DEPARTMENT OF JUSTICE

FEDERAL BUREAU OF PRISONS

JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

Pursuant to the Federal Acquisitions Regulation (FAR} Subpart, 6.302-1 and the Bureau of Prisons Acquisition Policy Subpart 6.304(b}, the Federal Bureau of Prisons has determined the use of the other than full and open competitive procedures is justified for this procurement action.

1. Contracting Agency - United States Department of Justice, Federal Bureau of Prisons, Central Office, Administration Division, Acquisitions Branch, National Acquisitions Section.

2. Description of Action - The Psychology Treatment Programs has a requirement to educate psychology staff on various treatment methods for inmates. The Bureau determined that providing e-learning modules is an effective way to provide educational training to staff located across the United States with minimal work interferences. The Bureau requires the perpetual license to these modules to maintain access to the content. The requirement is a one-time purchase order.

3. Description of Supplies/Services Required to Meet the Agency's Needs - Inclusive of the Estimate Value - The Psychology Treatment Programs Protocol for the Bureau consists of the following training modules for staff:

• Understanding How People Change

• Motivation for Change

• Cognitive Behavioral Therapy Pt. 1

• Cognitive Behavioral Therapy Pt. 2

• Criminality

• Addressing Alcohol and Other Drug Problems

• Basic Counseling Skills

• Facilitating Journal Group

• Understanding the Modified Therapeutic Community

• Small Therapy Group Facilitation Pt. 1

• Small Therapy Group Facilitation Pt. 2

• Documentation and Treatment Planning

The estimated value for perpetual E-Leaning licenses located on the Bureau's intranet is not expected to exceed

4. Statutory Authority Substantiating this Action - 41 u.s.c.

3304(a) (7), Use of noncompetitive procedures

5. Demonstration of the nature of the acquisition requires use of the authority cited - The Change Companies collaborated with the Bureau's Psychology staff to develop e-learning protocols based on the Bureau's Psychology Treatment Program journals several years ago. The e-learning modules provide training to all the Psychology Treatment Programs staff administering he Programs. Treatment specialists may earn continuing education credits to maintain existing certification. The Change Companies and the Bureau's Psychology staff developed the e learning protocols together; therefore, there are no other sources available that currently have the modules tailored for Bureau use.

6. Efforts to Obtain Competition - The Contracting Officer will post the justification on Federal Business Opportunities. After the Bureau obtains the perpetual licenses for the e-learning modules, the Bureau will obtain competition when required updates are needed on the modules. The perpetual license includes source code. Competition would be obtained for programming to update the modules.

7. Contracting Officer's Fair and Reasonable Cost Determination. Market research revealed that the market price is approximately for the creation of a one hour e learning module. The Bureau has 36 hours of e-learning modules.

The market price is around to obtain 36 hours of e learning modules. .The Bureau paid for the product development of each e-learning module. Additionally, the Bureau has continued to pay for the annual licensing fee. The aggregate amount for the development of e-learning modules and annual licensing fee the Bureau paid is . The co previously evaluated solely on the licensing fee. Upon re evaluating the entire component, the CO has determined that price to be fair and reasonable to own the perpetual license.

8. Market Survey -The Change Companies collaborated with the Psychology Staff to create the e-learning modules. There are no resellers of the collaborative material.

9. Other Factors - The Change Companies worked together with the Bureau to create the e-learning modules. The Bureau continues to have an e-learning requirement, and The Change

Companies is the only available source who can provide the required perpetual licenses the Bureau needs. No resellers are available.

New treatment staff is required to complete Fundamentals of Drug Treatment, Part I within one year of starting the position.

The Bureau anticipates utilizing the e-learning modules for the next 10-15 years for staff training.

A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required The usage of the e-learning modules are a continual need for psychology staff. Therefore, by obtaining the perpetual e learning licenses for unlimited access for Bureau Psychology staff on the Bureau's intranet indefinitely would eliminate the sole source annual licensing fee.
