Statement of Work

1. INTRODUCTION

The National Park Service (NPS) is seeking contractors to provide towing and miscellaneous wrecker “road” service, i.e., jump start, fuel, tire changes, winch work, etc., within areas under the primary jurisdiction of the United States Park Police (USPP), hereinafter referred to as NPS.

2. JURISDICTIONS

A. District of Columbia Region: For towing services rendered to the general public, includes all NPS areas within the boundaries of the District of Columbia including Columbia Island on the George Washington Memorial Parkway. For towing services rendered to the NPS, includes all of District of Columbia.

B. Maryland Region: For towing services rendered to the general public, includes the Baltimore-Washington Parkway, Clara Barton Parkway, and the Maryland portion of Suitland parkway.

For towing services rendered to the NPS, includes the counties of Prince George, Charles, Ann Arundel and Montgomery.

C. Virginia Region: For towing services rendered to the general public, includes all of the George Washington Memorial Parkway (except Columbia Island). For towing services rendered to the NPS, includes the counties of Arlington, Fairfax, Loudoun, Prince William, Stafford, Spotsylvania and the City of Alexandria.

3. SCOPE OF WORK

Contractor shall provide the necessary equipment and manpower for towing and miscellaneous wrecker “road” service to designated vehicles that are determined to be in need of such service by the United States Park Police and are (a) NPS property (owned or leased from GSA), and (b) United States Park Police property (owned or leased from GSA), and (c) private property (general public individually or commercially owned or leased).

The contractor shall provide the aforementioned service within NPS jurisdiction 24 hours a day, seven days a week. The quantities for service specified in this contract are estimates.

The contractor is to respond to all requests by a representative of the United States Park Police (police officers and police communications technicians) for towing and miscellaneous wrecker “road” service within the following time frames:

1. Non-Emergency calls………………..45 minutes

2. Emergency calls………………………..30 minutes

If Contractor is unable or fails to respond within the timeframes referenced in 1, and 2, above, the United States Park Police reserve the right to cancel the call and request another crane service to respond.

4. TOWING SERVICES RENDERED TO THE GENERAL PUBLIC

The contractor will be given first preference to respond to all towing and miscellaneous wrecker “road” service calls within each region for the general public when no preference in indicated by the motorist, hereafter referred to as the First Preference Clause.

Vehicles to be removed include all forms passenger vehicles, light and heavy duty trucks, motorcycles, trailers, recreation vehicles, ATVs, boats of more than one ton capacity and vehicles having a net weight which exceeds four ton (8,500 lbs.) i.e., buses and tractor trailers. The estimated number of these tows is:

District of Columbia……………………………………2,500 per annum Maryland……………………………………………………1,800 per annum Virginia Region……………………………………………1,500 per annum

These vehicles shall be towed at owner/operator expense (First Preference Clause).

The contractor shall tow vehicles (motor vehicle accidents) unable to move on their own power from the NPS jurisdiction. These vehicles shall be towed at owner/operator expense (First Preference Clause). The estimated number of accidents is:

5. TOWING SERVICES RENDERED TO THE NPS

A. The contractor responsible for the area where an NPS vehicle breaks down shall provide all labor, materials and equipment necessary for towing and miscellaneous wrecker “road” service for NPS owned disabled vehicles from any location within 50 air miles of the District of Columbia at no cost to the Government. The contractor shall not refuse a call for such service. The estimated number of assistance calls is:

District of Columbia……………………………………60 Maryland……………………………………………………35

B. The contractor shall tow NPS owned and leased vehicles from any location within 50 air miles of the

District of Columbia to the Brentwood Maintenance Yard, 515 New York Avenue, NE, Washington

DC, or any other specified repair facility within the immediate area of the District of Columbia at no cost to the Government; and 1 tow per vehicle from the Brentwood Maintenance Yard to a specified repair facility if necessary, also within the immediate area of the District of Columbia.

The Government fleet includes the following:

USPP……..300 (includes full size police cars, mid-size sedans, light duty pickup trucks, and “dualies” medium range motorcycles[(Honda 200s?Kaw 305/Yam 250], large range motorcycles [Harley 1340], ATVs

NPS……….33 heavy trucks (17,000 40,000 GVW) 23 medium trucks (12,500 16,000 GVW) 12 light trucks (8,500 12,500 GVW) Light trucks/van (under 8,500 GVW)

C. At the direction of the Government, the contractor shall tow vehicles which have been seized (a vehicle that was taken by NPS of forfeiture to the Government); impounded (a vehicle that was taken by NPS but may be released to the owner); or abandoned (vehicles left on NPS property for more than 48 hours).

D. The contractor shall tow vehicles falling into the following three categories at no cost to the Government.

(1) Need for processing due to being part of Crime Scene

(a) Stolen Vehicles……….towed to Anacostia Operations Facility, 1901 Anacostia Drive, SE, Washington, DC

(b) Drug Vehicles…………towed to designated location within D.C. as directed

(c) Other Crime Scene…towed to Anacostia Operations Facility, 1901 Anacostia Drive, SE, Washington, DC

(d) Seized Vehicles………towed to USPP seizure lot, NE quadrant, D.C.

(2) Traffic related to the following reasons:

(a) Ownership in question….towed to Contractor’s lot

(b) Fatality accident……………towed to US Park Police designated Impound Lot

(c) Serious Injury………………..towed to US Park police designated Impound Lot

(3) Abandoned (left to the discretion of USPP Officer in charge)

(a) Vehicles left on NPS property…….towed to Contractors lot

(b) Blocking traffic or abandoned in roadway…….move off roadway to a non-hazardous location

E. Once processing is complete, the vehicle may be towed, at the direction of the US Park Police, to the contractor’s lot. The second tow, from the USPP to the Contractor’s lot, will occur with no cost to the government or the owner, however, the contractor may begin charging storage fees beginning the day after notification is made to the owner that the vehicle has been released from USPP custody. Owners may be required to reclaim their vehicle at the contractor’s lot.

F. The impounded vehicles referred to in 2 (a) and 3 (a) above (towed to contractor’s lot) shall be stored at the Contractor’s storage facility for up to 45 calendar days at no cost to the Government.

All fees incurred shall be charged to the owner of the vehicle.

Records show approximately 60% are released to the owner.

6. IMPOUND PROCEDURES

A. The contractor shall not impound a vehicle without immediately receiving a completed

“Impound Vehicle Record” form. This form will be completed by a US Park Police Officer and handed to the crane operator at the time of the hook-up only.

7. REMOVALS

The contractor shall provide the following services at no cost to the Government:

A. Snow Removal…………………Move from roadway to the nearest non-hazardous location.

B. Hazardous location…………. Move from roadway to the nearest non-hazardous location.

C. Snow Emergency………………During snow emergency, vehicles abandoned in lanes or on shoulders of NPS roadways, at the request of the US Park Police, maybe removed and towed to the contractor’s lot at the expense of the owner.

8. Special Events / Emergency Events

A. The contractor providing services for the District of Columbia region shall provide Standby Service as follows:

(1) Rush Hour Restriction……one tow truck shall report to designated area (Monday – Friday excluding Federal Holidays, morning/evening – Constitution Avenue between NW 15th and NW 23rd Streets, 0700 – 0900 and 1600 – 1830 hours) Vehicles shall be moved from the roadway to the nearest non-hazardous location.

B. The contractor shall provide the following services for the DC/MD/VA regions upon United

States Park Police request:

(1) Special Events………………..Up to two tow trucks shall report to designated area (estimated number of annual special events is 30).

(2) Emergency (unplanned event)…. Up to two tow trucks shall report to designated area (estimated number of emergencies is less than 5).

The NPS will attempt to give a three day advance notice of unplanned events when possible.

Shorter notice may be necessary. Number of trucks needed, will be designated at the time.

Service rendered is governed by those rules set forth in sections “Service Rendered to general Public” and “Service Rendered to the NPS”.

9. MAXIMUM SERVICE RATE SCHEDULE

The following lists services customarily performed by a commercial towing company.

The following rates for these services are the maximum that the Contractor shall charge the public. The Contractor shall not exceed these rates.

The Contractor shall maintain a copy of this rate schedule in each tow truck/crane for public information and produce it upon request.

Prior to providing any service, each tow truck/crane operator shall inform the owner or operator of the vehicle of ALL charges associated with desired service and provide an itemized receipt upon completion.

The Contractor shall have the capability of accepting cash and major credit cards as payment for services rendered.

If the Government exercises its option to extend services, for each option year the Contractor shall provide with a revised maximum Rate Schedule.

RATE SCHEDULE

(trucks up to ten tons)

2. Extraction/Winching $55.00 per ½ hour or part thereof

3. Storage $45.00 per day

4. Fuels

A. Service charge $40.00 B. Per gallon shall not exceed price paid by the Contractor, the wrecker operator shall carry the most recent gasoline receipt indicating the unit price per gallon of gasoline.

5. Jump Start $40.00 all

6. Miscellaneous

a. Tighting cables, belts hoses, etc. $40.00

b. Checking fluid levels and adding when necessary $40.00

c. Changing flat tires

(replace with spare and return spare to spare compartment) $40.00

d. Refilling soft or flat tire $40.00

e. Lock-outs (if capable) $40.00

10. SPECIAL PROVISIONS

1. The Contractor shall have all permits and licenses as may be required by each jurisdiction.

2. The Contractor shall have adequate facilities, equipment, devices and personnel to perform all services required under this contract.

3. The Contractor shall provide a bi-annual list of their licensed and bonded working drivers.

The Contractor shall be responsible for ensuring that the drivers assigned to perform work under this contract shall maintain a current and valid driving status with no suspensions or revocations. Subject to a driver with an unfavorable NCIC security check, the NPS retains the authority to exclude the Contractor from assigning that driver to perform work for under this contract. If there are new drivers added to a previous listing, then a copy of the new driver CDL license needs to be attached and shall be subject to the NCIC security check.

4. The Contractor shall maintain one or more vehicle storage facility(ies) within a 30 mile radius of the contract towing area. Such facility (individually or combination of) shall be able to store a minimum of 50-DC/30-MD/20-VA vehicles under this contract at any given time and must meet all applicable codes and regulations.

5. The Contractor shall maintain adequate vehicle storage facility(ies) for vehicles towed under this contract. The contractor’s facilities shall be in such location and have such ingress and egress as to not jeopardize the safety of the owner or operator. Contractor personnel shall be readily available for recovery of motor vehicles in a safe manner. Contractor’s facilities shall be secured in such a manner so as to prevent theft or vandalism of vehicles under this contract.

6. The Contractor shall tow all privately owned vehicles to the nearest contractor vehicle storage facility within 30 mile radius of the contract towing area.

7. The Contractor’s equipment shall meet all applicable jurisdictional codes and regulations.

The Contractor’s equipment shall be capable of towing/moving/recovering all privately owned vehicles and all NPS vehicles, without suspending the vehicles (no chains, rope, or cable). The Contractor equipment shall be equipped with dolly or other means of towing vehicles incapable of being towed on their own wheels.

8. In impound cases, Contractor will be responsible for notifying the owner of the vehicle in a timely manner, in compliance with applicable laws/regulations.

9. In the event that the Contractor cannot perform a tow for any reason, the Contractor shall be responsible for securing those services at no cost to the Government (i.e. Oversized vehicle).

10. When allied law enforcement agencies are assisting the Government on Primary jurisdiction, the Contractor shall perform basic towing services at no cost to the Government or the allied agency (i.e. removal from roadway, “hot shot”, towing to safe location, etc.) at the direction of the Government.

11. The Contractor’s vehicles used in the performance of this contract shall be in good repair and of neat appearance and equipped with a minimum of the following:

a. A flashing or revolving yellow/amber beacon light at or near the highest point on the vehicle visible from 360 degrees.

b. A minimum 5 pound fire extinguisher.

c. A wheel lift or a heavy-duty sling with rubberized, fabric straps or of other composition that will minimize possible damage to tow vehicles (not applicable to flatbed).

d. A power operated crane winch or wheel lift.

e. Minimum of 2 gallons of gasoline contained in EPA/USDOT approved container for gasoline calls.

f. Minimum 50-50 mixture to ten gallons of water and antifreeze for protection to -5 degrees F.

g. Air compressor and/or portable air tank equipped with air hose and tire chuck for tire inflation.

h. Adequate tools for simple on-the-scene repairs/adjustments.

11. LIABILITY

The Contractor shall accept all liability for damage to towed vehicles and for personal property in such vehicles during hookup, transit, delivery, and storage of such vehicles at the designated facilities.

12. GOVERNMENT FURNISHED PROPERTY

The Contractor shall be furnished with sufficient two-way radios for use when providing services requested by the United States Park Police. The Contractor shall be supplied with any instructions of the United States Park Police regarding the use of the police radio. The United States Park Police will determine the number of radios and when they will be deployed on an as-needed basis. The D.C. Crane assigned to Constitution Avenue will be the only one with a radio assigned on a permanent basis.

The Contractor shall return the radios in good condition, less normal wear, upon completion of this contract. The Contractor will be held liable for expenses incurred due to the loss of this equipment which is determined to have been the result of the Contractor’s negligence.

The Contractor is responsible for installation, maintenance, security and proper use of the equipment.

All cost associated with installation and repair of these radios shall be at the Contractor’s expense. Such work shall be in conformance with the procedures established by the United States Park Police and the equipment manufacturer.

13. INCORPORATION OF TECHNICAL PROPOSAL

(A) The Contractor’s technical proposal is incorporated herein by reference. In the event of conflict between the provisions of the technical proposal and any other clause of this contract (including, but not limited to, the statement of work), the conflict will be resolved in accordance with 52.215-08, Order

S o l i c i t a t i o n P 1 5 P S 0 0 7 3 5 Page| 8 of Precedence. For this contract, the contractor’s technical proposal will be deemed to be sub item (f) (last in order of precedence). The detailed technical content of the contractor’s proposal in an important factor in the selection of the contractor for award of this contract. It is agreed, therefore, that in performance of this contract, the contractor shall not change or otherwise deviate from the content of the technical proposal without prior written approval of the Contracting Officer. If it is necessary for the contractor to change the performance, design, configuration, or other items specified in the technical proposal, in order to comply with the requirements, of the Statement of Work, contract clause, or special contract requirements, the contract shall be modified at the discretion of the Government to reflect the changes at no increase in contract cost/price or extension of schedule.

(B) The Government, upon award of this contract, shall have full rights of ownership in the technical proposal and the data contained therein.
