N10 - CONTRACTS AND BUSINESS MANAGEMENT DIRECTORATE
COMBINED SYNOPSIS/SOLICITATION
Military Sealift Command Combined Synopsis and Solicitation Notice Information
1. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.
2. Solicitation number is N3220522Q0037 and is being issued as a Request for Quotes (RFQ).
3. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular (FAC) FAC 2021-07 / 09-10-2021 located on https://www.acquisition.gov
4. The associated NAICS code is 811310 and the associated PSC code is J039 for this procurement: NOTE:

0001 Inspect, service, repair, weight test and certify fifteen
(15) Hyster forklifts and two (2) Wesley International forklifts in accordance with the statement of work below. Service will include labor, travel and material.

6. Statement of Work (SOW): The following work items shall be accomplished by the selected service provider (contractor) at the Government’s facility in conjunction with this repair and maintenance requirement.
The Government intends to award a Fixed Price Contract to the selected service provider:
a. Services to MHE identified in Table 1 below shall be performed ashore at the Government’s facility. The Contractor’s quote shall specify the proposed location of the service and provide a summary of the proposed process for training, maintenance, repairs, and safety recertification.
b. Contractor shall perform all related inspections (incl. fork/tines), maintenance, repair, testing and certification of MHE identified in Table 1 in accordance with the requirements set forth in references (a) and (b), attachments 1 through 3 (technical exhibits), and appropriate vehicle technical manuals.
c. Contractor shall conduct training and instruction for up to three (3) MHE Program Support staff personnel in the procedures associated with the successful completion of periodic maintenance and repair of all equipment listed in Table 1, below.
d. Contractor shall conduct training and instruction for up to three (3) MHE Program Support staff personnel in the procedures required to inspect, test and certify all shipboard/ashore model type Material Handling Equipment (MHE) – and associated equipment assets - in accordance with guidance procedures and requirements set forth in references (a) and (b).
e. Contractor shall perform an operational check on all forklift batteries installed in MHE identified in Table 1.
Contractor shall provide a condition report on batteries including all recommended repair/replacement actions.
f. Contractor shall provide training for up to three (3) MHE Program Support staff personnel in the performance of basic corrosion control, spot painting techniques and proper marking/ stenciling on all MHE identified in Table 1 utilizing appropriate wire brush and approved application processes. Contractor shall perform these service requirements (as required), if beyond the capability and/or availability of customer activity personnel.
g. Scope of repair work includes, repair/replacement of brakes (including parking brakes, master cylinders, wheel cylinders, brake shoes, and brake lines); lights and light wiring; vehicle electronics and computers; encoder bearings; bushings; mechanical and hydraulic systems; hydraulic hoses; lifting components; repack lift and tilt cylinders as necessary; verification of error codes and completion of repairs required to clear the codes; re-stenciling; tire replacement utilizing warehouse/reserve stock and equipment tire press at Building LP-26. Items outside the scope of work include: transmission repairs, major engine repairs, differential repairs, and repairs requiring the removal of any major component (e.g. engine, mast, counterweight, and axle).
h. Contractor shall perform a test of all rear brake systems on standard HYSTER forklifts listed in Table 1 by lifting the rear axle off the ground, applying the brakes and testing the brake operation. Proper operation of the rear master cylinder and wheel cylinders will be verified. Master cylinder and brake drums shall be adjusted to ensure appropriate rotational resistance of the rear wheel with brake pressure applied.
i. Contractor shall remove, and inspect the counterweight, mounting bolt, and the base plate threads for wear on all shipboard diesel forklifts to include removing the bolt, and counter weights for inspection of rust, corrosion, and worn threads on the bolts, and threaded base plate surface. Contractor shall re-install the counterweight, and mounting bolts that are within SAE standards, and re-torque the counterweight bolts to 410 foot pounds, or replace the bolts, and re-thread the base plates that fail the visual inspection, as required.

NOTE: Many of these assets are unable to be moved therefore the service must take place in Bldg LP-26.
8. Deliverables:
The contractor shall provide
a. Condition report for all units listed in Table 1 to the MHE Program Support Office at MSC Norfolk (N44) within 10 days of receipt of MHE.
b. Contractor shall complete and sign an MHE Safety Certification form for each asset listed in Table 1 in accordance with NAVSEA Instruction SW023-AH-WHM-010 reference (a.
c. Contractor shall complete and sign a Fork Inspection form for each unit listed in Table 1 in accordance with NAVSUP P-538 guidance.
d. Final condition reports containing all remaining additional work requirements to the MHE Program Support Office no later than 15 days prior to the end of the scheduled Period of Performance (POP) listed in paragraph 4, above.
e. Safety Certification Markings stenciled or affixed to each unit listed in Table 1.
f. A condition report on all batteries installed in electric and diesel forklifts, (as required).
g. Contractor shall coordinate with the technical point of contact to arrange U.S. Government inspection of the MHE/forklifts prior to their return. The inspection will occur on a date mutually agreed upon by the service provider and technical point of contact.
h. A copy of all condition reports, certification paperwork and inspection forms to the Norfolk technical points of contact, listed below.
i. Contract must be able to read and understand all items listed on Technical Exhibits (attachment 1, 2 and 3). These items are all REQUIRED to be perform, additional repair action found that are not listed on these attachment must be submitted on condition found report within 5 days of receipt and approved by an MSC government representative.
9. Qualifications: The selected service provider/contractor must meet the following qualifications.
a. All management and technical personnel performing above listed services must be able to demonstrate the following:
- Experience performing safety certifications on shipboard-approved MHE in accordance with the requirements set forth in the NAVSEA SW023-AH-WHM-010, NAVSUP PUB 538, and equipment technical manuals.
- Experience interpreting, trouble-shooting, and resetting HYSTER on-board dash displays.
- Access to HYSTER proprietary hardware and software required to reset onboard electronics.
- Able to read and understand the Technical Exhibits and meet all requirement.
b. Contractor shall staff and equip the service with the capability to perform all actions without assistance from MSCHQ command personnel.
c. Contractor must have access to technical and diagnostic manuals applicable to the equipment being serviced.
d. Contractor shall have the ability to change/press tires using existing location tire press (if available) and/or obtain alternate services relative to satisfying the MHE asset requirement.
e. Contractor must be able to perform the required services within the Period of Performance (POP) identified in the RFQ/Statement of Work document. If additional work is identified, and approved by the Government, the Contractor must have the ability to complete the additional service work by close of the requested POP as well.
f. Contractor shall complete a security form for each employee that will be servicing MHE onboard government installations and submit the information (including, but not limited to name, social security number, and birth date) to Military Sealift Command (MSC)/MSC Security Officer, as requested. The Government will provide approval for personnel to access base installation locations for a pre-determined timeframe (up to one year), as appropriate.
g. Contractor personnel performing maintenance and repairs onboard MSC vessels or affiliated shore activities shall abide by all DOD, Navy, MSC security requirements and clearance procedures required to access U.S. Government facilities and/or MSC customer locations.

14. The provision at FAR 52.212-1, Instructions to Offerors – Commercial applies to this acquisition and is incorporated by reference. The provision is amended as follows:
52.212-1 (ADDENDUM) ADDITIONAL INSTRUCTIONS TO OFFERORS--COMMERCIAL
ITEMS
a. Any inconsistency between FAR Provision 52.212-1 and the Addendum to FAR 52.212-1 shall be solved by giving precedence to the Addendum to FAR 52.212-1.
b. After receipt of quotes the Government may, with or without notice, negotiate with and, if desired, seek quote revisions from as many or as few quoters as it, in its discretion, deems appropriate.
c. The term “offeror” or “offer” as used in FAR 52.212-1 shall be understood to mean “quoter” and “quote,” respectively. Further, the term “award” shall be understood to describe the Government’s issuance of an order.

d. The Government will consider all quotes that are timely received and may consider late quotes.
Failure of a quote to address any items required in the submission package may make a quote unacceptable.
e. Paragraph (b) of FAR Provision 52.212-1, Submission of Offers, is amended as follows:
In addition to the quote submission requirements stated in FAR provision 52.212-1, quoters shall provide the following, as part of the quote submission package, no later than the required time and date for quote submission:
Responsible sources shall provide the following:
1. Price quote which identifies the requested item(s), unit price inclusive of shipping (if any), and extended price.
2. Total Firm Fixed price
3. Price quotes shall be accompanied by the vendor’s published labor rates.
4. Any Discount Terms
5. Estimated time of delivery
6. Technical Submission Requirements
a. For Parts/Supply buy, the quote shall contain a description including part number and title for each item listed in the solicitation to allow the Government to verify that the quoted parts match the requirements listed in the requirements schedule. Brand Name/OEM parts shall be used for this service.
b. Quote shall contain ALL material, labor and travel to complete the entire service requirement without contract modification.
c. It is strongly encouraged that prospective vendors comply with FAR 52.237-1 Site Visit to determine what material is required prior to submitting a quote. Points of contact are in Paragraph 10 of the SOW.
d. Quote must contain proof that the vendors have the experience and capability as specified in paragraph 9 of the statement of work above. Failure to provide proof will be considered non-compliant and will be deemed non-responsive.
7. Responses to the solicitation are due 11 November 2021 @ 3:30 PM, Norfolk, VA time. Quotes may be e-mailed to Kyanee McAllister, Kyanee.t.mcallister@navy.mil and James Van Natta, james.vannatta@navy.mil. Please be sure to copy both parties with your quote. To be considered timely, an E-mail quote must be received in its entirety in the designated E-mail inbox by the due date and time for quote submission. Quotes received after that time will be considered at the Government’s sole discretion. Please reference the solicitation number on your quote.

The Government will consider all quotes that are timely received and may consider late quotes in accordance with 52.212-1. Failure of a quote to address any items listed in the attached submission package may make a quote unacceptable.
15. Provision 52.212-2 Evaluation—Commercial Items (Oct 2014) applies to this acquisition.
(a) The Government may award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
(i) technical capability of the item offered to meet the Government requirement;
(ii) price;
Award shall be made to the lowest priced technically acceptable offeror in LPTA solicitations.
To be considered a technically acceptable solution for a parts procurement, the quoted parts shall meet the solicitation requirements including required parts, delivery dates, and terms and conditions stated in the solicitation.
To be considered a technically acceptable solution for a service, the quoted service shall meet the solicitation requirements including terms and conditions stated in the solicitation. The quote shall state that all aspects of the technical requirement, including required delivery date and part numbers, can be met.
The Government will evaluate quoted pricing for reasonableness utilizing techniques described in FAR 13.106-3.
(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror by the Government within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
16. All Offerors must include a completed copy of FAR 52.212-3, Offeror Representations and Certifications – Commercial Items with its offer.
17. Clause 52.212-4 Contract Terms and Conditions – Commercial items (OCT 2018), applies to this acquisition.
18. CLAUSE 52.212-5, CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (DEC 2019)
The Offeror shall not complete the representation in this provision if the Offeror has represented that it “does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument” in the provision at 52.204-26, Covered Telecommunications Equipment or Services-Representation, or in paragraph (v) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items.
(a) Definitions. As used in this provision— “Covered telecommunications equipment or services”, “critical technology”, and “substantial or essential component” have the meanings provided in clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition. Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. (c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for “covered telecommunications equipment or services”.
(d) Representation. The Offeror represents that it □ will, □ will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
(e) Disclosures. If the Offeror has represented in paragraph (d) of this provision that it “will” provide covered telecommunications equipment or services”, the Offeror shall provide the following information as part of the offer—
(1) A description of all covered telecommunications equipment and services offered (include brand; model number, such as original equipment manufacturer (OEM) number, manufacturer part number, or wholesaler number;
and item description, as applicable);
(2) Explanation of the proposed use of covered telecommunications equipment and services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b) of this provision;
(3) For services, the entity providing the covered telecommunications services (include entity name, unique entity identifier, and Commercial and Government Entity (CAGE) code, if known); and
(4) For equipment, the entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the OEM or a distributor, if known).

52.204-25 PROHIBITION ON CONTRACTING FOR CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (AUG 2020)
(a) Definitions. As used in this clause—
Backhaul means intermediate links between the core network, or backbone network, and the small subnetworks at the edge of the network (e.g., connecting cell phones/towers to the core telephone network).
Backhaul can be wireless (e.g., microwave) or wired (e.g., fiber optic, coaxial cable, Ethernet).
Covered foreign country means The People’s Republic of China.
Covered telecommunications equipment or services means–
(1) Telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities);
(2) For the purpose of public safety, security of Government facilities, physical security surveillance of critical infrastructure, and other national security purposes, video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities);
(3) Telecommunications or video surveillance services provided by such entities or using such equipment;
or
(4) Telecommunications or video surveillance equipment or services produced or provided by an entity that the Secretary of Defense, in consultation with the Director of National Intelligence or the Director of the Federal Bureau of Investigation, reasonably believes to be an entity owned or controlled by, or otherwise connected to, the government of a covered foreign country.

Critical technology means–
(1) Defense articles or defense services included on the United States Munitions List set forth in the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations;
(2) Items included on the Commerce Control List set forth in Supplement No. 1 to part 774 of the Export Administration Regulations under subchapter C of chapter VII of title 15, Code of Federal Regulations, and controlled-
(i) Pursuant to multilateral regimes, including for reasons relating to national security, chemical and biological weapons proliferation, nuclear nonproliferation, or missile technology; or
(ii) For reasons relating to regional stability or surreptitious listening;
(3) Specially designed and prepared nuclear equipment, parts and components, materials, software, and technology covered by part 810 of title 10, Code of Federal Regulations (relating to assistance to foreign atomic energy activities);
(4) Nuclear facilities, equipment, and material covered by part 110 of title 10, Code of Federal Regulations (relating to export and import of nuclear equipment and material);
(5) Select agents and toxins covered by part 331 of title 7, Code of Federal Regulations, part 121 of title 9 of such Code, or part 73 of title 42 of such Code; or
(6) Emerging and foundational technologies controlled pursuant to section 1758 of the Export Control Reform Act of 2018 (50 U.S.C. 4817).
Interconnection arrangements means arrangements governing the physical connection of two or more networks to allow the use of another's network to hand off traffic where it is ultimately delivered (e.g., connection of a customer of telephone provider A to a customer of telephone company B) or sharing data and other information resources.
Reasonable inquiry means an inquiry designed to uncover any information in the entity's possession about the identity of the producer or provider of covered telecommunications equipment or services used by the entity that excludes the need to include an internal or third-party audit.
Roaming means cellular communications services (e.g., voice, video, data) received from a visited network when unable to connect to the facilities of the home network either because signal coverage is too weak or because traffic is too high.
Substantial or essential component means any component necessary for the proper function or performance of a piece of equipment, system, or service.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub.
L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. The Contractor is prohibited from providing to the Government any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract, or extending or renewing a contract, with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system, unless an exception at paragraph (c) of this clause applies or the covered telecommunication equipment or services are covered by a waiver described in FAR 4.2104. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
(c) Exceptions. This clause does not prohibit contractors from providing—
(1) A service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(2) Telecommunications equipment that cannot route or redirect user data traffic or permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(d) Reporting requirement.
(1) In the event the Contractor identifies covered telecommunications equipment or services used as a substantial or essential component of any system, or as critical technology as part of any system, during contract performance, or the Contractor is notified of such by a subcontractor at any tier or by any other source, the Contractor shall report the information in paragraph (d)(2) of this clause to the Contracting Officer, unless elsewhere in this contract are established procedures for reporting the information; in the case of the Department of Defense, the Contractor shall report to the website at https://dibnet.dod.mil. For indefinite delivery contracts, the Contractor shall report to the Contracting Officer for the indefinite delivery contract and the Contracting Officer(s) for any affected order or, in the case of the Department of Defense, identify both the indefinite delivery contract and any affected orders in the report provided at https://dibnet.dod.mil.
(2) The Contractor shall report the following information pursuant to paragraph (d)(1) of this clause
(i) Within one business day from the date of such identification or notification: the contract number; the order number(s), if applicable; supplier name; supplier unique entity identifier (if known); supplier Commercial and Government Entity (CAGE) code (if known); brand; model number (original equipment manufacturer number, manufacturer part number, or wholesaler number); item description; and any readily available information about mitigation actions undertaken or recommended.
