SECTION 1
PROJECT SPECIFIC INFORMATION
1.1 Project Overview
The United States Section of the International Boundary and Water Commission (USIBWC) requires the replacing of Headgate 1&2 Hoist control panel components and wiring at Amistad Dam located at 670 Texas Spur 349, Del Rio, Texas 78840.
1.2 General
A. This is a non-personnel services Contract for the replacing of Headgate 1 & 2 Hoist Westinghouse control panel components and wiring at Amistad Dam. The Government shall not exercise any supervision or control over the Contract service providers performing the services herein. Such Contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
B. This document is A Performance Work Statement (PWS) which describes the work in terms of the required results and the standards to be met rather than how the work is to be accomplished. The Contractor is solely responsible for determining the steps and tasks that the Contractor and Sub-Contractors will perform to attain the required results.
1.3 Description of Services
The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary for the replacing of Headgate 1&2 Hoist control panel components and wiring at Amistad Dam as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
1.4 Objective
The replacement of Westinghouse Headgate Hoist control panel 1 & 2 components and wiring to each Headgate Hoist device within 25 feet of control panels.
1. The Contractor shall replace all existing internal components such as terminal blocks, wiring, labels, breakers, and heaters with new Westinghouse components.
a. Each Headgate Control Panel shall maintain operability while a new control panel back board is being built to replace existing control panel back board.
b. All new components such as terminal blocks, wiring, labels, breakers, and heaters shall be mounted on new backboard and installed in existing Westinghouse NEMA 4 enclosure control panel.
c. All new Westinghouse components shall have the same functions and operational capabilities in accordance with Westinghouse Electric wiring diagram #873D083 and control equipment #657C399.
d. All new components and wiring shall be labelled on each end of the wiring the same as all existing components and wiring.

2. The Contractor shall replace all exterior control panel devices such as handles, breakers, locking handles, bolts, screws, electrical switches, electrical outlets, indicating lights, over-load reset button, control cable with ends to match existing, slack cable switches and labels on existing control panel.
3. The Contractor shall clean, varnish interior, remove exterior old paint and repaint the Westinghouse NEMA 4 enclosure control panel with primer and two coats of existing exterior gray enamel paint for metal.
1.5 Project Location
A. USIBWC Amistad Dam is located at 670 Texas Spur 349, Del Rio, Texas 78840.
B. The work is located completely within the United States but is adjacent to the international border with Mexico.
1.6 Period of Performance
A. The period of performance shall be for a maximum of Ninety (90) days after the Notice to Proceed (NTP) is issued by the Government. The Contractor may proceed with building the new boards for both control panels at its workshop offsite, as well as onsite, as soon as the contract is signed, and any required material approvals are obtained.
B. Replacement of a control panel components and wiring shall be completed one panel at a time. When all the new wiring and components are ready to replace the existing ones, the panel may be taken out of service for a maximum of five calendar days to complete the replacement.
C. Replacement of the Control Panels components & wiring and complete recommissioning shall be completed as follows:
• Headgate Hoist Control Panel #1, within 45 days after NTP.
• Headgate Hoist Control Panel #2, within the remaining 45 days (i.e. within 90 days after NTP).
1.7 Investigation of Site Conditions
A. Contractors are encouraged to attend an agency organized site visit. Alternatively, site visits may be scheduled by contacting Juan Escobar at 830-774-5519 or Juan.Escobar@ibwc.gov. While attending the site visit all contractors must adhere to COVID-19 requirements for social distancing and the use of personal protective equipment (PPE) (i.e. mask and gloves). Contractors will not be permitted access to IBWC facilities without proper PPE.
B. Submission of a quote shall be conclusive evidence that the Contractor has reviewed, investigated, and acknowledged all items below.
1. Conditions bearing upon transportation, disposal, handling, and storage of materials.
2. The availability of water, electric power, and roads.
3. Uncertainties of weather and similar physical conditions at the site.

4. The conformation and conditions of the ground.
5. The character of equipment and facilities needed for the performance of the work.
C. Submission of a quote shall be conclusive evidence that the Contractor has investigated and is satisfied as to the conditions to be encountered, the character, quality, and work to be performed, and the quantities of materials to be furnished.
D. Submission of a quote constitutes agreement that Contractor has provided written notice of all conflicts, errors, ambiguities, and discrepancies discovered in PWS, that responses to these written notices are acceptable to Contractor, and that PWS is enough to indicate and convey understanding of all terms and conditions for performing and furnishing required work.
E. Contractor has the sole responsibility to make such independent investigation and examination as they deem necessary in order to satisfy themselves as to the conditions to be encountered in the performance of work and the quantities required to complete the work in accordance with the PWS.
F. The Government assumes no responsibility for any understanding reached or representation made concerning conditions which can affect the work by any of its officers or agents before the execution of this Contract, unless that understanding, or representation is expressly stated in this Contract.
G. Any failure of the Contractor to take the actions described and acknowledged in this paragraph will not relieve the Contractor from responsibility for estimating properly the difficulty and cost of successfully performing the work, or for proceeding to successfully perform the work without additional expense to the Government.
1.8 Duty to Inquire
A. Contractor shall review the full PWS.
B. If during review of these items, the Contractor finds discrepancies, omissions, conflicts, defects, errors, or ambiguities, they have a duty to inquire and shall notify the Contracting Officer prior to the question submission deadline as established in the solicitation. The Contractor shall also inquire about items that are unclear or open to interpretation.
C. The Contractor shall take no advantage of any item of which they have a duty to inquire.
1.9 Work Restrictions
A. The Contractor is responsible for conducting business between the hours of 7:00 AM thru 3:30 PM (Central Time Zone), Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government-directed facility closings.
B. The Contractor may request different working hours and must do so in writing to the Contracting Officer Representative (COR). USIBWC will make final determination as to the approval of a different work schedule.
1.10 Department of Homeland Security
In any event the staff of the US Department of Homeland Security (DHS, also known as US Customs and Border Protection or CBP) alerts and directs any field crews to stop work for any security reasons in the area, the Contractor shall consider this as top priority and fully cooperate with the directions of DHS at all
USIBWC Solicitation Page-5 of 16 times until the security alert is cleared by the DHS. In addition, the Contractor shall contact and coordinate with the COR for any additional steps to be taken during and after the security alert.
SECTION 2
PROJECT REQUIREMENTS
2.1 General
A. The Contractor shall replace the wiring to Headgate 1&2 Hoist control panel components and wiring to all Headgate Hoist devices such as (Motors, Limit Switches, Safety Switches, Brake Motor) within 25 feet of control panel except for the feeder wires.
B. The Contractor shall replace Westinghouse control panel components to Headgate Hoist control panels 1 & 2 in accordance to the existing Westinghouse Electric Corporation wiring diagram # 873D083.
C. The Contractor shall replace the wiring to each control device within 25 feet of the Headgate Hoist control panels 1 & 2. All wiring shall be securely held in place and arranged in a neat and orderly manner in horizontal and vertical runs. The wire and terminal numbers shall be neatly and legibly identified in an approved manner. Terminal blocks shall be used for making all external connections.
D. The Contractor shall provide detailed cost breakdown to include all equipment, supplies, and service required to completely replace the wiring to each device contained within the two (2) Headgate Hoist control panels 1 & 2 and replace wiring to control devices within 25 feet of the two (2) Headgate Hoist control panels 1 & 2.
E. The Contractor shall document the work progress periodically and maintain progress records, including date-stamped digital photos and videos throughout the project.
F. The Headgate Hoist control panels 1 & 2 must maintain operability while replacement control board is being designed, fabricated and built until time of its installation into the control panel and only one panel shall be worked on at a time.
G. The Contractor shall submit a Job Safety Analysis (JSA) Form filled out to be reviewed by Amistad Dam Personnel.
H. Conduct a Safety Meeting with all the personnel involved in the project and Amistad Dam Personnel prior to start the project.
I. The Contractor shall conduct a Safety Meeting with all the personnel involved in the project and Power Plant Personnel prior to starting the project. In addition, daily safety meetings shall be conducted at the start of each workday.
2.2 Clean-Up and Disposal of Waste Materials
A. The Contractor shall be responsible for the cleanup and disposal of waste materials and rubbish from the site, field office(s), and staging area(s).
B. The disposal of waste materials and rubbish shall be in accordance with applicable Federal, state, and local laws and regulations and with the requirements in this Contract. Should a conflict exist in
USIBWC Solicitation Page-6 of 16 the requirements for cleanup and disposal of waste materials, the most stringent requirements shall apply.
1. All waste unless otherwise noted in these specifications shall be disposed of at a licensed landfill or waste disposal facility.
2. Recyclables
a. The Contractor shall dispose of recyclable and reusable products through waste disposal only as a last option.
b. Scrap metal shall be donated or sold to scrap dealers or recycle centers whenever possible.
c. The existing Westinghouse control panel boards and components shall remain the property of USIBWC.
C. No excess materials shall be deposited within Government property, unless compliance confirmed by the Government.
D. The Contractor shall maintain work and storage areas free from accumulations of waste materials and rubbish and before completing the work, shall remove all temporary facilities, including, buildings, unused materials, concrete forms, and other like materials, which are not a part of the permanent work.
2.3 Testing and Training
The Contractor shall test the new system and provide training to power plant personnel at project completion prior to project acceptance. The functional testing shall be observed by the COR for verification and approval.
A. Prior to Contract closeout, the Contractor shall provide a comprehensive project-specific
Government personnel training program for the systems and equipment designed and installed under this Contract.
B. When operating procedures are not detailed in owner’s manuals, the Contractor shall write SOPs.
These SOPs shall be available prior to the scheduled training provided below.
1. The Contractor shall furnish factory-trained representatives as required to conduct training sessions on the operation and maintenance of constructed works. The trainers shall be qualified in providing all required training and have expert knowledge of all aspects of the operation and maintenance of their systems and associated components.
2. Training materials shall become the property of the Government after completion of the training.
C. The selected time for training will be scheduled shortly after completion of the installation of the project but will be no later than 24 hours after the final walk-through inspection. The Government will coordinate with the Contractor to schedule this training.
D. Training shall include the components listed below:
1. Basis of system design, operational requirements, and criteria.
2. Documentation and use of O&M Manuals and schematics.

3. Relevant health and safety issues.
4. Emergencies, including warnings, trouble indications, shutdown and special operating instructions.
5. Operations - Start-up, normal operation, shutdown, unoccupied operation, seasonal changeover, manual operation, controls set-up and programming, troubleshooting, and alarms.
6. Adjustments.
7. Troubleshooting.
8. Maintenance as well as special maintenance and replacement sources.
9. Repairs, including diagnostic instructions, disassembly, and instructions for identifying parts and components.
2.4 Warranty
A. The Contractor shall warrant that work performed under this PWS conforms to the Contract requirements and is free of any defect in equipment, material, or workmanship performed by the Contractor or any subcontractor or supplier at any tier for a period of at least one (1) year from project acceptance.
1. The Contractor is responsible for providing warranties on items when the manufacturer's warranty is less than the time indicated in Paragraph 2.4B or when the manufacturer's warranty does not cover full repair and/or replacement as appropriate.
B. The Contractor shall obtain warranties from responsible subcontractors, suppliers, and manufacturers, within sixty (60) days after completion of the applicable item of work, but no later than the date of warranty commencement. The minimum warranty period for any item shall be one year from acceptance.
C. Starting date of warranty is date of Government acceptance of the work.
D. A warranty requires that if a warranted item fails to meet Contract requirements, it shall be repaired, replaced, or have other remedial actions taken to bring the item into compliance with the Contract requirements, at no cost to the Government. Any item damaged due to failure or malfunction of item warranted under this Contract shall be repaired or replaced at no cost to the Government.
E. The Contractor shall supply the CO with a telephone number, mailing address, email address, and contact name for the point of contact for any required warranty work.
SECTION 3
EXISTING CONDITIONS
3.1 General
The Amistad Dam has two (2) Westinghouse NEMA 4 enclosure Headgate Hoist control panels.
3.2 Government Furnished Utilities
A. The Government will not be furnishing any equipment or material for this project.

3.3 Use of Government Land
A. USIBWC property is available for use as the Contractor's staging and/or storage areas, subject to the approval of the COR. The Contractor shall preserve and protect existing features, trees, and vegetation to the maximum extent practicable.
B. Housing for Contractor personnel will not be permitted on Government land.

SECTION 4
QUALITY REQUIREMENTS
4.1 Common Product Requirements
A. Materials Certification The Contractor shall submit a materials certification package to COR which contains a checklist and supporting documentation for all materials used on the project. The supporting documentation shall consist of a summary of all documentation practices utilized for material acceptance and explanations of any deficiencies noted on the checklist.
1. Material certifications shall ensure that all items meet the Buy American Act (41 USC 10a -
10d).
B. Source Control
1. The Contractor shall use only materials that meet the Contract requirements.
2. Unless otherwise specified or compliance confirmed, the Contractor shall use new materials for the work. Material can be reused onsite upon written approval of COR.
3. All materials installed shall be free of defects.
4. The Contractor shall secure the Government’s compliance confirmation of the proposed source of materials to be used before their delivery.
C. Quality Control / Quality Assurance of Materials
1. Source Limitations
To the greatest extent possible for each item of work, the Contractor shall provide materials of a singular generic kind from a single source.
2. Compatibility of Options Where more than one choice is available as options for Contractor's selection of a product, material, or equipment, the Contractor shall select an option which is compatible with other products, materials, or equipment. Compatibility is a basic general requirement of product, material, and equipment selections.
3. Field Measurements Verify field measurements, lines, grades, locations, and details at the jobsite prior to fabrication. It shall be the Contractor's responsibility to conform to and satisfy actual field conditions, for accuracy of dimensions, proper fit, and for adequacy of use intended.
4. The Contractor shall correct or remove materials that fail to meet Contract requirements or that do not produce satisfactory results. The Contractor shall reimburse the Government for cost incurred if additional quality assurance sampling and testing is required by a change of source.
5. Materials not meeting Contract requirements will be rejected, unless the Government approves corrective actions in writing. Upon rejection, the Contractor shall immediately remove and replace rejected materials. Should the Contractor fail to comply with the removal of rejected materials, the Government may remove and replace defective material and the cost of testing, removal, and replacement will be deducted from the Contractor’s final payment.
D. Hazardous Materials The Contractor shall use materials that are free of hazardous materials. The Contractor shall notify the Government immediately when a visual observation or odor indicates that materials in required
USIBWC Solicitation Page-10 of 16 material sources or on sites owned or controlled by the Government may contain hazardous materials.
E. Surplus Materials
1. The Contractor shall take ownership of surplus materials unless otherwise indicated in the
Contract documents.
2. The Contractor shall remove and dispose of materials in accordance with Paragraph 2.27 of this PWS. If requested or otherwise noted in these specifications, the Contractor shall provide an appropriate level of documentation to verify proper disposal.
F. Storage and Protection
1. Designate receiving/storage areas for incoming products so that they are delivered according to installation schedule and placed convenient to work area to minimize waste due to excessive materials handling and misapplication.
2. Store and protect products in accordance with manufacturers' instructions.
3. Store with seals and labels intact and legible.
4. Prevent contact with material that may cause corrosion, discoloration, or staining.
5. Provide equipment and personnel to store products by methods to prevent soiling, disfigurement, or damage.
6. The Contractor shall store and handle materials to preserve their quality and fitness for the work and shall store materials so that they can be easily inspected and retested. When required by the Government, the Contractor shall protect the material with cover, on wooden platforms, or on other hard, clean surfaces as necessary.
SECTION 5
DELIVERABLES
5.1 General
A. Deliverables include, but are not limited to:
1. Material certifications and product information
2. Inspection report, including photos, videos, and other supporting documentation.
3. Safety documents
4. Warranty
5. Project Schedule
a. Project Schedule is to be delivered to COR within seven (7) Calendar Days of contract award.
b. The schedule shall show the main activities, their durations, schedule of values and the Critical Path
7. System Design: All system designs shall be approved by the Power Plant Superintendent or his delegated representative prior to installation.
8. Installation Procedure Plan: The Contractor shall provide a procedure to perform this work without disturbing the Power Plant daily operations.
9. Material and Equipment Certification

11. Training
a. Training Manuals.
b. O&M Manuals.
12. The resume for an on-site representative with at least three-year experience in identical or similar projects.
13. Weekly reports charting the work progress against the agreed schedule as well as a weekly record of safety measures. The report for each week shall be due on the first working day of the following week.
14. Technical specifications of all material to be incorporated in the contract prior to procurement.
The Contractor shall submit all manufacturer literature, specifications, samples and certifications and obtain USIBWC approval before purchasing any item for applying to or incorporation into the work.
15. Written summary report and as built drawings, as appropriate, providing a complete record of the completed works.
16. Licenses and Certifications: The Contractor shall obtain and submit all Mandatory Licenses and Certifications to perform this type of work.
B. Recordings
1. Video recordings shall be MPEG encoding, delivered on DVD (DVD+R) disks using high definition (1080p) video cameras with clear and succinct narrative or captioning.
2. All video recordings must include metadata (catalogue information) to include the date and time of recording, the name of the area being documented, the project name, direction of travel, the viewing side, project number, project name, Contract number and description, and name or company of photographer.
3. The date and time shall appear in the upper left-hand corner of the picture, for example:
Time: 08:35:15 (using twenty-four (24) hour clock time) Date: 09/18/2002. (date format MM/DD/YYYY)
C. Photos
1. All photographs shall be taken with digital cameras. The digital camera files must be captured as eight (8) megapixel files or greater with a minimum pixel array of 3,266 pixels by 2,450 pixels.
2. Each photograph shall have a unique name.
a. Filenames shall start with the date of the photo in the format of YYYYMMDD.
b. Use underscores "_" instead of blanks in the filename.
c. Include basic description of project after date in filename.
d. The entire filename shall not exceed thirty (30) characters, excluding .jpg.
3. Each photograph shall be identified by a photo number, name of photographer, project name, date and time of photograph, location of photographer, orientation, and description of photograph.
4. The above captioned information shall be detailed on IBWC Form 148.
5. Include tags in the jpg file. Tags shall include, but not be limited to:
a. Contract Number
b. Project Name
c. Contractor's Name
d. Amistad Reservoir and Dam Project

6. Except for adding tags, submit digital images exactly as originally recorded in the digital camera, without alteration, manipulation, editing, or modifications using image-editing software.
7. The Contractor shall submit an electronic copy of all photographs on a CD. The CD shall contain IBWC Form 148 to identify each photograph as described above.
SECTION 6
PROJECT COORDINATION & ADMINISTRATION
6.1 General
A. The Contractor shall provide all materials, equipment, labor, and services required by this Performance Work Statement to perform the work for the Contract sum and within the Contract period of performance.
B. The Contractor shall be responsible for ensuring that all its suppliers, manufactures and subcontractors have reviewed all applicable documents relative to their work. The Contractor shall provide all labor, material, equipment, and services not provided by the Contractor’s suppliers, manufacturers, fabricators, and/or subcontractors.
6.2 Security
The Contractor is responsible for securing the work site, equipment, and materials from vandalism and theft.
6.3 Safety
A. The Contractor is solely responsible for worksite safety while performing work or inspections on Government property. The Contractor shall implement a safety program that protects the lives and health of personnel in the project area, prevents damage to property, and avoids work interruptions.
B. The Contractor is responsible for being cognizant of and ensuring compliance with the requirements set forth. Such responsibility shall apply to both the Contractor’s operations and those of the Contractor’s subcontractors.
C. The Contractor shall comply with all provisions of all applicable regulations of the Occupational Safety and Health Administration (OSHA), 29 CFR 1910, Occupational Safety and Health Standards, and 29 CFR 1926, Construction Standards.

D. The Contractor’s personnel shall be required to use appropriate personal protective equipment such as, but not limited to hard hats, safety goggles, welding shields, face shields, protective footwear, protective gloves, and hearing protection.
E. The Contractor shall perform daily housekeeping. The Government will not provide trash dumpsters.

SECTION 7
PROJECT MEETINGS
7.1 General
A. The Contractor, the COR, or the CO may schedule project meetings at any time.
B. When USIBWC schedules a meeting, the COR shall inform participants and others involved and individuals whose presence is required, of date and time of each meeting. The COR shall prepare the meeting agenda and distribute to all invited attendees.
C. When the Contractor schedules a meeting, the Contractor shall inform participants and others involved and individuals whose presence is required, of date and time of each meeting. The Contractor shall prepare the meeting agenda and distribute to all invited attendees.
D. The following meetings are anticipated, and the Contractor shall identify them in the Schedule:
1. Kickoff Meeting
2. Progress Meetings
7.2 Kickoff Meeting
A. After award of the Contract, the COR will coordinate with the Contractor to schedule a Kickoff Meeting within two weeks after award of contract. The meeting shall take place prior to the beginning of any Contract work.
B. The purpose of the meeting is to introduce project personnel and to review responsibilities and procedures.
C. The Contractor shall reach an understanding with the Government regarding the project requirements as stated is this Performance Work Statement. This understanding shall be documented in writing and approved by the CO after the Kickoff Meeting.
D. Attendees include, but are not limited to:
1. Contractor's Project Manager
2. COR
3. Amistad Power Plant Representative
4. It is recommended that Contractor's engineers, inspectors, subcontractors, suppliers, and other concerned parties also attend the conference. The Contractor may invite anyone they wish to this meeting.
5. All participants at the conference shall be familiar with the project and authorized to conclude matters relating to the work.
E. Agenda Discussion of items of significance that could affect the work and project, including the following:
1. Introduction/designation of key personnel and their duties.
2. Review of the current phasing, critical work sequencing, and long-lead items.
3. Review of minimum project requirements.
4. Review of procedures for handling and processing modifications, RFIs, deliverables, and applications for payment.

5. Preparation of deliverable documents.
6. Use of site.
7. Work restrictions.
8. USIBWC and other's occupancy requirements.
9. Safety and first aid.
10. Security.
11. Maintenance of project site.
12. Working hours.
F. Meeting Minutes The COR will record the discussions of the meeting and distribute the minutes to all attendees for review prior to finalizing.
7.3 Progress Meetings
A. If needed, the COR will schedule progress meetings once the Contractor has mobilized onsite. The COR will conduct and issue minutes of the meetings. Meeting minutes will become official Contract correspondence.
B. The Government may call other meetings on an "as needed" basis.
C. The purpose of these meetings shall be to analyze the progress of the work, resolve conflicts, and in general coordinate the operation of all organizations active at the project site.
SECTION 8
PROJECT SCHEDULE
8.1 Description / Purpose
A. The Contractor shall prepare a project schedule which shall reflect completion of all work under this Performance Work Statement.
B. Project schedule submittal shall include an electronic pdf file.
1. All abbreviations shall be defined.
2. Each project schedule shall show a revision date.
C. Baseline Schedule Preparation Prepare a list of all activities required to complete the work. The baseline schedule shall include all planned work activities and sequences and show Contract completion within the number of calendar days specified in the Contract.

SECTION 9
REGULATORY REQUIREMENTS
9.1 Contractor's Responsibility
A. It is the Contractor’s responsibility to perform work in compliance with all applicable requirements of federal, state, and local laws, codes, rules, regulations, ordinances, and standards, including, but not limited to, those outlined in 9.4 below.
B. It shall be the responsibility of the Contractor to acquire copies of all applicable codes, regulations, and standards for ready reference.
C. In instances where requirements are in conflict, the stricter standard, as determined by the Government, shall apply.
D. All inspections, observations, or tests required for code compliance are the responsibility of the Contractor.
9.2 Permits
A. Prior to the beginning of work, the Contractor shall be responsible for researching, coordinating, obtaining, and paying all applicable fees for all permits required by Federal, state, and local entities.
The Government is not responsible for any existing or newly introduced permits required before, during and/or after work on of this project.
B. The Contractor shall be responsible for and shall give and maintain all notices required by applicable regulations, laws, or permitting authorities pertaining to work on of this project.
9.3 Dates
A. For all related standards and regulatory requirements in this document, the version, edition, or year shown indicates the governing version.
B. All Public Laws, Code of Federal Regulations (CFR), Federal Acquisition Regulation (FAR), Executive Orders (EOs), Management Policies, Government Directives, Government Standards, refer to the original document as well as any subsequent amendments, corrections, and/or additions.
1. The latest amendments, corrections and additions are to be assumed applicable in the same way as the document itself.
