B.2 Statement of Work

Spill Prevention Control and Countermeasure Evaluation, Training and Documentation

Statement of Work

SCOPE

This contract will cover the services and work necessary to maintain a Spill Prevention Control and Countermeasure (SPCC) plan, provide annual SPCC training and documentation for the Nebraska Western Iowa Heath System (NWIHCS) and conduct an annual spill drill. The NWIHCS SPCC program encompasses two campuses. These locations include the Veterans Hospital Omaha at 4101 Woolworth Ave Omaha, NE 68105 and the Grand Island campus at 2201 North Broadwell Grand Island, NE 68803. Each campus will have its own SPCC plan.

SPECIFIC REQUIREMENTS

The contractor will identify current plan deficiencies and opportunities for improvement by performing a thorough review and analysis of each campus’s existing SPCC Plan, including all referenced attachments, diagrams, and facility inspection and testing forms. Review will occur on an annual basis.

The contractor will visit each campus to inspect and verify all existing petroleum and oil storage areas including, but not limited to, above ground storage tanks, underground storage tanks, hydraulic systems, transformers, waste cooking oil containers, and 55-gallon oil storage.

The contractor will also perform an annual evaluation of each campus’s cathodic protection, valves, piping, metering devices and record keeping required by Federal, State and Local agencies such as the EPA and OSHA. The written evaluation will be given to the COR annually to keep on file.

The contractor shall draft a revised SPCC plan annually for each campus in accordance with the results for the site inspection and current statutes and regulations. Ensure the revised plan can be easily maintained, accounts for environmental controls currently in place, contains current staff information and emergency contacts, and is flexible to update for future operational changes.

At a minimum the updates and revisions shall:

1. Describe the physical layout of the facility and include a facility diagram, which must mark the location and contents of each fixed oil storage container and the storage area where mobile or portable containers are located. Including the following:

a. Type of oil in each fixed container and its storage capacity for all containers over 55 gallons. For mobile or portable containers, either provide the type of oil and storage capacity for each container or provide an estimate of the potential number of mobile or portable containers, the types of oil, and anticipated storage capacities;

b. Discharge prevention measures including procedures for routine handling of products (loading, unloading, and facility transfers, etc.);

c. Discharge or drainage controls such as secondary containment around containers and other structures, equipment, and procedures for the control of a discharge;

d. Countermeasures for discharge discovery, response, and cleanup (both the facility's capability and those that might be required of a contractor);

e. Methods of disposal of recovered materials in accordance with applicable legal requirements; and

f. Contact list and phone numbers for the facility response coordinator, National Response Center, cleanup contractors with whom you have an agreement for response, and all appropriate Federal, State, and local agencies who must be contacted in case of a discharge.

2. Provide information, form and procedures to enable a person reporting a discharge to relate information on the exact address or location and phone number of the facility; the date and time of the discharge, the type of material discharged; estimates of the total quantity discharged; the source of the discharge; a description of all affected media; the cause of the discharge; any damages or injuries caused by the discharge; actions being used to stop, remove, and mitigate the effects of the discharge; whether an evacuation may be needed; and, the names of individuals and/or organizations who have also been contacted.

3. Include a prediction of the direction, rate of flow, and total quantity of oil which could be discharged from the facility as a result of each type of major equipment failure.

4. Recommend, if needed, appropriate containment and/or diversionary structures or equipment to prevent a discharge.

5. Be certified by a licensed Professional Engineer

6. Identify written procedures for inspection, tests, and record keeping requirements. Including the following:

a. Identify and document an inspection schedule for AST integrity testing that is appropriate for the types of containers we have at all three sites (based on applicable industry standards.) Include a description of the conditions of the container that led to the specific inspection schedule identified in the Plan.

b. Identify responsible party for conducting monthly SPCC inspections.

c. Identify where inspection records will be kept for the required three-year duration.

7. Include requirements for personnel, training, and discharge prevention procedures related to:

a. Operation and maintenance of equipment to prevent discharges;

discharge procedure protocols; applicable pollution control laws, rules, and regulations; general facility operations; and, the contents of the facility SPCC Plan.

b. Key personnel who are accountable for discharge prevention.

8. Provide a system for documenting inspections.

9. Describe how the facility will secure and control access to the oil handling, processing and storage areas; secure master flow and drain valves; prevent unauthorized access to starter controls on oil pumps; secure out-of-service and loading/unloading connections of oil pipelines; and address the appropriateness of security lighting to both prevent acts of vandalism and assist in the discovery of oil discharges.

10. Describe procedures for filling and dispensing oil at the facility and recommend methods for preventing releases.

11. Include a complete discussion of conformance with the applicable requirements and other effective discharge prevention and containment procedures required by federal, state and local guidelines.

The contractor must also provide facility specific, training annually to each individually identified campus for up to 30 employees per site. The training should provide detailed requirements related to the entire SPCC Plan not just specific to the most recent revisions. This training will include basic tank maintenance and checks, record keeping, metering, remediation of spills and disposal of material used, list of emergency numbers to call (located in the current SPCC plan) as well as pertinent statutes and regulations.

The training shall include the submission of an electronic copy of the training for future facility training use. The contractor will also supply a roster of employee’s who were present for the training. The roster shall include the printed name of the employee and their signature as well as the instructors name, signature and date of training. One copy of the training and roster will be kept at each campus. One copy of the training and roster will be submitted to Contracting Officers Representative (COR). A list of involved employees’ will be supplied by the Contracting Officers Representative (COR).

The contractor will provide a detailed summary report of all deficiencies, recommendations and/or upgrades required to keep the SPCC program current with all regulatory statutes and guidelines. One copy will be provided to the Maintenance and Operations Supervisor of the campus with deficiencies, one copy to the Contracting Officers Representative (COR) and one copy to the Chief of Engineering.

The contractor will provide a draft copy of the SPCC plan to the Contracting Officers Representative (COR) for review and comment and will revise the plan in accordance with any feedback received.

The contractor will provide two hard copies and one electronic copy, capable of being edited, of each campus’s final SPCC plan and report. The final reports will be certified by a Nebraska licensed Professional Engineer and shall be submitted to the COR.

The contractor will supply any certification issued by Federal, State or local Agencies for the evaluation of Tank and piping systems.

SECTION C - CONTRACT CLAUSES

C.1 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES

(NOV 2021)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation and is most advantageous to the Government, a Best Value evaluation shall be used to evaluate offers.

The Government will utilize the following evaluation factors in make the award decision:

Factor 2: Past Performance

Factor 3: Veterans Involvement

Factor 4: Price

THE FOLLOWING EVALUATION METHODOLOGY WILL BE UTILIZED:

All quotes shall be subject to evaluation by Government personnel. The Government intends to make award based on the initial offers. If further questions are required, the Contracting Officer may contact the offerors for clarifications. The Government reserves the right to award without discussions based on initial evaluation of offers. The quotes will be evaluated strictly in accordance with its written content.

NOTE: Failure to submit any of the required information, statements, or certifications may result in rejection of the quote without further consideration for award.

Factor 1 (Past Performance)

Present and past performance shall be evaluated as a measure of the Government’s confidence in the offeror’s ability to successfully perform based on previous and current contract efforts. Past Performance will be determined to be relevant if the performance involves work that is the same or similar in nature, size, and complexity to the services being procured under this Solicitation, and recent if performed within the past three (3) years.

Offerors are cautioned that the Government will review any or all of a combination of past performance information submitted by offeror as required per the solicitation and past performance data available in the Past Performance Information Retrieval System (PPIRS) and/or System of Award Management (SAM.Gov).

The Government reserves the right to obtain past performance information from any available source (i.e., Better Business Bureau) besides those specified above. If an offeror has no record of relevant past performance or if past performance information is not available for such offeror, the offeror may not be evaluated favorable or unfavorable on past performance. These offerors will be assessed a “Neutral” rating for past performance relevancy and confidence.

Past Performance will be evaluated as either Acceptable, Unacceptable, or Neutral. To be considered for award, a rating of “Neutral” or “Acceptable” for Past Performance Relevancy must be achieved by offeror.

Factor 2 (Technical Capability)

The offeror’s technical capability shall be evaluated based on offeror providing capability statement summarizing its knowledge and ability to provide items in Statement of Work/Performance Work Statement.

• If a sub-contractor is being utilized, the offeror shall identify the sub-contractor with:

o Business Name (Legal Name) o Doing Business as Name (if any) o Address o SAM Unique Identifier or DUNS Number.

o The offeror shall provide a breakdown of the work being completed by the Offeror and what is being provided by sub-contractor, a report similar in scope and complexity to services identified in SOW/PWS identifying what percentage of requested procurement will be completed by the Prime Contractor and what percentage will be completed by subcontractor(s) (if any).

o The Government suspends or debars Contractors to protect the Government’s interests.

The Contractor shall not enter into any subcontract with a company that is debarred, suspended, or proposed for debarment by any executive agency. The Contractor shall identify where or not any proposed subcontractor is debarred, suspended, or proposed for debarment (if any).

Technical Capability will be evaluated as either Acceptable or Unacceptable. To be considered for award, a rating of “Acceptable” must be achieved by offeror.

Factor 3 (Veterans Involvement) Pursuant to VAAR 813.003-70 (c) (2), to the extent that market research does not support an SDVOSB or VOSB set-aside, the Contracting Officer shall include evaluation factors prescribed at VAAR 815.304}

Factor 4 (Price)

The offeror’s total estimated price for will be evaluated to ensure that they are fair and reasonable. Prices will be evaluated for completeness, and any incomplete pricing could result in the offeror being considered non-responsive. The Government reserves the right to make an award to other than the lowest priced offeror.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

Evaluation of Option to Extend Services under 52.217-8. For the purposes of the award of the resulting contract, the Government intends to evaluate the option to extend services, provided under FAR 52.217-8, as follows: The evaluation will consider the possibility that the option can be exercised at any time, and can be exercised in increments of one to six months, but for no more than a total of six months during the life of the contract. The evaluation will assume that the prices for any option exercised under FAR 52.217-8 will be at the same rates as those in effect under the contract at time of award. The evaluation will therefore assume that the addition of the price or prices of any possible extension or extensions under FAR 52.217-8 to the total price for the basic requirement and the total price for the priced options has the same effect on the total price of all offers relative to each other, and will not affect the ranking of offers based on price, unless, after reviewing the offers, the Government determines that there is a basis for finding otherwise. This evaluation will not obligate the Government to exercise any option under FAR 52.217-8.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

ADDENDUM to 52.212-2 EVALUATION—COMMERCIAL PRODUCTS AND COMMERCIAL

SERVICES

(a) Basis for Award. The Government will issue a purchase order to the responsible quoter whose quotation conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

(b) The following factors shall be used to evaluate quotations:

(1) Technical or Quality

(2) Past Performance

(3) Veterans Involvement

(4) Price

(c) Evaluation Approach. The Government will evaluate quotations using the comparative evaluation process outlined in FAR 13.106-2 (b) (3), where quotations will be compared to one another to determine which provides the best benefit to the Government. The Government reserves the right to consider a quotation other than the lowest price that provides additional benefit(s). Quotations may exceed minimum requirements of the solicitation. The Government reserves the right to select a quotation that provides benefit to the Government that exceeds the minimum requirements of the solicitation, but is not required to do so. Each response must meet the minimum requirements of the solicitation. The Government is not requesting or accepting alternate quotations. The evaluation will consider the following:

(d) Technical or Quality: The quotation will be evaluated to the extent to which it can meet and/or exceed the Government’s requirements as outlined in the solicitation and based on the information requested in the instructions to quoters section of the solicitation.

(1) Past Performance: The past performance evaluation will assess the relative risks associated with a quoter’s likelihood of success in fulfilling the solicitation’s requirements as indicated by the quoter’s record of past performance. The past performance evaluation may be based on the contracting officer’s knowledge of and previous experience with the supply or service being acquired; Customer surveys, and past performance questionnaire replies; Contractor Performance Assessment Reporting System (CPARS) at http://www.cpars.gov/; or any other reasonable basis.

(2) Veterans Involvement: In accordance with Veterans Affairs Acquisition Regulation (VAAR) 852.215- 70 (DEVIATION), Service-Disabled Veteran-Owned and Veteran-Owned Small Business (VOSB) Evaluation Factors, the Government will assign evaluation credit for a Quoter (i.e., prime contractor) which is a Service-Disabled Veteran-Owned Small Business (SDVOSB) or a VOSB. To receive credit, an offeror must be registered and verified in Vendor Information Pages (VIP) database at time of quotation submission and at time of award ( https://www.vip.vetbiz.va.gov/) and must meet federal small business size standards for the North American Industry Classification System (NAICS) code assigned to this solicitation. Non-SDVOSB/VOSB quotations that use SDVOSBs or VOSBs as subcontractors will receive some consideration under this evaluation Factor. Quoters must state in their quotations the names of the SDVOSBs and VOSBs with whom they intend to subcontract and provide a brief description of the proposed subcontracts and the approximate dollar values of the proposed subcontracts. In addition, the proposed subcontractors must be registered and verified in the VetBiz.gov VIP database ( https://www.vip.vetbiz.va.gov/) and must meet federal small business size standards for the NAICS code assigned to this solicitation at time of both quotation submission and at time of award.

(3) Price: The Government will evaluate the price by adding the total of all line-item prices. The Total Evaluated Price will be that sum.

C.2 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS—

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.

(a) Definitions. As used in this provision—

Covered telecommunications equipment or services has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR 127, and the concern is identified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

Forced or indentured child labor means all work or service—

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

Highest-level owner means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.

Immediate owner means an entity, other than the offeror, that has direct control of the offeror.

Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.

Inverted domestic corporation means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).

Manufactured end product means any end product in product and service codes (PSCs) 1000- 9999, except—

(1) PSC 5510, Lumber and Related Basic Wood Materials;

(2) Product or Service Group (PSG) 87, Agricultural Supplies;

(3) PSG 88, Live Animals;

(4) PSG 89, Subsistence;

(5) PSC 9410, Crude Grades of Plant Materials;

(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;

(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;

(8) PSC 9610, Ores;

(9) PSC 9620, Minerals, Natural and Synthetic; and

(10) PSC 9630, Additive Metal Materials.

Place of manufacture means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Reasonable inquiry has the meaning provided in the clause 52.204–25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.

Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education;

or

(6) Have been voluntarily suspended.

Sensitive technology—

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

Service-disabled veteran-owned small business concern—

(1) Means a small business concern—

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

Small business concern—

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and size standards in this solicitation.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

Small disadvantaged business concern, consistent with 13 CFR 124.1001, means a small business concern under the size standard applicable to the acquisition, that—

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by—

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States;

and

(ii) Each individual claiming economic disadvantage has a net worth not exceeding the threshold at 13 CFR 124.104(c)(2) after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and

(2) The management and daily business operations of which are controlled (as defined at 13 CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.

Subsidiary means an entity in which more than 50 percent of the entity is owned—

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

Veteran-owned small business concern means a small business concern—

(1) Not less than 51 percent of which is owned by one or more veterans (as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and

(2) The management and daily business operations of which are controlled by one or more veterans.

Women-owned business concern means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.

Women-owned small business concern means a small business concern—

(1) That is at least 51 percent owned by one or more women; or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and

(2) Whose management and daily business operations are controlled by one or more women.

Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300.
