Eek Remediation Support – Alaska Region 2023 Introduction
The Bureau of Indian Affairs (BIA), Alaska Regional Office (ARO), Division of Environmental and Cultural Resources Management (DECRM) is requesting proposals, to enter into a contract for a preliminary investigation/ site assessment of soil and groundwater contamination within the Village of Eek. The purpose of this contract is to conduct a preliminary investigation/ site assessment and remediation at the old school site (Haz ID: 25493) within the Village of Eek in order to characterize the contamination and design a remediation plan.
The scope of work includes research of historic documents, site reconnaissance, identification of contamination, geotechnical investigation, risk evaluation, permitting, field work, sampling, analysis, data evaluation and additional activities to determine the quantity and quality of any contaminants present at the site. The scope of the investigation shall provide information sufficient to identify potential liability and risk associated with environmental and public health considerations concerning the property. In addition, the site characterization will allow managers to plan further investigations, if required, to determine cleanup requirements and design a cleanup action in accordance with the Alaska Department of Environmental Conservation (DEC), federal and tribal laws and regulations.
Background
Eek is located on the south bank of the Eenrayak River, 35 miles south of Bethel and 420 miles southeast of Anchorage, Alaska. The old school is located approximately 125 feet south of the Eenrayak River. The geographic description for the old Eek school is: Seward Meridian, Township 2 North, Range 73W, Section 31, of the United States Geological Survey. In 2010 there were seven ASTs with an unknown capacity associated with the site. Previous reports estimated 550 CY of petroleum contaminated soil contamination in the vicinity, with DRO concentrations of up to 46,600 mg/kg. A 2011 report from the site indicated: approximately 300 CY of fuel contaminated soil and possible groundwater contamination.
The Environmental program ensures BIA’s compliance with environmental laws and regulations related to Native Allotments, Trust properties and BIA-funded projects. Among the support provided are contaminated site characterizations, remediation, groundwater sampling and laboratory analysis. The intent of the project is to characterize contamination at the site and determine if impacts could pose a threat to the environment and/or human health, as well as if existing conditions may violate environmental regulations.
The Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERLCA), also known as Superfund, was created to provide the authority and a source of funding for cleaning up hazardous substances released into the environment. A basic goal of Congress in writing CERCLA was to make those who are in control of property (owners and operators) contaminated by hazardous substances financially responsible for their clean up.
Under CERCLA; you are potentially liable for clean up if you were a past owner/lessor/lessee of property when it was contaminated, are a current owner/lessor/lessee of contaminated property or if you buy or lease property already contaminated by someone else. Current property owners who did not cause contamination may still be financially liable for contamination associated with their land because of CERCLA's provisions of strict liability for contamination, and joint liability among all potentially responsible parties (PRPs).
The Superfund Amendment and Reauthorization Act of 1986 (SARA) amended CERCLA and created an "innocent purchaser" exception to owner responsibility. The current legislative, regulatory, and judicial climate has provided notice to property buyers, developers and lending institutions of the environmental risks associated with purchasing property. This risk, as well as the "innocent purchaser" defense, has created the need for environmental site assessments.
Required Tasks
Conduct a contaminated site characterization/site assessment within the Village of Eek. The Contractor(s) shall furnish the necessary personnel, material, equipment, services and facilities to perform the work for successful completion of the following project objectives for the investigation:
1. Planning and Project Management: Conduct project kick-off meeting and a planning meeting with BIA; develop work plan, schedule for the tasks and interim milestones.
2. Field Work: Obtain direct, in situ information that connects recognized environmental conditions to the property and delineates the area contaminated above regulatory cleanup levels. Also, if prior information is confirmed work may include excavation and in-situ landfarm treatment of approximately 330 CY of fuel contaminated soil and groundwater monitoring.
3. Interviews and Records Review: Obtain information from past and present owners and occupants along with tribal, state and/or local government officials to connect recognized environmental conditions to the property; and obtain and review records and documents for the property that may identify recognized environmental conditions.
4. Report: The report must identify the environmental professional and others whom conducted steps 2 and 3 listed above, support findings and ensuing opinions with documentation, and use enough detail to allow another party to reconstruct the work that was performed and come to the same conclusions.
Task 1: Planning and Project Management
The contractor(s) will lead a project kick-off meeting with BIA within two weeks of the contract award to introduce the Contractor's Project Manager and key BIA personnel (Project Manager, Contracting Officer). Within one month after the award, a planning meeting will occur where the work plan, including schedule for the task elements will be identified, and interim milestones will be agreed upon and accepted by DEC. Key Contactor personnel/subcontractors will participate in the planning meeting. The Contractor will prepare materials and minutes for these two meetings. Minutes are due one week from the date of the meeting for review and comments and finalized 10-days after meeting dates. The Contractor should plan for one additional meeting during the period of performance following submittal of the draft final report.
In preparation for the planning meeting, the Contractor shall:
• Collect and review existing data and files located on the DEC’s Contaminated Sites website
• Prepare a draft work plan, including sampling plan, and submit to BIA and DEC for review and approval
• Prepare a draft health and safety plan (HASP) in accordance with 29 CFR 1910.120 to ensure worker protection
• Prepare a draft notice to Native Corporation/Village advising them of the proposed site visit and sampling
Task 2: Field Work
The Contractor will plan field work with BIA personnel to document current site conditions, inspect known and potential sources of contaminants of potential concern (COPC) and delineate the area contaminated above regulatory cleanup levels. If confirmed, probable excavation and in-situ landfarm treatment of approximately 330 CY of fuel contaminated soil and groundwater monitoring. The field work will be coordinated with local tribal governments to ensure adherence to any restrictions.
A thorough inspection of the site is usually conducted first to familiarize the assessor with the physical parameters of the property and the surrounding properties. During this inspection, the assessor inspects the property and adjacent properties at the property line for signs of obvious contamination such as discolored soil, dead vegetation, underground tank appurtenances, leaking drums or other containers, transformers and evidence of asbestos or lead paint. The assessor also takes note of all current property users and any relevant activity that may have impacted the property being assessed. These observations are documented with photographs and GPS coordinates for the final report. If contamination is identified or suspected, soil and ground-water samples (as appropriate) will be collected and analyzed as necessary to characterize the contaminated area. Site visitation and sampling event will be dependent on weather conditions.
Task 3: Interviews and Records Review
The contractor shall contact and interview past and present owners and occupants as well as, tribal, federal, state and/or local government officials to determine and document any contaminants issues associated with the property.
Historical records are also searched to determine historical ownership and occupancy of the subject property for the past 50 to 100 years. Chain-of-title documents are obtained from a title company and are reviewed for property ownership. Because property owners are not always property occupants, historical maps and city directories are viewed for property occupancy.
Historical references include village directories and Fire Insurance Maps. Available aerial photographs are also reviewed for historical and current property occupants and uses. Aerial photographs are often available for the past 50 to 60 years and property development can be verified by reviewing them. Public agency files are then reviewed for information on the subject property. Environmental regulatory agency files are reviewed for documentation of hazardous substance contamination and/or regulation of the subject property. Files and site lists are reviewed at the Environmental Protection Agency (EPA).
Local village, borough, native corporations and agencies such as fire departments, health departments and public works departments' records are also reviewed. These local agency files may contain information on: building and commercial utilities permits (water, sewer and electrical permits), fire department inspection records/permits for buildings and underground storage tanks; information on zoning, adjacent landfills and electrical transformers. Interviews with representatives of these local agencies are conducted to expand on the information found in file reviews.
Task 4: Reporting
Based on the site inspection, field work, interviews, historic records and public agency file review; a report is prepared that summarizes the findings and presents recommendations for further field and laboratory work, if required.
A draft report will be submitted for review by BIA and DEC within 45 days following completion of the field work. The contractor shall schedule a joint work session to review the draft report and note comments for incorporation into the 90% submittal to expedite the review process. Following the final review and approval of the draft documentation by BIA and DEC, the contractor shall prepare the final report at 100% completion. This should include an electronic pdf version and three hard copies.
Period of Performance, Schedule and Delivery
The period of performance shall be one year from the initial contract award date. Final reports shall include an electronic pdf version and three hard copies; contractor will provide all electronic files in an editable format to include, Word, Excel, photos, etc.
Schedule for delivery of contract-required deliverables:
The Contractor will obtain all necessary permits and access permission. Contractor shall adhere to all applicable federal, state and tribal laws and regulations. The Contractor is responsible for any utilities that are damaged during the course of the work and shall repair them immediately at no cost to the Government. Alaska per diem shall be based on the rates set by the Department of Defense (https://www.defensetravel.dod.mil/site/perdiemCalc.cfm).
Barring any complications in site access or other site-specific factors, the Contractor shall have one year to complete the site characterization/ initial remediation work. As data is developed and regulatory agencies provide direction and guidance, Contractor shall be expected to provide timely and quality response to issues raised by the regulator(s). All contact between the public, private or regulatory community shall be made through the BIA, Alaska Regional Office. No information may be released without the written consent of the BIA, ARO.

Instructions, Conditions and Notices to Contractors
Specification Terms Contracting Officer (CO) – The term refers to the Bureau of Indian Affairs (BIA or Bureau) employee who signs the Contract on behalf of the Federal Government. The Contracting Officers Representative (COR) is a person specifically designated and authorized to represent the CO.
The COR will monitor all progress during the performance period. The Contracting Officer (CO) has the overall responsibility for the administration of this contract. However, the CO may delegate certain other responsibilities to the Contracting Officer's Representative (COR). The CO shall designate a Contracting Officer's Representative (COR) at the time of contract award. The COR shall be responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the CO prior to completion of the contract.
Contract Type This contract is Firm Fixed Price.
Work Hours Services shall be provided during normal work hours Monday through Friday, excluding federal holidays. Work scheduled to be mutually agreed upon between the COR and Contractor. Work hours shall be submitted and approved in writing to the COR.
Inspection And Acceptance of Work The COR will monitor all phases of Contractor’s operations for the acceptability of work, submittals and progress on a regular basis. Satisfactory works shall be determined by the reviews of submittals conducted by the BIA COR. Contractor will be informed in writing, of any unacceptable work, submittals, or progress in a timely manner, so the unacceptable condition can be rectified.
Unsatisfactory Work Notice If, at any time, any measure for work falls outside the standards set forth in the Contract, the COR will immediately notify the CO and Contractor in writing so the work quality issue can be brought within Contract specifications. If the quality of prior and current work, is not brought within the minimum acceptable standard within two workdays after receipt of notice, the Contractor’s right to proceed may be stopped and the Contractor considered in breach of Contract. Repeated failures to perform work at or above the acceptable standard shall be considered sufficient reason for default action including attachment of payment or Contract termination.
Payments Invoices for progress payments are acceptable to more frequently than every (30) days. Final Invoice will be submitted upon completion of contract and final report. Final payment will be made upon receipt of final invoice in IPP, acceptance of work is recommended by the COR and a Release of Claims form (DI-137) is submitted to the CO. The contractor shall not exceed the purchase order amount without prior approval and authorization from the Contracting Officer (CO). All additional work requested shall be fully estimated and provided to the CO and documented to include total labor hours for each job classification. Each estimate that has been prior approved by the CO may be submitted for payment and reported on the final invoice.
Tribal Employment Rights Ordinance (T.E.R.O.)
All Contractors working within Indian Reservations may be subject to a Tribal license tax and a Tribal Employment Rights Ordinance (TERO) tax. In addition, the Contractor shall work with local Indians and local Indian Organizations and Tribal members to include possible hiring of Indian labor.
Many tribal organizations have policies which specify conditions that contractors must satisfy to assure the tribes that tribal members are given appropriate opportunities for employment in on-reservation projects. In addition to requiring the hiring of tribal member labor, some TERO also impose a TERO tax based on the amount of the contract.
The contractor is responsible to determine the cost of compliance with applicable TERO and include those costs in the contractor’s cost estimates. Additional tribes may adopt TERO without notice and the contractor is responsible to contact the tribe on whose reservations they shall be working to determine whether a TERO is in force and what the terms of that TERO are.
The government assumes no responsibility for any conclusions or interpretations made by the contractor based on the information made available by the government. Nor does the government assume any responsibility for any understanding reached or representation made concerning conditions, which can affect the work, by any of its officers or agents before the execution of this contract, unless that understanding or representation is expressly stated in this solicitation.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1), in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
(i) 52.203-13, Contractor Code of Business Ethics and Conduct (NOV 2021) ( 41 U.S.C. 3509).
(ii) 52.203-17, Contractor Employee Whistleblower Rights (NOV 2023) ( 41 U.S.C.
4712).
(iii) 52.203-19, Prohibition on Requiring Certain Internal Confidentiality Agreements or Statements (Jan 2017) (section 743 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235) and its successor provisions in subsequent appropriations acts (and as extended in continuing resolutions)).
