JUSTIFICATION FOR AN EXCEPTION TO FAIR OPPORTUNITY

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Dahlgren Division (NSWCDD), Contracts Department

2. Description of the Action Being Approved

Award of a firm-fixed-priced delivery order under the NASA Solutions for Enterprise-Wide Procurement (SEWP) Government-wide acquisition contract (GWAC). The proposed order will be on a limited source basis for brand-name products to be used by Integrated Engagement Systems Department (E), High Energy Laser (HEL) Weapon Systems (LWS) (E10), Laser Weapon System Technology and Lethality Branch (E11), manufactured by Teledyne FLIR Surveillance Inc.

3. Description of Supplies/Services

Delivery is requested 4 weeks after receipt of the order, or sooner, if available.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

The estimated cost of the proposed contract action is $464,598.00. The type of funds to be used for this procurement is Fiscal year 2025 Naval Innovative Science & Engineering (NISE) funds.

4. Identification of Exception to Fair Opportunity Process

41 U.S.C. §§ 4101 – 4106, as implemented in FAR 16.505(a)(4);

Requirements for use of items peculiar to one manufacturer.

5. Rationale Justifying Use of Cited Statutory Authority

The Pulsed Laser Lethality Laboratory Complex requires utilization of Forward Looking InfraRed (FLIR) Cameras that are tuned to the medium wave infrared spectral range for help in identifying significant thermal related events with high-energy and high-power laser engagement experiments. The X6981HS and X8581HS cameras are the next generation cameras over the previous version camera that is used by E10. The X6981HS series cameras, now utilizes a larger resolution format (1280x1024 pixels) over its predecessor of 640x480, providing double the resolution. The X8581HS camera provides over 1,000 frames per second (fps), 5x faster shutter speeds that previous generation thermal cameras used in E10 Laser Lethality. The combination of these cameras will allow for twice the resolution and five times the frame rate over current E10 capabilities. The FLIR Cameras must be compatible (form, fit, and function) with the current system to ensure proper measurements to properly allow data to be recorded.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market Research was conducted through vendor and subject matter expert (SME) discussions, online research, and obtaining a market research quote. Additional market research was conducted through contacting the original equipment manufacturer, Teledyne FLIR

Surveillance Inc., which confirmed that there are multiple authorized resellers available for these proprietary products.

The required brand-name supplies are available from multiple authorized resellers under the NASA SEWP GWAC and solicitation will include all authorized resellers based on the required brand name products. Based on the knowledge of subject matter experts in E10, using another product would result in the loss of over $1,000,000.00 over the course of 12 months for multiple personnel to conduct additional re-work and testing to meet capability needs. This additional cost could not be recovered through full and open competition with the delays resulting in unacceptable risk to the program and the Fleet.

7. Determination of Fair and Reasonable Costs

The NASA SEWP GWAC does not establish the price for the required supplies. Therefore, the NSWCDD Contracting Officer will determine, using the procedures in FAR 15.3, that the order represents the best value to meet the Government's needs.

8. Actions to Remove Barriers to Competition

The proposed order uses the NASA SEWP GWAC and will be solicited and awarded in accordance with FAR Subpart 16.5 and the NASA SEWP ordering procedures. For the reasons set forth in Paragraph 5, NSWCDD’s Contracts Department has no plans at this time to compete future contracts for the type of equipment covered by this document. If another potential source emerges, the Contracts Department will assess whether competition for future requirements is feasible.
