4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

At this time, NAWCWD cannot support multiple device types. If a new source was chosen, NAWCWD would be forced to purchase everything in this current order, replacements for existing HOTAS, and to task simulator vendors with interface modification, one of which has tightly integrated calibration software. In addition there would be significant mount redesign and remanufacturing. In 2019, comparable vendors charged roughly for their F-35 HOTAS.

The below table details expected cost if the system was to be sourced to anyone other than Bugeye Technologies. It assumes the cost is similar for F-18 front seats (Throttle & Stick) and back seats (two hand controllers). It also assumes for engineering support from the simulator developers, in line with estimates received from the simulator vendors on other efforts.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

In accordance with DFARS PGI 206.302-1(d), a sources sought for this requirement was posted in Contract Opportunities on the beta.sam website on 17 June 2021 with a capability submission date of 27 June 2021. One response was received.

Aerotronics LLC:

Aerotronics LLC proposed the use of their Aerotronics Grips and Controllers. After Technical Review of their response, Aerotronics response presented several issues:

1. The Aerotronics devices are not drop-in replacements (neither physically, electrically, nor in their software-interface) for the existing Bugeye Technologies devices already in use.

2. Aerotronics LLC does not provide repair services for 3rd Party devices (such as the existing Bugeye Technologies devices already in use).

3. Using the Aerotronics equipment would entail hardware and software redesign efforts at two major contractors in addition to in-house redesign of the physical hardware mounts resulting in greatly increased cost to the project.

A combination synopsis / solicitation will also be prepared in accordance with simplified procedures outlined in FAR Subpart 13.5.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the estimate. Bugeye Technologies Inc proposal will be reviewed by experienced technical analysts, cost analysts, and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

NAWCWD China Lake, CA has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAWCWD China Lake, CA will assess whether competition for future requirements is feasible.
