. 1 EVALUATION CRITERIA AND SUBMISSION REQUIREMENTS
Due Date for Quotations
Offerors shall submit their quotations so that NIST receives them not later than 03:30 PM Eastern Time on April 15, 2015. FAX quotations shall not be accepted. E-mail quotations shall be accepted at Lynda.Roark@nist.gov. Offerors’ quotations shall not be deemed received by the Government until the quotation is entered into the e-mail address inbox set forth above.
Quotations shall be sent to the National Institute of Standards and Technology, Acquisition Management Division, Attn: Lynda Roark, 100 Bureau Drive, Stop 1640, Gaithersburg, MD 20899-1640. All offerors should ensure the RFQ number is visible on the outermost packaging.
Because of heightened security, FED-EX, UPS, or similar delivery methods are the preferred method of delivery of quotes. If quotes are hand delivered, delivery shall be made on the actual due date through Gate A, and a 48 hour (excluding weekends and holidays) prior notice shall be provided to Lynda Roark, Contract Specialist on 301-975-3725.
Addendum to FAR 52.212-1, Quotation Preparation Instructions
1) Price Quotation: The offeror shall submit an original and one copy of the completed price schedule. If the quotation is submitted electronically, additional copies are not required. The pricing quotation shall be separate from any other portion of the quotation. The offeror shall propose a firm-fixed-price, FOB Destination Required, for each CLIN. Price quotations shall remain valid for a period of 90 days from the date quotations are due.
2) Technical Quotation: The offeror shall submit an original and one copy of the technical quotation. If the quotation is submitted electronically, additional copies are not required. The technical quotation shall address the following:
Technical Capability: The offeror shall submit a technical description or product literature for the equipment it is proposing, which clearly identifies the capability of meeting the requirements listed in the SOW and Drawings. The offeror must demonstrate that its proposed equipment meets or exceeds each minimum requirement described in the statement of work by providing a citation to the relevant section of its technical description or product literature.
3). Acceptance of Terms and Conditions: This is an open-market solicitation for equipment as defined herein. The Government intends to award a Purchase Order as a result of this solicitation that will include the clauses set forth herein. The quotation should include one of the following statements:
“The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion, or addition.”

“The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:

Offeror shall list exception(s) and rationale for the exception(s)
Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant Purchase Order, not the terms and conditions of the offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation.
QUOTATION EVALUATION:
Evaluation Factors
Award shall be made to the offeror whose quotation meets or exceeds the requirements stated and is lowest price. The Government will evaluate quotations based on the following evaluation criteria: 1) Technical Capability and 2) Price.
Technical Capability: No prototypes, demonstration models, used or refurbished instruments will be considered. Evaluation of technical capability shall be based on the information provided in the quotation. NIST will evaluate whether the offeror has demonstrated that its proposed equipment meets or exceeds all minimum requirements. Quotations that do not demonstrate the proposed equipment meets all requirements will not be considered further for award. If an offeror does not indicate whether its proposed equipment meets a certain minimum requirement, NIST will determine that it does not.
Price: The Government will evaluate price for reasonableness.
Price shall not be evaluated on quotes that are determined technically unacceptable under the Technical Capability Evaluation factor.

. 3 SPECIFICATIONS
Specifications for a 15,700 Gallon Helium Storage Tank
1.0ऀIntroduction
This specification is for a helium storage tank to be used as part of a helium refrigerator system for the NCNR deuterium cold neutron project. The storage tank is composed of an ASME Section VIII Division 1 pressure vessel and support structure.
2.0ऀScope of Work
ऀ2.1ऀThe contractor shall be responsible for Code Calculations and detailed shop drawings including weld details. Since the storage tank will be a “U” Stamp Tank, the design, fabrication must meet the requirements of the ASME Boiler and Pressure Vessel Code, Section VIII. The Government will review and provide feedback or approval within 7 days of receipt of drawings and code calculations.
ऀ2.2ऀFabrication techniques and methods not specified in the NIST drawing are the responsibility of the contractor. The use of techniques specified in the NIST drawing does not relieve the contractor of responsibility for the proper design and fabrication of all components, but all alternative recommendations must be reviewed and approved by the government (NIST).
ऀ2.3ऀTesting in accordance with ASME Section VIII, Division 1 and shall be performed by the contractor and witnessed by government personnel as deemed necessary by the government.
ऀ2.4ऀThe contractor is responsible for providing fully qualified and certified welders. All butt welds shall be visually inspected to confirm full penetration, visually inspect all ID welds where permissible.
ऀ2.5ऀCertification of materials (mill test reports) procured by the contractor is required, and copies must be provided to the government (NIST).
2.6ऀAll internal and external surfaces shall have been media blasted to remove all scale, grease and oil prior to painting. Tyvek foot protection shall be worn when welding the inside tank surfaces to maintain surfaces clean and free of dirt, oils and other foreign matter.
2.7ऀCertified test reports, test record/data sheets and weld radiographic inspection reports, if required, shall be provided to the government (NIST).
2.8ऀAfter pneumatic pressure testing, all exterior carbon steel surfaces shall be painted, ‘white’ using an Amerlok 2 epoxy or an NIST approved equivalent. Inspect all painted surfaces for required mil thickness and coverage. Do not paint stainless

steel surfaces, instrument or valves.
2.9ऀThe contractor is responsible for packing, marking, and shipping. The contractor shall assume full responsibility for the helium storage tank while it is in transit to and until it is received by the government (NIST). FOB Destination to NIST, Gaithersburg, MD is required.
2.10ऀThe contractor is responsible for final placement of the storage tank on the existing cement pad.
3.0ऀDesign
ऀThe helium storage tank shall have an internal volume of not less than 15,700 gallons. The helium storage tank shall have four penetrations as shown in (002-2936). Four assemblies supplied by the government will be welded in these four penetrations, (002-2937, 002- 2938, 002-2939 and 002-2940) shown on Section B-B, Section C-C & Section D-D of 002-2936. The system shall be designed to operate at the following pressure and temperature conditions:

Internal working pressure:ऀ0-175 psig External pressure: ऀऀऀ14.7 psi Working temperature:ऀऀ-20 to 120 F
Note:ऀThe minimum wall thickness is .625 inches

ऀ3.3ऀConstruction Requirements
ऀऀThe vessels (rolled sheet 5/8” thick) linear seam welds shall be staggered 90 ऀऀDegrees, no four point corners.
Two internal Stiffeners Rings shall be fabricated from Stainless Steel Angle 4” X 4” X ¼” Thick, 279-3/8” Long rolled the hard way to match tank ID.
CNR drawing 002-3723 Rev 1, defines the footprint for the tank base, any changes to this requires approval by the government.

Orientation of lifting lugs is defined to allow for installation at the site, any changes to this orientation requires approval by the government.
4.0ऀConflicts
ऀIf there is any discrepancy between the drawings and the written specifications, the written specifications shall take precedence.
5.0ऀMaterials of Construction
Any alternatives to the materials specified below shall be submitted to the Contracting Officer for approval. The Government will review and provide feedback or approval within 7 days of receipt of drawings. Material certification (mill test reports) required for all materials.
Storage tank: SA 516 Gr. 70 Alloy Steel, Support base: SA 516 Gr. 70 Alloy Steel, Pressure Transmitter Support Brackett: ASME SA-479, 304 Stainless Steel Alloy, Government Supplied Sub-assemblies: SA 312 304/304L Stainless Steel Alloy.
6.0ऀHeat Treatment ऀAs required by ASME code.
7.0ऀTesting
Certification of all test results is required. Copies of all test results must be provided to the government (NIST).
ऀ7.1ऀRadiography
ऀऀAll structural (pressure) welds shall be radiographed according to the ASME code.
ऀ7.2ऀPressure Test
The pressure test shall be performed pneumatically with either oil free nitrogen or helium as per ASME code.
8.0ऀSurface Finish
ऀSurface finishes as required by ASME code.

9.0ऀCleaning
ऀAll surfaces shall be free of moisture, dirt, organic compounds, scale and other foreign matter.
10.0ऀAcceptance
Upon delivery of the helium storage tank to NIST the unit will be inspected for conformance with this specification. If the helium storage tank does not meet the requirements of this specification the unit will be unacceptable and will be returned to the manufacturer for repair or replacement at no expense to the government. The Government will provide inspection feedback or acceptance within 7 days after receipt and placement of final Helium Tank.
11.0 ऀDeliverables
ऀDocuments/Drawings:
ऀThe Contractor shall submit the following documents to the designated TPOC within 4ऀ ऀweeks of receipt of order.
1. Code Calculations and detailed shop drawings including weld details.
2. Certification of materials (mill test reports) procured by the contractor
3. Certified test reports, test record/data sheets and weld radiographic inspection reports, if applicable
4. Certification of all test results is required
Final Delivery:
The final delivery and placement of the Helium Tank is required not later than August 1, 2015.

. 4 52.204-7 SYSTEM FOR AWARD MANAGEMENT (JUL 2013)
(a) Definitions. As used in this provision-- "Data Universal Numbering System (DUNS) number" means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.
"Data Universal Numbering System +4 (DUNS+4) number" means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional System for Award Management records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.
"Registered in the System for Award Management (SAM) database" means that--
(1) The offeror has entered all mandatory information, including the DUNS number or the DUNS+4 number, the Contractor and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see Subpart 4.14) into the SAM database;
(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in the SAM database;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record ``Active''''.
(b)
(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation "DUNS" or "DUNS +4" followed by the DUNS or DUNS +4 number that identifies the offeror` name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the SAM database.
(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.
(1) An offeror may obtain a DUNS number--
(i) Via the Internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or
(ii) If located outside the United States, by contacting the local Dun and Bradstreet office.
The offeror should indicate that it is an offeror the a U.S. Government contract when contacting the local Dun and Bradstreet office.
(2) The offeror should be prepared to provide the following information:
(i) Company legal business.
(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.
(iii) Company Physical Street Address, City, State, and Zip Code.
(iv) Company Mailing Address, City, State and Zip Code (if separate from physical).

(d) If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.
(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights-
(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and
(2) Before any substantial change occurs in the condition ofthe item, unless the change is due to the defect in the item.
(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.
(f) Termination for the Government`s convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work. Subject to the terms of this contract, the Contractor shall be paid a percentage of the contract price reflecting the percentage of the work performed prior to the notice of termination, plus reasonable charges that the Contractor can demonstrate to the satisfaction of the Government, using its standard record keeping system, have resulted from the termination. The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor`s records. The Contractor shall not be paid for any work performed or costs incurred that reasonably could have been avoided.
(g) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide theGovernment, upon request, with adequate assurances of future performance. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.

. 7 52.219-1 SMALL BUSINESS PROGRAM REPRESENTATIONS (OCT 2014)
(a) Definitions. As used in this provision-- Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.
Service-disabled veteran-owned small business concern--
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
