This action will be awarded as a new contract. It is planned that this will be awarded under a Firm Fixed Price (FFP) pricing structure.

V. Demonstration that the contractor's unique qualifications or nature of the acquisition requires the use of the authority cited above (applicability of authority).
VI. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.
Competition can be obtained for this effort. This justification only restricts competition to vendors with the ability to offer the Vaisala MW-51 Multichannel specific brand/system. SAM.Gov will be used in order to gain the most competition possible.
VII. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The Contracting Officer will ensure that the items described herein are negotiated at a fair and reasonable price to the Government. In accordance with (IAW) FAR Subpart 15.403 as supplemented, the contractor will not be required to provide certified cost or pricing data. A price analysis will be accomplished. The cost of this acquisition will be fair and reasonable. Actions anticipated to ensure reasonableness of the price will be accomplished with procedures and criteria contained in Federal Acquisition Regulation (FAR) under Part 30 - Cost Accounting Standards, Part 31 - Contract Cost Principles and Procedures, Subparts
15.4 - Contract Pricing, as appropriate. Further actions will be under the guidance of the Contract Pricing Reference Guides, jointly developed by the Federal Acquisition Institute and the Air Force Institute of Technology.

VIII. Description of the market research conducted and the results, or a statement of the reasons market research was not conducted.
309 SWEG Acquisitions did a search on GSA Advantage. The OEM was the only vendor found to offer this product. However, this requirement includes open market items, so GSA cannot be utilized. A phone conversation by the Program Manager to the Original Equipment Manufacturer (OEM) found that the OEM does not wholesale to 3rd parties for resale but has no restriction on a 3rd party purchasing their product to resell.
Therefore, this will go full and open through Sam.gov

Once the MW-51 system becomes operationally accepted (by August 2024) the parts will be stock listed by Space Force and will no longer need to be purchased by contract.
