About this file
This document is a Justification and Approval (J&A) for a sole-source procurement by the Defense Logistics Agency (DLA) Troop Support for a Winch Parts Kit. The procurement is for National Stock Number (NSN) 3950-99-244-1495, a 72-month Parts Kit for a davit manufactured exclusively by Caley Ocean Systems Limited. The kit contains 250 parts with 829 individual pieces, critical for maintaining ship equipment by replacing underperforming parts. DLA determined Caley is the only source capable of producing this proprietary kit, which is essential for Navy vessel maintenance and mission readiness.
The J&A justifies using other than full and open competition under 10 U.S.C. 2304(c)(1), citing Caley as the sole Original Equipment Manufacturer with the necessary technical knowledge. A Sources Sought Notice issued on January 31, 2024, received no responses. The first-time buy is planned for August 2024, with a market research survey confirming the pricing is strictly material cost-driven. Future solicitations will include a procurement note encouraging alternate product submissions, and technical data packages will be reviewed by the Government Engineering Support Activity to potentially expand competition in subsequent acquisitions.

Justification and Approval (J&A) Format
1. Defense Logistics Agency (DLA) Troop Support, Construction and Equipment Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for DLA requirements on an other than full and open competition basis.
3. Following are the supplies required to meet DLA’s needs:
National Stock Number (NSN): 3950-992441495 Item Description: Parts Kit, Winch Approved Source: Caley Ocean Systems Limited (CAGE KA522) Contractor Part Number: KIT-LPD/72 Quantity: 1.00 KT Unit Price:
Estimated Dollar Value:
4. The applicable statutory authority permitting other than full and open competition is 10 U.S.C. 2304(c)(1) as implemented by FAR Part 6.302-1, only one responsible source and no other supplies will satisfy agency requirements.
5. The use of this authority is necessary because Caley Ocean Systems Limited (“Caley”) is identified as the Original Equipment Manufacturer (OEM) of this 72-month Winch Parts Kit. This kit is used to maintain a davit, which is a crane-like device, to replace parts on ships that have exceeded their useful life. It is necessary to keep the applicable machine fully functional and provides the crew with a proven mechanism to support, raise, and lower equipment such as boats and anchors in a seamless manner.
If the davit is not available for use, then the warfighter cannot deploy the necessary watercrafts to complete their mission. Furthermore, they may not be able to lift the vessel to receive their scheduled maintenance thus avoiding future equipment failure.

There is another kit manufactured by Caley that can be used for a 36-month overhaul.
The 36-month procedure is not as comprehensive as the 72-month part kit being procured, and may be utilized only for minor refurbishment, and reusage of parts. In comparison, the 72-month part kit, is a more thorough kit which can accommodate the full replacement of the underperforming parts of the davit with newly conditioned ones.
There are no other winch part kits available for this usage due to the proprietary davit which can only be manufactured by Caley. This individual davit has been modified to meet the Navy’s performance metrics with the Caley complete parts kit overhaul.
Caley is the only one possessing the technical knowledge and skills needed in terms of the manufacturing of the parts for assembly and maintenance for the davit. The 72-month kit has 250 parts consisting of 829 individual pieces. A different kit would not be acceptable as the parts would be inferior and would not be engineered for the modified davit. This could cause parts to break, improper functionality, and potentially increased down time. The government does not possess the unrestricted technical data needed to develop an acceptable kit that meets the governments need for purpose of full and open competition. Subject National Stock Number (NSN) 3950-99-244-1495 must be acquired from the manufacturing source specified as the approved source for this item of supply.
Suitable technical data or government rights are not available to permit acquisition from any other source.
6. A Sources Sought Notice (SSN) was issued on January 31, 2024, and closed on March 1, 2024. No vendors responded to the SSN. Furthermore, this justification for other than full and open competition will be made available for public inspection, with the solicitation, in accordance with FAR 6.305(c).
7. As the contracting officer, I hereby determine that the anticipated cost to the Government will be fair and reasonable based on comparison of offeror’s prices to prices for the kit components available in the commercial market. Other than certified Cost or pricing data, including non-Government sales data for quantities comparable to those in the solicitation, will be requested with initial offers.
8. A market research survey was sent to Caley Ocean Systems Limited, who is the approved source of supply for this winch parts kit, conducted from February 1, 2024, to February 8, 2024. Caley Ocean Systems Limited completed the market research survey on February 22, 2024. According to the information received, the pricing for this item is strictly material cost driven. This parts kit includes approximately 830 pieces which need to be packaged and have different delivery lead times.
9. Based on prior research Caley Ocean Systems Limited is the only manufacturer of this item and it is strictly proprietary. There are no other facts supporting the use of other than full and open competition.
Source Selection Information – FAR 2.101 AND 3.104
10. The OEM Caley Ocean Systems Limited (CAGE: KA522) is the only vendor to express interest in this acquisition. This acquisition is the First Time Buy for NSN 3950- 99-244-1495.
11. Actions taken to remove or overcome any barriers to competition before any subsequent acquisition include:
Procurement Note L04, Offers for Part numbered Items (SEP 2016), will be included in this and future solicitations to encourage the submission of offers for alternate products.
Technical data packages for alternate items will be sent to the Government Engineering Support Activity (ESA) for review/approval.
12. As the contracting officer, I hereby certify that this justification is accurate and complete to the best of my knowledge and belief.
