About this file

The document consists of two certification forms from the Kenton County Airport Board related to bidder residency status for a Kentucky state procurement opportunity. The forms provide detailed instructions for bidders to certify their status as either a Kentucky resident or non-resident bidder, which impacts potential preference in the bidding process. For Kentucky resident bidders, the certification requires proving authorization to transact business in the Commonwealth, filing Kentucky Corporate Income Taxes, making payments to the Kentucky Unemployment Insurance Fund, and maintaining a Kentucky Workers Compensation Policy during the year prior to the bid advertisement.

The certification process is specifically tied to a backup network storage procurement for the Cincinnati/Northern Kentucky International Airport (CVG), with key dates including a February 24, 2025 deadline for questions, February 27, 2025 for answer postings, and a bid submission deadline of March 6, 2025 at 2:00 pm. The forms outline that Kentucky law provides a preference for resident bidders against non-resident bidders, with the preference equal to what the non-resident's home state would provide. Bidders must complete the appropriate certification form based on their residency status, and may be required to provide proof of their claims, with potential consequences for failing to substantiate their certification.

KENTON COUNTY AIRPORT BOARD

CERTIFICATION AS TO KENTUCKY RESIDENT STATUS

1. Kentucky law provides that a Kentucky resident Bidder shall be given a preference against a nonresident Bidder equal to the preference given or required by the state of the nonresident Bidder, unless such preference conflicts with federal law. In addition, if a procurement determination results in a tie between a Kentucky resident Bidder and a non-resident Bidder, preference shall be given to the Kentucky resident Bidder.

2. To be eligible to be considered as a Kentucky resident Bidder, a Bidder must: (i) satisfy the requirements set forth under Sections 3(a) and (b) below; and (ii) properly complete this certification and submit it with the Bid. Do not sign and submit this certification unless you meet each of the requirements set forth below under Sections 3(a) and (b) below. If a Bidder does not meet the requirements set forth below under Sections 3(a) and (b) the Bidder must furnish a Certification as to Non-Resident Status contained within this solicitation.

3. The undersigned, by subscribing to this certification, certifies under oath and upon penalties of perjury, that each of the following is true and correct and that the Bidder can furnish proof upon request by KCAB that each of the following is true and correct:

(a) The Bidder was authorized to transact business in the Commonwealth; and

Prior to an award to a Kentucky resident Bidder, KCAB may require the Bidder to furnish proof satisfactory to KCAB that the Bidder meets each of the requirements set forth in (a) and (b) above.

Failure to timely submit such proof upon KCAB’s request may result in the lack of a preference being applied.

By certifying and signing below, I certify that each of the foregoing is true and correct for the Bidder submitting this Bid.
