SECTION C

C-1.0 Scope of Work/Mission

The contractor shall provide personnel and material for securing SBX-1 in accordance with (IAW) Sponsor Security

Requirements (as delineated in MDA Memorandum of 26 July 2012 entitled “SBX-l Security Requirements”), SI

538-2 (Sea-Based Missile Defense Systems (SBX/AEGIS/OSV)) and other terms of this PWS. Security requires continuous armed force protection of the SBX-1 at all times; when the SBX-1 is at sea and when the vessel is in port. The contractor shall be responsible for maintaining onboard physical security 24 hours 7 days a week 365 days a year and be able to sustain 63-day rotations in two scenarios, 1) when the vessel is at sea in International Waters, and 2) while the vessel is in U.S. Territorial Seas and internal waters (including U.S. Navy and commercial facilities). Contractor Security Officers shall perform their duties onboard SBX-1 and not outside the lifelines of this vessel, notwithstanding any other requirements of SI 538-2 (and successor directives). It is understood, however, that contractor Security Officers onboard SBX-1 may have to use force against attackers who are located outside the lifelines of the ship. The PWS does not include scope to provide SI 538-2 protection to the vessel when moored, anchored or docked at a foreign port or shore-side security duties IAW SI 538-2. The contractor shall maintain communications with escort, security patrol craft (when applicable), and port security personnel and demonstrate capabilities and preparedness to Navy and other authorized and appropriate review agencies (such as but not limited to; Naval Criminal Investigative Services (NCIS), Combatant Commander (COCOM) staff, Coast

Guard, etc.) (See for example: DoDI 2000.16 (series) and OPNAVINST 5530.14 (series)). To facilitate this the contractor shall have 3 years of experience in security in support of port security or Security System Level A (SSL-

A) requirements as well as 3 years of company experience with weapons maintenance of the types that will be used on SBX-1 (handguns, shotguns, military assault rifles, and crew served weapons).

C-1.2 Operational Control (OPCON) Operational control of the ships covered under this contract is normally exercised by a designated operational commander who may or may not be the cognizant MSC Area Commander.

The contractor shall comply with Operational Commander's and MSC Area Commander’s operational control direction. If there is a conflict between the Operational Commander and the MSC Area Commander then the contractor shall follow the direction of the Operational Commander. In exercising command authority commanders are not authorized to make changes to the scope of the contract. If compliance will result in expenses that will exceed available funding obligated to the contract, then the Contractor shall obtain preapproval IAW section G-7, prior to incurring the expense. The vessel could also be activated as a contingency asset in case of emergency with

Secretary of Defense approval. OPCON will vary in either case.

C-1.2.1 Operational Control (OPCON) and Tactical Control (TACON) of SBX-1 will reside with Commander, Missile Defense Agency, Sensors Directorate when SBX-1 has not been activated for Homeland Defense operations.

C-1.2.2 Contingency Operational Control (OPCON) of SBX-1 and assigned personnel will reside with

Commander, U.S. INDO-PACIFIC COMMAND (USINDOPACOM) and Tactical Control (TACON) will reside with U.S. Pacific Fleet (COMPACFLT) unless specified otherwise. Activation for Homeland Defense Operations will be via EXORD from U.S. Northern Command.

C-1.3 Administrative Control (ADCON)

Administrative control of the ship will be exercised by Military Sealift Command Headquarters (MSC HQ).

C-1.4 Area of Operations Operations are anticipated to be conducted in the Pacific Ocean. SBX-1 is expected to be operating in the United States (to include U.S. territories and U.S. territorial waters), and on international waters.

C-1.4.1 Operating Scenario Vessel operations consist of Ballistic Missile Defense operations in support of Home

Land Defense test events, transits, and maintenance. The Government may vary Operational Tempo (OPTEMPO) to meet mission requirements. Typical annual OPTEMPO for SBX-1 operations (see Section C1.10 for mobilization information):

C-1.4 Rotation Schedule for Contract Security Force Rotation Schedule for Contract Security Force in an

Underway (SSL A) Scenario - Full operational status is planned for 365 days per year. SSL A security posture will be in effect during this time. In the event the vessel is underway for longer than 60 days in an SSL-A status, contractor personnel may be relieved on a rotation schedule determined by Offshore Support Vessel (OSV) runs or other means to transport personnel (OSV runs are expected every 21 days). Due to these unusual mission equirements, security personnel may have to serve onboard SBX-1 for extended periods (> 60 days), or experience delays in transit while enroute to the vessel. The Contractor shall provide continuous protection of the vessel during such delay periods.

C-1.4.1 Unscheduled Extensions of Duty The on-board staff is subject to mobilization and other modifications of established shifts and work schedules to respond to potential or real threats as determined by the SBX-1 Master

(hereafter referred to as Master) or as preplanned by Force Protection Condition (FPCON) as defined in the Vessel

Security Plan (VSP).

C-1.4.2 Reimbursable Overtime The Contractor shall comply with the manning requirements specified in Section

C-1.10.1. All overtime that is incurred beyond the 40 hour workweek for each Security Officer shall be reimbursable in accordance with the contractor’s approved Staffing Plan (C-1.24(b) and Section G-8. The following are sources of reimbursable overtime: 1. Response requiring immediate action to meet SI 538-02, approved Fleet security plan, or COMSCINST 5530.3G requirements (ex. Actual Security Incident, Increased FPCON requiring additional manpower etc.) 3. Overtime associated with Section C.1.15.3. Other reimbursable OT as discussed and pre-approved by the Contracting Officer (OT associated with Security training outside of the normal 40 hour workweek.). 4. Overtime due to SSL-C requirements during shipyard periods.

C-1.4.4. Deduction for Crew Shortages

The contractor shall maintain a list of crew shortages (by billet) and shall calculate wages and fringes associated with these shortages for every calendar month. IAW Section G, a copy of this list shall accompany the per diem invoice for the covered period, and the total wage/fringe shortage values shall be reflected as a credit to the

Government by a line item deduction on that invoice.

C-1.5 Embarkation/Debarkation The Contracting Officer’s representative (COR) will provide the contractor the port location of the SBX-1 and/or the disembarkation point for the OSV not less than four (4) working days prior to when they are expected to report. Contractor personnel may embark the SBX-1 while in-port or underway (via the

OSV, helicopter, or other means). The location of the SBX-1 and OSV shall only be communicated as necessary.

C-1.6 Personnel Equipment Requirements Contractor will provide all necessary personal use equipment for duties onboard the SBX-1 including but not limited to clothing suitable to allow other personnel onboard SBX-1 to recognize contractor Security Officers, cold weather gear, ballistic personal protective equipment and consumables.

Clothing suitable to recognize contractor Security Officers includes uniforms. Cold weather gear includes clothing suitable for outdoor wear in Arctic at sea Environments. Ballistic personal protective equipment includes equipment suitable to stop a 7.62x39mm round. (CDRL A017)

C-1.6.1 Gas Mask/JLIST Suit Fit Testing Program

a. The Contractor shall ensure every user of a Gas Mask/JSLIST Suit to be properly fitted to ensure adequate protection from CBRN agents. In the event any user reports aboard without first being fit tested by the N44

Fit Test Team, they may be temporarily fitted using the sizing tool method, followed by donning the mask and performing a negative pressure. At the earliest possible opportunity, the individual must be scheduled to be fitted by the N44 Fit Test Team to verify that the mask size initially selected provides adequate protection. The frequency of periodic quantitative fit testing is not to exceed five (5) years. Fit testing is also required when a condition develops that requires a change in mask size (e.g., a noticeable weight gain or loss or other change in facial sizes such as dental changes, scarring, or facial surgery in the face sealing area). Fit Test results must be in a centralized filing system.

b. During the negative pressure check, only a slight inward deflection of face piece and lens is required. If inhalation is too forceful, the face piece will collapse against the face and the mask outlet valve may become dislodged. Before donning and adjusting the mask, mariners shall remove all jewelry worn on head or face, hair fasteners (hair clips, hairpins, combs, and rubber bands), hair knots, buns, or braids that will interfere with the mask seal and let hair hang freely.

c.) All Contract personnel must be cleanly shaven. Facial hair could result in an improper mask fit resulting in illness or death. A leak-proof fit cannot be expected unless the wearer is clean shaven. Security forces who are NOT cleanly shaven must be reported to N-1/N-10 as Non-Compliant in accordance with MSC

Commander’s guidance and processed accordingly.

C-1.7 Personnel Qualifications A SECRET Facility Clearance is required at the start of performance. SECRET

Personnel Security Clearances are required prior to assignment to the vessel (see Section C 1.16). The contractor shall provide a Security Force with qualifications as described below:

a.) Contractor Security Officers shall complete training in accordance with the requirements of

COMSCINST 5530.3(series), this PWS, DoD Directive 5210.56 of November 6, 2020 and as directed by the

Master. All contractor Security Officers must maintain proficiency on all tasks identified in COMSCINST

5530.3 series, SI 538-02 series, and the Numbered Fleet Security plan and their applicable underlying references.

b) CBRN Training is required annually for all shipboard personnel including MSC employees, military personnel, civil, contract mariners and security contractors permanently assigned to the vessel.

1. Whether initial or revalidation, this training must be conducted prior to reporting aboard a ship. No person must report aboard a ship without the training in periodicity for the duration of their projected tour.

2. This mandatory training must be conducted in a formal school (MSC, MSC Approved Union

Schoolhouse, and USN School) every 5 years. The CD-based training must be conducted in the years the formal schoolhouse training is not attended.

(a) This CD training only takes place as the requalification method for the annual requirement.

(b) It does not take the place of the mandatory 5-year formal schoolhouse class.

(c) In the event that a Mariner/CIVMAR is unable to receive this training prior to departing CONUS, the CBRNO must provide it within 7 days of the individual reporting aboard ship and indicate in the

CONMAR/CIVMAR training record.

c) Security Officers shall be capable of detecting, assessing, responding, and delaying security threats and meeting performance standards of SI 538-2 (duties are limited to providing security to SBX-1 by contractor

Security Officers who will remain onboard within the lifelines of the vessel) and all applicable instructions

(including COMSCINST 5530.3(series) and approved Numbered Fleet Commander Security Plans and

OPORDS) to suppress covert and overt activities against SBX-1. Contractor Security Officers must be

U.S. Citizens and have a secret security clearance before boarding the vessel.

d) Contractor Security Officers shall be armed while on duty. (CDRL A015) All Security Officers shall be capable of, and are authorized to, respond in accordance with Force Protection Conditions (FPCON) in accordance with applicable referenced documents, rules and regulations, including the authorizations, restrictions, and use of force rules in DoD Directive 5210.56 of November 6, 2020 (and any changes).

e) The contractor shall provide training on the Use of Force rules contained in DoD Directive 5210.56. All contractor Security Officers are required to show certification of the training received and certify understanding of the Use of Force rules contained in DoD Directive 5210.56 of November 6, 2020.

(CDRL A012). Contractor Security Officers are required to fulfill DoD and Navy periodic training requirements for the use of firearms, warning shots, and use of force, to include meeting the requirements of DoD 5210.56.

f) All contractor Security Officers shall be qualified to employ and maintain 9mm handguns, 12-gauge shotguns, M-4 equivalent rifle, deck-mounted and handheld M-240 machine guns, and deck-mounted M-2 machine guns IAW OPNAV INSTRUCTION 3591.1(series) SMALL ARMS TRAINING AND

QUALIFICATION. (CDRL A010). Contractor Security Officers will be trained in the firing of warning shots from rifles and crew-served weapons in accordance with DoD Directive 5210.56. Contractor

Security Officers are required to fulfill DoD and Navy continuing firearms qualification requirements. One contractor Security Officer per watch section will be qualified to operate any Counter – Unmanned Aerial

System (C-UAS) equipment provided by MSC to support FP

g) Contractor shall provide proof that all contractor Security Officers possess a valid Transportation

Worker’s Identification Card (TWIC) or DoD Common Access Card, and United States passport.

Verification of Physical Certification for Physical Fitness (Merchant Mariner’s Physical Examination

Equivalent) is required for each crew rotation on the SBX-1). (CDRL A012)

h) Contractor Security Officers (this includes all contractor personnel who will board SBX-1) shall be vetted before access to the vessel shall be granted (see paragraph C-1.16.1). The Contracting Officer has the right to direct the removal of any contractor Security Officer from SBX-1 when the contracting officer deems this appropriate.

i) All contractor Security Officers shall submit DD Form 2760, “Qualification to Possess Firearms and

Ammunitions”, certifying the individual is not prohibited under U.S. law from possessing a weapon or ammunition due to conviction in any court of a crime of domestic violence whether a felony or misdemeanor, and shall submit the MSC supplement to DD Form 2760 (found in COMSCINST

5530.3(series)) and not be disqualified thereunder from possessing, receiving, shipping, or transporting arms or ammunition. (CDRL A012)

j) Written acknowledgment by the contractor and individual contractor Security Officers that (CDRL

A015):

1. Inappropriate use of force by contractor Security Officers may subject such personnel to prosecution by U.S. authorities, State and local authorities, and civil liability. Such written acknowledgement should not be construed to limit potential civil and criminal liability to conduct arising from "the use of weapons." For example, contractor Security Officers could be held criminally liable for any conduct that would constitute a federal offense (see the Military

Extraterritorial Jurisdiction Act, (Section 3261 of title 18, United States Code)).

2. Written proof of authorization to be armed must be carried by all contractor Security Officers who will be armed. Proof of authorization to fire warning shots must also be carried by all contractor personnel who will be armed. Such written authorizations may be granted by (and once granted, may be rescinded by) the Master, the Commodore of the cognizant MSC Area Command that the vessel is operating in, or an individual designated in writing by them. The written authorization(s) will be signed by the Master, Commodore, etc., (e.g., signed in ink or digitally).

3. Contractor Security Officers may possess only U.S. Government issued or Contracting Officer approved In Writing weapons and ammunition for which they have been qualified iaw section

C1.7 (e) of this PWS.

4. Contractor Security Officers were instructed on and understand the rules and limitations on the use of force.

5. Authorization to be armed or fire warning shots may be revoked for non-compliance with established rules for the use of force, firing of warning shots, or safe handling of weapons and ammunition.

6. Contractor Security Officers are prohibited from consuming alcoholic beverages or being under the influence of alcohol during tour of duty on board.

7. Contractor Security Officers DO NOT have a psychiatric diagnosis for which medication is necessary (a waiver of this limitation may be available, in some circumstances, in accordance with the requirements of paragraph 6b of OPNAVINST 3591.1(series)).

8. After investigation by the Contractor of the background and qualifications of contractor

Security Officers and organizations, the Contractor certifies that contractor Security Officers are not prohibited under U.S. law to possess firearms. Individual contractor Security Officers shall certify that they are not prohibited under U.S. law to possess firearms. (CDRL A012)

C-1.8 Physical Security: The contractor shall comply with all anti-terrorism/force protection (AT/FP) and other security requirements for the ships while at sea and in port that the Operational Commander requires MSC ships follow. Expenses incurred in performance of meeting AT/FP and other security requirements will be reimbursable when the contractor obtains contracting officer approval prior to incurring the expense. If a situation arises which prevents the operator from complying with mission tasking, the contractor shall immediately notify the Contracting

Officer’s Representative and MSC Area Commander Force Protection Officer (who will in turn notify the

Numbered Fleet and Operational Commander).

The Operational Commander or Area Commander will obtain clearances to call at foreign ports for each ship. Each operational mission will be the subject of a classified Operational Order (OPORD) or Sailing Order (SAILORD) that specifies exactly how the mission will be accomplished. The contractor shall comply with all direction and instructions in OPORDs. The Master is authorized to make minor deviations from sailing orders to meet mission requirements, provided the Master immediately notifies all commands within the operational chain of command of the deviation. The contractor shall immediately report any delay of any ship and/or diversions from operations to the

Operational Commander, the MSC Area commander, and the Contracting officers Representative. The Contractor shall coordinate with the Master to establish and maintain minimum theater anti-terrorism/force protection (AT/FP) requirements for SBX-1 which comply with Sponsor Security Requirements and applicable portions of SSL-A requirements set forth in STRATCOM SI 538-2 and Navy Priority B requirements OPNAVINST 5530.14(Series) that can be performed on board the vessel by contractor Security Officers (i.e., within the lifelines of SBX-1).

C-1.8.1 Contractor Security Requirements when SBX is Operational or Operationally Capable:

Contractor will comply with Sea-Based Missile Defense Systems and SSL-A security requirements codified in SI

538-02 series and the applicable Numbered Fleet Commander approved security plan. Contractor will additionally comply with COMSCINST 5530.3 series requirements. This is with the understanding that the contractor and contractor Security Officers will perform their security duties onboard SBX-1 (within the lifelines of the vessel) and will not perform security duties off the vessel (including security on piers, land approaches, vehicle barriers, or on patrol craft).

C-1.8.2 Contractor Security Requirements when SBX is Non Operational:

SI 538-02 SSL requirements do not apply. Contractor will comply with the applicable Numbered Fleet Commander approved security plan and COMSCINST 5530.3 series.

C-1.9 Small Arms Locker and Weapons The SBX-1 has a central Armory and a magazine with 4 Ready Service

Lockers. The contractor will store and secure ammunition and 40mm flashbang rounds in the ship’s magazine

(located port side amidships in the vicinity of the armory) for issue to each Ready Service Locker. In addition one set of binoculars and one insulating gun barrel change mitt will be stored inside each RSL. Other equipment that may be necessary to the mission may also be stored in the RSLs as relevant to the mission at the discretion of the

Assistant Anti Terrorism Officer (Assistant ATO). The leading contractor Security Officer on board SBX-1 will be designated as the Assistant Anti-Terrorism Officer (Assistant ATO), and will have authority over other contractor

Security Officers on SBX-1; it being understood that the vessel’s Master still has final responsibility for and authority on the vessel. The Government will provide the contractor with firearms and ammunition. See Attachment

A (Government Property List). The contractor (as Assistant ATO with authority delegated to him by the

Master) shall be responsible for the weapons; weapons repairs will be conducted according to NSWC Crane weapons return guidelines. (CDRL A003)

C-1.10 Personnel

C-1.10.1 Key Shore Based Personnel: The Contractor shall submit to the Contracting Officer resumes of all Key

Shore Based Personnel, to include the Project Manager as well as a listing of contact information of these personnel;

including name, office telephone number and cellular telephone number and a list of references. Substitution with equal or better qualified personnel requires Government Contracting Officer concurrence. (CDRL A014). The

Contracting Officer will review all resumes submitted by the Contractor and approve/disapprove the employment of each individual. The Contractor shall provide particulars dealing with the Project Manager’s qualifications showing why they are qualified for these functions. The Project Manager shall have at a minimum 10 years of Security, Law

Enforcement or Military experience and 5 years of Project Management experience.

C-1.10.2 Key Shipboard Personnel: The Contractor shall submit to the Contracting Officer Representative (COR) resumes of the Assistant Anti-Terrorism Officer assigned to the vessel under this contract as well as a listing of contact information of these personnel; including name, office telephone number and cellular telephone number and a list of references. ATO's assigned to this vessel shall have a minimum of 10 years experience in security or law enforcement and 3 years of supervisory experience in security or law enforcement either in the civilian or military sector. Substitution with equal or better qualified personnel requires Government Contracting Officer

Representative (COR) concurrence. (CDRL A014). The COR will review the resumes submitted by the Contractor and approve/disapprove the employment of each individual. All documentation required under this contract for these key shipboard personnel shall be included with their resumes. The leading contractor Security Officer on board

SBX-1 will be designated as the Assistant Anti-Terrorism Officer (Assistant ATO), and will have authority over other contractor Security Officers on SBX-1; it being understood that the vessel’s Master has final responsibility and authority on the vessel for all persons on board (other than military Embarked Security Teams). The Government may unilaterally revoke any key billet approval (KBA) during the entire period of performance of this contract. The government will not pay costs that arise from revoking a key billet approval.

C-1.10.3 Contractor Security Officers: If for any reason the Government is dissatisfied with the qualifications, conduct or performance of any contractor Security Officer (including the Assistant ATO) employed for service on

SBX-1, the COR will provide particulars to the Contractor, in writing, who shall promptly, independently investigate and take immediate corrective action, when appropriate, up to and including dismissal of the employee.

The COR may nonetheless direct that a contractor employee be removed from service on SBX-1. The Contractor will have no recourse, to include financial, to the Navy for any corrective action taken by the Contractor.

C-1.10.4 Contractor Security Officers Requirements: All contractor Security Officers must be U.S. citizens and meet all state and federal regulations pertaining to security duties including background checks as well as obtain and maintain secret clearance as required by this performance work statement. Inclusive of this (but not limited to) is:

Speak, read, write and understand English clearly and correctly; Follow instructions, both written and spoken;

Prepare written reports as required; Physically be able to stand the entire watch on his or her feet and fulfill roving watch duties as required; Attend Government Furnished training as required.

C-1.10.5 Crew Retention Plan: Contractor shall establish and implement a Security team retention plan, which shall remain current throughout the contract. It shall address continuity of services and actions taken to increase the instances of Security team members returning to the SBX-1. (CDRL A016)

C-1.11 Operational Responsibilities

a) The Master will act as the Anti-Terrorism Officer (ATO) onboard SBX-1; the Master has the authority to delegate his responsibilities as ATO to an Assistant ATO. The Contractor shall provide an Assistant

Antiterrorism Officer (Assistant ATO) (who serves as lead Security Officer) who will report to the Master

(who will act as the ATO), and to act as liaison between security forces, other contractors and government personnel onboard. The Assistant ATO will communicate directly with appropriate Area of Responsibility

(AOR) Combatant Commander (COCOM) Antiterrorism/Force Protection (AT/FP) POCs, to include MSC area commands. The Navy O&S AT/FP Lead will provide contact information for these POCs. A team lead or second in command must be appointed to act for the Contractor’s Team Leader when the Assistant

ATO is off-duty (CDRL A014).

b) Contractor Security Officers shall be trained IAW COMSCINST 5530.3 (series). Contractor personnel shall be capable of detecting, assessing, responding, delaying and disabling security threats and meeting performance standards of SI 538-2 and all applicable instructions. Periodic Navy and other agency inspections will evaluate performance and readiness of the Security Forces.

c) The Contractor shall comply with approved Numbered Fleet Commander Security Plans, SI 538-02, and

FOS portions of COMSCINST 5530.3G. The Contractor shall appoint a qualified individual who shall serve as the vessel's Assistant Anti-terrorism Officer (Assistant ATO). Security checks may be required as directed by the COR. Contractor shall provide regularly scheduled readiness drills and exercises to assure readiness and capability to respond to anticipated threats. Such drills and exercises shall be scheduled in coordination with the Master, onboard Government representative and other operational contractors aboard the SBX-1. The Navy Numbered Fleet approved security pland will further define and detail each of the security positions required IAW SI 538-2 and applicable references. The contractor shall further collect and maintain verification records to demonstrate that the requirements of the COMSCINST 5530.3 series, SI

538-02, and the Navy Numbered Fleet Commander approved Security Plan are met.

d) The security contractor shall designate certain Security Officers for service as Security Console Officers

(SCO). The SCO position operates the CCURE Alarm System, Close Circuit Television (CCTV) System, and communication equipment. Government will provide On-The-Job (OJT) training for CCURE Alarm

System operations during the Transition period. The SCO coordinates actions of the Security Officers with

Assistant ATO/Shift Lead oversight and control as required and IAW Emergency Action Checklists contained in COMSCINST 5530.3 series and underlying references. Duty schedule and rotation for the

SCO position is the defined by the Assistant ATO.

e) The Vessel and its associated contractor Security Officers will be subject to COMSC 5530.3 (series) requirement for MSC performed Spot checks as well as NCIS performed Individual Ship Assessments

(ISA).

f) A minimum of one roving security watch must be active at all times. Roving watch duties include alarm investigation, patrolling, and armed response. Additional roving watches may be required by the Assistant

ATO, FPCON or situations justifying increased security and vigilance (such as chokepoints, in-port, etc.), and times the vessel is either moored or dockside IAW SI 538-2, the Navy Numbered Fleet Commander approved security plan, and COMSCINST 5530.3 series and underlying references.

g) IAW SI 538-2, the Navy Numbered Fleet Commander approved security plan, and COMSCINST 5530.3 series and underlying references, the in-port response force will consist of two members of the Vessel

O&M Crew as provided by the Ship’s Master (ATO). The Assistant ATO shall ensure that assigned Vessel

O&M Crew designated as in-port response force members are integrated into the Navy Numbered Fleet

Commander approved security plan and COMSCINST 5530.3 series requirements, associated drills, and shipboard training (conducted by the ATO). These individuals are “on-call” to respond in accordance with plans within the the Navy Numbered Fleet Commander approved security plan, and COMSCINST 5530.3 series and underlying references and situations arising from actual incidents or increases in FPCON. Use of force by Vessel O&M contract personnel will be in accordance with COMSCINST 5530.3 series, COMSC 011327ZJUN2017 Rules for the Use of Force by MSC Mariners.

Arming and the Use of Force).

h) Intel Warnings and Indicators: The Mission Integrator or Master will provide the Assistant ATO (Lead

Security Officer) with access to classified message traffic and SIPRNET in order to access, read, and ensure his team is briefed on appropriate Intel Warnings and Indicators.

i) Contractor Security Officers must become familiar with the relevant characteristics of the SBX-1 prior to assuming their duties. As appropriate, these include, but are not limited to: general arrangement of the

SBX-1, proper operation of the installed and portable security equipment, weapons and gear, firefighting equipment, lifesaving equipment, exposure suit, emergency duties, etc.

j) Functional Relationship: A professional and cooperative relationship between contractor Security

Officers and the SBX-1 crew is critical to mission success, and must be maintained at all times. It is essential that the Assistant ATO/Shift Leads and Master appreciate their individual responsibilities and dependence upon each other. Embarked contractor Security Officers shall follow all lawful commands of the Master (including directions regarding the use of force) and act as much as possible, as part of the crew.

C-1.12 Commnunications: Telephone contact is preferred for items requiring immediate resolution.

C-1.13 Functional Responsibilities

a) Contractor Security Officers shall not perform tasks other than security functions aboard the vessel unless otherwise confirmed in writing by the Contracting Officer.

b) Use of force by contractor Security Officers shall be in accordance with DoD Directive 5210.56. But, the Master has overall authority on board and responsibility for the vessel and can veto the use of force by contractor Security Officers that he believes is inappropriate or unlawful. The Master can also personally direct the use of force by contractor Security Officers when the use of force is lawful under Use of Force rules and the Master concludes that the use of force is necessary and appropriate. It is understood that the

Master does not have to directly authorize the use of force by contractor personnel that is otherwise lawful under the Rules for Use of Force.

c) It is imperative for the Master and contractor Security Officer on watch to work together as a team while implementing force protection measures. This will require the contractor Security Officer/ Assistant ATO to maintain situational awareness while the Master is navigating the ship, as well as determining the intent of approaching vessels. The contractor Security Officer shall keep the Master informed of the tactical force protection picture to allow the Master to maneuver his vessel so as to best protect his vessel and crew.

Consultation between contractor Security Officers and ship’s Master prior to the employment of force or protective measures is recommended when feasible, but is not required in the event that time does not permit such consultation.

C-1.14 Staffing

C-1.14.1 Underway Crew Size Each 15 person contractor Security Officer Team is separated into three contract labor categories: one Assistant Anti-Terrorism Officer, two Shift Leads, and twelve Marine Security Officers. The

Assistant ATO and Shift Leads are supervisors and exempt from overtime pay. Underway, fifteen armed contractor

Security Officers shall always reside on the vessel unless conditions require otherwise. In those cases, special accommodations will be made to provide for billeting and messing, and capability to respond to incidents.

C-1.14.2 In-Port Crew Size Each 8 person inport contractor Security Officer team is separated into three contract labor categories: one Assistant ATO, one Shift Lead, and six Marine Security Officers. Inport, eight armed contractor Security Officers shall always reside on the vessel unless conditions require otherwise. In those cases, special accommodations will be made to provide for billeting and messing, and capability to respond to incidents.

C-1.14.3 Operational Underway Manning (Operational SSL-A) A minimum of three people shall form the SBX-

1 on-duty guard force while the vessel is underway. These include one Assistant ATO or Shift Lead, one Roving

Security Patrol/Response Force person, and one Security Console Operator. The remaining off-duty security personnel shall form the Designated Immediate Response Force. Elevated threat levels may require additional security watchstanders IAW the Navy Numbered Fleet Commander approved security plan, and COMSCINST

5530.3 series.

C-1.15 Personnel Clearances The Contractor shall ensure that all Security officers are U.S. Citizens and have a final secret security clearance before boarding the vessel (interim security clearances are not acceptable for contractor personnel). One person on board at all times will be required to have a security clearance with a government provided COMSEC and CRYPTO briefing. The Contractor is responsible for obtaining all required security clearances.

C-1.15.1 Crew Screening The contractor is responsible for providing a complete crew list to the COR no later than four working days prior to the date the security personnel will embark onboard the vessel in accordance with

COMSCINST 5521.1(series). The Contractor shall submit the Full Name, Billet, SSN, Date of Birth, US Passport number, nationality for all security personnel. When a security personnel member is replaced, only submit that security personnel member instead of submitting the entire crew list again when the new security personnel member is submitted. All new personnel must be screened at the beginning of the hiring process prior to being sent to the

SBX-1. All personnel shall be resubmitted at least once in each 12-month period.

C-1.16 BLANK

C-1.17 Medical Requirements

C-1.17.1.1 General

The contractor shall maintain crew medical records and ensure immunizations and screening of mariners IAW applicable guidelines of COMSCINST 6000.1 (series), Medical Manual. Additional MSC Directives may also apply (e.g. N2.35.6100.1-Q (series), MSC Coronavirus Disease 2019 (COVID-19) Command Response Plan and Medical Guidance)

C1.17.1.2 Medical Exam Requirements for Security Personnel) The contractor shall screen all Security

Personnel and conduct pre-employment multi-phasic medical/dental physical examinations on them to ensure and validate they are in good physical condition, do not have a history of injuries onboard ship, and do not have a history of inability to perform the physical requirements of their position. If the contractor is unable to validate any of the listed items for a mariner, then the contractor shall not assign the mariner to any ship under this contract unless the

COR approves the assignment. The contractor shall use USCG medical examination requirements and periodicity to standardize the physical qualification parameters for initial entry, retention, duty assignments, and training programs. USCG requirements shall be used for Security Personnel who will be, or are in, positions at sea aboard ships under this Contract. Each crewmember’s Physical Examination Report shall display the following statement above the signature of the designated licensed Physician to ensure the Contractor shall provide all crewmembers with medical/dental multi-phasic screening examinations in accordance with COMSCINST 6000.1 (Series):

"[Mariner's Name and last four digits of Social Security Number] has been examined and found to be physically and psychologically qualified for duty at sea in an isolated environment in accordance with COMSCINST 6000.1

(Series) and COMUSFLTFORCOM/COMPACFLT 6320.3B.

All Crew and embarked personnel are responsible for bringing a normal crew rotation plus sixty day supply of all required prescription medications onboard ship at the time of assignment. The shipboard Medical Department is not responsible for providing medications for chronic medical conditions. Spare glasses or contact lens should also be brought on the ship during assignments.

C-1.17.1.3 Supplemental MSC Medical Screening

The contractor shall perform the following medical examinations on all Security Personnel assigned to perform work on a ship under this contract:

Complete Blood Count (CBC)

Lipid Profile – (total cholesterol, LDL, HDL, triglycerides)

Hemoglobin A1C test (in place of fasting glucose)

Urinalysis

EKG

Dental exam by licensed healthcare practitioner (dentist is also acceptable but not required)

The contractor’s designated medical representatives shall validate the above listed medical screenings are performed at the required times. The contractor shall perform the above exams every five years up to age 50, then every two years after age 50. The examinations may be more frequent at the discretion of the contractor’s medical representative.

C-1.17.1.4 Granting Waivers

The contractor’s designated medical representative may grant a waiver of the supplemental MSC medical screenings at their discretion for any waiverable condition. Further information on waiverable conditions can be found in

COMSCINST 6000.1 (series), Medical Manual, or medical representatives may consult the MSC Force Medical

Division.

C-1.17.1.5 Medical Records

The contractor shall maintain the following for each crewmember while onboard the ship: (1) a listing of all current medical diagnoses; (2) a listing of all medications currently prescribed and utilized; (3) International Certificate of

Vaccinations CDC-731 and; (4) any additional information on medical care which has been obtained since the crewmember’s most recent medical examination. The contractor shall make medical records for each crewmember available to any medical provider who examines the crewmember. The contractor shall mandate each crewmember give the MDR/M-PIC any applicable documents given to the crewmember by a local physician or clinic each time they are examined or treated ashore while assigned to a ship as a crewmember. The Privacy Act protects crewmember medical records, and all information will be maintained in strict confidentiality by the contractor.

C-1.17.6 Provide Medical History

The contractor shall not accept crewmembers for employment if previously evacuated from any ship for a medical condition unless a complete report from a physician verifies the predisposing condition was corrected or cured, and such report was approved by the contractor's designated licensed physician and MSC has reviewed and approved the member as fit for duty. The contractor shall not supply crewmembers with existing health conditions that constitute a hazard to the person or to others onboard ship unless it can be demonstrated that the condition is controlled and being monitored by the crewmember’s physician who rendered the crewmember fit for duty (FFD). A medical condition that may preclude a mariner from performing their duties and/or may require emergency medical evacuation from the vessel is determined to be “high risk”. If such a medical condition is discovered during a crewmember’s assignment to a ship, then the contractor shall repatriate the crewmember at the contractor’s expense.

C-1.17.1.6.1 Tuberculosis (TB) Control Program

The contractor shall comply with the Navy’s TB Control Program requirements as outlined in BUMEDINST 6224.8

(series) and COMSCINST 6000.1 (series), Medical Manual.

C-1.17.1.7 Immunizations-General

C-1.17.1.7.1 Supplemental Immunizations and Medical Countermeasures

The contractor shall comply with additional requirements for supplemental prophylactic and medical countermeasures (including immunization programs for civil service mariners) established by COMSC. Upon establishment, the contractor shall mandate officers, crewmembers, and other individuals embarked on ships comply with the COMSC requirements.

C-1.17.1.7.2 Immunizations - Failure to Comply

Any crewmember or other individual who refuses to comply with: any immunization requirement, any preventive or medical countermeasure requirement, who declines or is ineligible to take or use a required immunization or other preventive or medical countermeasure shall be removed by the contractor from the ship as soon as possible.

However, removal shall take place no later than the next port call. A removed crewmember shall be replaced with a medically qualified individual. A crewmember who is administratively or medically ineligible to receive an

Anthrax shot is addressed in COMSC Anthrax Resumption Policy Naval Message ALMSC 010/07 (series). MSC may grant exceptions to the Anthrax shot requirement for situations that are not addressed in the COMSC Anthrax

Resumption Policy. Any removal and replacement of personnel pursuant to this section shall be solely at the contractor’s expense, including but not limited to: travel, per-diem, wages and associated administrative expenses.

C-1.17.1.8 Status of Medical Countermeasures, Including Immunizations

When supplemental preventive and medical countermeasures, including immunizations, are required IAW Section

C-1.17.1.7, the contractor shall provide notification to the COR of the immunization status of all officers, crew and other individuals no later than 96 hours prior to assignment to a ship unless otherwise authorized by the COR. The contractor shall provide relief personnel who comply will all immunization and medical countermeasure requirements no later than 96 hours prior to the personnel change, unless otherwise authorized by the COR.

C-1.18 Contractor Responsibility for Safety. Nothing in this Performance Work Statement, nor any Government action or failure to act in surveillance of this contract, shall relieve the contractor of its responsibility for the safety of the contractor’s personnel and property, the Government’s personnel and property, and the general public whether it is Instructor/Only support or turnkey. Furthermore, nothing in this performance work statement shall relieve the contractor of its responsibility for complying with applicable Federal, State, and Local Laws, ordinances, codes and regulations (including those requiring applicable licenses and permits) in connection with the performance of this contract.

C-1.19 Berthing Accommodations Berthing space is limited to 8 staterooms, all of which are dual bunks (2 beds per stateroom). Persons berthed together should be of the same sex unless it is as spouses and arrangements be made, create no undue disruptions to ships operations, and are in the best interest of the command.

C-1.20 On-board Storage The contractor‘s general storage is limited to that provided in the staterooms described in

C1.19. Additional locker space may be available but is not guaranteed.

C-1.21 Travel Personnel travel will be necessary. Travel origination for employees will be based on each employee’s residence within the Continental United States, Alaska or Hawaii for purpose of determining maximum allowable limit. When travel to Dutch Harbor is required, Anchorage per diem rates will be applicable when overnight stay in Anchorage is required. Reimbursement will be limited to actual costs incurred in going to initial destination and return. All travel shall be in accordance with the Joint Travel Regulations.

C-1.22 Food and Recreation On board facilities include limited recreation facilities including gym and cafeteria.

The Government through the MSC Vessel Operations contractor shall provide all necessary food. (3 meals a day and personnel assigned to nightwatch with hot lunches served between the hours of 2330-0030.) Due to the limitations onboard not all dietary restrictions may be provided for.

C-1.23 Reporting Criteria The Assistant ATO shall submit reports to the Master (ATO) and the Contracting

Officer’s Representative as required by the terms of this contract.

C-1.24 Deliverables: Deliverables shall be submitted in accordance with the associated CDRL.

a) Transition Plan The contractor shall provide a plan to accommodate the transition between the incumbent contractor and the performing contractor. The Transition Plan shall include a mobilization schedule as well as a VSP POAM (see Section C-1.12c). This is a one-time deliverable due with the proposal. The mobilization schedule shall outline the Contractor’s tasks and timelines for assumption of responsibilities. All transition costs shall be for the Contractor's account except as specifically otherwise provided in the contract.

b) SBX Vessel Security Plan Within 3 days of contract award, the contractor will, after reviewing

COMSCINST 5530.3 series, the Navy Numbered Fleet Commander approved security plan, and SI 538-02, engage discussion with the COR, COMSC N34, and the MSC Area Command Force Protection Officer

(FPO) as to whether the development of a separate Vessel Security Plan (VSP) is necessary. If COMSC

N34 then determines that a VSP is necessary, the contractor will co-develop the VSP with the COR, COMSC N34, and the MSC Area Command FPO within 30 days of contract award. If required, the VSP will:

1. Be consistent with and subordinate to SI 538-02, the Navy Numbered Fleet approved SBX Security Plan, and COMSCINST 5530.3 series.

2. Cover detailed procedures necessary to meet requirements in the above instructions.

3. Be reviewed by the Contractor annually with recommended changes sent to the COR, COMSC N34, and the MSC Area Command FPO.

c) Staffing Plan (CDRL A002) The COR, Master and Mission Integrator shall be provided with the contractor’s staffing plan. The initial staffing plan is required with the contractor’s proposal and the final staffing plan is required 2 weeks after contract award and updates must be submitted two weeks before implementation except in emergency situations or as required by FPCON. Due to the unique nature of mission and vessel operations aboard the SBX-1, personnel schedules may frequently change to support operational missions and OSV transit scheduling.

d) Daily Logs and Briefings (CDRL A003) Daily security and Anti-Terrorism/Force Protection (AT/FP) briefing shall be in accordance with the CDRL, including information such as Vessels of Interest (VOI), Integrated Electronic Security System status and discrepancies, etc. The contractor shall maintain a Daily

Activity Log/Blotter of all activities, incidents or threats.

e) FP/CBRN Monthly report (CDRL A004) contractor shall submit this report per COMSCINST5530.3

f) Security Plan Verification Records (CDRL A005) The contractor shall collect and maintain records demonstrating that the requirements of the COMSCINST 5530.3 series are met.

g) Administrative Procedures and checklists (CDRL A006) The Contractor shall develop and maintain the Security Administrative Procedures and Security Officer Response procedures and check lists as required.

h) Firearms and Ammunition Control (CDRL A007) The contractor shall maintain control of and responsibility for firearms and ammunition aboard the vessel IAW OPNAVINST 5530.13 (series) (Physical

Security of Conventional Arms, Ammunition, and Explosives), OPNAVINST 8015.2 (series)

(Conventional Ordnance Inventory Accountability), the NAVSUP P724 (latest rev) (Conventional

Ordnance Stockpile Management, Policies and Procedures), NAVSEA OP4 (Ammunition & Explosives

Safety Afloat) and COMSCINST 4000.2 (series), ch 5 (Supply Procedures Manual) as delegated responsibility from the Master. Contractor shall maintain a daily log of daily weapons, ammo issuance and receipt and associated keys and locks on the SBX-1.

i) Weekly Alarm Reporting (CDRL A008) The Contractor shall complete DA Form 4930 Alarm/Intrusion

Detection Record weekly, CCURE Alarm Report weekly.

j) Monthly Summary Report & Monthly FP/CBRN Report (CDRL A009) The Assistant ATO shall submit a monthly FP/CBRN report IAW COMSCINST 5530.3(Series).
