STATEMENT OF WORK
Cedar Grove Sub-District Solid Waste Collection
1. DESCRIPTION
The work of this contract consists of providing all labor, equipment, and material necessary to collect and dispose of solid waste in National Park Service administrative areas, campgrounds, and residential areas in the Cedar Grove area of Kings Canyon
National Park. There were approximately 124 tons of solid waste removed from this location during the year 2021 service season.
2. LOCATION:
The locations of this contract are in the Cedar Grove Sub-District in Sequoia & Kings
Canyon National Park at the eastern end of California State Route 180 in Fresno County.
The subject location is an exclusive federal jurisdiction under management by the
National Park Service, United States Department of the Interior. The general service address will be 108532 Cedar Lane, Kings Canyon National Park, CA 93633. This location is under the management of the National Park Service, Sequoia and Kings Canyon
National Park headquarters, which are addressed at 47050 Generals Highway, Three
Rivers, California, 93271. This is also the billing address. The location is a located at an elevation of approximately 4,500’ and is seasonal in both accessibility and solid waste contract operation.
3. STATEMENT OF WORK/SPECIFICATIONS
a) The Contractor shall provide all labor, equipment, supplies, materials, and incidentals, except as otherwise noted herein, necessary for the collection and disposal of solid wastes from those areas within Cedar Grove as listed in the Schedule of Services.
Intermittent service may be ordered prior to, during or immediately following scheduled periods when service is needed less frequently, or fewer service areas and /or containers need service. Intermittent service may also be ordered as an addition to scheduled service at selected service areas because of heavy visitation or other factors.
Number of collections shown on the Bid Schedule is estimated for the purposes of canvassing the Bid only. Actual numbers of collections will depend on need. The type of

Section J - Att No 002 contract contemplated is termed “Commercial Items” which provides for payment for items or services that are delivered in compliance with this Statement of Work, Specifications, and the Schedule of Services.
b) The agreement shall cover the period of performance of 7/1/2022-10/03/2022.
4. SCHEDULED SERVICE DAYS
a) The Government anticipates that service will be necessary on weekends and holidays, as indicated in the Schedule of Services in order to prevent overflows and unsanitary conditions. Service on the days provided in the draft Schedule of Services is understood to be the most efficient distribution of services to meet the needs of the Government and shall be the foundation for pricing under this agreement.
b) The Contractor may propose an alternative distribution of services, including variation of service frequency, collection days, and bin numbers and capacities, in order to avoid service on weekend and holiday days, which alternative proposal if it remains within the total price for service agreed to, may, on agreement by the Contracting Officer, be implemented by modification to this agreement. Occurrence of bin overflows on weekends greater than two per season shall be grounds for the immediate restoration of the original schedule on written direction by the Contracting Officer.
i) Bin overflows occurring on weekend or holiday days, beyond two per service year, under an alternative schedule shall be collected and cleaned up at no additional charge to the government.
Collection and clean-up shall be completed within one day following written or telephonic notice to the
Contractor or their Representative.
5. CONTRACTOR-FURNISHED SOLID WASTE BINS
a) The Contractor shall furnish all solid waste bins required for use during the term of this Contract, and any extensions thereof. Minimum bin size shall be 1 cubic yard (CY) capacity. Maximum bin size shall be
3 CY capacity. The Contractor shall furnish the bin capacities and quantities as specified for each schedule item location in the Schedule of Services.
b) The Government anticipates that the following numbers and capacities of bins will be required:
i) 3 yard capacity- 32 each
ii) 2 yard capacity- 7 each
c) Bin Changes: The Government may, at its sole discretion, request the change in capacity or quantity of up to three bins per year within the annual schedule of services without incurring a Bin Change Fee.
Changes in the quantity or capacity of more than three bins per year will result in the assessment of the
Bin Change Fee provided in the Bid Schedule multiplied by the number of bins above three requested to be changed.
d) Bin Relocations: The Government may, at its sole discretion, direct the move of a bin from its established location to a new location on a regular scheduled service day. Relocations shall be charged at the rate provided in the Bid Schedule.
e) The Contractor shall provide low opening force, counterbalanced lid, bear-proof, solid waste bins and maintain them to prevent bear entry. Each bin placed in service shall meet the following minimum specifications:
i) All metal construction of body and lid;
ii) Watertight to prevent leakage of liquid or other wet waste;
iii) Each bin shall have a lid-locking system that will secure the lid in a closed position. The device furnished can be a locking system that will engage automatically when the lid is lowered to the closed position (latch must have ease of opening), or a chain and latch assembly consisting of 1/4" chain, 5/8" snaphook, 1/4" U-bolt (minimum sizes) securely attached to prevent bear entry;
iv) Lids shall be equipped with handles, to facilitate opening, be free of sharp edges, and shall be light enough to be raised by most Park visitors, including children. Lids will be counterbalanced or have other approved low opening force construction approved by the Contracting Officer;
v) The unhinged edges of the lid shall be reinforced with 3/4"x3/4"x1/8" angle iron to provide rigidity, if such reinforcing is not part of the lid as manufactured;
f) The Contractor shall perform all needed maintenance and upkeep on Contractor-owned bins. Bins shall be painted a brown color compatible with surroundings, and both the exterior and interior shall be kept clean. Frequent cleaning by square point shovel or washing before disinfecting Contractor-owned bins may be necessary to reduce odors, eliminate flies, and discourage attraction of wild animals. Any defacement or damage will be repaired or repainted immediately. The Government will not be responsible for defacement or other damages resulting from acts of vandalism or malicious mischief caused by visitors to the Parks. The Government reserves the right to stencil bins with instructions for use as deemed necessary. The Government will remove or repaint the stenciling at the end of the
Contract period.
6. METHOD OF OPERATION
a) The Contractor will service each container at each service area in accordance with the appropriate pickup schedule in effect. When Contractor-owned bins are serviced, care will be taken to secure the bear- proofing mechanism immediately following service, and to secure bins to posts where provided.
b) The Contractor shall be responsible for the pickup of all loose trash, resulting from overfilling of bins, within a 10-foot radius of the collection site, including any trash scattered by wild animals, Park visitors, wind, or other unknown elements. The Contractor shall advise the Contracting Officer of bin overflows and on provision of a snapshot of the encountered condition before and after collection may assess a bin Overage Service charge per each event.
c) The Contractor shall exercise reasonable care in handling trash containers to insure against undue damage. Bins or covers damaged through negligence on the part of the Contractor or the Contractor's employees shall be repaired or replaced at the Contractor's expense.
d) The Contractor shall conduct operations so as to have minimum impact on visitor activities, and to impose minimum interference with the normal use of roads, structures, utilities, or other Park facilities.
Special care shall be exercised to prevent damage to natural features of the Parks and to protect the natural surroundings. The Contracting Officer's Representative in each area will designate a site for storage of collection vehicles and/or bins, if necessary.
e) The Contractor shall practice safe work habits at all times while performing under this contract. All contract operations will be in accordance with the applicable standards of the Occupational Safety and
Health Act (OSHA) and other appropriate Federal or State safety regulations. The Parks' Safety Officer shall have the right to inspect the Contractor's operations in the Parks at any time.
f) The Contractor and all his employees are subject to and shall comply with all Park rules and regulations applicable to Sequoia and Kings Canyon National Parks.
g) The Contractor shall comply with all legal load restrictions in the hauling of equipment or materials on public roads beyond the limits of this project. Rules and regulations for vehicular traffic on National Park
Service roads are promulgated by the Superintendent and are available to the public. A Special Permit will not relieve the Contractor of liability for damages resulting from his operations.
7. CONTRACTOR PERSONNEL
a) The Contractor shall provide all personnel necessary to perform the services required under this
Contract in a timely manner. Individuals currently employed by the Government will not be utilized by the Contractor as part-time or contractual employees, or in an advisory capacity, or any other capacity during the period of this contract.
b) Driver Qualifications: All drivers shall be trained and qualified in the operation of Collection vehicles and must have in effect a valid license, of the appropriate class with appropriate endorsements, issued by the California Department of Motor Vehicles. All Collection vehicle drivers shall also complete
CONTRACTOR's in-house training program, which includes education on the use of all vehicles in the
Collection fleet, Collection programs, and route information as well as Customer service practices and safety information.
c) The Contractor assumes direct supervision over and full responsibility for all employees engaged in the performance of work under this contract. The rights and privileges of Park visitors and others who may be using Park facilities must be recognized at all times. The Contractor shall not permit any employee to perform work on Park premises who is determined to be intoxicated, or under the influence of narcotics, or otherwise deemed unfit to perform the work of this Contract.
8. CONTRACTOR WORK SCHEDULE
All collection and disposal services shall be performed during daylight hours. Collection services shall be performed in accordance with the contracted schedules. If the contractor is unable to accomplish any collection, the Contractor shall immediately notify the Contracting Officer or his Representative.
9. CONTRACTOR VEHICLES
a) The Contractor shall use vehicles equipped with compactor-type units for the collection and transportation of solid wastes as the preferred type of collection vehicle. These units must be sealed to prevent leakage of liquid or other waste materials. Contractor shall immediately clean up any leakage or spills resulting from Contractor's vehicles or operations. Vehicles must be equipped to handle bins when used in areas where this type of container has been specified. Contractor vehicles shall be operated only on designated roadways, driveways, and parking areas. All vehicles used in the performance of this
Contract shall be kept clean, in good mechanical condition, painted to present a good appearance, meet all applicable California State Department of Motor Vehicles Codes, show evidence of annual safety inspections performed by the California Highway Patrol, and display proper registration and license. All
Contractor vehicles shall be equipped with approved backup alarms. Alarms shall be maintained in operating conditions at all times. All advertising or other slogans, logos, or pictures, other than the
Contractor's firm name, are prohibited.
b) In the event of serious mechanical breakdown, the Contractor must have reserve equipment available to continue performance as called for in this Contract.
c) The contracting officer may approve an alternate vehicle type in specific areas where use of a compactor unit is considered unsafe, or when its use could otherwise affect the safe flow of traffic. Such approval is contingent upon receipt of evidence that the vehicle proposed for alternate use meets the same standards of appearance, inspections, registrations, licensing, and backup alarms required for the primary, compactor-type, collection units
d) Solid waste, which is collected in authorized alternate vehicles, shall be transferred directly from these vehicles into compactor-type units as soon as possible. Under no circumstances will trash be temporarily stored at other collection sites or placed in other containers for later pickup by the compactor. When authorized, alternate vehicles shall be equipped to prevent leakage of liquid or loss of materials while collecting or transporting garbage.
10. DISPOSAL SITES, FEES, REPORTING
a) All solid waste collected as a result of this Contract shall be disposed of outside of these Parks, at disposal sites meeting State of California sanitation standards. The Contractor shall identify disposal sites used in conjunction with this Contract prior to issuance of a Notice to Proceed.
b) The Contractor is responsible for paying all fees levied for the disposal of waste. A current fee schedule for the disposal site to be used will be submitted prior to beginning performance under this
Contract.
c) Tonnage of waste and disposal location(s) shall be submitted to the Parks concurrent with billing information preparatory to invoicing through the Internet Payment Platform (IPP).
d) Substantiation of invoices: The Contractor shall submit service records for each month concurrent with billing information preparatory to invoicing through IPP. This service record shall indicate, at a minimum:
i) The service area as described in the Schedule of Supplies/Services and Prices
ii) The date and time for, and at, which service was performed
iii) The status of that service
iv) Driver’s identification
e) Separate from requirements put forth by the Government, the Contractor shall comply with requirements put forth by the State of California, and as implemented by the County in which disposal is performed, for recycling of wastes and reporting of disposals.
f) The Contractor shall provide the Contracting Officer, by November 30 of each service year, a report detailing the total tonnage of waste collected and the quantities of materials diverted from landfill for recycling, or composting, as a percentage of the total waste stream and by weight for each type of material diverted.
11. PRE-SERVICE MEETING- Initial, Site, and Annual
a) Following award and prior to the issuance of a Notice to Proceed, the Contracting Officer’s
Representative together with the Contractor and any designated representatives, shall meet jointly to discuss the details of this Contract. The purpose of this meeting will be to mutually discuss the intent, clarify all terms, conditions, and special provisions, and to resolve any misunderstandings. The date and time of this meeting will be mutually agreed upon as soon as possible after contract award. The
Contractor can present his tentative work schedule and other, required submittals, at this meeting.
b) This initial meeting will be followed, after issuance of a Notice to Proceed, by a service location visit to review the current siting of waste bins and make any adjustments to accommodate Contractors equipment. Once finalized, bin locations will be changed only on presentation of a written request and agreement by the Contracting Officer or his Representative.
c) Parties may meet annually, as needed, to discuss any needed changes in service, provide clarifications, and arrive at understandings.
12. REMEDIES- UNSATISFACTORY SERVICE
a) Failure of the Contractor to pickup and remove waste as required by the Bid Schedule, or other
Contractor activities in violation of these requirements that cause unsanitary conditions that attract wildlife or otherwise damage park resources will be cause for remedy, as described in this Section.
i) In addition to the remedies described below, the Contractor and their employees may, at the discretion of park law enforcement, be cited for violation of 36 CFR Chapter 1, Sec 2.10(d) for repeated, or egregious violations.
b) Unsanitary Containers, including leaky compactor and container seals and drains- Contractor-owned.
i) Conditions must be corrected within forty-eight (48) hours after verbal or telephone notice, by the
Contracting Officer or their Representative, to the Contractor or the Contractor's Representative.
ii) Failure to correct within the time allowed will result in a reduction of 1% of the Contractor's total monthly compensation for each 24-hour period (or portion thereof) condition continues to exist beyond the initial correction period. Repeated or egregious violations may be treated as described at Section
11.a)i).
c) Missed Collections, Failure to Clean-up
i) To the extent possible, Contractor will be notified in writing or by telephone of missed collections and/or failure to clean up around collection site, and will be afforded the opportunity to correct.
Correction must be accomplished within one day of notice the deficiency exists.
ii) If, for any reason, Contractor fails to make any collections, total monthly compensation will be reduced by the amount provided for the collection in the bid schedule and, in addition, Contractor will be billed actual costs incurred by the Government for providing the service.
