C. Scope of work:

1. Remove existing roofing, flashing, rigid insulation, and miscellaneous items from the project buildings.

2. Survey condition of existing roof structure before the new roofing installation.

3. Provide a Class ‘A’ fully adhered PVC membrane roofing system with a minimum R30 rigid insulation factor and new roof walk pad.

4. Modify existing parapets (if needed), roof drain/scupper and overflow, and equipment curb to adapt the new slope.

5. Provide fall protection including guard railing, edge distance marking, and safety railing.

D. DEFINITIONS

E. OFOI: Owner Furnished, Owner Installed.

F. MFOI: Manufacturer Furnished, Owner Installed.

1.3 SUBMITTALS

A. Submit in accordance with Sections 01 33 00 and 01 33 23.

B. Submit schedule for MFOI products and equipment in accordance with paragraph 1.5.

C. Submit information on proposed laydown area in accordance with paragraph 1.6.F.

D. Submit proposed crane movement plan in accordance with paragraph 1.6.I.

1.4 MANUFACTURER FURNISHED, OWNER INSTALLED (MFOI) PRODUCTS

A. Products Furnished by Manufacturer:

1. Each MFOI product is indicated in the relevant Specification Section.

2. Unless otherwise indicated, MFOI products will be furnished at Site.

B. Owner’s and Manufacturer’s Responsibilities:

1. Manufacturer to arrange for and deliver Owner/Architect reviewed shop drawings, product data, and samples, to Architect.

2. Owner to receive designated products.

3. On Owner’s receipt of products from manufacturer, inspect products jointly with manufacturer.

4. Arrange for required Manufacturer’s service.

5. Receive, handle, and store MFOI items when required by CDCR representative, any time subsequent to been given Notice to Proceed.

6. Owner to receive products at site from Manufacturer.

7. Manufacturer to unload products delivered to site by Manufacturer. Prior to and during unloading, Owner to inspect products furnished to site for completeness and damage jointly with CDCR Representative and Manufacturer.

8. Prior to unloading, inspect products furnished by Manufacturer for completeness and damage jointly with CDCR Representative.

9. Owner to handle, store and install products.

C. Spare Parts and Extra Stock Materials:

1. Manufacturer to deliver to CDCR Representative, items designated as spare or extra stock, and place in storage at on-site location as directed.

1.5 USE OF PREMISES

A. Access to the site is available from CDCR Representative to the manufacturer. If deemed warranted by CDCR correctional staff, suspicious vehicles may be stopped and/or searched for security reasons.

B. Manufacturer to confine operations within the limits of designated construction areas unless otherwise approved.

C. Manufacturer must protect roads used to access work during the period of construction and is financially responsible for any damage and repairs to the roads beyond their current condition.

D. Limit vehicular access to the construction site to company vehicles of Manufacturer.

Manufacturer’s vehicles must be plainly marked on both sides of the exterior with Manufacturer’s name and/or company symbol.

E. Manufacturer is to confine material storage, shop areas, equipment yards, and employee parking within designated areas unless otherwise directed by CDCR Representative.

F. Laydown Area(s):

1. Manufacturer to request from CDCR Representative the assignment of a laydown area(s) within the area assigned by institution.

a. Only the area actually required by the Manufacturer will be assigned for the

Manufacturer’s use.

b. Enclose laydown area(s) within a temporary fence in conformance with Section 01

50 00 and as approved by the CDCR Representative.

c. Laydown area(s) may be located inside or outside of the secure perimeter as approved by CDCR Representative.

d. Locate Manufacturer’s site offices within Manufacturer’s laydown area outside the secure perimeter.

2. The area assigned to the Manufacturer may be improved by the Manufacturer for their use.

a. Electric power is available as indicated at the Owners expense.

b. Telephone service is available as indicated at the Owners expense.

c. Submit plan for area development for approval. Do not begin development prior to approval.

d. Manufacturer shall not contaminate the soil during occupancy of the area.

e. Upon termination of construction, Manufacturer will return area to its original condition.

f. After removal of laydown area(s) within the Secure Perimeter, Owner will conduct metal sweep. Manufacturer to obtain CDCR Representative’s acceptance of vacated area.

G. Heavy Vehicular Equipment:

1. Where transportation across the site of equipment over 10,000 pounds gross weight is necessary for Manufacturer’s operations, submit plan of proposed route for approval by CDCR Representative.

2. Do not move equipment without approved plan.

3. Manufacturer is responsible for the cost and repair of all damage created by the movement of heavy vehicles and equipment.

H. Crane Movement:

1. Plan:

a. Manufacturer to submit within 60 days of date of Notice to Proceed.

b. Manufacturer to indicate (if required) proposed areas and elevations of cut and fill for crane access.

c. Manufacturer to review and coordinate crane access plans based on actual site conditions and site underground utility plans.

d. Manufacturer to indicate and provide steel “drive” plates or other measures to protect underground utility lines and appurtenances from damage.

e. Manufacturer is responsible for the cost and repair of all damage created by the movement of its crane and equipment.

f. CDCR Representative will review plan.

g. Manufacturer to revise plan as required by CDCR Representative and resubmit.

h. Approved plan will be retained by CDCR Representative and returned to

Manufacturer.

2. Movement:

a. Crane movement is not allowed prior to approval of crane movement plan without written permission of CDCR Representative.

b. Crane movement must be in accordance with approved plan.

3. Earthwork:

a. Manufacturer to perform cut and fill operations required to accommodate crane movement.

b. Manufacturer to provide temporary culverts and grading to allow proper drainage or prevent ponding of storm water.

c. Manufacturer to immediately upon completion of crane movement for any facility, restore grading to original elevations, using materials, methods, quality control, and tolerances originally specified for affected areas.

UNIT PRICES

PART 1 GENERAL

1.1 SUMMARY

A. Section Includes

1. Measurement and payment criteria applicable to portions of the work performed under a unit price payment method.

1.2 DEFINITIONS

A. Fixed Costs: Necessary labor, materials, and equipment costs directly expended on the item or items under consideration, which remain constant regardless of the quantity of Work done.

1.3 UNIT QUANTITIES

A. Quantities indicated are for bidding and Contract purposes only.

B. If the actual Work requires more or less quantities than those quantities indicated, provide the required quantities.

1.4 INCREASED QUANTITIES, UNIT PRICE ITEMS

A. Work in excess of 100 percent, but less than or equal to 125 percent of the estimated quantity will be paid for at the unit price indicated.

B. Work in excess of 125 percent of the estimated quantity not covered by an executed change order will be paid for by adjusting the unit price.

1. The adjustment of the unit price will be the difference between the unit price and the actual unit cost. The actual unit cost will be determined in accordance with General Conditions.

2. Fixed costs will be deemed to be recovered by payments made for 125 percent of the estimated quantity, and will not be included in determining the adjustment.

1.5 DECREASED QUANTITIES, UNIT PRICE ITEMS

A. Work in the quantity of 75 percent or more, but less than 100 percent of the estimated quantity will be paid for at the unit price indicated.

B. Work greater than zero but less than 75 percent of the estimated quantity not covered by an executed change order will be paid for by adjusting the unit price, upon Contractor’s written request.

1. The adjustment of the unit price will be the difference between the unit price and the actual unit cost, including fixed costs.

2. The actual unit costs will be determined in accordance with General Conditions, inclusive, plus a markup of 22 percent and 15 percent on the actual costs for labor and materials, respectively.

3. In no case will payment exceed that which would have been made for 75 percent of the estimated quantity at the Contract unit price.

1.6 MEASUREMENT OF QUANTITIES

A. Measurement devices must be acceptable to the CDCR Representative.

B. Take all measurements and compute quantities. The CDCR Representative will verify the measurements and quantities.

1.7 PAYMENT

A. Payment Includes

1. Full compensation for all required labor, products, tools, equipment, plant, transportation, services and incidentals.

2. Erection, application or installation of an item of the Work when specifically indicated.

3. Indirect costs, overhead, and profit.

C. SUBSTITUTION SUBMITTALS: Submit in writing, on form provided as 01 25 00 - Attachment A, Notice of Request for Substitution. Notice of Request for Substitution must include complete data substantiating compliance of proposed substitution with Contract.

D. Notice requesting substitution, along with supporting documentation, must be submitted no later than 35 days from the date of Notice to Proceed.

H. Substitution Submittal Procedure:

1.4 GENERAL SCHEDULING REQUIREMENTS

A. The term “Schedule(s)” refers to the Contract Schedule and any variations, revisions, or updates thereof.

1. Baseline Contract Schedule: the Accepted Contract Schedule submission, without updates.

2. Contract Schedule: the Accepted Contract Schedule.

B. Contactor must develop and maintain a Contract Schedule for performing the work of the Contract. The Schedule will be used for planning and reporting progress during execution of the Work; form the basis of the Contractor’s monthly progress payments; and for evaluating time extensions.

1. Contractor must submit a proposed Contract Schedule within 45 days of the NTP to the

CDCR Representative. The CDCR Representative will review the proposed Contract Schedule within 14 days and provide written comments and/or provide written Acceptance of the proposed Contract Schedule. The Contractor must address and revise the Schedule within 7 days.

2. Upon the Contractor’s resubmittal of the proposed Contract Schedule, the Contractor and CDCR Representative must meet to review the schedule revisions and all responses to the written comments of the CDCR Representative. The goal of the meeting is for CDCR to have all of its comments addressed and be able to accept the proposed Contract Schedule as the Baseline Project Schedule for the project, subject to any additional revisions agreed to in the meeting.

C. Failure by the Contractor to include any element of Work required for performance of the Work or failure to properly sequence the Work will not excuse the Contractor from completing all Work within the Contract Time, regardless of CDCR's Acceptance of the Contract Schedule.

D. Preliminary Contract Schedule Requirements:

1. Develop Preliminary Contract Schedule reflecting the days from NTP to the first 90 calendar days of mobilization and construction.

2. Develop the schedule utilizing the Precedence Diagramming Model organized by a Work

Breakdown Structure that coincides with the SOV.

3. Include activities that reflect the scope of work to occur in the first 90 calendar days of mobilization and construction.

4. Submit the Preliminary Schedule to the CDCR Representative within 14 calendar days of the NTP.

5. The CDCR Representative will review the Preliminary Schedule and return with comments and / or approval within 7 calendar days of submission.

E. Baseline Contract Schedule Requirements:

1. Develop schedule utilizing the Precedence Diagramming Method organized by a Work

Breakdown Structure (WBS).

2. The Contractor must use the latest version of Primavera P6 or comparable CPM software for scheduling the work. Submittal must be in native electronic file for Contract Schedule.

3. Include activities to reflect the entire scope of work, including but not limited to;

submittals, procurement, construction phasing, and key milestones.

4. Activity data and description must provide adequate information to identify work and location.

5. After baseline acceptance, Activity description and planned duration must not change.

6. When schedule calculations are performed, the “Retained Logic” setting must be used.

7. Contract Start Milestones must be constrained by the “Start on or Before” or “Start no

Earlier than” constraints.

8. Contract Completion Milestones must be constrained by the “Finish on or Before” constraints.

9. Constraints of activities or milestones other than contractual milestones, may only be used with the agreement with the CDCR Representative.

10. Mandatory “Start On” or Mandatory “Finish On” constraints are not permitted.

11. Indicate for each activity, whether activity’s duration is in work days or calendar days.

12. An activity is defined as critical when the float is equal to zero and/or it is the longest path in the schedule.

13. Include activities for the review of key submittals by CDCR Representative; CSFM (if applicable) and other applicable regulatory agencies.

14. Include activities for Owner-Furnished Contractor-Installed equipment (if applicable).

15. Include all close-out activities such as, but not limited to the following:

a. Preparation and submittal of operations and maintenance manuals and as-built documents.

b. Demonstration and training.

c. Punch List Development / Contractor’s Correction of Punch List. Activity duration for the development and correction of the punch list must be no less than fourteen

(14) days and twenty-one (21) days, respectively.

d. Final cleanup.

e. CDCR pre-final and final inspections.

f. Contractor’s Certification of Milestone Completion.

16. Include interim progress milestones, identified by the project team in the pre-scheduling conference, that are on the critical path of the Contract Schedule.

F. Schedule of Values (SOV) Requirements:

1. Preliminary Contract Schedule SOV.

a. Provide a Preliminary SOV and Preliminary Cash Flow within fourteen calendar days of the Notice to Proceed.

b. The Preliminary SOV and Preliminary Cash Flow will be reviewed within 7 calendar days of submission.

c. The Accepted Preliminary SOV becomes the Accepted SOV for monthly progress payments for the first 90 days of the Project.

2. Baseline Contract Schedule SOV.

a. Provide the Baseline Contract Schedule SOV and Baseline Resource Allocation Flow Charts within seven calendar days of the Acceptance of the Baseline Contract Schedule.

b. The Baseline Contract SOV and Baseline Resource Allocation Flow Charts will be reviewed and returned to the Contractor with comment and / or approval within 7 calendar days of submission.

c. Monthly progress payments will not be made until the Contract Schedule and Baseline Contract SOV are Accepted by the CDCR Representative.

d. The Accepted Baseline Schedule SOV becomes the Accepted SOV for monthly progress payments on the Project.

3. SOV must correlate to the Work Breakdown Structure (WBS) in the Accepted Contract Baseline Schedule. The WBS Item level must represent:

a. The subcontractor and / or self-performed work packages.

b. Payment of job site expenses.

c. Payment of home office overhead.

d. Insurance and Bonding.

e. Mobilization.

4. Each WBS Item in the SOV must contain:

a. Baseline Budget Value.

b. Baseline Total Manpower in Man-Days (MD).

c. Baseline dates for start and finish of the WBS package

5. The elements of a Baseline Resource Allocation Flow Chart are:

a. Monthly output of project costs over the duration of the Project.

b. Monthly output of project resources (labor and material) over the duration of the

Project.

6. The WBS must be accepted by the CDCR Representative.

7. The sum of the WBS Items of the Contract SOVs must total to equal the Agreement

Amount.

8. Contractor must provide substantiation of costs for activities pertaining to administrative and engineering activities, such as submittals and shop drawings. Payment of these administrative and engineering activities will not occur until approval of submittals and shop drawings.

G. Schedule Technical Requirements:

1. All activities must be tied into the Schedule by logical restraints. The Schedule must only contain two (2) open-ended activities: NTP with no predecessor relationship, and the latest completion Milestone with no successor relationship.

2. The Schedule must not include any Start-to-Finish relationships.

3. The Schedule must not include finish-to-start relationships with positive lag. Lags in

Start-to-Start or Finish-to-Finish relationships must not exceed the duration of the predecessor or successor activity, respectively.

4. Except for Milestones, the use of constraints that override Schedule calculated early or late dates will not be allowed.

H. Schedule Updates:

1. Contractor must submit monthly progress updates to the Contract Schedule to the CDCR

Representative for review. The Accepted Schedule update submission is to be included with the SOV submission. Submittals must include a written report of key schedule activities and a native electronic file for Contract Schedule. The CDCR Representative will provide comments and directions as required.

2. Schedule updates may be submitted to the CDCR Representative for approval that include limited changes to:

a. Durations of activities.

b. Logic changes.

c. Sequence of activities:

1) These changes are to reflect the day-to-day operations of field activity, decision making, and response to owner directives. These changes are to be used to give accuracy to projections on Contract Milestones.

3. An activity that is completed but that includes a deficient Work is to be indicated as “finished” on the Schedule update, unless otherwise directed by the CDCR Representative.

4. Contract Completion Milestone dates will not be changed by submission of a Schedule Update, unless specifically authorized by a Change Order.

5. Schedule Coordination Sessions:

a. Every 90 days from NTP, the Contractor and CDCR Representative will meet to have a scheduling coordination session with all responsible individuals per trade for all activities leading up to the next significant scope of work. This session is to maintain schedule alignment with the trades, examine time impacts (if any), and validate the remaining work. If exposure is realized during this alignment, a Time Impact Analysis Charrette will be scheduled and / or schedule revision commitment date will be made. The schedule must be revised within the commitment date or after a PCO for time that has been approved following the Charrette.

I. Schedule Revisions:

1. Updating the Contract Schedule to reflect actual progress will not be considered revisions to the Contract Schedule.

2. If the CDCR Representative believes further Schedule detailing is required for the management of the project, upon the CDCR’s request, the Contractor must propose a Revised Contract Schedule within an agreed upon time period.

3. Contractor may request to revise the Contract Schedule.

J. Schedule of Value (SOV) Updates:

1. SOVs must be updated monthly for progress payments and must reflect the progress of the Contract schedule.

2. A monthly status date will be agreed to by the Contractor and the CDCR Representative to process the payment estimates.

3. The date that the updated SOV is accepted by the CDCR Representative will commence the payment processing time.

4. Payments will be administered in accordance with the General Conditions.

5. Payment for Mobilization is governed by Public Contract Code 10264. Insurance and bonds may be reimbursed separately based on paid invoices.

6. All executed Proposed Change Orders (PCOs) must be added to the SOV update at an appropriate level of detail, including responsible Subcontractor, contract value and manpower with executed Proposed Change Order and contract schedule duration.

K. Schedule of Values (SOV) Revisions:

1. Contractor must submit SOV revisions for review and Acceptance by the CDCR

Representative in a separate submittal from the SOV monthly updates. Submittal must include a brief narrative explaining revisions. SOV revisions can be submitted concurrent with, or in advance of, the Monthly Submittal.

2. The CDCR Representative may ask for an update in the SOV and Cash Flow to reflect the current project status, PCOs and Change Orders executed since the original Notice to Proceed of the project.

L. Time Impact Analysis (TIA):

1. The Contractor must quantify and provide an estimate of the impact to the Contract Time using the Contract Schedule and Project Documents.

2. Contractor must provide a brief narrative explaining the cause and effect of the impact, supporting documents and schedule calculation.

3. The CDCR Representative will review the Contractor’s request and provide a response.

The project team may choose to meet as a collaborative unit (TIA Charrette) to respond, negotiate and/or resolve a TIA that has been identified and documented.

4. Time extensions will be administered in accordance with General Conditions.

5. The delay demonstrated by the impacted Schedule must not exceed actual delay when the analysis is performed after the fact. The TIA must incorporate all actual dates and durations known as of the time of its submittal.

6. Where the Contractor is requesting compensation for a delay, the TIA must demonstrate lack of concurrency with all other Contractor-caused delays within that time period. A delay will be considered a concurrent delay when it is determined to be an actual independent delay of which the effect on the Contract Milestone overlaps with that of the Compensable Delay in question. A Concurrent Delay may impact any path of activities, resulting in negative Total Float, and not necessarily the schedule’s longest critical path.

7. To establish entitlement to compensation, all activity paths and their respective float must be examined. The Contractor must demonstrate that but-for the CDCR-caused delay, the Contractor could have finished the Work in accordance with the Accepted Contract Time.

M. Weather:

1. Normal inclement weather conditions, also referred to as anticipated weather days, will be considered and included in the planning and scheduling of all Work influenced by high or low ambient temperatures, wind, and / or precipitation to ensure completion of all Work within the Contract Time.

2. “Rain Day” will only be a day where rain precipitation is greater than 0.10” within a 24-hour period as measured at the weather. No time extensions will be allowed due to precipitation unless Rain Days occurring during a month exceed the average number of Rain Days provided in the Supplementary Conditions.

3. Work must be planned to minimize the impact of rain and include the grading of the Work area, installation of dewatering pumps and provision of covers.

4. Keep drainage and dewatering systems operable 24 hours per Day and 7 Days each week throughout construction.

1. The Contractor must submit, on a weekly basis, a Weekly Work Plan (WWP). The plan must list the activities in progress or completed during the previous week and the activities scheduled for the succeeding two (2) weeks.

2. The WWP must be generated from the Contract Schedule timeframes and Milestones. It is to include further details to provide a day-to-day plan of upcoming work by the Contractor and each Subcontractor. This Weekly Work Plan may be maintained in the Contract Schedule software or in a software of the Contractor’s choosing, with the approval of the CDCR Representative.

O. As-Built Schedule:

1. As a condition precedent to the release of retention and making final payment, submit an

"As-Built Schedule," as the last Schedule update showing all activities at 100 percent completion and indicating Actual Start and Finish Dates. This Schedule must reflect the sequence in which the Project was actually constructed.

1.2 SUBMITTAL LOG

A. Within 45 days after Notice to Proceed, Contractor must furnish to CDCR Representative, an electronic version and four printed copies of the Submittal Log. The CDCR Representative will review and approve the Submittal Log or return it with comments for correction or revision.

B. Submittal Log must include all submittals required by the Contract Documents and include the following information for each of the Contractor’s submittal packages:

1. Specification Section number and title.

2. Submittal Title / description of the Work covered.

3. Name of responsible entity (CONTRACTOR, CDCR, Subcontractor…etc).

4. Submittal category (action or informational).

5. Provide written signatures of subcontractors indicating their review and approval of

Submittal Log dates and information for their submittals.

6. Identify deferred submittals which must be reviewed by state departments other than

CDCR and/or local regulatory agencies.

7. Identify critical and near critical submittals as defined in Section 01 32 00, Scheduling.

8. If Submittal is included in Contract Schedule per Section 01 32 00, the following additional information must also be included in Submittal Log:

a. Corresponding Contract Schedule Activity ID/number.

b. Contractor’s scheduled date for…
