This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued.
The solicitation number for this procurement is 140A0421Q0010 and is issued as a Request for Quote (RFQ). The Bureau of Indian Affairs (BIA), Rocky Mountain Regional Office intends to award a firm-fixed price contract in response to this Request for Quote (RFQ).
The solicitation documents and incorporated provisions and clauses are those in effect through the most current Federal Acquisition Circular.
This solicitation is an Indian Small Business Economic Enterprise (ISBEE) set-aside. Under the Buy Indian Act, 25 U.S.C. 47, offers are solicited only from Indian Economic Enterprises (Subpart 1480.8) that are also small business concerns. Any acquisition resulting from this solicitation will be from such a concern. Offers received from enterprises that are not both Indian economic enterprises and small business concerns will not be considered and will be rejected. As part of your quote, you must complete and return the Indian Economic Enterprise Representation form (DIAR Clause 1452.280-4 (see below full text).

The Bureau of Indian Affairs (BIA), Rocky Mountain Region, is soliciting offers for the installation of 1240’ of steel fencing.
Price Schedule (Perspective contractors must submit bids itemized by each project location. One contractor will be selected to complete the awarded projects.

The Contractor shall bid “all or none.” No partial bids will be accepted.
Description of Services:
The objectives for the contractor are for the installation of approximately 516' of 8' Ameristar Commercial Ornamental steel fencing (Classic Style) with 1 each 12’ double swing gate for the Forestry/Fire Equipment Yard, and approximately 724’ of 8’ Ameristar Commercial Ornamental steel fencing Classic Style with 2 sets of 12’ double swing gate to match with all hardware for the Natural Resources Equipment Yard.
The contractor will provide all labor, equipment, and materials necessary to install the fencing, for both the Branch of Forestry/Fire and Natural Resource Equipment Yards, according to the specifications that the agency is providing based on conversations with professional fencing companies. In addition, the contractor will tear down existing fences and disposal of any waste material in a legally acceptable manner.
The Forestry/Fire equipment yard houses Fleet, Trailers, UTV’s , Snow Machines and misc.
equipment. The Natural Resources Equipment Yard houses Fleet, Trailers, UTV’s, Range Unit Fencing Supplies and equipment and a Boat for the Programs of Lease Compliance, Natural Resources. In addition, the yard also houses the Social Services GSA Fleet.
All machinery that will be used will have a weight restriction of 16,000 pounds OR 8 PSI equipment ground pressure. This restriction seeks to minimize sub-surface ground disturbance.
Period of Performance: All actions will be completed by July 30, 2021 to compile with environmental considerations.
Once work has begun at a project location, the contractor has ninety (90) calendar days to complete all work on said specific project location. Once work has been completed at said project location, no more than fourteen (14) calendar days may lapse before work commences at the next project location. If the contractor is expecting not to be able to work at a project site for an extended period of time, 7 days or longer, notification to bureau personnel must occur. One exception to the contract time is environmental compliance. Project work at a specific project location may need to be initiated and work completed within a specific timeframe at the discretion of bureau staff to comply with environmental consultation requirements.

FAR 52.212-2 – EVALUATION – COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made using a Lowest Price Technically Acceptable (LPTA) approach; the Government will award to the lowest priced offeror that is determined technically acceptable. The following factors shall be used to evaluate offers:
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record. Alternate I (Feb 2000). As prescribed in 12.301(b)(4)(i), delete paragraph (d) from the basic clause, redesignate paragraph (e) as paragraph (d), and revise the reference to “paragraphs (a), (b), (c), or (d) of this clause” in the redesignated paragraph (d) to read “paragraphs (a), (b), and (c) of this clause.”
Alternate II (Oct 2018). As prescribed in 12.301(b)(4)(ii), substitute the following paragraphs (d)(1) and (e)(1) for paragraphs (d)(1) and (e)(1) of the basic clause as follows:
(d)(1) The Comptroller General of the United States, an appropriate Inspector General appointed under section 3 or 8G of the Inspector General Act of 1978 (5 U.S.C. App.), or an authorized representative of either of the foregoing officials shall have access to and right to—
(i) Examine any of the Contractor’s or any subcontractors’ records that pertain to, and involve transactions relating to, this contract; and
(ii) Interview any officer or employee regarding such transactions.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), and (c), of this clause, the Contractor is not required to flow down any FAR clause in a subcontract for commercial items, other than—
(i) Paragraph (d) of this clause. This paragraph flows down to all subcontracts, except the authority of the Inspector General under paragraph (d)(1)(ii) does not flow down; and
(ii) Those clauses listed in this paragraph (e)(1). Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
