Amendment 0004

The purpose of this amendment is to:

1. Publicly provide answers to inquires posed by interested parties.

Q1. What does the Government anticipate will be the order of importance for the Labor Categories?

Given the duration (5 years) and scope of this IDIQ, it is not possible to rank the order of importance for the labor categories. Please also see the response to Amendment 0003 Q19.

Q2. Can the Government please expand on what "unlimited data rights" entails? Does it extend to the use of any Intellectual Property (IP) assets on how the data is collected or just the output?

“Unlimited rights” means the right of the Government to use, disclose, reproduce, prepare derivative works, distribute copies to the public, and perform publicly and display publicly, in any manner and for any purpose, and to have or permit others to do so. To what the unlimited rights apply to is dependent on what clause or provision you are referring to. For instance, as stated in FAR 52.227-14(b)(1)— “Except as provided in paragraph (c) of this clause, the Government shall have unlimited rights in-

(i) Data first produced in the performance of this contract;

(ii) Form, fit, and function data delivered under this contract;

(iii) Data delivered under this contract (except for restricted computer software) that constitute manuals or instructional and training material for installation, operation, or routine maintenance and repair of items, components, or processes delivered or furnished for use under this contract; and

(iv) All other data delivered under this contract unless provided otherwise for limited rights data or restricted computer software in accordance with paragraph (g) of this clause.”

Q3. Does the Government desire to have the subcontracting participation goals listed for whole the IDIQ or for each task order?

Subcontracting participation goals should be listed for the IDIQ Contract. FAR 19.704 shall be complied with for the Subcontracting Plan.

Q4. Does the Offorer have the discretion of determining when to include a subcontractor vs themselves for each task order? Or are is there a minimum amount of work for subcontractors that they must include in each task order?

The Offeror is responsible for determining who will perform what work. However, Offerors are expected to comply with their Subcontracting Plan for the IDIQ contract, unless the offeror is a small business and does not have a Subcontracting Plan.
