Justification and Approval For
Limited Sources, Use of Multiple Award Schedule
1. Contracting Agency: Defense Human Resource Activity- Procurement Support Office 4800 Mark Center Drive, Alexandria, Virginia, 22350.
2. Authority Cited: 41 U.S.C. 251, et seq. and Title 40 U.S.C. 501, FAR 8.405-6 – Limited Sources, Multiple Award Schedule Program
3. Description of Supplies and Services: The Office for Reintegration Programs (ORP) and Yellow Ribbon Reintegration Program (YRRP) requires a military-centric, online homework tutoring (OHT) services for authorized military Selected Reserve Component (RC) members and families at grade levels kindergarten through grade twelve, college introduction and adult-learning services including General Education Development (GED) diploma preparation, citizenship test preparation, proof-reading services and other adult learning resources.
4. Description of Action: A Firm Fixed Price bridge contract is planned with a period of performance of seven (7) months from date of award through December 31, 2014. FY14 Operating and Maintenance (O&M) funds are available in the total estimated amount of $1,000,000.00.
5. Reason for Authority Cited: The Office for Reintegration Programs and Yellow Ribbon Reintegration Program office has obtained online homework tutoring (OHT) services for the last four (4) years under a USMC contract that ends 31 May 2014. Notification that these services could no longer be obtained through USMC was not received with enough advance time to seek the follow-on requirement on a competitive basis and allow for the time needed for a lengthy transition of services, if applicable. As a result, a bridge contract is being sought with the incumbent contractor, Tutuor.com to ensure continuity of services while the follow-requirement is being competed and a new award can be made. The incumbent contractor has successfully performed these services for the past four years and can provide the services needed for the bridge contract. Only the incumbent is capable of meeting this bridge requirement without delays or disruptions in service.
6. Effort to Obtain Competition: This requirement is being sought as a short-term sole-source contract as an interim solution until the Government can implement its comprehensive re-compete strategy to award a competitive contract.
7. Effort to remove barriers to/increase competition: It is the Government’s intent to seek the follow-on requirement. A thorough market research will be conducted for the follow-on requirement to ensure that any/all barriers to competition can be identified and removed so that competition can be obtained to the maximum practicable extent.
8. Market Research: Market research was limited to determining that the incumbent was capable of meeting the bridge requirement.
