This acquisition is being conducted under FAR 13.5 Simplified Procedures for Certain Commercial Items. Only FAR Part 13 procedures will be used to solicit and evaluate offerors. Per FAR 52.216-1, the Government contemplates award of a firm-fixed-price contract resulting from this solicitation.
MSC Strategic Sealift Program Support Office, N103A, requests proposals for vessel(s) capable of meeting the transportation requirements described below. The paragraph numbers below apply to the box layout of references (a) and (b), which are incorporated herein by reference (available on the MSC web site at https://www.msc.navy/mil, under “Contracts,” then “Proforma” or upon request), and shall be the charter form of any contract resulting from this solicitation. By submission of a proposal, the offeror confirms agreement with all terms and conditions of this solicitation and the charter form, unless otherwise identified therein.

A. PART I - TUGCON BOXES:
1. Vessel Required:
a. General: One U.S. flag, Jones Act, and ocean certified tug capable of a tandem tow of yard craft barges, YC-1574 and 1632 “IAW the U.S. Navy Tow Manual (SL740-AA- MAN-010)” from Naval Base San Diego, CA to Joint Base Pearl Harbor Hickham, HI.
b. Description of the tows – each barge is:
• 111 LT (Long Tons) or 243,566 lbs. displacement
• 110.0 feet LOA
• 32.0 Feet Beam
• Lightship Draft 1.0 foot and 6.0 inches
c. Minimum Tug Requirements:
• Bollard Pull: Sufficient to tow both barges in seasonal weather conditions at a minimum tow speed of 6 knots. Maximum tow speed to be calculated IAW the U.S.
Navy Tow Manual.
• Sufficient endurance to complete tow without stops for fuel or supplies.
• Internet and Satellite phone capability.
• Owners must provide an Independent Marine Surveyor for tow certification.
• Owners must provide tow bridle and hardware, emergency tow lines, flooding alarms, navigation lights and day shapes IAW the COLREGS Rules of the Road and perform mailto:courtney.t.woodley.civ@us.navy.mil nondestructive testing of tow vessel deck fittings for submission in a comprehensive towing package.
• Owners must prepare and submit a comprehensive towing package for review and approval prior to commencement of tow.
• U.S. Navy Towing Manual (SL740-AA-MAN-010) will be used and complied with for this requirement. The link for download is:

• Barge pictures and General Arrangement drawings will be available upon request.
• There will be pre-tow conferences in San Diego, CA prior to towing barges. The time of this meeting will be mutually agreed upon by MSC, Sponsor, and contractor, but should occur not later than 24 hours before tow. Required attendees include Tug Captain/Contractor Representative(s), MSC Representative(s), Sponsor representative(s), and the Independent Marine Surveyor (IMS).
• Position reports shall be issued by electronic mail: vessel shall provide position/status report in port twice daily at 0000Z and 1200Z and at-sea four times daily at 0000Z, 0600Z, 1200Z, and 1800Z. Additionally, position/status reports shall also be sent upon arrival port, upon departure port and at other times requested by the applicable MSC Area Command for Force Protection reasons.

3. Port of Destination: Joint Base Pearl Harbor Hickham, HI, Pier Location TBD
4. Laytime: Respondents provide the number of days required for the entire mission.
5. Laydays: Barges are currently available and shall be picked up not earlier than 01 April 2022.
Respondents provide date available to pick up the tow at Naval Base San Diego, CA. Delivery of barges to place of destination is required no later than 30 April 2022.
6. Terms/Conditions/Attachments (added, deleted or modified):
ADD SPECIAL REQUIREMENTS:
(1) There will be pre-tow conferences in San Diego, CA prior to towing barges. The time of this meeting will be mutually agreed upon by MSC, Sponsor, and contractor, but should occur not later than 24 hours before tow. Required attendees include Tug Captain/Contractor Representative(s), MSC Representative(s), Sponsor representative(s), and the Independent Marine Surveyor (IMS).
(2) U.S. Navy Towing Manual (SL740-AA-MAN-010) will be used and complied with for this requirement. The link for download is:

(3) Contractor shall obtain the services of an Independent Marine Surveyor (IMS). This service should be included in the offer’s lump sum price. The IMS is an independent third party to act as a mediator between the Navy and the contractor to provide independent analysis of the operation and to assist in settling disagreements. The IMS selected should be proposed by the towing contractor and agreed to by MSC technical representative. IMS duties shall include the following:
(a) Perform detailed technical evaluation and oversight as necessary, to ensure the tug and
YC-1574 and 1632 are prepared and rigged for tow IAW the U.S. Navy Towing Manual, as applicable.
(1) Technical evaluations shall include a review of the following:
- Contractor prepared Tow Package.
- Pre-Tow checklist to include items such as verify condition of the barge to be towed as seaworthy of the tow
- Material condition of tug and barge.
- Preparations of the tug and barge.
- Inspection of all material, equipment, hardware, lines and required certificates.
- Completed U.S. Navy Towing Manual Appendix H.
(b) Issue a Towing Certificate when the tug and barge are safely rigged for tow to be included in the towing package.
(4) The cargo shall be picked up at its pier location at Naval Base San Diego and delivered to the cargo’s designated pier location at Joint Base Pearl Harbor Hickham, HI. Contractor shall coordinate all arrangements for arriving and departing ports with the appropriate authorities. Assist tugs, if required, are the responsibility of the Contractor. Contractor is responsible for line handlers on the tug and cargo as required.
(5) The ship-owner agrees that crew and other embarked personnel may be ordered by the charterer to stay aboard the vessel during port visits under this charter as deemed necessary by the charterer or local government authorities. Further, the ship-owner agrees that the charterer may limit access to the vessel by any shore-side personnel upon the vessel’s port calls during this charter.
(6) Owner agrees that no routine crew changes will occur during the course of the charter and that all costs (e.g., transportation, Restriction of Movement, or other quarantine costs) associated with any non-routine crew changes shall be the responsibility of the Owner and not the Charterer.
MODIFY PART III. TUGCON TERMS AND CONDITIONS (Addendum FAR 52.212-4 (d)(3)) to read as the following:
Independent Marine Surveyor (IMS) must have prior experience towing military cargo and completing the Comprehensive Tow Package IAW the U.S Navy Tow Manual. Independent Marine Surveyor and an MSC representative must approve the Comprehensive Tow Package, prepared IAW the Navy Tow Manual, prior to tug on hire (submitted to tina.kim.civ@us.navy.mil and timothy.c.vickers.civ@us.navy.mil).
MODIFY PART III. TUGCON TERMS AND CONDITIONS (Addendum FAR 52.212-4 (k)) to read as the following:

(d) Comptroller General Examination of Record. Offerors shall use the guidelines set forth in Part VIII for submission of offers; however, at a minimum, offers must contain the following:
