Environmental Protection Agency Chemical Analysis of Flame Retardants

This is a Request for Quote (RFQ) for environmental services prepared in accordance with FAR Part 13.

1. DESCRIPTION OF REQUIREMENT

AED (US Environmental Protection Agency, National Health and Environmental Effects Research Laboratory, Atlantic Ecology Division) is conducting studies to determine the ecological effects of chemical flame retardants (FRs), specifically including the analyte 2-ethylhexyl 2,3,4,5-tetrabromophthalate (TBPH) in media (such as food and sediment) and biological samples (fish and worm tissues). The goals of this project will be supported by characterizing the chemical contamination of FRs in laboratory-generated and field-collected samples. This Purchase Order will require the vendor to analyze a minimum of 100 and a maximum of 200 samples of media and biological tissues (~1 g). The EPA will provide the vendor with these samples.

Period of Performance: The anticipated Period of Performance for this effort is from date of award plus two (2) years.

Place of Performance: The vendor shall perform work off-site at their facility.

Contract Type: The Government contemplates award of an IDIQ contract with a Firm-Fixed Price CLIN 0001 for the minimum order of 100 samples and a Fixed Unit Price CLIN 0002 for each additional sample ordered by EPA, up to 100.

2. REQUEST FOR QUOTE INSTRUCTIONS

Submission Delivery- Deliver your quote via e-mail to the Contracting Officer, Christie Deskiewicz, at deskiewicz.christie@epa.gov, and to the COR, Diane Nacci, at Nacci.diane@epa.gov. The email shall contain the quote in two (2) separate files, one (1) for the Technical Quote and one (1) for the Price Quote. The Quote must be received no later than Thursday, August 13, 2015 at 3:00 pm EST.

Questions- All questions regarding this quote shall be submitted via e-mail to deskiewicz.christie@epa.gov and to Nacci.diane@epa.gov no later than Thursday, August 6, 2015 at 3:00 pm EST.

Offeror shall furnish the quote in two separate volumes or electronic files as follows:

Volume I Technical Quote

Volume II Price Quote

2a. VOLUME I: Guidance on submitting the Technical Quote

The written Technical Quote shall be prepared using the following guidance:

Quantity - The offeror shall submit 1 electronic copy of the Technical Quote in its own volume via email to the Contracting Officer. The electronic copy of the Technical Quote shall be provided in either a .doc, .docx or searchable .pdf format. In addition, all files shall be virus free, non-corrupted, and contain no password protection.

Organization - The offeror’s quote and supporting documentation must provide a sufficient basis for a thorough evaluation of the quote and provide the information needed to evaluate the quote in accordance with the evaluation factors set forth in Section 3 of this RFQ, evaluation factors for award. It is suggested that the quote clearly indicates the following sections:

Volume I: Technical Quote

Section 1 Technical Approach

Section 2 Technical Experience

Format- The Technical Quote shall be written to include a cover page with the solicitation mailto:deskiewicz.christie@epa.gov mailto:deskiewicz.christie@epa.gov mailto:Nacci.diane@epa.gov number, date of submission, offeror’s corporate name, address, phone, fax, Data Universal Numbering System (DUNS), tax identification number (TIN), Point of Contact (POC) name, POC title, POC phone number, POC e-mail address, and the name, title and signature of the authorized representative. This section shall also include a table of contents identifying the sections of the Technical Quote.

Prohibition of Cost Data - No cost or pricing information shall be included in the Technical Quote. Un-priced details on labor source, material, travel, and other direct costs shall be presented using exhibits and formats that will facilitate a comparison with the associated costs in your Price Quote.

Exceptions - Any exceptions or conditional assumptions taken with respect to the requirements of this RFQ shall be fully explained in the quote. Please note, however, that exceptions or deviations may not be in the best interest of the Government to consider your quote for award without discussions.

Sufficiency - The information provided in the technical quote should be concise, factually complete and responsive. The offeror must clearly demonstrate their ability to meet all the requirements contained in this RFQ. The technical quote must be sufficient to explain how you propose to comply with the Statement of Work, including a full explanation of the techniques and procedures you propose to follow. The Government will not consider information for an offer that is incorporated into the technical quote by reference.

2b. VOLUME II: Price Quote Instructions

These instructions are to assist the offeror in submitting information required for EPA to evaluate the reasonableness of its proposed cost/price. The Offeror’s quote shall be sufficiently detailed to demonstrate its reasonableness. EPA will consider a quote that offers all services as well as teaming arrangements that are necessary to provide the services specified herein. For pricing purposes, the vendor shall assume an estimated start date of August 26, 2015.

The cover page shall include the following statement:

“This quote is submitted in response to the Request for Quote for the “Chemical Analysis of Flame Retardants” requirement. By submitting this quote, the offeror, if selected for discussions, grants the contracting officer or an authorized representative of the contracting office the right to examine, at any time before award, any of those books, documents or other records directly pertinent to the information requested or submitted.”

Vendors shall submit a final price quote, separate from the technical quote, to perform the services outlined in the SOW. The pricing section shall be broken down into two parts:

SECTION 1 – Labor Rates

In this section, the offeror shall provide a spreadsheet (in excel) of labor rates for all proposed contract labor categories to complete the requirement. Labor rates shall be hourly, fixed, and fully burdened.

SECTION 2 – Total Contract Price

In this section, the offeror shall provide an excel spreadsheet calculating the total contract price.

Total Contract Price = CLIN 0001 + CLIN 0002.

The vendor shall clearly articulate the build-up of the total price, which should include:

1) CLIN 0001, the Firm-Fixed price component of the first 100 samples analyzed, and

2) CLIN 0002, the Fixed Unit Price component for the remaining 100 potential samples.

For each of these CLINs, the offeror shall articulate the proposed labor categories and rates, estimates for level of effort for each labor category, ODCs, and the overall contract price for the contract. Each of these factors must be clearly broken out.

IMPORTANT NOTE 1: The successful offeror’s total contract price will be used as part of the Government’s price evaluation and will represent the successful offeror’s contract value at time of award. The offeror’s quotes must be valid for 180 days after submission of quote.

IMPORTANT NOTE 2: The unit price samples in CLIN 0002 shall be performed and paid for on a unit price basis for the number of units actually performed and accepted, at the firm fixed unit prices set forth in the vendor’s quote. At no point shall the vendor shall perform work exceeding the ceiling price for CLIN 0002 without prior written approval from the Contracting Officer.

3. EVALUATION FACTORS FOR AWARD

Evaluation for this Request for Quote will be based on the Technical Approach, Technical Experience, and the price of the vendor’s quote. After quote assessment, the contracting officer (CO) may obtain additional information from and negotiate with that vendor to improve the terms of the deal reflected in its quote. If the contracting officer is unable to negotiate a favorable deal with the vendor, the contracting officer reserves the right to negotiate and reach agreement with another firm.

EVALUATION FACTORS FOR AWARD (EPAAR 1552.215-71) (AUG 1999)

The reviewer will assign an adjectival rating to each technical quote based on the two technical criteria: Technical Approach and Technical Experience.

Adjectival Description Exceptional Greatly exceeds all minimum requirements of the criteria; has a high probability of success; contains no weaknesses or deficiencies.

Good Exceeds all the minimum requirements of the criteria; has an above average probability of success; contains no significant weaknesses and only minor, correctable weaknesses exist.

Acceptable Meets all of the minimum requirements of the criteria; has an average probability of success; no significant weaknesses or any of the deficiencies can be corrected.

Marginal Fails to meet one or more of the minimum requirements of the criteria;

low probability of success; major weaknesses and/or significant number of deficiencies exist.

Unacceptable Fails to meet any of the minimum requirements of the criteria; needs major revisions; very low probability of success.

3a. TECHNICAL EVALUATION FACTORS

SECTION 1 – Technical Approach – (FACTOR 1)

In this section the offeror shall discuss its technical ability to perform this requirement as evidenced by the offeror’s demonstration of:

Availability to receive the samples submitted by EPA when necessary Efficiently and accurately analyzing samples in accordance with the methods and standards depicted in the SOW.

Its approach to thoroughly documenting and providing all required and relevant information, including QA/QC data, as outlined in the SOW.

SECTION 2 – Technical Experience – (FACTOR 2)

The offeror will be evaluated on the adequacy of the specific, relevant experience in providing services similar in analysis type and sample size described in the Statement of Work. The offeror shall provide at least two (2) references for which they have performed or are delivering services of similar analysis type and sample size within the past three (3) years. The offeror shall include client names, nature of work performed, complexity, and dollar amount. Specifically, the offeror shall be sure to include how its experience for the references are applicable to carrying out the current methodology under this SOW (i.e. analytical methods and standards), and complying with the Quality Assurance Project Plan for this requirement.

3b. PRICE EVALUATION FACTOR

Award will be made to the offeror whose offer represents the best value to the Government considering the factors referenced above. For this solicitation, all evaluation factors other than cost or price when combined are significantly more important than cost or price.

4. BASIS FOR AWARD

Technical approach and technical experience when combined are significantly more important than price.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

Statement of Work

Project Name: Chemical analysis of Flame Retardants

General Description: AED (US Environmental Protection Agency, National Health and Environmental Effects Research Laboratory, Atlantic Ecology Division) is conducting studies to determine the ecological effects of chemical flame retardants (FRs), specifically including the analyte 2-ethylhexyl 2,3,4,5-tetrabromophthalate (TBPH) in media (such as food and sediment) and biological samples (fish and worm tissues). The goals of this project will be supported by characterizing the chemical contamination of FRs in laboratory-generated and field-collected samples.

General requirements: The vendor shall provide the necessary personnel, facilities and equipment, and otherwise do all things necessary for, or incidental to complete the following task.

EPA Responsibilities: AED will provide the vendor with a minimum of 100 and a maximum of 200 samples of media and biological tissues (~1 g). These samples will be submitted in sealed foil packets that have been loaded, labeled and sealed according to the contractor’s instructions.

Each set of samples will be accompanied by electronic files providing a complete listing of all samples provided. AED will ship samples overnight on dry ice by public carrier.

Vendor Responsibilities and Task Description:

1. Methods: The vendor shall provide analysis of samples exactly as described in the specific high quality scientific manuscripts, La Guardia et al. 2012 and 2013 (See Attachments A and B), so that data shall be exactly comparable to data provided in these publications. Specified FR analyte and total lipid (tl) will be measured for each sample.

Briefly, samples shall be subjected to accelerated solvent extraction with methylene chloride; surrogate standards shall be added to each sample prior to extraction. Extracts shall be purified by size exclusion chromatography (SEC), and each post-SEC extract shall be reduced in volume, added to the top of a solid phase 2-g silica glass extraction column and eluted with 3.5-mL hexane (fraction one), followed by 6.5 mL of 60:40 hexane/DCM and then 8 mL DCM (fraction two). The second fraction, containing the compounds of interest, shall be reduced in volume and solvent exchanged to hexane.

Decachlorodiphenyl ether shall be added as the internal standard; identification and quantitation shall be done by ultra-performance liquid chromatography (UPLC)/atmospheric pressure photoionization (APPI) tandem mass spectrometry (MS/MS). Blanks shall be included, and analyses shall be flagged if any targeted compounds are above the quantitation limit (QL) of 1 ng g−1, dry weight (dw).

Sample analysis shall include the following QA/QC elements:

The mean variance of all analytes of interest in standard reference materials shall be documented in the QAPP and reported for each batch of samples. The vendor shall re-analyze (at no cost to the Government) samples if results of the blanks or standards are deemed unacceptable for the methods utilized. The vendor shall permit QA audit of laboratory and/or data entry procedures by an authorized agent of EPA at any time while conducting the analyses (given advance notification).

2. Data reporting requirements - A written report detailing the methods used and all final data reports shall be submitted to the Government in both hardcopy and electronic formats; electronic data shall be in ASCII comma-delimited or Excel format. Analytical results for each sample shall be linked to the Sample ID code designated by the US EPA;

in addition, all requested QA/QC data shall be included in each final report-for both hardcopy and electronic formats. Any laboratory notes discussing problems encountered shall be included as an appendix to this report. Original records, such as laboratory notebooks and chromatograms, shall be retained for three years following final report submission; copies may be requested to be sent to the EPA up to the three year period.

Sample results shall be reported both as ng g−1, dw, as well as ng g−1, tl.

3. Audits and Performance Reviews - With advance notice, the US EPA reserves the right to request that any data files or records relevant to the performance of this scope of work be made available for review. A routine audit of data quality may be scheduled after conclusion of the work; if so, the vendor shall be provided with a list of elements to be reviewed as well as a reasonable time frame to prepare for the audit.

Schedule and Delivery of Performance:

A report of analytical results shall be delivered within 90 calendar days following receipt of samples by the vendor.
