RFQ-CSU-21-008-JJP
The Billings Area – Crow Service Unit (CSU), Indian Health Service (IHS) is requesting quotes in response to RFQ-CSU-21-010-JJP for Solid Waste Disposal Services, Crow Service Unit.
The CSU/IHS intends to award One Firm Fixed Price Purchase Order for Solid Waste Disposal Services as provided in the scope of work
The procurement is conducted under Federal Acquisition Regulations (FAR) Part 13, Simplified Acquisition Procedures, and FAR Part 37.101, Non-Personal Services, Subject to the Service Contract Act Wage Determination Number: 2015-5397 Revision: 12 Date: 12/21/2020. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Regulation (FAR) Circular FAC 2021-05
The associated North American Industrial Classification System (NAICS) code for this procurement is: 562111 and the small business size standard is $41.5 million.
This Solicitation will be an all or none basis, meaning all Contract Line Item Numbers (CLIN) must be fulfilled, partial submittals will not be accepted.
If Freight will be charged, then FOB destination must be included into the quote.
1. DESCRIPTION OF SERVICES/SUPPLIES:
The Contractor shall provide waste receptacles, complete pick-up, transportation off-site, destruction and disposal of services for regulated Solid Waste generated at the CSU locations. Contractor shall provide an all-inclusive rate (including time, travel and labor costs, pickup fee, fuel surcharge fees) for weekly services.
a) The Contractor shall provide 44 waste receptacles to the CSU Locations in Crow Agency, Lodge Grass and Pryor Montana, see section 4 for details. any spills, damage to containers, or environmental contamination or damage caused by regulated Solid Waste collected shall be cleaned, repaired or corrected at the expense of the contractor. The Contractor shall provide and maintain equipment at the IHS facilities to be used for Solid Waste Removal Services. The Government shall have the right to approve and inspect all such equipment. Credit will be provided to the Government whenever it is determined that overage charges resulted from defective equipment.
b) The Contractor shall pickup and empty waste receptacles in accordance with industry standards. The Contractor shall observe all Federal, State, and local laws, or any other regulations and procedures relative to the collection, transport, handling, storage, destruction, disposal, tracking, recordkeeping, manifesting, and documenting of the handling of regulated medical waste when providing regulated medical waste removal services. Once solid waste is collected it is the Contractors responsibility to ensure proper disposal.
c) The following locations are to be serviced; Crow Service Unit, Pryor Health Clinic, and the Lodge Grass Clinic.
d) Copies of all current licenses and permits shall be submitted upon request.
e) The Contractor shall have in place and maintain a valid contingency plan to meet the requirements of the contract whenever regulated Solid waste cannot be handled by or at the primary transportation or processing facilities due to interruption of service or failure of equipment. The Contractor shall incur all costs associated with fulfilling this contingency plan as well as alternate contingency plans at no additional expense to the Government. Written documentation shall be made available upon request to the Government that the contingency plan is in accordance with all Federal, State, Municipal and local specifications and regulations for the transportation, storage and disposal of regulated Solid waste.
f) Responsibility for all regulated Solid waste removed by the Contractor shall pass from the Government to the Contractor upon receipt of such regulated Solid waste. Each vehicle/truck used for this contract shall be placarded in accordance with DOT regulations.
g) The Contractor shall only respond to requests for service from the Contracting Officer or Housekeeping Supervisor Daniel Brien, Daniel.brien@ihs.gov. If service is requested from any other source, the Contractor is to advise the caller of the requirement and refuse to respond. Any billing resulting from unauthorized service will not be paid by the government.
h) Government property shall in no way be damaged, damaged property shall be repaired at the contractor’s expense.
2. SCHEDULING
The Contractor shall provide services covered by this contract as defined herein. The Contractor shall not be required, except in case of emergency, to furnish such services on a federal holiday or during off duty as described below. The following terms have the following meaning: (a) Normal Work Hours: Monday through Friday, 8:00 AM to 5:00 PM, excluding Holidays. (b) Federal Holidays: The federal holidays observed by the Federal Government are: New Year’s Day; Martin Luther King, Jr.’s Birthday; Presidents Day;
Memorial Day; Independence Day; Labor Day; Columbus Day; Veterans Day;
Thanksgiving; and Christmas Day. When one of the holidays falls on Sunday, the following Monday shall be observed as a federal holiday. When a holiday falls on a Saturday, the preceding Friday shall be observed as a federal holiday by U.S. Government Agencies. Also included would be any day specifically declared by the President of the United States of America as a federal holiday. The contractor shall collect the regulated solid waste at precisely One (1) week intervals on the same day of the week. (i.e. if the pick up day is Monday, then every pick up thereafter shall be on a Monday).

5. PRICE SCHEDULE:
Contractor shall provide an all-inclusive rate for weekly services including travel and labor costs for each fiscal year shown in the price schedule.

6. PERIOD OF PERFORMANCE:
Base Year 07/01/2021 to 06/30/2022 Option Year 1 07/01/2022 to 06/30/2023 Option Year 2 07/01/2023 to 06/30/2024
7. PAST PERFORMANCE:
The Contractor must demonstrate their record of successful performance in past contracts and/or jobs that display technical capability and the ability perform the tasks described in the statement of work
8. EVALUATION FACTORS:
The Government will award a purchase order resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
a. Technical = 70 points. Offeror must submit a technical proposal, not to exceed 3 pages, that specifies requirements in the request for quotation.
b. Past Performance = 30 Points. Offerors must demonstrate their record of successful performance in past contracts and/or jobs. The Government is seeking to determine whether the Offeror has the experience that will enhance its technical capability to perform the tasks described in the statement of work. The offeror must list at least three contracts/jobs and include the following information. (1) Name of Government agency/Company; (2) Contract number, if applicable; (3) Dates of Service/Employment; (4) Total contract value/Hourly wage; (5) Description of contract work/Job duties; (6) Contracting Officer/Company Manager and telephone number; (7) Program Manager and telephone number, if applicable
9. CONTRACTING OFFICER AUTHORITY:
Authority to negotiate changes in the terms, conditions or amounts cited in this contract is reserved for the Contracting Officer.
10. TECHNICAL ADVISOR:
The technical advisor will be Dionne PrettyOnTop, Dionne.prettyontop@ihs.gov, CSU Safety Officer. Monitoring of contract compliance and appropriate recordkeeping will be demonstrated using reports, billing details, or any other appropriate records. Dionne PrettyOnTop will be responsible for verifying contract compliance to the COR.
11. CONTRACTING OFFICER REPRESENTATIVE (COR):
The COR shall be responsible for:
(1) Monitoring the Contractors technical progress, including surveillance and assessment of performance and recommending technical changes;
(2) Interpreting the Statement of Work;
(3) Technical evaluation as required;
(4) Technical inspections and acceptance; and
(5) Assisting the Contractor in the resolution of technical problems encountered during performance of this contract.
11. INVOICE SUBMISSION AND PAYMENT:
INVOICE SUBMISSION AND PAYMENT: The Contractor shall submit its invoice to the Crow Service Unit, attn. Lori Oldbear Lori.Oldbear@ihs.gov the Contractor agrees to include the following information on each invoice:
(1) Contractor’s name and address;
(2) Contact name, title, and telephone number;
(3) DO/TO/PO/Contract Number;
(4) Invoice number and date;
(5) Description, quantity, unit of measure, unit price, and extended price of supplies delivered or services performed;
(6) Remit to Address;
(7) Taxpayer Identification Number (Employer Identification Number or Social Security Number); and
(8) Data Universal Numbering System (DUNS) number (to ensure payment is made to the correct bank account) and vendor mailing address, as provided in the System for Award Management (SAM), formerly known as the Central Contractor Registration (CCR) database. Payment shall be made by the Billings Area Financial Management Branch, P.O. Box 36600, Billings, Montana 59107.

(a) The Government desires delivery to be made according to the following schedule:

If the offeror is unable to meet the desired delivery schedule, it may, without prejudicing evaluation of its offer, propose a delivery schedule below. However, the offeror’s proposed delivery schedule must not extend the delivery period beyond the time for delivery in the Government’s required delivery schedule as follows:

Offers that propose delivery of a quantity under such terms or conditions that delivery will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. If the offeror proposes no other delivery schedule, the desired delivery schedule above will apply.

CLIN Quantity Within days after date of contract
(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed or otherwise furnished to the successful offeror results in a binding contract. The Government will mail or otherwise furnish to the offeror an award or notice of award not later than the day the award is dated. Therefore, the offeror shall compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term "working day" excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
C1. 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)
The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.
C2. 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed three (3) years.

BASIS FOR AWARD:
Selection of the successful offeror will be made based on the quote provided by the contractor that is the Best Value to the Government. .
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
Contractors intending to conduct business with the Federal Government must register with the System for Award Management (SAM). SAM replaces the Department of Defense’s Central Contractor Registration (CCR) database. SAM is now the primary Government repository, which retains information on Government contractors. You may register via the Internet at www.sam.gov.
All responsible offerors may submit a proposal, which shall be considered by the Agency. Offers shall be submitted via email to johnna.pryor@ihs.gov no later than 2:00pm MST, June 25 , 2021. The offer may also be submitted in a sealed envelope, addressed to this office, showing the time specified for receipt, the solicitation number, and your company's name and address.
ACCEPTANCE PERIOD: Your proposal must stipulate that it be predicated upon all the terms and conditions of this RFQ. In addition, it must contain a statement to the effect that it is firm for a period of at least 90 days from the date of receipt by the Government.
