52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS ADDENDUM
Request for Proposal (RFP)
Defense Contract Management Agency (DCMA), San Diego
1. Description of Requirement The Defense Contract Management Agency (DCMA) office at San Diego, California is relocating to a commercial leased space approximately three miles from their current location. Furniture and appliances are required for the new space as well as the relocation of property items and disposal of existing furniture. The
Technical Work Statement (Attachment 1) describes the minimum requirements.
2. RFP Schedule Questions submitted in response to this RFP should be made to Brian Gillead via email address:
larry.gillead@dcma.mil on or before June 2, 2015, 1:00 p.m. (noon) Eastern Time.
Proposals/Proposals submitted in response to this RFP shall be submitted via email on or before June 15, 2015
9:00 a.m. Eastern Standard Time. No late proposals will be considered.
3. Mandatory Site Visit
Contractors must attend the mandatory site visit in order to be eligible to submit an offer for this solicitation.
Contractors are limited to two representatives per offeror.

All contractors intending to attend the site visit must register with the site visit POC by email NLT 22 May
2015. Information required: Name of Company (cage code & DUNS Number) Name of attendees and driver’s license numbers. Site visit attendees must have a photo ID and are subject to security screening IAW DoD &
DCMA policy.
Dates and Time: May, 28 at 9:00am local time for check in. Site Visit shall be conducted from 09:30 a.m. to
11:00 a.m. Attendees will also visit the new site during this visit.
Contractors are required to sign in with the designated POC listed above by 9:00 a.m. Contractors who fail to meet the 9:00 a.m. sign in deadline will not be allowed to attend the Site Visit designated for that day.
There shall be no contact between the contractor and the site visit POC during the time following the site visit and prior to award.

5. Schedule of Supplies The Awardee shall deliver all required supplies set forth in the Technical Work Statement document, entitled
Attachment 1: San Diego CA Technical Wok Statement, to this RFP.
6. Inspection and Acceptance
Inspection and acceptance of the supplies and deliverables to be furnished shall be performed by the Inspector.
The Contracting Officer or the Inspector may inspect any aspect of performance under this contract at any time.
Government inspection and acceptance for all contractual items listed herein will be at destination by the designated Inspector.

Instruction to Offerors - Proposal Submission Requirements
General: This is a Request for Proposal for the attached Technical Work Statement (TWS). This request does not obligate the government in any form to issue your company a contract award. Offerors are notified that the
Government will not reimburse costs incurred for RFP preparation, to include pre-award site visits.
All firms must be registered and active in the System for Award Management (SAM) database at https://www.sam.gov/portal/public/SAM/ to be considered for award. All proposals must be directly submitted by mailto:Jarrod.January@dcma.mil the firm registered in SAM that is intended to be the successful awardee. A proposal submitted by another firm on behalf of a SAM registered company with the intention of being award “care of” will not be accepted.
Proposal Submission Requirements: In order to be eligible for award, proposals shall provide all information specified herein. Proposals that fail to furnish the required information, or reject the terms and conditions of the solicitation may be excluded from consideration. Contractor proposal’s will be evaluated in accordance with the evaluation criteria stated below. The proposal shall consist of the following parts:

If the offeror uses a different format (font size, margin, etc.), the government reserves the right to adjust the proposal to fit the parameters of the format as stated in the RFP, and if this results in the proposal exceeding the page limitations in any one area, the government will not consider those excess pages.

b. Transmittal letter: The transmittal letter to the offerors proposal should include a statement regarding acceptability of proposed contract schedule, clauses and general provisions, any recommendations, and any exceptions taken. In the event the offeror takes any exceptions to, or sets any conditions for its proposal under the subject solicitation, such exceptions or conditions shall be set forth in the transmittal letter and include the offerors name, the effective date, and the period covered by the contract.
c. Executive Summary. The offeror should provide an executive summary for the technical proposal. In the executive summary, the offeror should highlight the significant factors of its technical proposal. A brief narrative form any unusual features that the offeror wishes identified before Government evaluation is initiated. The executive summary for the technical approach should be no more than two pages long.
d. teaming Agreement (As Applicable) Provide a copy of any subcontract, teaming, or consultant agreements or letter of intent containing a description of and the extent of their role in the requirement, and a statement of commitment on their part to satisfy the requirements of this solicitation.
The solicitation is issued as a Request for Proposal (RFQ) IAW FAR Parts 12 and 13, utilizing the simplified acquisition procedures outlined in FAR 13.5, Test Program for Certain Commercial Items, as authorized by Section
815 of the National Defense Authorization Act of FY 2015.
Technical Proposal
Subfactor 1: Site Visit: All offerors must attend the site visit. Offers received from contractors who have failed to visit the location will be considered unacceptable and removed from the evaluation process. The site visit will provide offerors on opportunity to verify all applicable as-built utility drawings and determine any relevant existing conditions not available on existing utility drawings. Interview the user/occupant to obtain detailed functional requirements.
Note: Any additional information and or instruction provided to vendors during the site visit that is not identified in the TWS which the contractor wishes to rely on in preparation of an offer must be confirmed with the contract specialist prior to the closing of the question period.
Subfactor 2: Understanding of the requirement and ability to meet the requirement objectives: Offerors are required to submit a written Technical Proposal for the requirement. The offeror shall demonstrate their full understanding of the TWS. In particular, the offeror shall demonstrate their capability and capacity to perform the requirements identified in the TWS and provide the stated deliverables by submitting a narrative detailing their approach. The Technical Proposal shall not include any price information. Proposals which merely offer to conduct a program in accordance with the requirements of the Government’s scope of work will not be eligible for award.
Offerors shall provide written technical information that demonstrates their qualifications to meet all requirements of the TWS.
Factor 2: Past Performance:
Offeror’s past performance will be evaluated to determine how well the offeror demonstrated compliance with prior contract requirements for work similar in complexity and magnitude to the work described in the TWS. The
Government will utilize PPIRS for those contractors having previously performed on a Government contract(s). A neutral rating would be applied for any contractor not having data available. The Government may also consider past performance information obtained through other sources.
Offerors must provide information concerning performance in providing supplies and services relevant to those required in the PWS, for the last three contracts similar in nature to this requirement, either completed or currently being performed during the last three years. Offerors shall describe the relevance of each listed contract to the current RFP’s requirements, and have an authorized representative of the company fill out the Past Performance
Questioner) Attachment II and return it the contract administration POC NLT than the closing date of the solicitation. Contracts listed may include those entered into by the Federal Government, agencies of state and local governments and commercial customers.
Part III: Price
Factor 3- Price The offeror shall carefully review the Technical Work Statement (TWS) and propose all costs that will be necessary for the offeror to successfully perform the contract.
Any information obtained will be identified as “Source Selection Sensitive Information.”

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Evaluation Criteria
Proposals submitted in response to this RFP will be evaluated as Lowest Price Technically Accepted.
Award will be made to the offeror whose price complies with the RFP, and meets the TWS requirements, represents the lowest price technically acceptable to the Government.
The Government intends to evaluate proposals and make award without discussions. Proposals should contain the vendor’s best terms regarding non-price and price factors. Additionally, the Government reserves the right to conduct discussions and request revisions to proposals if it is determined to be necessary. If a negotiation range is established, the Government may limit the number of proposals in the negotiation range to the greatest number that will permit an efficient competition among the most highly rated proposals.
Factors: Technical subfactors are equal to each other. Technical and past performance factors when combined are less important than price.

Evaluation Rating: The offeror’s proposal will be evaluated to ensure it meets the Government’s minimum requirements. The acceptability of product or service factors/subfactors will receive a rating of acceptable or unacceptable basis using the ratings in Table A-1. In order to be considered awardable, there must be an
“acceptable” rating in every non-price factor/subfactor.

Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Factor 3 – Price: Cost/Price Factor evaluation will not be given a rating; however, it will be evaluated using price analysis techniques in accordance with FAR 15.404-1(b) in order to determine that the offered price is fair and reasonable.
The Government may determine that an offer is unacceptable if the CLIN prices are significantly unbalanced. An offer price is considered to be materially unbalanced when it is based on prices significantly less for some services and prices which are significantly higher for other similar services.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (MAR 2015)
ALTERNATE I (OCT 2014)
An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (b) through (i) of this provision.
(a) Definitions. As used in this provision:
"Emerging small business" means a small business concern whose size is no greater than 50 percent of the numerical size standard for the NAICS code designated.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of
6 U.S.C. 395(c).
Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except--
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the
Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment
Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act
(50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern—
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
Small disadvantaged business concern, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

Subsidiary means an entity in which more than 50 percent of the entity is owned--

Veteran-owned small business concern means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
"Women-owned small business concern" means a small business concern—

(b) (1) Annual Representations and Certifications. Any changes provided by the offeror in paragraph (b)(2) of this provision do not automatically change the representations and certifications posted electronically on the SAM website.
(2) The offeror has completed the annual representations and certifications electronically via the SAM website accessed through https://www.acquisition.gov. After reviewing the SAM database information, the offeror verifies by submission of this offer that the representations and certifications currently posted electronically at FAR 52.212-
3, Offeror Representations and Certifications--Commercial Items, have been entered or updated in the last 12 months, are current, accurate, complete, and applicable to this solicitation (including the business size standard applicable to the NAICS code referenced for this solicitation), as of the date of this offer and are incorporated in this offer by reference (see FAR 4.1201), except for paragraphs ----------.
