About this file

This document contains a notice of intent to award a sole source contract along with a related determination of justification for a single source award. The Department of the Interior Bureau of Reclamation intends to award a firm fixed price contract to ANSYS, Inc. for the purchase of 74 LS-DYNA software licenses for an initial one year period with options to renew for up to four additional one year periods. The software licenses are required to conduct sophisticated non-linear dynamic analysis of concrete dams to ensure dam safety. The LS-DYNA software was determined to be the only product capable of simulating the complex problems and was proprietary to ANSYS. Interested parties were provided until March 30, 2022 to submit capability statements for consideration, though award was anticipated to be made to ANSYS by April 2022 based on the single source justification.

DETERMINATION TO SOLICIT FROM A SINGLE SOURCE

Pursuant to Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), for purchases not exceeding the Simplified Acquisition Threshold (SAT) Contracting Officers may solicit from only one source if the circumstances of the contract action deem only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand name, or industrial mobilization).

Pursuant to FAR 13.106-1(b)(1)(ii), when a single source is identified to provide a portion of the purchase as a Brand-Name, the documentation in paragraph 3 must state that this determination is only for a portion of the requirement.

1. Agency and Contracting Activity. U.S. Department of the Interior, Bureau of Reclamation, Denver Acquisition Branch.

2. Name and Address of Single Source.

Ansys, Inc.

2600 Ansys DR Canonsburg, Pennsylvania 15317-0404, United States

3. Description of Supplies/Services and Estimated Cost.

Purchase of 74 each LS-Dyna Software Core Licenses Base 1 year with the option to exercise up to 4 additional 1-year performance periods (5 years) 04/01/2022-03/31/2027

Total estimated contract value: $298,385.00

4. Description of Circumstances, including why only one source is reasonably available.

Reclamation’s Technical Service Center’s Waterways and Concrete Dams Group 1 performs sophisticated non-linear dynamic analysis of concrete dams. The results from these analyses are used by Reclamation’s Dam Safety Office (DSO) to ensure that the risks associated with operating dams are within Reclamation’s Public Protection Guidelines. As such, the analysis must be as realistic and accurate as possible and must incorporate all the aspects of the dam including contraction joints, concrete material properties, reservoir hydrodynamic interaction, foundation mass, radiation damping effects, and jointing.

IAW FAR 13.106-1(b)(1)(ii), specific characteristics of the LS-Dyna Software package is unique in that it provides a general-purpose finite element program which is capable of simulating complex real-world problems. This software enables Reclamation personnel to apply numerous and can be used to model and simulate a wide range of physical events and engineering related problems. LS-Dyna consists of a single executable file and is entirely line driven which means that it only requires a command shell, an executable action, an input file, and enough free disk space to run the calculations.

The LS-Dyna software is a critical component in Reclamation’s dam modeling simulation and data gathering process. This software package is a proprietary license, with Ansys, Inc as the sole provider. Due to the wide proliferation of this software into Reclamation’s design and testing process, incorporating a replacement system at this time would result in higher cost with an unacceptable risk of losing vital data or setbacks on critical projects. Therefore, it is the Contracting Officer’s determination that making a sole source award to Ansys, Inc for the purchase of the LS-Dyna software is in the best interest of the Government.

5. Determination of Fair and Reasonable Price.

The Contracting Officer will perform necessary price analysis techniques such as a comparison of the proposed price with prices found fair and reasonable on previous purchases (FAR 13.106-3 (a)(2)(ii)), and/or review of current price lists or catalogs (FAR 13.106-3(a)(2)(iii)). Finally, pricing within the Independent Government Estimate may also be used (FAR 13.106-3(a)(2)(vi)).

6. Description of Market Research.

Market research was conducted by use of the Internet and reviewing previous purchase order 140R8118P0036. In this review it was discovered that Livermore Software Technology Corporation, the previous owners of the required LLS- Dyna Software, was acquired by Ansys, Inc. After speaking with Ansys Representatives it was verified that the software remains proprietary and can only be purchased through them.
