SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS IN ACCORDANCE WITH FAR 13.5
Acquisition Plan Action ID: 36C246-22-AP-1465
1. Contracting Activity: The Department of Veterans Affairs, Network Contracting Office 6 proposes to enter into a contract on the basis of other than full and open competition for the Salisbury VA Medical Center (VAMC). Purchase Request number 659-22-1-048-0093.
2. Nature and/or Description of the Action Being Processed: This procurement is for Olympus brand video equipment components in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. Network Contracting Office 6 intends to issue a competitive, open market, brand name only solicitation and award a new firm-fixed-price contract for Olympus video equipment components that are utilized in the operating rooms at the Salisbury VAMC, Charlotte and Kernersville Health Care Centers (HCC).
3. Description of Supplies/Services Required to Meet the Agency’s Needs: This requirement is for Olympus surgical video equipment components to include operating room video equipment, mobile operating room carts, and autoclavable camera equipment compatible with the existing Olympus equipment owned by and operated at the Salisbury VA Medical Center and Health Care Clinics. The equipment is used during all endoscopic procedures in conjunction with scopes for diagnostic, therapeutic, and interventional care of Veteran patients. The requirement includes 15 Surgical Imaging Systems with 16 LCD 4k Monitors, 16 Video System Medical Recorders, and 16 Video System Touch Panels; 10 Mobile Workstations with 9 Nurses Control Arms, 9 LCD Monitor Arms, 1 Scope Pole Kit, 2 Sterile Water Holders, 1 Flushing Pump, 1 Double Carbon Dioxide Cylinder Holder, and 1 Endoscopic Carbon Dioxide Regulation Unit accessories for the workstations; 20 High Definition Autoclavable Camera Heads, 20 Autoclavable Light Guide Cables, and 15 Autoclavable Dye Sublimation Printers. This requirement includes a trade-in value of for aged components. The total estimated cost is and the delivery date is anticipated for June 15, 2022.
4. Statutory Authority Permitting Restricted Competition: FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106- 1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition
Requires the Use of the Authority Cited Above (applicability of authority): This is a brand name requirement. The medical center maintains standardization of equipment across the Surgical Departments at the Salisbury VA Medical Center, Kernersville HCC, and the Charlotte HCC. Practitioners travel to all locations with surgical scopes to perform procedures. The required equipment and accessories are compatible with the installed Olympus surgical video equipment at the medical center and health care clinics. The surgical scopes used at the Salisbury VAMC, Kernersville HCC, and Charlotte HCC are Olympus brand and compatible with the Olympus video equipment. Using mixed and incompatible technology will lead to errors and can adversely affect patient safety. A change to the brand of video equipment would require replacement of endoscopes at the facilities with an estimated cost to the government of $5,000,000. Utilizing a brand other than Olympus would result in a substantial duplication of costs that could not be expected to be recovered through competition. The Olympus equipment is the only brand capable of meeting the requirement described in section 3 above.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: A sources sought notice was not sent or posted. Olympus, the manufacturer, has identified themselves and Alliant Healthcare as an authorized distributor for the equipment.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: Prior to award of the proposed contract price analysis will be performed and documented. The Contracting Officer will determine the proposed price to be fair and reasonable based on a comparison of proposed prices received in response to the solicitation.
8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research was conducted in accordance with FAR Part 10 to identify available sources and to evaluate the availability of the marketplace to meet the requirement. A search of the VA Vendor Information Pages (VIP) database identified three SDVOSB concerns. Of the three VIP database results only one was identified by the manufacturer as an authorized distributor for the required equipment. A search of mandatory supply sources and non-mandatory sources by the VA revealed no results. Searches of the Federal Procurement Data System and the System for Award Management were conducted but did not reveal any additional capable sources
