JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)
1. I recommend that US Embassy Panama City use other than full and open competition for the acquisition of 130 Units of a "Tracking System Package" to vendor TRAILBLAZER INNOVATIONS, INC. The estimated cost is
USD133,612.90.
2. Nature and/or description of the action being approved.
This is a sole source procurement request for the acquisition and provisioning of 130 tracking devices, with configuration and integration services to a Common Operational Picture at JIA TF -South using the DOD Gateway, activation services and related shipping charges.
3. A description of the supplies or services required to meet the agency's needs.
This is a sole source procurement request for the acquisition and provisioning of 130 tracking devices, with configuration and integration services to a Common Operational Picture at JIATF-South using the DOD Gateway, activation services and related shipping charges, as follows:
• 130 Units ofHHTSW Tracking System Package, Part Number HHTSW
PKG-00101.
• 130 Activation Services, Part Number TBI-IA-001
• Shipping charges to US Embassy Panama City.
4. An identification of the statutory authority permitting other than full and open competition.
This request is submitted under authority of 1 0 U.S. C .23 04( c)( 1) and 41 U.S.C.3304(a)(l) and FAR Part 6.302-1 (2)

(c) The head of an agency may use procedures other than competitive procedures only when
(1) the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency;

§3304. Use of noncompetitive pmcedures
(a) When Noncompetitive Procedures May Be Used.-An executive agency may use procedures other than competitive procedures only when-
(1) the property or services needed by the executive agency are available from only one responsible source and no other type of property or services will satisfy the needs of the executive agency;

(2) When the supplies or services required by the agency are available from only one responsible source, or, for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).
NORTHCOM guidance states that vendor TRAILBLAZER INNOVATIONS, INC.
is the only company capable of provisioning devices to a Common Operational Picture at JIATF-South using the DOD Gateway.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and if not, which exception under FAR 5.202 applies (e.g., blanket waiver provided in
DOSAR 605.202-70).
Guidance from NORAD and USNORTHCOM indicate that requesting additional offers for similar products is not applicable in this case as no other company is capable of providing and provisioning the devices for this particular use with JIATFS systems.
The notice of intent to purchase Sole Source products or this J&A will be published on FedBizOpps within 14 days of award in accordance with FAR Section 6.305, or at the discretion ofthe Contracting Officer.
7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The associated costs have been reviewed and are considered fair and reasonable.
8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.
No market survey was conducted as the guidance from NORAD and NORTHCOM indicates that Trailblazer is the only company capable of the provisioning, configuring, and integrating these devices to a Common Operational Picture at JIATF-South using the DOD Gateway.
9. Any other facts supporting the use of other than full and open competition.

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
It is understood that no additional actions can be taken to overcome barriers to competition.
