This is a combined synopsis/solicitation for commercial items prepared in accordance with Federal Acquisition Regulation (FAR) Subpart 12.6, in conjunction with FAR Part 13, as supplemented with additional information included in this notice. Naval Supply Fleet Logistics Center (NAVSUP) Puget Sound intends to award a firm fixed price (FFP) purchase order using Simplified Acquisition Procedures for Batteries that meets the specifications outlined below. This announcement constitutes the only solicitation; a written solicitation will not be issued. Paper copies of this solicitation will not be available.

The Request for Quotation (RFQ) number is N0040624Q1005. This RFQ incorporates all provisions and clauses in effect through Federal Acquisition Circular (FAC) 2024-06 and the Defense Federal Acquisition Regulation Supplement (DFARS) DPN 09/16/2024. It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at these addresses:

The proposed contract action is for commercial supplies for which the Government intends to solicit as a Small Business Set-Aside. Interested persons may identify their interest and capability to respond to the requirement or submit quotes. This posting is a request for competitive quotes. All quotations received by the closing response date may be considered by the Government.

QUESTIONS: Offerors may submit their questions regarding clarification of solicitation requirements to Amanda Cordell via email at Amanda.j.cordell.civ@us.navy.mil no later than 1:00 PM EST on 20 SEPTEMBER 2024. Any questions received after this deadline may not be answered. Questions received by the deadline will be answered in an amendment to the solicitation.

Shipping term shall be FOB Destination; therefore, quote SHALL include shipping cost.

Quoting vendors must be registered in the System for Award Management (SAM) database to be considered for award. Registration is free and can be completed on-line at http://sam.gov/.

Quote packages are due by 23 SEPTEMBER 2024 at 1:00 PM EST. Late quotes will not be considered. Quote packages shall be sent to Amanda.j.cordell.civ@us.navy.mil and must contain a cover sheet that provides the following information:

1. Official Company Name;

2. Point of contact including name and phone number; and

3. Cage Code number.

To be considered for this opportunity, all quotes shall be submitted in either Microsoft Word, Excel spreadsheet or Adobe PDF. Quote must include price(s), FOB Destination, a point of contact, name and phone number, business size, cage code, and UEI number. The Government will award a contract resulting from this solicitation to the responsible quoter whose quote, conforming to the solicitation that will be of best value to the Government, taking price, past performance, and other factors into consideration. The Government intends to evaluate all timely quotes received from eligible quoters. The Government intends to evaluate quotations and award a contract without discussions with quoters.

Each quote must clearly indicate the capability of the vendor to meet all specifications and requirements in the Performance Work Statement. Responses to this solicitation are due by 23 SEPTEMBER 2024 at 1:00 PM EST.

CLIN 0001-0002 OF THIS SOLICITATION IS A 100% SMALL BUSINESS REQUIREMENT FOR FORKLIFT

BATTERIES

The Government anticipates awarding a firm, fixed price contract in response to quotes/proposals received to this solicitation.

Because a firm, fixed price contract places the maximum risk and full responsibility for all costs and resulting profit or loss on the contractor, offerors are advised to consider these risks when pricing their quotes/proposals.

1. This solicitation is for the procurement of CLINS 0001-0002 (FORKLIFT BATTERIES) in support of

NAVSUP FLCY CODE 451 MHE MANAGEMENT. It is anticipated that this solicitation will result in an award of a FIRM, FIXED PRICE SUPPLY type contract.

2. The entire solicitation shall be filled out and returned as part of your quote.

3. The deadline for submission of questions regarding the solicitation’s terms, conditions, specifications, and/or the Statement of Work (SOW) is 24 hours prior to the solicitation closing date.

All questions regarding this solicitation shall be submitted in writing to Amanda Cordell via email at Amanda.j.cordell.civ@us.navy.mil.

4. Award will be made to the quote/offer that represents the best value to the Government. Note: the Government reserves the right to consider the past performance of all quotes/offers, conduct a price, past performance tradeoff, and award to other than the lowest price quote/offer.

5. SINGLE AWARD FOR ALL ITEMS: Due to the interrelationship of supplies and/or services to be provided hereunder, the Government reserves the right to make a single award to the bidder whose quote is considered in the best interest of the government, price and other factors considered. Therefore, bidders who quote less than the entire effort specified herein may be determined to be unacceptable.

6. EXCEPTIONS: All bidders MUST note all exceptions from the solicitation’s terms and conditions, specifications, and/or the statement of work / performance work statement, if any. It will be assumed that any quote without mention of any exceptions will take no exception from all specifications, terms and conditions, clauses, or provisions within the solicitation.

7. SHIPPING INFORMATION: Important - all cargo shall be palletized in an appropriate manner. All cargo in the freight container shall be forklift accessible. Due to material handling safety reasons, cargo shall never be stacked on other cargo without appropriate safe method. Freight container with unsafe cargo stacking shall be rejected at receiving point. In this case, the contractor shall de-van all cargo and re-deliver the shipments to the destination at contractor’s expense.

SHIPPING INFORMATION

HAZARDOUS MATERIAL, PREPARATION FOR DELIVERY (Previously D14)

1. The preservation, packaging, and packing of hazardous materials shall be in accordance with the requirements of one of the regulations listed below, depending upon the mode of shipment. In the event of any discrepancies between the contract requirements and these regulations, the applicable regulation shall govern. Shipments must be packaged, packed, marked, labeled and certified in proper condition for transportation according to the following appropriate regulation:

a. Department of Transportation Code of Federal Regulations, Title 49, parts 100-199, as applicable, for domestic shipments;

b. U.S. Postal Service Publication #52 for shipments via the U.S. mail system;

c. International Maritime Organization's (IMO's) International Maritime Dangerous Goods Code (IMDGC) for shipments intended for delivery overseas via water transportation;

d. International Civil Aviation Organization (ICAO) Technical Instructions for the Safe Transport of

Dangerous Goods By Air or International Air Transport Association (IATA) Dangerous Goods Regulation for shipment via commercial air; and

e. AFJMAN 24-204 (formerly AFR 71-4)/TM 38-250/NAVSUP PUB 505/MCO P4030.19/DLAM 4145.3 (Preparing Hazardous Material for Military Air Shipments).

2. Address/Commodity marking and labeling requirements shall be in accordance with MIL-STD-129 and the appropriate governing regulation for the mode of shipment.

3. Unless otherwise stated below, assume surface transportation.

4. Limited Quantities. If an item offered for transportation falls within the guidelines of a limited quantity and is not regulated by the applicable mode of transportation, it shall be packaged to meet the requirements of Level A packaging listed in MIL-STD-2073-1.

5. In addition to the above, packaging (container and containment components) designs shall pass all applicable performance-oriented packaging (POP) tests in accordance with Title 49 CFR, the ICAO, IATA or IMDGC.

Compressed gases are excluded from these tests. Each packaging of acceptable design shall bear certification markings outlined in the regulations. All certificates and test reports denoting test compliance shall be available for inspection by authorized government representatives.

6. Contractors shall submit any discrepancies between contractually specified packaging procedures and Title 49 requirements to the Contracting Officer for review and evaluation.

7. Non-Manufactured Wood Packing. All non-manufactured wood utilized in wood pallets and wood containers shall be heat treated to a minimum core temperature of 56 degrees centigrade for 30 minutes and certified by an accredited agency recognized by the American Lumber Standards Committee (ALSC). Refer to www.aphis.usda.gov/ppq/swp/eunmwp.html for wood packing policy, enforcement regulations and accredited agencies. Non-coniferous (hardwood) and manufactured wood, such as particleboard and plywood, are exempt from this requirement.

(a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:

THE FOLLOWING NAVSUP LOCAL TEXT IS HEREBY MADE PART OF THE STATEMENT OF

WORK/PERFORMANCE WORK STATEMENT.

NAVSUP Fleet Logistics Center (FLC) Puget Sound (PS) may utilize contractor support through the AbilityOne Program, as needed, to perform contract closeout functions for this acquisition. Information, including business sensitive/confidential or proprietary data, that the offeror provides to the Government or information already in the possession of the Government may be viewed and utilized by the AbilityOne Program support contractor personnel during the course of its contract performance. The information that may be made available to the support contractor may include, for example, pricing and technical proposals, historical contract, pricing and performance information, Commercial Asset Visibility (CAV) reporting information and similar data/information.

By submission of a proposal in response to this solicitation, the offeror and its subcontractors consent to a release of their business sensitive/confidential or proprietary data to the Government's AbilityOne Program support contractor personnel in order to perform close out services. Prior to the release of any such information to the support contractor, the support contractor will have in place with the Government a Non-Disclosure/Non-Use Agreement in accordance with the terms of the AbilityOne Program support contract.

Offerors may execute their own Non-Disclosure Agreement with the AbilityOne Program (AbilityOne contact information available from the contracting point of contact).
