Description

This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in

Federal Acquisition Regulation (FAR) subpart 12.6, “Streamlined Procedures for Evaluation and

Solicitation for Commercial Items,” as supplemented with additional information included in this notice.

This announcement constitutes the only solicitation; quotations are being requested, and a written solicitation document will not be issued.

This solicitation is a request for quotations (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-05 / 03-10-2021.

The associated North American Industrial Classification System (NAICS) code for this procurement is

334516, with a small business size standard of 1000 Employees.

The Network Contracting Office 7 is seeking to purchase an Advanced Instruments A02 fully automated, multi-sample osmometer for the Ralph H. Johnson VAMC, 109 Bee Street, Charleston South

Carolina. This is a Brand Name only requirement.

All questions regarding this RFQ must be in writing and may be e‐mailed to jason.compton1@va.gov.

Questions must be received no later than May 13, 2021 at 9:30 AM CDT. No further questions will be accepted after that date and time.

Statement of Work

OSMOMETER - LABORATORY

STATEMENT OF WORK

1. INTRODUCTION/BACKGROUND:

a. The purpose of this requirement is to obtain a fully automated, multi-sample osmometer with walkaway operation for the measurement of osmolality.

• Osmometer: an instrument measuring the osmotic strength of a solution or compound. The osmometer uses the solution’s freezing point depression to establish its strength. It is used to determine the level of osmotically appropriate body fluid in various chemicals dissolved in the blood using the relationship which a mole of dissolved substance reduces the freezing point of water by 1.86 degrees Celsius.

• Osmolality: a measure of a solution’s osmotic concentration, which defines the total number of solute particles within the liquid that contribute to osmotic pressure.

b. The lab does not have an up to date osmometer in service currently.

2. OBJECTIVE:

a. The objective is to obtain an upgraded automated osmometer for patient testing. This osmometer should be the upgrade automated system to the current automated osmometer that is validated and on-site at the Medical Center.

b. This item is a fixed price purchase of Hospital Laboratory Equipment.

3. MAJOR REQUIREMENTS:

a. The Ralph H. Johnson VAMC is seeking to procure an automated Osmometer for the

Hematology Department. The contractor shall provide an osmometer that provides freezing point depression technology and is fully automated with multi-sample capability for the testing of osmolality. Must be interfaced with the laboratory’s current LIS, Data Innovations. The osmometer must provide positive sample identification, barcode scanner, operator lockout and have sampling capabilities to process samples in duplicate, triplicate, or any other sampling protocol, STAT sample capability, built in quality control, and process samples quickly.

The vendor shall be responsible for the delivery and installation of all equipment, initial validation of all equipment, provide training to staff for use of the system, and provide service and routine maintenance. Installation and validation of the osmometer will include but is not limited to, the delivery and set up of the osmometer in laboratory. The vendor is responsible for all parts and documents required for the installation of the osmometer. The initial validation of the instrument will confirm that the osmometer was installed accurately and appropriate for patient testing. Training will include two (2) hours of on-site training and training documents. Additional training hours will be available as needed.

4. GOVERNMENT FURNISHED INFORMATION OR MATERIAL:

a. No Government furnished materials are for consideration in this contract activity.

5. TRAVEL REQUIREMENTS:

Any cost of travel is the responsibility of the equipment vendor, unless otherwise specified in the contract award. The cost of travel for repairs under warranty are the responsibility of the product vendor.

6. CONTRACTING OFFICER'S REPRESENTATIVE (COR):

The COR shall clarify technical points or supply relevant technical information, but no requirements in this scope of work may be altered as a sole result of such verbal clarification."

8. REPORTS/DELIVERABLES:

a. One (1) Osmometer.

b. Product delivery within two (2) months of the contract award.

9. PERIOD OF SERVICE:

Service provided will include one (1) year of coverage in addition to the manufacturer’s one-year warrant. Service includes a year supply of manufacturers recommended Protinol Protein-Based Controls and Renol Urine Osmolarity Controls.

Use of controls from other manufacturers will impact the instrument’s warranty and service agreement. Product delivery within one (1) month of contract award.

10. SECURITY/NATIONAL AGENCY CHECK REQUIREMENTS:

N/A- No VA sensitive information will be shared with or stored by contractor.

11. Salient Characteristics

Must allow for customized sample testing protocols to be developed specific and unique to the desired laboratory or testing method.

Must be fully automated, multi-sample, freezing point method analyzer.

Must provide automated liquid handling and a self-cleaning fluid management system.

Must have built-in quality control software package. 115/120 VAC. Ethernet/LIS connectivity.

On-board printer. Full calibrated range: 0 4000 mOsm/kg H2O.

Must have Initial and pre-test barcode scanning for positive specimen identification.

Must have touch screen operation, bidirectional data communications, a built-in quality control module, Ethernet and USB connectivity and an integrated data management system.

Must have removable 20-position carousel for easy sample loading. Sample test volume >50

µL. Turn-Around Time.

(a) This solicitation includes VA Acquisition Regulation (VAAR) 852.219-10, VA Notice of Total Service-

(b) Accordingly, any contract resulting from this solicitation is subject to the limitation on subcontracting requirements in 13 CFR 125.6. The Contractor is advised that in performing contract administration functions, the Contracting Officer may use the services of a support contractor(s) retained by VA to assist in assessing the Contractor’s compliance with the limitations on subcontracting or percentage of work performance requirements specified in the clause. To that end, the support contractor(s) may require access to Contractor’s offices where the Contractor’s business records, or other proprietary data are retained and to review such business records regarding the Contractor’s compliance with this requirement.

(c) All support contractors conducting this review on behalf of VA will be required to sign an

“Information Protection and Non-Disclosure and Disclosure of Conflicts of Interest Agreement” to ensure the Contractor’s business records or other proprietary data reviewed or obtained in the course of assisting the Contracting Officer in assessing the Contractor for compliance are protected to ensure information or data is not improperly disclosed or other impropriety occurs.

(d) Furthermore, if VA determines any services the support contractor(s) will perform in assessing compliance are advisory and assistance services as defined in FAR 2.101, Definitions, the support contractor(s) must also enter into an agreement with the Contractor to protect proprietary information as required by FAR 9.505-4, Obtaining access to proprietary information, paragraph (b). (d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller

General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the dispute’s clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

1. The offeror shall submit their quote on company letterhead. The offeror’s quote shall include the name, address, and telephone number of the offeror, the offeror’s DUNS#. Offeror’s SAM registration at www.sam.gov must me current, complete, and accurate.

2. Acknowledgement or signed copy of all amendments posted to the solicitation.

3. All offerors must be VIP verified SDVOSB concerns at the time of quote submittal and at the time of award. See VAAR 819.7003.

4. All Offerors must meet the small business size standard of 1000 Employees for NAICS code

334516 Analytical Laboratory Instrument Manufacturing – at the time of submission of quote and at the time of award.

5. All offerors must be registered in SAM at the time of quote submittal.

6. All offerors shall demonstrate ability to meet the Limitations on Subcontracting as described in

13 CFR 125.6 in accordance with VAAR clause 852.219-10. If the offeror plans on using subcontractors, you must provide a subcontracting plan to include:

c. Work they will be performing, to include % of work on contract

7. Price: The offeror shall fill-in all unit prices and totals for each CLIN as well as the total amount of the price quote in the solicitation’s Price Schedule.

8. Technical Approach: The offeror shall demonstrate in its quote in as much detail as possible how it will meet the requirement as described in the solicitation’s Statement of Work.

9. Past Performance: The offeror is required to provide a minimum of one (1) past performance reference for similar services within the last four (4) years, either Governmental or Commercial entity, in response to this solicitation, to include place, size, and years of service performed. If no past performance is available, you must address this in your offer. Past performance will be reviewed as part of the responsibility determination only.

FAR 52.212-2 EVALUATION-COMMERCIAL ITEMS (OCT 2014)

This Request for Quote (RFQ) is issued in accordance with FAR 12 and in conjunction with

Simplified Acquisition Procedures FAR 13.5. Evaluation of price and other factors will be considered in accordance with procedures outlined in FAR 13.106-3. A single award will be made to the offeror who represents the “Best Value” utilizing comparative analysis evaluation, considering price and technical approach.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

• Price: The contracting officer will evaluate the offered price to determine whether it is fair and reasonable in accordance with FAR 13.106-3. The total evaluated price is the offeror’s quoted price.

• Technical Capability: The technical evaluator will evaluate the offerors’ quote to fulfill this requirement. The offeror will show its understanding of the requirement and the viability of its quote by demonstrating its plan of action to provide this service, demonstration of knowledge of the service and ability to perform by providing a detailed plan of equipment and personnel required to fulfill the need and the procedures you will use while executing the requirement.

(b) A written notice of award or acceptance of an offer, emailed or otherwise furnished to the successful offeror, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
