About this file

This document includes a justification and approval for a sole source award as well as the related federal contract opportunity notice. The justification proposes awarding a firm-fixed-price contract to Cepheid for an extended warranty and service plan on two GeneXpert Systems. The equipment is used by the Department of State's Bureau of Medical Services for testing to support diplomatic missions domestically and overseas. The justification cites Cepheid's exclusive licensing agreements that prevent third-party sales of its product warranties. Market research found no other responsible small businesses able to meet the requirements competitively. The estimated value covers a 12-month base period plus two one-year options. The Department of State Office of Acquisition Management issued the sole source award to Cepheid on February 5, 2024 under contract number 19AQMM24P0189 for an unknown amount.

MED purchase Cepheid GeneXpert System in 2021 at the height of COVID. At the end of CY2022, MED purchased another extended warranty/service plan for these devices.

The extended warranty/service plan period is soon to lapse, therefore, MED plans to purchase a warranty/service plan that spans a 12-month base plus two (2) 12-month options.

The Bureau of Medical Services (MED) has an ongoing requirement to continue the service plan on the lab equipment that been used to sustain testing that may otherwise compromise the life and safety of the personnel conducting diplomatic missions both domestically and overseas.

The prior (19AQMM23P0241) value for the extended warranties/service plan was for one 12-month period. The estimated value for this new justification is for a period of performance of 12-month Base plus two (2) 12-month options.

3. An identification of the circumstances that preclude competition:

In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting

Officer has deemed only one source reasonably available based on the following:

☒ Exclusive licensing agreements

NOTE: Cephid, does not allow their product warranties to be sold through third party.

Therefore, no reasonable expectation of obtaining offers from two or more responsible small business concerns that are competitive in terms of fair market prices, quality, and delivery.
