Dear Contractor:
The purpose of this Request for Proposal (RFP) 9531CB21R0001 is to acquire a disability insurance carrier to provide disability insurance benefits to CFPB employees, as outlined in the Statement of Requirements provided herein. The resulting contract will be Fixed Unit Price with one (1) base year and four (4) one-year option years, not to exceed five (5) years, if all options are exercised.
The CFPB hereby issues a combined synopsis/solicitation for commercial items issued on Contract Opportunities (beta.sam.gov) using the policies contained in FAR Part 12 – Acquisition of Commercial Items and FAR Part 13.5 Simplified Procedures for Certain Commercial Items, to obtain contractor services in support of this requirement. CFPB intends to award a single contract as a result of this solicitation.
This solicitation is not issued as a small business set-aside. The NAICS code is 524113, Direct Life Insurance Carriers, and the business size standard is $41.5 Mil.

SECTION 1
PRICING DESCRIPTION AND TABLES
1. FIXED UNIT PRICES FOR SERVICES
Offerors shall provide firm fixed unit prices for the Base Year and Option Years 1 through 4 as indicated in the Pricing Model (Attachment 1).
The fixed unit prices for servicing the ST/LT Disability Insurance policies shall apply for the duration of the contract. The fixed unit prices are flat rate pricing and includes the cost of any claims, report preparation, salaries, overhead, other direct costs, general and administrative expenses, and profit.
The unit prices for the Base Year and Option Years 1-4 are fixed unit prices and shall not be subject to price adjustment. The Contractor shall be paid on a bi-weekly (i.e., every other week) basis for Operations (i.e., effective period of coverage which begins January 1, 2021) at the fixed prices set forth below (to be included upon award, and taken from the contractor’s completed Pricing Model (Attachment 1)).
Please note the estimated volumes provided in the Pricing Model (Attachment 1) are derived from existing CFPB limited and historical census data and are only for the purposes of arriving at a total price for evaluation purposes. The estimated volume data do not represent actual volumes for purposes of payment. CFPB has limited and historical information and makes no representations as to the accuracy of these estimates.

C. DETERMINATION OF AMOUNT OF PAYMENT –
1. The Government will pay the Contractor on a bi-weekly basis. Payments shall be determined by the covered payroll and benefits for STD and LTD and shall be at the rates established in section titled “Fixed Unit Prices for Services” of this contract. The due date for payment shall be twenty days after the latest official pay date on the invoice.
2. At the end of Contract Year 1 and subsequent contract year(s), if their respective options are exercised by CFPB, the Bureau will analyze actual participation levels and advise the Offeror of any overpayment(s) or underpayment(s) due.
3. In the event of an overpayment of monies by CFPB to the Contractor, determined in accordance with item c.2. (above), and based on written notification of the overpayment, the Contractor shall provide a refund. The due date for this refund shall be 30 calendar days after notification. The refund may be made by a check payable to the “CFPB” or via wire transfer. The method of refund shall be at CFPB’s discretion.
4. In the event of an underpayment of monies by CFPB to the Contractor, determined in accordance with item c.2. (above), the Bureau will notify the Contractor in writing of the monies due and provide an adjustment payment. The due date for this adjustment payment shall be 60 calendar days after the end of the contract period.
5. The date of payments by the Government shall be construed to be the date payment is made.
Contractors may propose an alternative to the current self-billed process based on industry best practice.
If an alternative is proposed, your proposal should provide a detailed description of how the billing process will work.
SECTION 2
STATEMENT OF REQUIREMENTS (SOR)
ST/LT DISABILITY INSURANCE SERVICES PROGRAM
1.0 SCOPE
The Human Capital Division of Consumer Financial Protection Bureau (CFPB) requires a Disability Insurance carrier to provide Short-term and Long-term Disability Insurance benefits for its active employees effective January 1, 2021.
Enrollment Eligibility The eligibility requirement is defined as a regular employee (full-time or part-time) or temporary employee with an appointment greater than one year; and actively at work at least 60 hours biweekly.
Enrollment and Effective Dates
Initial enrollees will be effective January 1, 2021. New hires will be effective on the date employees meet the eligibility requirements.
2.0 BACKGROUND
The Dodd-Frank Wall Street Reform and Consumer Protection Act requires that CFPB provide benefits to employees that are comparable to the benefits provided by the Board of Governors of the Federal Reserve (FRB). In addition, CFPB compares itself to other FIRREA and Federal regulatory agencies.
In order to achieve comparability and to attract talent and to make sure that there are little or no benefit gaps for transferring employees, the purpose of this contract is to maintain a short-term disability (STD) insurance plan and long-term disability (LTD) plan for all employees effective January 1, 2021. Title 5 Federal benefits do not include separate insurance plans for STD and LTD. Instead, employees have sick leave benefits that accrue at four hours per pay period (13 days per year). Employees can accrue unlimited hours of sick leave. Transferring employees will transfer their sick leave balances. CFPB administers the STD and LTD benefits in conjunction with the usage of sick leave, leave donated from the Voluntary Leave Transfer Program, leave without pay and etc. CFPB employees are enrolled in either the Civil Service Retirement System (CSRS), the Federal Employees Retirement System (FERS), or the Federal Reserve System Retirement Plan. All of these retirement plans include disability retirement provisions and will be included as an offset to LTD benefits.
3.0 REQUIREMENTS
3.1 Plan Design – Contractor shall duplicate the current short-term disability and long-term disability (LTD) insurance benefit.

3.2. Administrative Requirements
The Contractor shall at a minimum provide the following administrative services for the CFPB STD and LTD Insurance Plans. The Contractor shall provide administrative services including, but not limited to, the following:
A. Administrative and Enrollment Services Minimum Requirements
a) Administer short-term and long-term disability (STD and LTD) insurance benefits that provide, at a minimum, the benefits summarized in Part II as outlined in the certificates.
b) Produce an employee certificate.
c) Provide electronic files of forms and materials in prescribed format (Adobe PDF format) to be uploaded to the CFPB Intranet.
d) Provide start and end dates of individual employee STD and LTD claims to CFPB as they become available.
e) Provide a seamless link to your firm’s website from the CFPB benefits website.
f) Provide a secured electronic site that CFPB benefits administrators can access to view the processing status of employees’ STD and LTD claims.
g) As requested by CFPB, assist in the communication to employees regarding STD and LTD insurance benefits, if needed.
h) Provide a Bi-Weekly premium bill (26 bills per year) to CFPB using the Invoice Processing
Platform (IPP) (https://www.ipp.gov). Provide for a 30-day net payment due. Implement an e-mail notification process to proactively alert CFPB benefit staff of late or missing premium payments.

i) The carrier shall provide eligibility for coverage to all employees on effective date. No active employees or disabled employees shall lose eligibility for coverage as a result of a change in carriers.
j) Designate an Account Manager with responsibility and authority to take all necessary steps to assure that CFPB’s expectations are met and to solve all professional performance, invoicing and other conflicts that may arise between CFPB and vendor.
k) Meet (in person, by phone, or virtual) with CFPB on a regular basis, to be agreed-upon with the Contracting Officer Representative (COR), to review status of claims and overall operation of the program. Conduct an annual account management satisfaction survey.
l) The plan should be sitused in Washington, DC.
B. STD and LTD Claims Processing Customer Service, and Reporting Minimum Requirements
a) Provide a flexible intake process including telephonic and on-line claim submission to allow for both East and West coast employees to submit. Intake may be by phone, online or email.
b) Generate STD approvals and benefit amounts that align with CFPB’s bi-weekly pay period schedules.
c) Provide LTD and STD benefit payments to individuals. Additionally, possess the ability to provide benefit payments through direct deposit, if requested by the CFPB COR.
d) Process benefit payments to LTD beneficiaries on a monthly basis.
e) Have the ability to withhold pre and post-tax deductions from employee’s check and report deductions back to CFPB.
f) Provide Federal and state tax withholding and remittance to various government entities, to include issuance of annual W-2 forms. Process 82.5% of STD claims within 10 business days. Process 90% of LTD decisions by the benefit start date.
g) Provide ongoing clinical claim management.
h) Monitor treatment plan and recovery progress of the disabled claimant to ensure timely and successful rehabilitation.
i) Identify potential Social Security disability candidates and assist with the approval process, including the initial application, reconsideration, and appeal; Provide CFPB with electronic quarterly and annual cumulative reports of claims, reserve, and premiums paid.
j) Provide CFPB with clear and concise management reports which include:
• Nature of illness/disability in terms of severity, functional impairment, and prognosis.
• Date of disability.
• Estimated return-to-work date.
• Actual return-to-work date.
• Case management goals, objectives, and responsibilities.
• Rehabilitation status.
• Amount paid in benefits, including Social Security and other offsets.
k) Provide lists of employee-contested claims that were denied or partially denied, separated by denial reason.
l) Maintain a claims service unit with minimum office hours from 8:00 a.m. until 8:00 p.m., Eastern Time, Monday through Friday (except Federal holidays) and provide a message device to handle calls after business hours or on weekends.
m) Provide a toll-free telephone service that has the capability to place calls on hold and queue during peak calling hours. Providing adequate staffing so that all calls are answered on average in 30 seconds.
n) Provide legal defense on disputed claims or to determine eligible beneficiaries where there is ambiguity.
3.3 Transition Period
The Contractor shall provide a transition period which will begin at contract award and continue through December 31, 2020. During the transition period, the contractor shall be responsible for setting up the plan design in its system, assisting CFPB with establishing enrollment and billing processes, and providing materials and staffing to aid in the communication of the benefit plan to employees. The new contractor shall be responsible for all claims incurred beginning Jan 1, 2021.
In addition, during the final year of performance for this contract, the contractor will prepare for and assist with a seamless transition to the new contractor (if applicable) by transferring to CFPB and/or the new supplier, as determined by CFPB, within 30 days of notice of this requirement, all required data and records necessary to administer the plans subject to state and federal confidentiality considerations, without a break in service. The transfer may be made electronically, in a file format to be determined based on the mutual agreement between CFPB and the provider of services. The contractor may be asked to provide phase-in, phase out services for up to a one-year period, if necessary.

INSTRUCTIONS TO OFFERORS
1.0 Submission of Proposals. Technical and Price Proposals are due electronically by 3pm ET December 01, 2020 to both Jerry.Salinas@cfpb.gov and Vanessa.DelToro@cfpb.gov.
All proposals shall have the subject line “RFP-9531CB21R0001.”
Proposals received after the deadline will not be considered.
Facsimile or physical mail transmissions will not be accepted.
2.0 Questions. Questions concerning this RFP shall be submitted in writing via email to both Jerry.Salinas@cfpb.gov and Vanessa.DelToro@cfpb.gov no later than 3pm ET November 20, 2020.
Questions will be answered in writing through an amendment to the solicitation at Contract Opportunities.
2.1 CFPB Census Data
If Offerors would like CFPB’s most recent available employee census data for disability insurance services, please contact both Vanessa.delToro@cfpb.gov and Jerry.Salinas@cfpb.gov.
In order to receive the census data for this requirement, the Offeror must submit, as part of its email request to both Vanessa.delToro@cfpb.gov and Jerry.Salinas@cfpb.gov, a signed Non- Disclosure Agreement (NDA) (Attachment 3), signed by an authorized representative of the Offeror.
3.0 Proposal Form and Content.

4. A confirmation by the Offeror that its proposed prices are inclusive of the services outlined in the Statement of Requirements.
****In pricing the plan, Offerors are reminded that CFPB is seeking a plan that will be fully-insured and non-participating.
Volume II - Technical
1. The Technical Proposal shall be divided into the following sections and is limited to 25 Pages.
a. Plan Design – Plan Design. Offerors shall provide a copy of the Plan Design Chart in
Section 3.1 of the Statement of Requirements, and add a column to the Plan Design Chart, indicating with a “yes” if the proposed plan meets each particular Plan Design Requirements. Offerors shall confirm that they provide all required services and require no deviations from the Plan Design.
b. Firm Experience – The Offeror must have one (1) year of prior experience of providing life insurance services as a prime contractor within the last five (5) years. Dollar value and contract description must establish that the Offeror experience is similar in size, scope, and complexity to the Statement of Requirements. The Offeror must submit the following information to demonstrate the experience requirements above:
- Customer name and address.
- Contract number.
- Total dollar value of the contract. If performed as part of a team, provide the dollar value of your firm’s contribution.
- Period of contract performance.
- Description of coverage provided, including the specific services provided by your firm.
SECTION 4
EVALUATION OF PROPOSALS FOR AWARD
1. The CFPB intends to award a single Fixed Price with Firm-Fixed Rates contract, to the responsible offeror on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors, which is known as the Lowest Price Technically Acceptable (LPTA) methodology. A decision on the technical acceptability of the lowest priced Offeror will be made. If the lowest priced Offeror’s proposal is determined to be technically acceptable, an award will be made to that Offeror and technical evaluations of other Offerors will not be conducted. If the lowest priced Offeror’s proposal is determined to be technically unacceptable, the next lowest priced Offeror’s proposal will be evaluated for technical acceptability, and so on.
2. To be accepted and eligible for technical evaluation, Proposals must be prepared in accordance with this solicitation and must comply with the instructions given in this solicitation document and must meet all the solicitation requirements. Proposals meeting the requirements of this solicitation and complying with other contract provisions will be evaluated and award made to the responsible Offeror whose proposal is deemed technically acceptable and offers the lowest total evaluated price.
3. The Proposals will be evaluated based on the following factors:
Factor 1: Financial Rating (Go / No Go Factor) Factor 2: Plan Design Factor 3: Firm Experience Factor 4: Price
Factor 1: Financial Rating (Go / No Go Factor) – Offerors must meet the following
Minimum Financial Rating(s) for at least one (1) of the Rating Agencies below in order to progress to the technical proposal evaluation stage. In lieu of being rated by one (1) or more of these Rating Agencies, the Offeror must have an annual premium volume of $1 billion or more as documented in the Offeror’s annual report. In lieu of providing evidence of its Minimum Financial Rating(s) (set forth below), the Offeror shall provide its annual report as part of its Proposal, in order to verify the Offeror’s annual premium volume.
Failure to meet the evaluation criteria for Financial Rating will deem the offeror’s proposal Unacceptable and the Proposal will not be further evaluated.
Minimum Financial Ratings:
A.M. BEST: Rating of B+ Standard and Poor’s: Rating of BBB Fitch: Rating of BBB Moody’s: Rating of Baa2
Factor 2: Plan Design – CFPB will evaluate the offeror’s plan design and any plan design deviations (see Section 2, Paragraph 3.1). Offerors shall confirm that they provide all required services and require no deviations from the Plan Design.
Please note: Any deviations to the Plan Design requirements will render the offeror’s proposal technically unacceptable. Offerors must be able to meet all plan design requirements specified in the Statement of Requirements and will not be credited for providing deviations to the specified requirements.
Factor 3: Firm Experience – The Offeror must have one (1) year of prior experience providing disability insurance benefit services as a prime contractor within the last five
(5) years. Dollar value and contract description must establish that the Offeror experience is similar in size, scope, and complexity to the Statement of Requirements.
The Offeror must submit the following information to demonstrate this minimum experience requirement:
Customer name and address.
Contract number.
Total dollar value of the contract. If performed as part of a team, provide the dollar value of your firm’s contribution.
Period of contract performance.
Description of services provided, including the specific services provided by your firm.
Factor 4: Price
The Government will determine which Offeror proposes the lowest evaluated price for the five
(5) year period (base year and four option years), using the following methodology and analysis of information supplied in the pricing tables of the Pricing Model (Attachment 1) of this solicitation.
For the Base Year and each of the four Option Years, the proposed biweekly premium rates by line of coverage (Short-Term and Long-Term) will be multiplied by the applicable volume divided by $10 or $100, Short and Long-term respectively, to develop a biweekly premium. The biweekly premium will then be multiplied by 26 to calculate the annual premium by line of coverage or age band. The sub-total by line of coverage or age band will be totaled to determine the total annual premium for the Base Year and each of the four Option Years.
