MHE could result in catastrophic mechanical failure causing damage to the equipment itself, the ship, loss of cargo, personal injury, or death.
C. __ X_ Unusual and Compelling Urgency: The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage, or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent and compelling requirement is based on the following:

The Logistics Life Cycle Management Division (N44) was unable to garner the required funding for this service. These delays have caused mission degredation and precipitated an urgent situation.

Navy ERP precluded the Logistics Life Cycle Management Division (N44) from securing timely funds to conduct the maintenance and safety certify the reserve pool ofMHE assets normally used to swap out forklift for the fleet during availabilities, As such, as of
20 Oct 2021 the MHE pool reserve has zero certified MHE assets available for swap out.
The Logistics Life Cycle Management Division (N44) is at mission failure. Immediately safety certification of the required assets will help all MSC vessels meet mission demands. The immediate need is the re-outfitting ofUSNS PATUXENT coming out of an availability and USNS JOHN LEWIS being delivered to MSC. The Logistics Life
Cycle Management Division (N44) must provide USNS JOHN LEWIS it's initial outfitting ofMHE assets. Getting these forklifts certified is crucial to the continuance of
MSC's CLF mission.
