CONTINUATION OF SF-1449, BLOCKS 19-24

SCHEDULE OF SUPPLIES/SERVICES

The contractor shall be capable of providing outpatient transitional drug abuse treatment (TDAT) and mental health services to offenders confined in community-based programs. Services are to be provided at a location that is in and/or near the following areas of Cape Cod - Falmouth, Pocasset, Brockton, Hyannis, Orleans, and Provincetown, Massachusetts.

All references to Residential Re-Entry Center (RRC) and Community Correctional Center (CCC) shall be treated equally for the purpose of this contract.

The performance period for the resulting contract will be for a one-year base period (to begin upon the effective date of contract award) and four additional one-year option periods. The anticipated total contract period is five years.

Services under this contract may be subcontracted.

DECISIONAL RULE CRITERIA

Each quotation will be initially reviewed to determine that all document submission requirements listed under Addendum to FAR 52.212-1, Instructions to Offerors–Commercial Items, are met.

By using the documentation submitted with each quotation, an initial review will also be conducted to determine whether or not it meets the minimum requirements contained in the Decisional Rule Criteria below. Any quotation not meeting this criteria may not receive any further consideration for award.

Quotes must clearly demonstrate at the time of submission, unless otherwise stated, the capability to meet the Decisional Rule criteria below. Quotes will be rated “go” or “no-go” based on the Decisional Rule criteria. Quoters receiving a “no-go” rating will be advised of their elimination from the procurement. Quoters receiving a “go” rating shall be considered for award.

Quoters shall clearly demonstrate the capability to meet all of the following Decisional Rule criteria:

1. The proposed facility is within the geographical restriction provided in Section 20, Description of Services, on the SF-1449. In addition, the proposed facility meets all licensing, certification, zoning and code requirements as stipulated by all government or other controlling authorities.

2. An approval memorandum from the RRC authorized negotiator is submitted with the quote if services are to be provided at the local residential reentry center (RRC). The RRC must be licensed to provide the services.

3. Both the primary contract holder and direct service provider must be a licensed/certified professional in the state in which service is provided with documented experience in providing all services listed in the Schedule of services.

A copy of their current license in the state where service will be provided must be submitted.

4. In addition, a copy of a current license, from the licensing board of the State, for each person providing direct service to Bureau inmates must be submitted with quote.

5. The contractor has a board certified or board eligible member of the American Board of Psychiatry or the American Osteopathic Board of Neurology and Psychiatry on staff or under contract to provide the medication monitoring services. The contractor may have other qualified practitioner with prescriptive authority who meet the standards of practice established in the state in which service is provided. The individual’s license must be submitted with the quote.

PRICING

Prices offered to the Government shall be as low as or lower than those charges to the supplier’s most favored customer for comparable quantities under similar terms and conditions, in addition to any discounts offered for prompt payment.

DELIVERIES

In accordance with Federal Acquisition Regulation (FAR), Part 16.505, Ordering, and the clause located in FAR, Part 52.216-18, Ordering, of this solicitation, any supplies or services to be furnished under this contract shall be ordered by issuance of task orders by a warranted Contracting Officer in the Privatized Corrections Contracting Office, or the United States Probation Office.

BILLING INFORMATION

The Government will make payment on a monthly basis via Electronic Fund Transfer. Invoices with the contract number should be submitted on a monthly basis with an original and two copies to the Regional TDAT Coordinator indicated in Item 18 of the SF-1449.

The United States Probation Office is an authorized user under this contract.

The Pricing Schedule begins on the next page. All quantities provided thereon are estimates only.

A.3 52.216-18 ORDERING (OCT 1995)

(a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated in the Schedule. Such orders may be issued from the first day through the last day of the contract's effective period.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

© If mailed, a delivery order or task order is considered "issued" when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule.

A.4 52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than one for any single item listed on the SF-1449 continuation pages 4 through 7in blocks 19-24, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor--

(1) Any order for a single item in excess of the estimated quantities identified on the Standard Form

1449 (Block 21, Quantity) within the current contract performance period;

(2) Any order for a combination of items in excess of the estimated quantities identified on the

Standard Form 1449 (Block 21, Quantity) within the current contract performance period or

(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section.

© If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the

Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and © of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 7 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

A.5 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor prior to expiration of the current contract period; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

© The total duration of this contract, including the exercise of any options under this clause, shall not exceed five years (excluding the exercise of any option under the clause 52.217-8, Option to Extend

Services).

A.6 CONTRACT M ONITOR (CM) (AUG 2008)

(a) The Regional TDAT Coordinator of the Federal Bureau of Prisons, Northeast Regional Office, Philadelphia, PA (or others later assigned by the Contracting Officer), is/are hereby designated to act as the Contract Monitor (CM) under this contract.

(b) The CM is responsible, as applicable, for: receiving all deliverables, inspecting and accepting the supplies or services provided hereunder in accordance with the terms and conditions of this contract;

providing direction to the contractor which clarifies the contract effort, fills in details or otherwise serves to accomplish the contractual Scope of Work; evaluating performance; and certifying all invoices/vouchers for acceptance of the supplies or services furnished for payment.

© The CM does not have the authority to alter the contractor's obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If as a result of technical discussions it is desirable to alter/change contractual obligations or the Scope of Work, the

Contracting Officer shall issue such changes.

A.7 DEPARTMENT OF JUSTICE (DOJ) RESIDENCY REQUIREMENT - BUREAU OF PRISONS

CLAUSE (JUN 2004)

For three of the five years immediately prior to submission of an offer/bid/quote, or prior to performance under a contract or commitment, individuals or contractor employees providing services must have:

1. legally resided in the United States (U.S.);

2. worked for the U.S. overseas in a Federal or military capacity; or

3. been a dependent of a Federal or military employee serving overseas.

A.8 CONTINUING PERFORMANCE DURING A PANDEMIC INFLUENZA OR OTHER NATIONAL

EMERGENCY (MAY 2008)

During a Pandemic or other emergency, we understand that our contractor workforce will experience the same high levels of absenteeism as our Federal employees. Although the Excusable Delays and Termination for

Default clauses used in Government contracts list epidemics and quarantine restrictions among the reasons to excuse delays in contract performance, we expect our contractors to make reasonable effort to keep performance at the acceptable level during emergency periods.

The Office of Personnel (OPM) has provided guidance to Federal managers and employees on the kinds of actions to taken to ensure the continuity of operations during emergency periods. This guidance is also applicable to our contract workforce. Contractors are expected to have reasonable policies in place for continuing work performance, particularly those performing mission critical services during a pandemic influenza or other emergency situation.

The types of actions a Federal contractor should reasonably take to ensure performance are:

• Encourage employees to get inoculations or follow other preventative measures as advised by the Public

Health Service.

• Contractors should cross train workers as backup for all positions performing critical services. This is particularly important for work such as guard service where tele-work is not an option.

• Implement tele-work to greatest extent possible in the workgroup so systems are in place to support successful remote work in an emergency.

• Communicate expectations to all employees regarding their roles and responsibilities in relation to remote work in the event of a pandemic health crisis or other emergency.

• Establish communication processes to notify employees of activation of this plan.

• Integrate pandemic health crisis response expectations into tele-work agreements

• With the employees, assess requirements for working at home (supplies and equipment needed for an extended telework Period). Security concerns should be considered in making equipment choices; agencies or contractors may wish to avoid use of employee’s personal computers and provide them with PCs or laptops as appropriate.

• Determine how all employees who may telework communicate with one another and with management to accomplish work.

• Practice telework regularly to ensure effectiveness

• Make it clear that in emergency situations, employees must perform all duties assigned by management, even if they are outside usual or customary duties.

• Identify how time and attendance will be maintained.

It is the contractor’s responsibility to advise the Government Contracting Officer if they anticipate not being able to perform and to work with the Bureau of Prisons (BOP) to fill gaps as necessary. This means direct communication with the Contracting Officer or in his/her absence, the Contracting Officer’s Technical Representative, via telephone or e-mail messages acknowledging the contractor’s notification. The incumbent contractor is responsible for assisting the BOP in estimating the adverse impacts of nonperformance and to work diligently with the BOP to develop a strategy for maintaining continuity of operations.

The BOP does reserve the right in such emergency situations to use Federal employees, employees of other agencies, contracting support from other existing contractors, or enter into new contracts for critical support services. Any new contracting efforts would be acquired following the guidance in the Office of Federal Policy issuance “Emergency

Acquisitions”, dated May 2007 and Subpart 18.2, emergency Acquisition Flexibilities, of Federal Acquisition

Regulations.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Quotes received after the quote deadline will be handled in accordance with FAR 52.212-1(f). Each quoter shall submit the following forms, clauses and statements with his/her quote. Failure to do so may cause your quote to be considered unacceptable.

1. Completed SF 1449 (blocks 12, 17a, 17b, 23, 24, 30a, 30b, and 30c).

2. Signed copy of any solicitation amendments.

3. Completed copy of the representations and certifications at FAR 212-3 (see paragraph (k) of that clause for those representations and certifications that the quoter shall submit electronically).

4. Completed Federal Bureau of Prisons Service Contract Business Management Questionnaire.

5. Copy of Bank Notification Letter.

6. Proof that the proposed facility is licensed/certified (as required by the controlling state, county, city or other controlling public entities authority).

7. Self-certification that the proposed facility meets all local zoning and fire codes. If services are to be performed at the local Residential Re-entry Center (RRC) a letter from the RRC’S authorized negotiator stating the quoter has permission to use the RRC must be provided with the quote.

8. Proof that the proposed facility is within the geographic restriction stated in block 20, Description of

Services on the SF-1449.

9. Copies of licensed/certified clinical professional (e.g. psychologist, social worker, etc.) with documented substance abuse training to oversee the program. Individuals shall be licensed in the state in which services will be provided to offenders.

10. Documentation of having a board certified/board eligible member of the American Osteopathic Board of Neurology and Psychiatry on staff or under contract to provide the medication monitoring service.

11. Proof of Indemnification and Medical Liability Insurance in the amount of $1,000,000.00.

12. Documentation proving capability to meet all requirements defined on page 2 under the heading

“Decisional Rule Criteria.”

Quoters who fail to furnish any of the above submission requirements may be excluded from consideration.

A.14 52.212-2 EVALUATION - COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, based on the lowest evaluated price and other non-price factors. Prior to evaluating any offer, the Government will first determine if:

1. The quote meets the minimum requirements outlined in the Decisional Rule Criteria (see Continuation

Page 2of SF 1449, Decisional Rule Criteria), and

2. Price will be the deciding factor among offers found to be acceptable in the above non-price factors.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

© A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or Part of an offer) whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
