Justification for Other than Full and Open Competition
Brand Name Justification
(1) Identification of the agency and contracting activity:
Requiring Activity: Defense Contract Audit Agency (DCAA), Fort Belvoir, Virginia 22060
Contracting Activity: DLA Contracting Services Office - Richmond
(2) Nature and/or description of the action being approved:
In accordance with FAR 13.501(a) this justification is for a particular brand name, product, or feature that is essential to the government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs. The supply required is an annual software maintenance renewal for existing Oracle software and additional new purchase of software and maintenance for a base year and four option years for use by DCAA, Fort Belvoir, Virginia 22060. This is a follow-on to task order SP4703-16-F-0043.
Any authorized Oracle reseller will be eligible to quote on this procurement.
(3) Description of the supplies or services required to meet the agency’s needs (including the estimated value):
Annual software maintenance renewal for existing Oracle software and additional purchase of software and maintenance. The period of performance for the base year is estimated to be September 14, 2021 through September 13, 2022. The estimated base year cost is and total estimated cost including four option years is .
(4) Identification of statutory authority permitting other than full and open competition:
10 U.S.C. 2304(c)(1), One source or limited sources.
(5) Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:
DCAA currently owns Oracle Relational Database Management System (RDBMS) server licenses. The Oracle RDBMS is used by the agency to provide support and storage for the agency’s management information system (DMIS), training and perception production, development, and test database servers.
The information stored in the Oracle RDBMS includes timesheets, assignments, audits, and training data. This includes both current and historical data. This information is used in the day-to-day operations of DCAA and occasional requests from other Department of Defense (DoD) entities and Congress. The implementation of a new RDMS would not be in the best interest of the government.
The DCAA information technology (IT) staff have been trained on this product and procedures are in place for its usage. The replacement of the Oracle products would require manpower and funding that is not available at this time. The Oracle RDMS has been in use for many years and fulfills agency requirements. Without the Oracle RDMS, DCAA would not be able to perform its mission.

(6) Description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies:
The contracting officer intends to publicize a notice as required under FAR Subpart 5.2 upon approval of this brand name justification via a combined synopsis/solicitation, which will be posted to the government point of entry at beta.sam.gov.
(7) A determination by the contracting officer that the anticipated cost to the government will be fair and reasonable:
The contracting officer anticipates the projected cost to the government will be fair and reasonable, and that the resulting order will represent the best value to the government through competition, by comparing proposed prices to the independent government cost estimate (IGCE), and comparison of proposed prices to historical prices paid.
(8) Description of market research conducted and results or a statement of the reason market research was not conducted:
Market research was performed by DCAA to look at Microsoft SQL Enterprise as a means to standardize all RDMS in the DCAA environment. Microsoft was on site in 2019 and conducted analysis on the DCAA SQL enterprise. This analysis included review of the DCAA SQL infrastructure as well as performing interviews with end users. The determination was made that the current SQL infrastructure was not configured correctly for a total migration of Oracle data and reporting services were so extensive that it would take at least six months to a year to migrate all reports. Additionally, end user training would be extensive. Based on this analysis, migration to Microsoft SQL services would take a minimum of 18-24 months to complete. DCAA is looking at potential migration to SQL in the future but currently the options would require procurement of new equipment, Microsoft migration support services that cost approximately , and extensive support hours to assist with migration and reporting services at a minimum of 500 FTE hours. Because of a new management information system (MIS) expected to be implemented in FY23, DCAA cannot migrate to another product or SQL yet until they know what the new MIS will be and can determine if the new capability will be compatible with Oracle or SQL.
This requirement cannot be satisfied through ESI as DoD is not authorized for ordering under the existing Oracle agreements.
A small business set-aside sources sought was posted on GSA under NAICS code 511210 on June 24, 2021 and closed on July 2, 2021. No responses were received to the sources sought notice. As such, in an effort to ensure maximum competition, the solicitation was posted unrestricted on GSA under NAICS 511210 for 30 days.
A solicitation was posted to GSA for 30 days, but no responses were received. Based on the lack of quotes, the contracting officer has determined to post the solicitation unrestricted on beta.sam.gov.
(9) Other facts supporting the use of other than full and open competition:
This procurement is a follow-on to task order SP4703-16-F-0043, which used a limited sources justification (LSJ). The previous LSJ indicated that the customer would continue to conduct market research in an effort to determine if other products would meet the government’s needs. Based on the market research provided by DCAA as detailed above, the customer has continued to conduct market

The contracting officer has determined that open market is the best route to go as no vendors provided a quote to the solicitation that was posted for 30 days on GSA.
(10) Listing of sources that expressed, in writing, an interest in the acquisition:
A solicitation was posted to GSA for 30 days; however, no quotes were received. Prior to closing, the contract specialist reached out to multiple vendors. DLT and Mythics stated that their GSA schedules no longer include Oracle Renewal.
(11) Actions, if any, the agency will take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:
For the reasons set forth in Paragraph 5 by DCAA, the agency will continue to conduct market research once a new MIS is selected to determine if alternate products can meet the agency’s needs.
