SECTION C

PERFORMANCE WORK STATEMENT (PWS)

SATELLITE TELEVISION SUPPORT SERVICES

3 SEPTEMBER 2019

1.0 SCOPE

1.1 Provide all personnel, equipment, tools, materials, supervision, and other items and non-personal services necessary to provide satellite television transmission service at the following locations on Redstone Arsenal, AL: BLDG 4810 Airfield RD; BLDG 4813 Airfield RD; and BLDG 3545 Kingfisher DR.

2.0 OBJECTIVES

2.1 Fire and Emergency Services Division, Directorate of Operations, US Army Garrison

– Redstone Arsenal (USAG-R) seeks a Contractor to provide on-site satellite television transmission support services for existing and established locations at the addresses specified in paragraph 1.1 of this document. Services include continuous and uninterrupted satellite TV service, twenty-four hours a day, seven days a week for satellite TV service containing at least 250 channels, similar to those offered in the Huntsville, AL area.

3.0 PERFORMANCE REQUIREMENTS

3.1 General: The Contractor shall be responsible for all infrastructure, distribution system, equipment, devices, hardware and software systems in providing the Government designated sites with TV signals. If necessary, the Contractor shall provide the Government with satellite receiving boxes. There are Government furnished cable distribution systems in place to receive or distribute Contractor furnished signals.

3.1.2 Service Response: The Contractor shall respond within 4 hours of initial contact by the Contracting Officers Representative (COR), to resolve loss of service, intermittent, degradation, or loss of signal within customer normal business hours. The COR shall be advised by the Contractor if service cannot be restored within 24 hours of initial notification.

3.1.3 Pro-rata rate adjustment: Service interruptions exceeding 24 hours from Contractor initial response shall result in a pro-rata credit adjustment of the current rates charged computed at 1/30 of the monthly billing for each day of interruption until service is restored.

3.1.4 Satellite TV services: The Contractor shall provide the same basic number of channels as those typically offered to commercial and residential customers of the greater Huntsville, Alabama area that do not require the payment of additional access fees, such as premium channels (i.e., HBO, Showtime, etc.) or Pay-per-View. This is typically no less than 250 channels. The TV signals shall contain access to local, as well as Continental US channels/networks and Public Access channels such as C-Span.

Satellite TV service provides the means to keep employees informed of programs, events and activities, as well as Force Protection and crisis communication applications such as during severe weather events. The Contractor shall be responsible for providing the cable and infrastructure to the display unit or monitor. Service and signal technology and quality provided shall be equivalent to or better than that afforded to the public.

3.1.5 Signal Strength: Signal strength provided shall be the minimum level required to provide a clear picture and sound quality without degradation of picture quality or sound static.

3.1.6 Period of Performance: The period of performance shall be a total of five (5) years. There will be a 5 year ordering period under which individual task orders will be issued. A total of no more than 14 days will be allotted for phase in of satellite TV services (if required).

3.1.7 Buildings Receiving Service: TABLE 4-1 represents Garrison Redstone Customers.

3.1.8 There are current restrictions on modifying, attaching or mounting fixtures/materials of any type on areas within buildings designated as or within historical districts.

4.0 TASK ORDER

4.1 Service requirement will be provided by the issuance of task orders from the Contracting Officers (KO), to the Contractor.

4.2 The contractor shall provide satellite TV services at the location directed by COR, upon receipt of a task order.

5.0 QUALITY CONTROL PLAN

5.1 The Contractor shall be responsible for implementing and maintaining a Quality Control Plan (QCP) that identifies and results in the correction of potential and actual problems IAW the table of Deliverables at Appendix A. The QCP shall outline the contractor’s plan to ensure the quality required to accomplish the PWS requirements.

Contractor shall update as changes occur.

6.0 QUALITY ASSURANCE

6.1 Periodic Progress Meetings: The contracting officer, COR, and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the contracting officer will apprise the Contractor of how the government views the Contractor's performance and the Contractor shall apprise the Government of problems, if any, being experienced. The contractor shall take appropriate action to resolve outstanding issues. These meetings shall be at no additional cost to the Government.

7.0 GOVERNMENT FURNISHED PROPERTY AND SERVICES

7.1 General: The Government will provide appropriate space (when available) for the contractor’s installation of satellite TV infrastructure. Coordination for approval to use un-used space must be coordinated through the Garrison Directorate of Public Works and Directorate of Operation prior to new installation of satellite TV infrastructure.

Construction cost to expand new satellite TV services to new locations is not included within the scope of this contract.

7.1.2 Utilities: The Government will provide the use of existing electrical outlets at the place of performance. Contractor personnel shall practice energy conservation IAW AR 420-1, Section VII, 3-42, Energy Conservation, to preclude energy waste.

8.0 CONTRACTOR QUALIFICATIONS/REQUIREMENTS

8.1 Performance of all work under this contract is restricted to US citizens. All work performed shall be in accordance with Federal, State of Alabama, and local laws, regulations and procedures.

8.1.2 The Contractor shall be able to demonstrate technical experience in providing satellite TV to other military and/or Government facilities in the past five years. The Contractor shall provide current contact information from installations that have previously been provided service as part of the proposal submitted.

8.1.3 Security Requirements: Contractor personnel shall be required to obtain and wear government issued badges while on the installation in the performance of this PWS while on Redstone Arsenal property.

8.1.4 Physical Security: The contractor shall be responsible for safeguarding all government property in the vicinity of the work location. The contractor shall coordinate with the COR or designated government facility point of contact (POC) prior to entering facilities or areas with limited access.

8.1.5 The Contractor shall provide (on company letterhead) a contractor personnel roster for access. (See Deliverables table at Appendix A.) Five days prior to start of work, Contractor shall provide full name of all personnel, Social Security number, date and place of birth. The Contractor shall state that information has been verified and shall have supporting records on file. The Contractor shall resubmit when changes in personnel occur.

8.1.6 Identification and Base Vehicle Passes: The Contractor shall obtain identification cards for employees. Application shall be coordinated through the Garrison Security Officer or designated representative. At time of application, Security Forces may conduct a background check. Upon termination of employment or the end of the period of performance, as applicable, the Contractor shall return identification cards to the COR office within 24 hours. New visit requests must be submitted prior to each contract or option year.

8.1.7 Identification of Contractor Employees: This standard language text is for contractor employees with an area of performance within an Army controlled installation, facility or area. The Contractor (to include subcontractors) shall provide each employee a Redstone Arsenal Identification (ID) Badge, which includes at a minimum, the Company Name, Employee Name and a color photo of the employee. ID Badges for Key Personnel shall also indicate their job title. ID Badges shall be worn at all times during which the employee is performing work under this contract. Each Contractor (to include subcontractors) employees shall wear the ID Badge in a conspicuous place on the front of exterior clothing and above the waist except when safety or health reasons prohibit. The Contractor (to include subcontractors) shall be responsible for collection of ID Badges upon completion of the contract or termination of employee. A listing of issued identification cards shall be furnished to the Contracting Officer prior to the contract performance date and updated as needed to reflect Contractor and Subcontractor personnel changes. Foreign owned companies and foreign national contractors will only be permitted to perform under this contract when there are no qualified U.S. companies and /or U.S. contractors. All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They shall also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

8.1.8 Confidentiality: Services rendered and all materials including records, files, documents, and work papers provided to the Contractor by the Government and data results, conclusions and recommendations obtained thereof shall be considered

Government property. The contractor shall not disclose, copy, modify, use (except in the completion of this contract) or otherwise disseminate to any other person or entity at any time to include, but not limited to, inclusion in any database external to the Government without the Government’s express consent.

9.0 CONTRACTOR PERSONNEL

9.1.1 The Contractor shall furnish sufficient personnel to perform all work specified within this contract. The Contractor at all times must maintain an adequate work force for the uninterrupted performance of all tasks defined within this PWS when the Government installation is not closed. The Contractor shall also maintain adequate work force for uninterrupted performance and service when the installation is closed.

9.1.2 The Contractor shall comply with Public law 105-270, Section 5 (2)(A). This law states that contractors shall not perform inherently governmental functions. Section 5(2)(A) of this Public law defines the term “inherently governmental function” as “a function that is so intimately related to the public interest as to require performance by Federal Government employees.” Per Section 5(2)(B), inherently governmental functions include activities that require either the exercise of discretion in applying Federal Government authority or the making of value judgments in making decisions for the Federal Government, including judgments relating to monetary transactions and entitlements. Per Section 5(2)(C), inherently governmental functions do not include, (i) gathering information for or providing advice, opinions, recommendations, or ideas to Federal Government officials or (ii) any function that is primarily ministerial and internal in nature.” The contractor shall also comply with Federal Communications Act of 1934 as amended and Cable Consumer Protection Act of 1984 and 1992.

9.1.3 Performing work associated with this PWS, the Contractor shall make clear to all individuals they deal with that they are Contractor employees and not DOD personnel when working in any situation where their contractor status is not obvious to third parties. Contractor employees shall clearly identify themselves as a Contractor (i.e.

company shirt, pin, visible company identification, etc.) in a visible location as to who their employer is, to avoid creating an impression that they are government personnel.

All Contractor produced documents, and reports shall be marked as Contractor products or marked such that the Contractor participation is appropriately disclosed.

9.1.4 Contractor personnel shall not manage, supervise, direct, or task US military, DOD civilians or other personnel not associated with the Contractor while performing the tasks within this PWS.

9.1.5 Contractor personnel shall not make any commitment, that commits the expenditure of US Government resources.

9.1.6 The Contractor performing services shall be required to comply with all US Army rules, regulations, and training that is applicable to conduct, safety, security, and procedures governing site entry and exit.

9.1.7 The Contractor shall not provide personal services to USAG-R. If Contractor employees are directed by any government employee at any time to perform services not covered under this contract, the Contractor shall immediately notify the COR.

10.0 APPLICABLE DOCUMENTS

10.1 The Contractor shall abide by all applicable documents contained in the table of Deliverables at Appendix A.

11.0 Contract Manpower Reporting

11.1 The Office of the Assistant Secretary of the Army (Manpower & Reserve Affairs) operates and maintains a secure Army data collection site where the contractor will report ALL contractor manpower (including subcontractor manpower) required for performance of this contract. See table of Deliverables at Appendix A. Contractor shall report data to the Contract Manpower Reporting database annually from contract award date but not later than 31 October of Each calendar year. The contractor shall notify the COR when data has been entered into the database. The contractor is required to completely fill in all the information in the format using the following web address:

The required information includes:

(1) Contracting Office, Contracting Officer, Contracting Officer’s Representative;

(2) Contract number, including task and delivery order number;

(3) Beginning and ending dates covered by reporting period;

(4) Contractor name, address, phone number, e-mail address, identity of contractor employee entering data;

(5) Estimated direct labor hours (including subcontractors);

(6) Estimated direct labor dollars paid this reporting period (including subcontractors);

(7) Total payments (including subcontractors);

(8) Predominant Federal Service Code (FSC) reflecting services provided by contractor (and separate predominant FSC for each subcontractor if different);

(9) Estimated data collection cost;

(10) Organizational title associated with the Unit Identification Code (UIC) for the Army Requiring Activity (the Army Requiring Activity is responsible for providing the contractor with its UIC for the purposes of reporting this information;

(11) Locations where contractor and subcontractors perform the work (specified by zip code in the United States and nearest city, country, when in an overseas location, using standardized nomenclature provided on website);

(12) Presence of deployment or contingency contract language; and

(13) Number of contractor and subcontractor employees deployed in theater this reporting period (by country).

As part of its submission, the contractor will also provide the estimated total cost (if any) incurred to comply with this reporting requirement. Reporting period will be the period of performance not to exceed 12 months ending September 30 of each government fiscal year and must be reported by 31 October of each calendar year. Contractors may use a direct XML data transfer to the database server or fill in the fields on the website. The XML direct transfer is a format for transferring files from a contractor’s systems to the secure website without the need for separate data entries for each required data element at the website. The specific formats for the XML direct transfer may be downloaded from the website.

12.0 ANTITERRORISM/OPERATIONS SECURITY

12.1 AT Level I Training. This provision/contract text is for contractor employees with an area of performance within an Army controlled installation, facility or area. All contractor employees, to include subcontractor employees, requiring access to government installations, facilities and controlled access areas shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within 30 calendar days after completion of training by all employees and subcontractor personnel. 12.2 Access and General Protection/Security Policy and Procedures: This standard language text is for contractor employees with an area of performance within an Army controlled installation, facility or area. All contractor employees, to https://jkodirect.jten.mil/ include associated sub-contractors employees shall comply with applicable installation, facility and area Commander Installation and facility access and local security policies and procedures (provided by the Government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. The contractor workforce shall comply with all personal identity verification requirements as directed by DoD, Department of the Army Headquarters, and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition at any individual facility or installation change, the Government may require changes in contractor security matters or processes. The prime contractor Human Resources/Security Officer is responsible for the collection of all Redstone Badges and CAC cards issued to their employees. The Human Resources/Security Officer will then turn over these credentials to the COR. This applies when the contract expires; as well as, when a contractor resigns or is terminated. After accounting for all badges/CACs, the COR will turn in the credentials at the One Stop Badging Office or CAC Office

(MILPO).

12.3 Escort requirements. Contractors will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas.

The contractor will coordinate with the COR and/or the facility security office for access when required. Use when security clearances are not required, i.e. facility repair or construction. Proposed language: "All contract employees, including subcontractor employees who are not in possession of the appropriate security clearance or access privileges, will be escorted in areas where they may be exposed to classified and/or sensitive materials and/or sensitive or restricted areas."

12.4 iWATCH Training: This standard language is for contractor employees with an area of performance within an Army controlled installation, facility or area. The contractor, to include subcontractors shall brief all employees on the local iWATCH program. The iWATCH slide presentation and supporting training video is provided by the USAG-R Antiterrorism Branch. Training material is located in the garrison contracting organizational files. This local developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to local law enforcement and security officials. This training shall be completed within 30 calendar days of contract award and within 15 calendar days of new employees commencing performance with the results reported to the COR within 10 calendar days after completion of training by all employees and subcontractor personnel.

12.5 Impact on contractor performance during increased FPCON during periods of increased threat (Contractor personnel working on an installation). During FPCON’s CHARLIE and DELTA, services may be discontinued / postponed due to higher threat. Services may resume when the FPCON level is reduced to level BRAVO or lower. All contractor service and supply delivery vehicles entering Redstone Arsenal that have not been vetted for unescorted entrance will report to ACP #1. A valid driver’s license and a shipping bill of lading must be provided. Enclosed cargo compartments will be secured by locks or (serial numbered) security bands in order to prevent tampering. Drivers will be directed to turn off the ignition, place the keys on the dash and open all storage compartments. All passengers will exit the vehicle to a designated holding area. Contractor service and supplies are subject to random inspection during food and water deliveries.

12.6 Random Antiterrorism Measures Program (RAMP) participation. Contractor personnel working on an installation are subject to participation in Installation RAMP security program (e.g. vehicles searches/inspections, wearing of ID badges, etc).

12.7 For contractors that require OPSEC Training. In accordance with AR 530-1, Operations Security, new Contractor employees shall complete Level I OPSEC training within 30 calendar days of their reporting for duty. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR, within 10 calendar days after completion of training by all employees and subcontractor personnel.
