JUSTIFICATION AND APPROVAL (J&A)
FOR OTHER THAN FULL AND OPEN COMPETITION
1. Identification of Agency and Contracting Activity: The U.S. Department of State’s Office of Acquisitions Management (A/LM/AQM) is conducting this acquisition on behalf of the Defensive Equipment and Armored Vehicle Division (DS/C/PSP/DEAV) of the Bureau of Diplomatic Security (DS).
2. Nature and/or description of the action being approved: This justification and approval is for the award of a purchase order for commercial items, on a sole-source basis, for the armoring of six (6) Cadillac DTS sedans that are equipped with the BO5 pre-armoring package.
3. A description of the supplies or services required to meet the Department’s needs (including the estimated value): DOS intends to armor six (6) Cadillac DTS sedans previously purchased from GSA.
4. An identification of the statutory authority permitting other than full and open competition: 41 U.S.C. 1901 (a)(2) as implemented by FAR 13.501(a).
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited: Scaletta Armoring is the only armoring company that is a certified General Motors Master Coachbuilder. As a Certified Master Coachbuilder, Scaletta has access to propriety information from General Motors concerning the DTS. Only a Cadillac Master Coachbuilder can receive OEM validation for proper engineering, strength, and reliability. Scaletta’ s exclusive Coachbuilders contract with General Motors ensures that only Cadillac Master Coachbuilders can purchase the special model chassis needed for vehicle armoring. As a Master Coachbuilder, General Motors conducts inspection of Scaletta’s finished vehicles to ensure they meet or exceed their factory standards.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable: A FedBizOpps notice will be publicized as required by FAR 5.2, along with a copy of the solicitation for all interested parties to review this opportunity.
As required by FAR 5.207(c)(16)(i), the agency shall consider all proposals submitted by responsible sources in response to the FedBizOpps posting.
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable: The Contracting Officer will include a statement of price reasonableness in the contract file based on a comparison of the proposed price with prices found reasonable on previous purchases.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted: The Government has conducted informal market research online and concluded no other potential competitor can meet this requirement.
9. Any other facts supporting the use of other than full and open competition:
NA
10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:
N/A
11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required: This J&A for other than full and open competition will be published on FedBizOpps in accordance with FAR 6.305 within 14 days after award and the Government will continue to check the marketplace to see if other armor vehicle manufacturers are able to offer similar solutions for future competitive opportunities.
