ATTACHMENT 1
PERFORMANCE WORK STATEMENT (PWS)
NATIONAL MALL AND MEMORIAL PARKS
CANADA GOOSE CONTROL
PART 1
GENERAL INFORMATION
1. GENERAL: This is a personnel service contract to provide environmentally friendly Canada Goose
Control Services to the National Park Service (NPS), National Mall and Memorial Parks. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Vendor who, in turn is responsible to the Government.
1.1 Description of Services/Introduction: The vendor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform goose harassment as defined in this Performance Work Statement. Any items not specifically noted, but necessary for performance in accordance with accepted industry standards, shall be furnished under this contract. The vendor shall perform to the standards in this contract.
Work will be performed in park units under the jurisdiction of the National Park Service (NPS), National
Mall and Memorial Parks.
1.2 Background: The primary role of this contract is to provide goose control services to the National
Mall and Memorial Parks. The goose harassment services provided by this contract are directed to help the NPS carry out the mission to conserve the scenery and the natural and historic objects and the wildlife therein and to provide for the enjoyment of the same in such manner and by such means as will leave them unimpaired for the enjoyment of future generations, as stated in the Organic Act.
1.3 Objective: To provide goose control services to the National Mall and Memorial Parks (see Part
1.6.5). The National Mall and Memorial Parks has a very large Canada Goose population. The services provided should discourage geese from grazing near and occupying the Lincoln Reflecting
Pool. The presence of geese is leading to the degradation of the pool water due to defecation.
Expanding the area of control to include Washington Monument grounds, World War II Memorial grounds, and the JFK Hockey Fields will support the main objective of controlling within the reflecting pool area.
1.4 Scope: It shall be the purpose of these specifications to provide for an environmentally friendly harassment technique to control geese with open class or better sheep trial dogs (Border Collies). This is to result in the control of the resident, local and migratory Canada goose population at the locations as described above (1.3). Vendor must be knowledgeable of and adhere to all federal, state, and local laws and regulations governing the management of the Canada Goose. Vendor to provide all labor, equipment, tools, materials, transportation, management, supervision and other items and services necessary. Vendor shall plan, schedule, coordinate, and assure effective performance to provide goose hazard management. Government will not furnish any additional supplies, materials, equipment or facilities to the Vendor to perform the services defined in this PWS.
1.5 Period of Performance: The period of performance shall be for a one (1) base year plus four (4) one
(1) year option periods, for a total contract performance period of five (5) years. The Period of
Performance reads as follows:
Base Year: May 11, 2015 – February 29, 2016
Option Year 1: March 1, 2016 – February 28, 2017
Option Year 2: March 1, 2017 – February 28, 2018
Option Year 3: March 1, 2018 – February 28, 2019
Option Year 4: March 1, 2019– February 28, 2020
1.6 Quality Control: The vendor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The vendor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The vendor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. Submit the Quality Control Plan (QCP) with the vendor’s proposal as it will be used as an evaluation criteria for the final award. Three copies of a comprehensive written QCP shall be submitted to the CO and COR within 5 working days when changes are made thereafter. After acceptance of the quality control plan the vendor shall receive the contracting officer’s acceptance in writing of any proposed change to his QCP system.
The vendor shall establish and maintain a QCP to ensure the work performed conforms to the contract requirements. The Performance Requirements Summary establishes performance standards that are the minimum requirements for acceptable performance of required services. The vendor’s QCP shall address methods for remedying poor performance. The Vendor shall develop QCP and submit with proposal package. The Vendor’s QCP includes:
Required services identified in Performance Requirements; brief summary
Vendor’s surveillance methodology (methods, principles, and rules for monitoring workers)
Method and timeframe for responding to COR or customer complaints
Progress meetings with government stakeholders
1.7 Recognized Holidays: Vendor may have to perform scheduled services on holidays. Vendor must get permission from the COR if work proceeds on the one of these days.

1.8 Hours of Operation: Normal hours of operation are 7 days a week, excluding federal holidays, year round. Service hours must be scheduled in coordination with COR. The Vendor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons (see section 1.7). When hiring personnel, the Vendor shall keep in mind that the stability and continuity of the workforce are essential.
1.9 Place of Performance: The work to be performed under this contract will be performed at the National
Mall and Memorial Parks, Washington DC 20024. Specifically the Lincoln Reflecting Pool, Washington Monument grounds, World War II Memorial grounds, and the JFK Hockey Fields. See attached map (Attachment 4).
1.10 Type of Contract: The government will award a firm fixed price contract. Vendor to invoice monthly.
1.11 Physical Security: The vendor shall be responsible for safeguarding all government property.
1.12 Loss or Damage: Vendor shall be responsible for all damages to persons or properties that occur as a result of a Vendor’s fault or negligence. The Vendor shall take proper health and safety precautions to protect the work, workers, the public and property of others.
Vendor shall repair or replace any portion of building structure, or landscape features, damaged by the
Vendor in the performance of this contract. Such damaged areas or materials shall be restored, repaired or replaced by the Vendor to original condition and to the satisfaction and as directed by the COR at no expense to the Government.
The Vendor shall be insured in accordance with District of Columbia insurance regulations. The
Government is not responsible for damage to Vendor’s equipment, vehicles, tools or materials or their employees and the personal property brought on-site. The Government will not accept any liability due to vendor employee negligence.
Workers Compensation: The vendor shall furnish proof of workers compensation insurance to the Contracting Officer for those employees performing work related to this contract and shall comply with the Workman’s Compensation Laws.
Liability: The Vendor shall maintain a level of insurance that will protect the vendor and the
Government from any claims as a result of bodily injury (including death) and property damage which may arise from and during the performance of this contract, and shall submit proof of insurance to the Contracting Officer.
1.13 Special Work Considerations: The vendor may be required to work inside a high security memorial.
This may require a background check of the employees performing work inside the secure area. All vehicles and equipment must be swept by a United States Park Police (USPP) K-9 unit prior to entering a secure area. Provide the COR background check information 5 working days prior to entering a secure area. Coordinate USPP K-9 sweeps with the COR.
1.14 Special Qualifications: All workers shall be recognizable as employees of the vendor by wearing distinctive clothing bearing the name of the company or by wearing appropriate badges which show the
Vendor's company name and employee name. All equipment must meet all federal OSHA, state and local safety requirements and must be properly licensed. The name or logo of the vendor’s company shall be clearly displayed on all trucks and dogs used on the job.
1.15 Post Award Conference/Periodic Progress Meetings: The Vendor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with
Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers
Representative (COR), and other Government personnel, as appropriate, may meet periodically with the vendor to review the vendor's performance. At these meetings the contracting officer will apprise the vendor of how the government views the vendor's performance and the vendor will apprise the
Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.16 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Vendor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance:
maintain written and oral communications with the Vendor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Vendor's performance and notifies both the Contracting Officer and
Vendor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Vendor personnel. A letter of designation issued to the COR, a copy of which is sent to the
Vendor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.17 Point of Contact: The follow personnel are considered key personnel by the government:
-Contract Manager
-Contract Manager Alternate
The vendor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the vendor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the vendor on all contract matters relating to daily operation of this contract.
Identification of Vendor Employees: All contract personnel attending meetings, working in the field, and working in other situations where their vendor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are government officials. They must also ensure that all documents or reports produced by vendors are suitably marked as vendor products or that vendor participation is appropriately disclosed.
1.18 Vendor’s Technical Proposal Package. The following deliverables are to be submitted with offer in response to RFQ.
Technical approach to perform required services.
Vendor safety plan.
Vendor’s QCP
Proof of Insurance–Business Liability & Workers Compensation.
Relevant Past Performance (References/proof of experience)
PART 2
SPECIFIC TASKS
2. SPECIFIC TASKS
2.1. Scheduled Services.
Vendor must perform said techniques at the Lincoln Reflecting Pool, JFK Hockey Field, World War
II Memorial grounds, and Washington Monument grounds so that they are 100% goose free 95% of the time.
At the COR’s discretion, the above mentioned “goose free 95%” standard can be modified should goslings be present or anytime the COR deems necessary.
Dogs must be able to perform their techniques on land or in water. Dogs cannot enter the water unless commanded to do so by Vendor only. Water entry may be limited to certain times of day or times of year depending on water quality and dog safety. Vendor shall determine the number of dogs needed for services rendered. Each handler can manage up to two dogs on-site.
No water fowl or other living creature shall be killed, harmed or injured in any way.
Vendor must be able to interact with the public in a professional manner and answer visitor questions as necessary. Inquiries from the press will be referred to the NPS.
Vendor to assist (creation and hand out) NPS with education documentation to the inform the public about the behavior of the geese and the environmentally safe Canada Goose control harassment techniques being used.
2.2 Documentation: Visits to the site will be logged and will be emailed to COR on a weekly basis as well as a proposed two week schedule. A monthly delivery report will also be emailed to the COR summarizing the past month’s visits, progress, and outlook.
PART 3
APPLICABLE PUBLICATIONS
3. APPLICABLE PUBLICATIONS AND REGULATIONS
3.1. The Vendor must abide by all applicable regulations, publications, manuals, and local policies and procedures.
The vendor shall comply with pertinent provisions of the Occupational Safety and Health Act (OSHA), and state, local, safety, laws.
The vendor shall comply with pertinent Environmental Protection Agency laws and regulations.
The NPS safety officer has the authority to issue restraint or cease-and-desist orders to the vendor when violations or unsafe acts are present and threaten Government and vendor employees or damage to Government property.
The NPS Natural Resource Specialist has the authority to issue restraint or cease-and-desist orders to the vendor when violations are present and threaten natural resources.
The vendor shall immediately report to the Contracting Officer, COR and NPS safety officer all accidents resulting in employee injury or death or damage to property/natural resources while performing this contract.
PART 4
DEFINITIONS & ACRONYMS
4. DEFINITIONS AND ACRONYMS:
4.1. DEFINITIONS:
VENDOR - a supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
CONTRACTING OFFICER - a person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
CONTRACTING OFFICER'S REPRESENTATIVE (COR) - an employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Vendor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
DEFECTIVE SERVICE - a service output that does not meet the standard of performance associated with the Performance Work Statement.
DELIVERABLE - anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
KEY PERSONNEL - vendor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
PHYSICAL SECURITY - actions that prevent the loss or damage of Government property.
QUALITY CONTROL - all necessary measures taken by the Vendor to assure that the quality of an end product or service shall meet contract requirements.
SUBVENDOR - one that enters into a contract with a prime vendor. The Government does not have privity of contract with the subvendor.
WORK WEEK – Seven days.
