UNGA 2016

JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND

OPEN COMPETITION (Unusual and Compelling Urgency)

1. Identification of the Agency and Contracting Activity

The U.S. Department of State, Office of Acquisition Management is processing this acquisition at the request of the Department of State’s Bureau of European and Eurasian

Affairs (EUR) in support of the United Nations General Assembly (UNGA) 2016.

UNGA will be held at the United Nations Headquarters in New York City.

The estimated cost is at a minimum value of $200,000.00 for EUR.

2. Nature and/or description of the action being approved.

UNGA is the annual gathering member of nations with representation at the heads of states and heads of government level that takes place at the United Nations Headquarters in New York City.

EUR is responsible for securing and executing the lodging accommodation required during this event for Senior High Level USG Participants and their staff attending UNGA

2016.

The Affinia 50 Hotel requires EUR to guarantee room nights for the period of September

2016 for High Level USG Principals traveling with a delegation inclusive of support staff elements in: Security, Communications, Logistics and Operations.

3. A description of the supplies or services required to meet the agency’s needs.

Due to the complex and compelling security and logistical requirements of UNGA 2016, EUR has an urgent and compelling need to utilize a facility that can effectively meet the special close proximity (1/2 mile walking distance) requirements to the Lotte New York

Palace Hotel in New York essential during the period of September 2016.

In meeting this requirement, it has been determined that the space and location of the

Affinia 50 Hotel in New York uniquely meets the close proximity and special security requirements essential for its VIP support staff during UNGA 2016.

4. An identification of the statutory authority permitting other than full and open competition.

The proposed procurement is to be made under the statutory authority of 41 USC

253(c)(2), FAR 6.302-2, Unusual and Compelling Urgency.

5. Demonstration that the Contractor’s Unique Qualifications or the Nature of the

Acquisition Requires Use of the Authority Cited.

Due to the complex and compelling security and logistical requirements of UNGA 2016

EUR has an urgent and compelling need to utilize a facility that can effectively meet the close proximity location requirements essential during the period of September 2016

UNGA.

Security concerns prohibit sufficient advanced notification of VIP travel support to allow for sufficient time to conduct full and open competition. In meeting this requirement it has been determined that the space and location of the Affinia 50 Hotel, located at 155 E.

50th Street, New York, NY 10022 uniquely meets the special location security requirements necessary for VIP support staff.

6. Description of Efforts Made to Ensure that Offers Were Solicited from as many

Potential Sources as Was Practical.

The Affinia 50 Hotel in New York is the only facility that can accommodate the unique location, security and logistical requirements. It has the space and accommodations necessary to meet the special security requirement during the meetings set during the period of September 2016 for UNGA 2016.

Security and logistics are the Department of State’s primary considerations when procuring hotel rooms. The Bureau of European and Eurasian Affairs must be able to provide a safe and secure environment for its staff and visitor. Frequently, VIP visits are not announced or confirmed in sufficient time to conduct a competition, creating an urgent and compelling need.

7. Determination of the Contracting Officer that the Anticipated Costs to the Government

Will be Fair and Reasonable.

The Contracting Officer has determined that anticipated costs to the Government are fair and reasonable based on the commercial listed prices for space and rooms at the Affinia

8. A Description of the Market Survey Conducted and the Results or statement of the

Reasons A Market Survey was not Conducted.

EUR led a survey of the area that found that the Affinia 50 Hotel is the only facility that has available rooms and meeting spaces to effectively meet all of the compelling and urgent location, security and logistical requirements essential during UNGA 2016.

11. A Statement of the Actions, If Any, The Agency May Take to Remove or overcome Any

Barrier to Competition Before Any Subsequent Acquisition for the Supplies or Services

Required.

While the UNGA meetings are a yearly event based on the uniqueness of the security issues of the attendees, the removal of barriers is not applicable for subsequent acquisitions for the services required.
