SECTION B - SUPPLIES AND PRICES

B-1 Blanket Purchase Agreement Pursuant to Federal Acquisition Regulation (FAR) 13.303, Blanket Purchase Agreements (BPAs), the contractor agrees to the following terms of a BPA for the National Transportation Safety Board (NTSB):

1. The contractor shall furnish supplies or services, as described in the Statement of Work (SOW), if and when requested by the NTSB Contracting Officer and authorized representative(s) for the duration of up to five (5) years, at a not-to-exceed $75,000 ceiling.

2. The NTSB is the only authorized user of this BPA; and therefore, other agencies may not place orders against this BPA.

3. This BPA does not obligate any funds. Funding obligations will be made on government purchase card, or orders issued against this BPA. The Government is obligated only to the extent of authorized purchases actually made under the BPA.

4. The BPA is not a contract. However, references to contract clauses and contract clauses set out in full which are contained in the BPA apply to future BPA orders, and upon acceptance of the BPA, those clauses are incorporated by reference into the BPA orders, unless otherwise stated in the BPA orders.

5. This BPA expires on mm/dd/yyyy, or upon cancellation by the Government. The anticipated ordering periods are as follows:

Base Year 12 months from date of award 2016 – 2017

Option Year 1 12 months from date of award 2017 – 2018

Option Year 2 12 months from date of award 2018 – 2019

Option Year 3 12 months from date of award 2019 – 2020

Option Year 4 12 months from date of award 2019 – 2021

6. The Government estimates, but does not guarantee, that the cumulative total or orders through this agreement is not-to-exceed $75,000.00.

7. The dollar limitation for each individual purchase using government purchase cards under the BPA is the micro-purchase threshold, currently at or below $3,500.

Government purchase card orders must be placed by an Authorized Ordering Representative(s) provided upon award. An individual purchase exceeding/is more than $3,500 will be placed by government purchase card provided by a NTSB Contracting Officer (CO).

8. All shipments under the agreement shall be accompanied by sales slips containing the minimum information:

(i) Name of supplier.

(ii) BPA number.

(iii) Date of purchase.

(iv) Purchase number.

(v) Itemized list of supplies furnished.

(vi) Quantity, unit price, and extension of each item, less applicable discounts (unit prices and extensions need not be shown when incompatible with the use of automated systems, provided that the invoice is itemized to show this information).

(vii) Date of delivery or shipment.

(viii) Address of shipment.

9. Aramark Brand or equal uniform apparel shall be provided within the scope set forth in the SOW may be ordered under this BPA. All proposed unit prices shall not exceed the prices set forth in Section B-2 – Price of Supplies under the Blanket Purchase Agreement.

10. If necessary, outstanding itemized invoice(s) shall be submitted at least monthly, or upon expiration of this BPA, whichever occurs first, for all deliveries made during a billing period and for which payment has not been received. These outstanding invoices need to be supported by copies of sales slip(s). The outstanding invoice shall be submitted to the Contracting Officer’s Representative (COR) and the Contract Specialist.

11. DELIVERABLE. The contractor shall deliver quarterly status reports to the COR via email TBD@ntsb.gov. At minimum, the report must include the total quarterly amount of orders by government purchase card.

B-2 Prices of Supplies Under the Blanket Purchase Agreement (BPA)

SUPPLIES

The contractor shall provide all personnel, personnel, facilities, equipment, materials, supplies, and other items or services necessary to provide brand name or equal to Aramark uniform apparel to the NTSB. Brand name or equal to Aramark uniform apparel applies to the brand’s sizes, performance, and colors.

B-3 Ordering Procedures No supplies are ordered under this BPA until orders are placed via a government purchase card. The contractor shall provide deliverable(s) after receipt of the BPA order from the authorized NTSB CO for orders over valued over $3,500; or from Authorized Ordering Representative(s) for orders under $3,500. Once a BPA order is made, the NTSB requires the contractor to provide deliverables in a thorough and acceptable manner in the timeframes, content, and format provided by the Agency. BPA order procedures are as follows:

(1) The contractor shall provide deliverables on an as-needed basis, within the scope of the BPA, and at the unit prices set forth in this BPA under its respective period. The mailto:TBD@ntsb.gov

Solicitation No. NTSB-R-16-0003, Rev. 1 Page 3 unit prices set forth in this BPA is the maximum unit price that includes shipping/delivery costs.

(2) The NTSB will designate a COR for this BPA. For orders valued over $3,500, the

COR will submit the quote request to the contractor for pricing. After all necessary discussions with the contractor are complete, the authorized NTSB CO will approve the quotation and provide the government purchase card payment.

(3) For orders valued under $3,500, Authorized Ordering Representative(s) stated herein will place the order directly with the contractor, and order via government purchase card.

(4) Scheduling of the BPA order deliverables shall be coordinated with the COR and/or

Authorized Ordering Representative(s).

(5) The contractor shall notify the CO and COR when the aggregate orders have reached 75% of the NTE BPA ceiling. The contractor shall not exceed the total NTE amount specified for each individual BPA order.

B-4 PRICES OF SUPPLIES

The NTSB anticipates awarding one (1) firm fixed-price Blanket Purchase Agreement (BPA) established with one (1) base year and four (4) option years, for a total performance period of up to five (5) years. The contractor shall furnish the supplies and services, as described in the SOW, if and when requested by the CO, COR and/or Authorized Ordering Representative(s) for up to five (5) years for a not-to-exceed $75,000.00 ceiling. The Government is obligated only to the extent of authorized purchases actually made under the BPA.

The Offeror shall submit the firm fixed-price unit prices which shall include delivery/shipping costs to provide the supplies as specified in the SOW, for the base year and each of the four (4) option years of the BPA. The delivery point is F.O.B. destination.

For evaluation purposes only, the Offeror must provide the firm-fixed-price for an estimated quantity of one (1) of each item of the brand name or equal to Aramark uniform apparel provided in Attachment 2 – Price Schedule. The unit price must include delivery/shipping.

The Offeror shall submit Attachment 2 – Price Schedule for firm fixed-price to include delivery/shipping cost per unit, to provide brand name or equal to Aramark uniform apparel for the base year, and each of the four (4) option years of the BPA as described below. Referring to the Delivery Location section of the SOW, Offerors are cautioned the unit prices proposed shall be set as the maximum BPA unit price that includes the costs as mentioned above.

The actual quantity of items ordered during the performance period of the BPA shall be determined upon the issuance of orders placed via government purchase card. Review the SOW Section of the Request for Proposals (RFP) for a detailed description of the requirement.

SECTION C - STATEMENT OF WORK

BACKGROUND

The National Transportation Safety Board (NTSB) is an independent Federal agency charged by Congress with investigating every civil aviation accident in the United States and significant accidents in the other modes of transportation -- highway, marine, railroad, and pipeline -- and issues safety recommendations aimed at preventing future accidents.

It is NTSB policy for all specified NTSB personnel to wear a uniform whenever they are performing official duties during the on-scene investigation of transportation accidents. The uniform may also be worn in other related activities, such as reconstruction activities, teardown or examination activities at a plant, laboratory, conferences, or other similar activities.

The official NTSB uniform consists of Aramark Arctic Tundra System Parkas, Knit Hats, WearTex 6-Layer Gloves, SuperWearTex Parkas, SuperWearTex Pants, Flame-Resistant Long Sleeve Coveralls and Heavy-Duty Long Sleeve Twill Coveralls.

SCOPE OF WORK

The NTSB has a requirement to purchase Aramark Arctic Tundra System Parkas, Knit Hats, WearTex 6-Layer Gloves, SuperWearTex Parkas, SuperWearTex Pants, Flame-Resistant Long Sleeve Coveralls and Heavy-Duty Long Sleeve Twill Coveralls as described below.

The NTSB will accept brand name or equal items to the Aramark items described below. Any items proposed as equal to the Aramark items described below, must demonstrate that its specifications are equal to the Aramark items.

The NTSB shall use this firm fixed-price BPA for filling all actual purchase requirements of the uniform apparel during a 12-month base year and up to four 12-month option years for a total period of performance of up to five (5) years, to one (1) contractor with deliveries to be scheduled by placing government purchase card orders with the contractor.

The contractor shall provide the following brand name or equal Aramark items, in brand name or equal Aramark sizes, performance, and colors of the items below:

1. Arctic Tundra System Parkas. Item # WEB-1436

a. Sizes: Small, Medium, Large, X-Large, 2XL, 3XL

b. Color: Navy

2. Knit Hats. Item # WEB-1984

a. Sizes: 1SZ (Unisex – One Size Fits Most)

3. WearTex 6-Layer Gloves. Item # WEB-7836

a. Sizes: Small, Medium, Large, X-Large, 2XL

4. SuperWearTex Parkas. Item # WEB-840

DELIVERY DATE

Supplies shall be delivered no later than twenty-one (21) days after each order is placed.

PERIOD OF PERFORMANCE

The anticipated period of performance of the BPA is for one 12-month base period and up to four 12-month option periods for a total period of performance of up to five (5) years.

It is estimated that there will be approximately one or two individuals who will be authorized to purchase supplies for this requirement. The list of Authorized Ordering Representative(s) shall be provided to the contractor after award, and only the individuals below may order the supplies as specified in this BPA.

INSPECTION AND ACCEPTANCE

The individual Authorized Ordering Representative(s) shall perform inspection and acceptance of the orders that they place. The individual Authorized Ordering Representative(s) shall inspect the supplies provided for each order and acceptance will be based on the contractor fulfilling the delivery of supplies as specified in this agreement and/or individual order.

SECTION L - PROPOSAL INSTRUCTIONS

GENERAL INFORMATION

The NTSB solicits your proposal of brand name or equal to Aramark uniform apparel as described in the SOW. This solicitation will result in the award of one firm fixed-price BPA to one

(1) offeror for one 12-month base year and up to four 12-month option years for a total period of performance of up to five (5) years.

Item descriptions provided for the requested brand name or equal to Aramark uniform apparel as described in the SOW are provided to identify a desired standard of performance and quality.

This reference shall not be construed as limiting competition, or precluding consideration of a product manufactured by another company. Items proposed must be equal to or better than the product identified. Offeror’s must specify each brand of the item being proposed, and its make and item number IAW FAR 52.211-6.

NOTICE AND INSTRUCTIONS TO OFFERORS

Offerors are required to meet all the requirements of the RFP, including but not limited to instructions, solicitation provisions, terms and conditions, and requirements in the SOW.

Offerors must above all, show that, if selected for award, they will be able to provide high quality brand name or equal to the Aramark uniform apparel in accordance with the SOW.

The NTSB will evaluate proposed equal products on the basis of the evaluation factors listed in this solicitation and the information furnished by the Offeror, or identified in the offer and reasonably available to the NTSB. THE NTSB IS NOT RESPONSIBLE FOR LOCATING OR OBTAINING ANY INFORMATION NOT IDENTIFIED IN THE OFFER. Include manufacturer’s name(s), item number(s), and specifications in your offer.

Proposals should address each factor and its sub-factors as described in the SOW and the RFP. Proposals that omit/fail to address the complete requirements of this RFP or provide inadequate terms of technical content, schedule commitment, or price will be deemed nonresponsive. Simply stating that the supply meets the requirements of the solicitation is not sufficient.

The Government may reject any proposal and/or deem a proposal non-responsive for omissions, lacking in understanding of the requirements, failure to comply with solicitation requirements, and/or solicitation instructions without a major reformation of the proposal that are not adequate for evaluation purposes. Alternate/conditional proposals may result in a proposal being rejected as non-responsive. The Government reserves the right to award without discussions; therefore, offerors are cautioned that they must submit a best offer with the initial proposal.

In responding to this RFP, Offerors shall submit one (1) proposal addressing the following factors:

PART I – TECHNICAL APPROACH

This section describes the Offeror’s overall understanding of the requirements. An Offeror’s technical approach describes the degree to which the Offeror’s technical capability satisfies all the requirements in the SOW, and demonstrates that the Offeror has a clear understanding and knowledge of the SOW requirements, and how to meet the requirement in a logical, feasible, and technically effective manner.

a. Sub-factor 1 – Quality of Clothing: Offerors must submit the technical specifications for the proposed brand name or equal to Aramark uniform apparel as specified in the SOW with their proposal. Include manufacturer’s name(s), item number(s), and specifications in your offer. An Offeror that is proposing an equal to the Aramark uniform apparel must provide comparable demonstration(s) for the various proposed items/styles are equal to the item(s) in salient characteristics, function and performance that is beneficial for diverse environments NTSB is exposed to. Include the brand name or equal to Aramark uniform apparel in sizes, colors, and styles described in the SOW.

b. Sub-factor 2 – Delivery: Offerors must submit delivery lead times after receipt of order

(ARO).

After the evaluation of written proposals, the NTSB reserves the right to request samples of the Offeror’s proposed brand name or equal to Aramark uniform apparel to be delivered to the NTSB in order to further evaluate the quality of the Offeror’s proposed items. The Government reserves the right to conduct testing on the sample items in its evaluation; including, but not limited to, performance in environments that NTSB may be exposed to. These samples must be received no later than seven (7) days following the request, and these items will not be returned to the Offeror by the NTSB after evaluation. The Government reserves the right to conduct testing on the sample items these items in its evaluation conducive to NTSB environments.

PART II – PRICE

The Offeror shall submit Attachment 2 – Price Schedule for firm fixed-pricing to provide the supplies as specified in the SOW, including delivery/shipping costs that may apply into the unit price of the items, as described in the SOW for the base year and each of the four option years of the BPA. Pricing is to be FOB destination. Referring to the Delivery Location section of the SOW, Offerors are cautioned the unit price quoted shall be set as the maximum BPA unit price that includes shipping/delivery. If you fail to acknowledge that all aforementioned costs are included in the unit price of the items, your proposal may be determined as nonresponsive.

Refer to the Delivery Location section of the SOW to review the delivery location for the items.

For evaluation purposes, the Offeror shall provide the firm fixed-price for an estimated quantity of one (1) of each of the brand name or equal to Aramark items through the submission of Attachment 2 – Price Schedule.

For evaluation purposes, prices will be evaluated by adding the total price for all options to the total price for the base year as depicted in Attachment 2 – Price Schedule. All prices will be evaluated but not scored.

Price will be evaluated to determine reasonableness for the BPA requirements.

Reasonableness is the degree to which all prices by their nature and amount do not exceed that which would be incurred by a prudent person in the conduct of competitive business.

EXPENSES RELATED TO OFFEROR SUBMISSIONS

This solicitation neither commits the Government to pay any cost incurred in the submission of the offer nor to contract for the supplies. Any costs incurred in anticipation of a BPA shall be at the Offeror’s own risk.

SECTION M - EVALUATION FACTORS FOR AWARD

EVALUATION OF PROPOSALS

The Government may award one (1) firm fixed-price BPA to the responsible Offeror whose proposal that conforms to the RFP, will be most advantageous to the Government, price and other price factors considered, such that it provides the best value to the Government. Best value is defined as means the expected outcome of an acquisition that, in the Government’s estimation, provides the greatest overall benefit in response to the requirement.

Under best value procurement, the NTSB may reasonably determine that the superior solution/approach merits a higher price and, therefore, represents the best value to the Government or the NTSB may reasonably determine that the Offeror with other than the highest rating in non-price factors is the best value. The Government may waive informalities and minor irregularities in proposals. The Government reserves the right to award without discussions.

Offerors are cautioned that they must submit a best offer with the initial proposal.

The Government reserves the right to reject any or all proposals if such action is in the public interest. In addition, the Government may reject or deem a proposal as nonresponsive as described in Section L – Proposal Instructions. Rejected and nonresponsive proposals will be deemed ineligible for award.

EVALUATION FACTORS

The following factors and sub-factor will be evaluated by the Government in descending order of importance:

The Government will evaluate Factor 1 based on the Offeror’s overall understanding of the requirements. An Offeror’s technical approach describes the degree to which the Offeror’s technical capability satisfies all the requirements in the SOW, and demonstrates that the Offeror has a clear understanding and knowledge of the SOW requirements. The Offeror must demonstrate meeting the requirement in a logical, feasible, and technically effective manner.

Offerors are cautioned that proposals that receive an unacceptable rating for Factor 1 will be deemed ineligible for award. Any sub-factor(s) that receive an unacceptable rating may result in an unacceptable rating for Factor 1.

Evaluation factors, other than price, when combined, are significantly more important than Price.

However, as proposals become more equal in non-price factors, price becomes more important.

Attachment 2 – Price Schedule must be submitted for Factor 2, Price. The price will be evaluated but not scored. Prices will be evaluated by adding together the base year price and all option year prices in Attachment 2 – Price Schedule. Evaluation of options does not obligate the Government to exercise the option(s).

(d) Comptroller General Examination of Record. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.

The Contracting Officer may exercise the option by written notice to the Contractor within 2 weeks. Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties otherwise agree.
