JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN

COMPETITION (OVERSEAS CONTRACTING ACTIVITIES)

1. I recommend Embassy Tbilisi use full and open competition for the acquisition of a brand name product: IBM/Lenovo hardware consisting of 2 (two) servers, 9 (nine) hard drives and 12 (twelve) sets of RAM memories to extend the capacity of the Backup Data Center in the country of Georgia. The estimated cost is $59,400.00

2. Nature and/or description of the action being approved.

Acquisition of hardware for expanding the storage capacity of the Backup Data Center in the country of Georgia. We require IBM/Lenovo to supplement parts already existing and compatible with the current structure.

3. A description of the supplies or services required to meet the agency's needs.

Acquisition of the following items:

2 (two) Servers IBM/Lenovo BC Server Flex System x240 M5 Compute Node, Next- Gen CPUs: 2 x Intel Xeon Processor E5-2680 v4 14C 2.4GHz 35MB 2400MHz120W, High-Speed Memories 384GB (12x32GB TruDDR4 Memory (2Rx4, 1.2V)PC4-19200 CL17 2400MHz LP RDIMM), 2x120GB SATA 2.5" MLC G3HS Enterprise Value SSD, Flex System EN4172 2-port 10Gb Ethernet Adapter, Flex SystemFC5052 2-port 16Gb FC Adapter. SD Media Adapter with 2xSD Media, with Extended Warranty Service: 5-Year Tech Install Parts 9x5x4 Response 6 (six)units of Hard drive IBM 300 GB 2.5" 15K SAS HDD for V7000 Gen, 2 (two) units of Hard drive IBM 3TB 3.5" NL SAS HDD for V7000 Gen1, 1 (one) unit of Hard drive IBM 200GB 2.5-inch Flash Drive for V7000 Gen1, 3 (three) sets of RAM memory (set) IBM 128GB KIT for Flex System x240 M5 Compute Node,' (8x16GB) TruDDR4 Memory (2Rx4, 1.2V) PC4-17000 CL15 2133MHz LP RDIMM 9 (nine) sets of RAM memory IBM 128GB KIT for Flex System x240 Compute Node,' (8x16GB) 2Rx4, 1.5V PC3-12800 CL11 ECC DDR3 1600MHz LP

4. An identification of the statutory authority permitting other than full and open competition.

5. A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited (for sole source acquisitions; also required for unusual and compelling urgency where more than one offer will not be solicited).

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable. The description should include whether a FedBizOpps notice was or will be publicized, as required by FAR 5.2, and ifnot, which exception under FAR 5.202 applies (e.g., blanket waiver provided in DOSAR 605.202-70).

INL is not requesting to limit full and open competition however requires the brand name product defined in paragraph 3.

7. A determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

8. A description of the market survey conducted and the results or a statement of the reasons a market survey was not conducted.

There are 3known local vendors certified and supported by IBMILenovo who can provide requested hardware. These companies are: UCT Ltd, Alts, Delta Comm.

9. Any other facts supporting the use of other than full and open competition.

Requested hardware is for the Backup Data Center and expands the storage capacity of an already existing system. No substitute or equivalent product can be used due to the compatibility issue.

10. A listing of sources, if any that expressed, in writing, an interest in the acquisition.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
