, solicitations and purchase orders developed to procure Electronic and Information Technology (EIT). These standards are found in their entirety at http://www.section508.gov. A printed copy of the standards will be supplied upon request. The contractor must comply with the technical standards at 36 CFR 1194.21 24, 26, 31, and 41 in performing this contract.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
