52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Technical

(ii) Price

The Government will award to the lowest price, technically acceptable proposal. The lowest priced offer will be evaluated for technical acceptability. If found technically acceptable award will be made without further consideration. If found technically unacceptable the government will evaluate the next lowest offer for technical acceptability until award can be made to the lowest priced technically acceptable offeror. Past Performance will not be evaluated. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint.

PRICE EVALUATION

Pricing is required for every CLIN, including optional quantity CLINs. The Government will evaluate and determine the lowest priced offeror by comparing the offerors total evaluated price. The total evaluated price will be the sum of each total price provided in Attachment 2, Pricing Schedule. The formula is as follows:

(CLIN 0001 and 0002 Total Price) + (CLIN 1001 and 1002 Total Price) + (CLIN 2001 and 2002 Total Price) + (CLIN 3001 and 3002) + (CLIN 9999 Total Price) = Total Evaluated Price

CLIN 9999 price, and total price shall be calculated in accordance with the SURGE paragraph below, and by using the following formula:

((CLIN 0001 and 0002 Total Price) + (CLIN 1001 and 1002 Total Price) + (CLIN 2001 and 2002 Total Price)) * 40% = CLIN 9999 Subtotal

The Government reserves the right to verify all prices offered sum correctly into the total price. If the calculations are not correct, the Government reserves the right to remove the offeror from consideration. Offerors are encouraged to verify their total price is correctly calculated before submitting an offer.

TECHNICAL ACCEPTABILITY EVALUATION

In order to be considered for award an offeror must meet or exceed technical acceptability standards for the following non-price factors: 1). Technical capability of the service offered to meet the Government requirement; 2). Secure Web Fingerprint Transmission (SWFT); 3). Places of Performance

1). TECHNICAL CAPABILITY OF THE SERVICE OFFERED TO MEET THE GOVERNMENT REQUIREMENT: Technical capability of the service offered to meet the Government requirement shall be defined as an offer that meets the minimum requirements of the solicitation, including the Specifications listed in Attachment (1) Performance Work Statement.

Acceptable: The proposal provides in PART 1- TECHNICAL Capability an understanding of the minimum requirements of the solicitation, and the specifications listed in Attachment (1) Performance Work Statement. Offerors must state that they have read all of the solicitation requirements, including requirements in Attachment 1, and understand the expectation.

Unacceptable: The proposal does not include a statement that they have read all of the solicitation requirements, including requirements in Attachment 1, and understand the expectation

2). SWFT: The Government will evaluate if the offeror provides evidence of collecting electronic fingerprints in the format required to meet Secure Web Fingerprint Transmission (SWFT) and Office of Personnel Management (OPM) standards. Additionally, the Government will evaluate if evidence is submitted in their proposal that demonstrates they are either approved by the SWFT Program Manager or are being vetted through the SWFT/OPM registration process and will be able to start submitting fingerprints by May 13, 2021. If working with multiple companies or sharing resources, the offeror must indicate in its proposal how it will meet this requirement and the requirement in Attachment 1, Performance Work Statement paragraph 7.1 Third Party Vendors.

Acceptable: The proposal provides in PART 1- TECHNICAL Capability evidence of SWFT.

Unacceptable: The proposal does not provide in PART 1- TECHNICAL Capability evidence of SWFT.

3). PLACES OF PERFORMANCE: The Government will evaluate if the offeror can meet the places of performance requirements in paragraph 10 of Attachment 1, performance work statement.

Acceptable: The proposal provides in PART 1- TECHNICAL Capability an achievable plan to meet the places of performance requirements. Achievable is defined as its plan can be implemented by May 13, 2021. Offerors must submit agreements with third companies/vendors it will team with to meet this requirement.

Unacceptable: The proposal does not provide in PART 1- TECHNICAL Capability an achievable plan to meet the places of performance requirements.

The Government intends to evaluate offers and award without interchanges, but reserves the right to conduct interchanges. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct interchanges if later determined by the Contracting Officer to be necessary. Offerors that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.

SURGE: The Government may require surge support during the base or any option period and surge modifications will be in-scope to provide increased support for the defined task areas of the PWS. Surge support is OPTIONAL and is not a guarantee. If the Government determines that an increased quantity of support is required for the task areas defined in the PWS, the Government reserves the right to exercise the surge option unilaterally. The KO will provide written notice to the contractor at least 10 calendar days prior to any unilateral exercise of the surge option. The Government is providing a percentage value to be used by all offerors when proposing surge: surge support will not exceed 40% of the offeror’s total proposed price for the base and all option periods, excluding any 6-month extension of services pursuant to FAR 52.217-8. Offerors are instructed to propose this EXACT percentage for Surge CLIN 9999. In the event the Government elects to exercise the surge option, surge support will be realigned under a new CLIN for the relevant task areas identified in the PWS, and an equal amount will be deducted from optional surge CLIN 9999 total. Surge support will be provided at the same labor rates proposed and found fair and reasonable at time of contract award for the applicable period of performance.

RESPONSIBILITY DETERMINATION/PAST PERFORMANCE: Provision FAR 52.212-3 must be completed and up to date through SAM.gov. Past performance will be reviewed as part of a responsibility determination but will not impact the technical acceptability evaluation. If overall past performance is found to be unacceptable, this may be cause for the offeror's proposal to be excluded from further evaluation. However, a prospective contractor shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history. The Government may use Supplier Performance Risk System (SPRS) information for past performance information and meet the requirements of the responsibility determination. For details concerning SPRS, refer to the User Guides, htps://www.sprs.csd.disa.mil/reference.htm. The Government may also use other internal Government information and records for responsibility determinations.
