Justification and Approval

For Other Than Full and Open Competition

1. Contracting Agency: Defense Human Resource Activity- Procurement Support Office 4800 Mark Center Drive, Suite 06J25-01, Alexandria, VA 22350-1300

2. Authority Cited: 10 U.S.C.2304(c)(1), FAR 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

3. Description of Supplies and Services: The Sexual Assault Prevention and Response Office (SAPRO) requires contractor services for a period of 30 days to provide for the complete processing, vetting, tracking and issuing approval of credentialing requirements, and to provide the national credentialing of Department of Defense personnel who provide direct services to sexual assault victims in the military.

4. Description of Action: A Purchase Order is planned for with a total estimated value of $71,512.59. The period of performance will be for 30 days. Fiscal Year (FY) 2015 Operation and Maintenance (O&M) funds are available.

5. Reason for Authority Cited:

a. The Department of Defense (DoD) established a training and certification program for Sexual Assault Response Coordinators (SARC) and Sexual Assault Prevention and Response (SAPR) Victim Advocates (VA) in accordance with the National Defense Authorization Act (NDAA) for FY12. In December of 2009, SAPRO was directed by the Under Secretary of Defense (USD) for Personnel and Readiness (P&R) directed to proceed with implementing oversight recommendations, to include Recommendation 6a from the Defense Task Force on Sexual Assault in the Military Services (DTF-SAMS) Report, which calls on the Department to establish VAs certified by the National Victim Assistance Academy. Individuals who complete the National Victim Assistance Academy program receive a credential from the National Advocate Credentialing Program (NACP). SAPRO has oversight of DoD Sexual Assault Advocate Certification Program which was established to standardize sexual assault response to victims and professionalize victim advocacy roles. This program consists of three prongs: (1) a national credential, (2) a competency framework, and (3) a plan for the evaluation and oversight of training of DoD personnel who provide advocacy services to sexual assault victims in the military.

b. This requirement is a follow-on procurement for services previously obtained on a sole source basis. The current contract, number H98210-12-C-0007, expires February 22, 2015.

Market research included posting a Request For Information (RFI) on FedbizOpps.gov to identify potential sources in addition to the incumbent, the National Organization for Victim Assistance (NOVA). Capability statements were received from three vendors: the incumbent, Virtual Technology Services, LLC (VTS), and KeyPoint Government Solutions. The VTS and KeyPoint Government Solutions responses did not demonstrate recognition as a national leader with subject matter expertise in sexual assault response competencies and training, and with National Advocate Credentialing Program (NACP) or the ability facilitate the required credential approvals. Therefore, the RFI did not result in identification of any new potential sources.

NOVA has successfully performed all services under the current contract and can continue to successfully perform the follow-on requirement.

6. Effort to Obtain Competition: RFI DHRA1242014BL was posted on FedBizOpps.gov on December 4, 2014 in an effort to identify potential sources in addition to NOVA, the incumbent.

As detailed above at paragraph 5.b. above, three capability statements, including one from the incumbent, were received by the response due date/time of December 18, 2014 / 1:00 PM ET.

A detailed review of the statements resulted in identifying only the incumbent as a source capable of meeting the full requirement. A notice of intent to award on a sole source basis will be posted on FedBizOpps.gov and interested offerors will have the opportunity to submit a capability statement for the Government’s consideration.

7. Effort to remove barriers to/increase competition: SAPRO will continue to monitor the market place for any new potential sources that may become available to meet this requirement. For new requirements, a thorough review of the marketplace will be conducted to ensure that any/all barriers to competition are identified and removed so that competition can be obtained to maximum extent practicable.

8. Market Research: Market research was conducted via internet search engines, potential vendor websites, issuance of an RFI (see paragraphs 5b and 6 above) and extensive contact/discussion with industry sources.

9. Interested Sources: NOVA, Alexandria, VA; VTS LLC, Oklahoma City, OK; KeyPoint Government Solutions, Fairfax, VA.

10. Other Information: None.
