BRAND NAME JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN

COMMERCIAL ITEMS IN ACCORDANCE WITH FAR 13.5

Nature and/or Description of the Action Being Processed: The purpose of this action is to award a new Firm-Fixed priced contract for an AMSCO Sterilization Unit for the new Charleston Community Based-Outpatient Clinic. This will be a Brand Name Justification with an estimated procurement value of Anticipated award date , 2020

Description of Supplies/Services Required to Meet the Agency’s Needs: The procurement of the AMSCO Sterilization Unit is intended to outfit the Sterile Processing Service (SPS) Department with equipment that will wash, decontaminate, and sterilize surgical instruments, containers/basins, some medical equipment, and other products/devices used throughout the medical center. Along with the Department of Veterans’ Affairs’ Office of Construction & Facilities Management, the Association for the Advancement of Medical Instrumentation (AAMI) 15883 provides operational standards for the department which aid in selecting appropriate equipment. The combined standards provide a best practice approach to infection control processes, worker safety, department productivity, operational cost savings, and equipment uptime.

Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): This equipment will replace and standardize all equipment for Sterile Processing Service per VA Directive 1116, page 12 paragraph (r). The AMSCO Sterilization Unit has been previously purchased and delivered from PO

534-A70538 for Sterile Processing Services. All machines in place at this time are from Steris;

therefore, keeping the consistency eliminates the need to have another repair contract in place to service the equipment currently being utilized and the new equipment requested for the Charleston CBOC activation. Staff employees are trained and familiar with the same cycles of the Innowave sonic Disinfector, AMSCO drying Cabinet, Evolution Sterilizer and Reliance Vision Washer/Disinfector. Use of the AMSCO description in the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company. Accordingly, Steris Corp, is the only firm capable of providing the brand name supplies described in Section III above without the Veteran’s Health Administration experiencing unacceptable delays in fulfilling its requirements.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: Steris has authorized two SDVOSBs as resellers of Steris Equipment; 1st

American Medical Distributors, Inc and AB Martin Services.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated price will be considered fair and reasonable using the techniques from FAR 13.106-2 and competition from both SDVOSB authorized resellers.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Market research found one SDVOSB via VipVetBiz that can provide for this requirement. Additionally, after further communication with the OEM, a second SDVOSB that is an authorized reseller of the Steris equipment was identified.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: N/A

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition:

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required:

The Facility requires Brand Name Steris equipment for standardization puposes. This equipment will replace and standardize all equipment for Sterile Processing Service per VA Directive 1116, page 12 paragraph (r).

12. Requirements Certification: I certify that the requirement outlined in this justification is a Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge and belief.
