COMPETITION

End User Support Contract

1. IDENTIFICATION OF THE AGENCY AND THE CONTRACTING

ACTIVITY, AND SPECIFIC IDENTIFICATION OF THE DOCUMENT AS A

2. NATURE AND/OR DESCRIPTION OF ACTION BEING APPROVED.

The purpose of this justification is to request a $78,786,191.77 bridge contract for the continuity of services currently provided under 86615321C00010. The current contract has a period of performance ending 02/27/2022 and is a critical part of OCIO’s capabilities, encompassing the majority of HUD’s End User Support services, providing the critical infrastructure and operational services necessary to HUD in fulfilling its mission.

Method of Contracting: Bilateral modification to the current contract

Type of Funds: IT Funds are provided for this action.

3. A DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE

AGENCY’S NEEDS (INCLUDING THE ESTIMATED VALUE).

A requisition, RCS-Q-2022-00074, has been established for End User Support and it is a request for a twelve-month base and one twelve month option with a Transition Out CLIN. The contract type for each item is identified in the table below.

4. AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING

OTHER THAN FULL AND OPEN COMPETITION.

The statutory authority cited is FAR 6.302-1 “Only one responsible source and no other supplies or services will satisfy agency requirements.”

5. A DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATIONS OR THE NATURE OF THE ACQUISITION REQUIRES

USE OF THE AUTHORITY CITED.

Leidos Inc, is considered the only responsible source that will satisfy the Department’s requirements within the established timeframe and with the specialized knowledge required. Their current contract is for End User Support which will expire 02/27/2022.

H54361 Text Box uniquely knowledgeable and qualified to perform a timely and efficient management of HUD’s current environment.

The HEAT End User contract was protested and action closed in 2021. A new CIO Infrastructure Operations Office (IOO) Support contract is in the process of being developed.

The requested extension will accommodate the time required finalize the requirements and start the acquisition process of the new contract.

Failure to extend the current contract will result in a break in service and the ability for the Department to maintain services for the current period of performance.

A lack of support for HUD infrastructure would have a definitive impact on the ability to deliver on its mission to “create strong, sustainable, inclusive communities and quality affordable homes for all.” All HUD staff (HUD employees and contractors) access to the HUD network would cease causing staff to not be able to perform their duties. This includes not being able to continue HUD mission support relating to Housing Foreclosures, Fair Lending, Rental Assistance, and specific citizen needs from Seniors, Homeless, veterans, disabled, and low-income populations.

As result of the protest on the previous HEAT End User contract, HUD is updating its requirement and is drafting the requirements for a new CIO Infrastructure Operations Office (IOO) Support contract. The new contract is targeted to be awarded in FY2023 Q3 (RCS-Q-2022-00067). There are no other alternatives currently available which could provide the continued support of the Department of HUD’s End User Support efforts at this time to mitigate a break in service that would cause an immediate shutdown of the Department’s network and render HUD unable to support the needs of the American public and HUD’s mission.

6. A DESCRIPTION OF EFFORTS MADE TO ENSURE THAT OFFERS ARE

SOLICITED FROM AS MANY POTENTIAL SOURCES AS IS

PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR WILL BE

PUBLICIZED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH

EXCEPTION UNDER 5.202 APPLIES.

The notice of intent to award a sole source bridge follow-on contract to the incumbent contractor will be posted and an additional notice will be posted in accordance with the FAR.

7. A DETERMINATION BY THE CONTRACTING OFFICER THAT THE

ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR AND

REASONABLE.

The basis of award and reasonableness of the total price proposed will be analyzed in accordance with FAR 15.404-1 with the following:

The contracting officer will determine that the anticipated cost to the Government will be fair and reasonable based on historical pricing and/or on the Independent Government Cost Estimate (IGCE) and/or any other technique available under the FAR for the same or similar services that s/he finds appropriate.

8. A DESCRIPTION OF THE MARKET RESEARCH CONDUCTED (SEE PART

10) AND THE RESULTS OR A STATEMENT OF THE REASON MARKET

RESEARCH WAS NOT CONDUCTED.

No market research was conducted for the requested bridge action as there are no other offerors that could provide the necessary support in the time needed to mitigate a break in service. Market Research was conducted for the new CIO Infrastructure Operations Office (IOO) Support requirements in accordance with FAR 10 and is planned to be solicited on a competitive basis providing opportunity for maximum industry participation.

9. ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL

AND OPEN COMPETITION.

Without the critical infrastructure and end user support currently being provided under the Leidos contract, HUD would experience a detrimental impact to its enterprise information technology infrastructure. HUD would not be able to deliver on its mission to “create strong, sustainable, inclusive communities and quality affordable homes for all.” All HUD staff (HUD employees and contractors) who access the HUD network would not be able to perform their duties. This includes staff that support actions which include Housing Foreclosures, Fair Lending, Rental Assistance, and specific citizen needs from seniors, homeless, veterans, disabled, and low-income populations. In addition, HUD would no longer be able to manage timely payment of benefits to lenders and to the public from the various financial systems providing over $1.3 trillion in mortgage insurance through HUD’s Office of Housing, and by the Office of Community Planning and Development to administer grants to local organizations. HUD would not be able to communicate important program and agency information through websites to all external parties.

There are no other alternatives currently available which could provide the continued support of the Department of HUD’s End Users at this time and the impact of a break-in-service would result in the immediate shutdown of the Department’s data center environment rendering HUD unable to support the needs of the American public and HUD’s mission.

At this time, Leidos, located in Reston, Virginia, is the only responsible source that can satisfy HUD’s End User Support requirements currently under contract without a potential delay.

6. A LISTING OF THE SOURCES, IF ANY, THAT EXPRESSED, IN WRITING,

AN INTEREST IN THE ACQUISITION.

This section is not applicable because this bridge is a sole source requirement to continue services.

7. A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE

ANY SUBSEQUENT ACQUISITIONS FOR THE SUPPLIES OR SERVICES

REQUIRED.

The new CIO Infrastructure Operations Office (IOO) Support contract will be a competitive action providing maximum opportunity for participation by industry. .

8. CONTRACTING OFFICER CERTIFICATION THAT THE
